In July 2019, Stella Creasy MP and her team succeeded in attaching an amendment to a largely administrative bill which would require the UK government to liberalise abortion laws in Northern Ireland by 21 October 2019, provided the Northern Ireland government does not resume before that date.1 The amendment succeeded in the Commons, 332 votes to 99 and later, with some adjustments, in the Lords, 182 votes to 37. The Bill received Royal Assent on 24 July 2019. In Northern Ireland, (...) abortion remains a criminal offence punishable by up to life imprisonment in all except exceptional circumstances, that is, where it is ‘necessary to preserve the life of the woman’ or where there is a ‘risk of serious adverse effect which is either long term or permanent’.2 The law makes no provision for women who are pregnant as a result of rape, incest or in the case of fatal fetal abnormality. Because there is a lack of clarity around which circumstances or conditions would have a sufficiently ‘serious and long-term adverse effect’, it has been argued that the law has had a ‘chilling effect’ on service provision.3 As a result, only 13 abortions were performed in Northern Ireland in 2018/2019.4 Instead, more than 1000 women travelled from Northern Ireland to England to access legal abortion services.5 A recent review of the law in Northern Ireland concluded that this situation disadvantages women who cannot afford to or are unable to travel.3 Women are also reportedly purchasing abortifacients unlawfully online, exposing them to the risk of prosecution as well as to risks where the pills are unsafe or lead to complications. In mid-2018, following a survey of lesbian, gay, bisexual and transgender groups, the UK government issued a consultation on the proposed reform of the Gender Recognition Act for England and Wales.1 When it was first introduced in 2004, the GRA was considered innovative, even world-leading legislation.2 The act enables any adult to seek to change their legal gender provided several criteria are met. These include: If the applicant is successful, he or she is issued with a ‘gender recognition certificate’, their (...) birth certificate is changed and ‘for all purposes’ they become, legally, their acquired or affirmed gender. Since 2004, cultural change in relation to gender identity has been rapid. During the government’s preliminary survey, several concerns were raised about the GRA, particularly among those who have changed, or who may be seeking to change, their gender. These included: The government has stated that being trans is not a mental illness—more a fact of human diversity. It points to the World Health Organisation’s revision of the International Classification of Diseases, in which ‘gender incongruence’, another term for gender dysphoria, is no longer classed under ‘mental and behavioural disorders’.3 ### Draft proposals for change The government considers the reform of the GRA …. The British Medical Association and Royal College of Physicians have published new guidance, endorsed by the General Medical Council, on decision-making about clinically assisted nutrition and hydration and adults who lack capacity to consent. The development of the guidance follows a series of legal cases which has created confusion about the precise circumstances in which an application to the court is required before CANH is withdrawn which has culminated with the decision of the Supreme Court in National Health Service Trust (...) versus Y. 1 This confirmed that there is no requirement to go to court, providing there is agreement as to the patient’s best interests, the provisions of the Mental Capacity Act 2005 have been observed, and the relevant professional guidance has been followed. The new guidance covers all decisions to start, restart, continue, or stop providing CANH in patients who are not imminently dying, in circumstances where CANH is the primary life-sustaining treatment being provided. It goes beyond the category of patients in permanent vegetative state or minimally conscious state who have previously been the subject of court applications, and also covers decisions for patients with neurodegenerative conditions and patients who have suffered a sudden onset brain injury in addition to having multiple comorbidities or general frailty which is likely to impact on life expectancy. It provides a clear statement of doctors’ legal responsibilities, covers the importance of robust best interests’ assessments and sets out the process to be followed for sufficient independent scrutiny of decisions. In light of some of the identified problems with decisions about CANH, a particular focus of the guidance is on the importance of regular best interests’ assessments, and it provides detailed practical guidance about how to approach these. Public health policies which involve active intervention to improve the health of the population are often criticized as paternalistic. This article argues that it is a mistake to frame our discussions of public health policies in terms of paternalism. First, it is deeply problematic to pick out which policies should count as paternalistic; at best, we can talk about paternalistic justifications for policies. Second, two of the elements that make paternalism problematic at an individual level—interference with liberty and lack of (...) individual consent—are endemic to public policy contexts in general and so cannot be used to support the claim that paternalism in particular is wrong. Instead of debating whether a given policy is paternalistic, we should ask whether the infringements of liberty it contains are justifiable, without placing any weight on whether or not those infringements of liberty are paternalistic. Once we do so, it becomes apparent that a wide range of interventionist public health policies are justifiable. (shrink)

We love these commands, especially in America, because they invoke what we love to believe: that there is an authentic self to which we can be true. But while we mock Tricky Dick and Slick Willie, we are inventing identities on Facebook, paying thousands for plastic surgeries, tuning into news that simply verifies our opinions. David Sloan Wilson has recently revived the idea of a group mind as an application of group selectionist thinking to cognition. Central to my discussion of this idea is the distinction between the claim that groups have a psychology and what I call the social manifestation thesis-a thesis about the psychology of individuals. Contemporary work on this topic has confused these two theses. My discussion also points to research questions and issues that Wilson's work raises, as well as (...) their connection to externalist conceptions of the mind familiar since the work of Putnam and Burge. Economic theory assumes that preferences are rational. However, experiments have found small violations of transitivity. This paper develops a model of rationality with preference discovery costs. Introspection is costly. Thus, agents may find it optimal to use less than full effort, even though this raises the risk of making a poor choice. This model could potentially explain the intransitivities observed in the data while retaining rationality and optimization.

We explain how the work of Charles Sanders Peirce (1839–1914) – the founder of semiotics and of the pragmatist tradition in philosophy – contributes an epistemological, metaphysical, and ethical foundation to some key transhumanist ideas, including the following claims: technological cognitive enhancement is not only possible but a present reality; pursuing more sweeping cognitive enhancements is epistemically rational; and current humans should try to evolve themselves into posthumans. On Peirce’s view, the fundamental aim of inquiry is truth, understood in terms (...) of a stage of ideal cognition (what he calls the “final opinion”). As current human cognitive abilities are insufficient to achieve this stage, Peirce’s views on cognition support a variety of ways in which they might be enhanced. Finally, we argue that what Peirce describes as our ethical summum bonum seems remarkably similar to what Bostrom (2005) argues to be the core transhumanist value: “the exploration of the posthuman realm.”. This article takes its point of departure from late Lacan's meditations on the incompatibility of psychoanalysis with Japanese culture due to its non-European linguistic basis. The article argues that this emphasis on language narrowly conceived fails to keep pace with the interconnected, multi-media, all-encompassing nature of the unconscious today. Illustrating this point, the article focuses on the figure of the hikikomori: middle-class Japanese youths who have withdrawn from all conventional social contact to indulge exclusively computer-based interactions. Thanks to the overlap (...) with the related figure of the ‘Bedroom DJ’, the analysis then moves on to the ambient music of Richard D. James, aka Aphex Twin. It argues for the validity of the concept of an ‘audio unconscious’ distinct from Lacan's unconscious ‘structured like a language’. The final part of the article, however, examines one of James's music videos and discerns in it modes of jouissance that psychoanalysis can still describe. (shrink)

Clinical and neuroscientific studies of Buddhist meditation practices are frequent topics in the news media, and have helped certain practices achieve mainstream cultural status. Buddhists have reacted by using these studies in a number of ways. Some deploy the studies to show the compatibility of science and Buddhism, often using the authority of science to lend credence to Buddhism. Other Buddhists use meditation studies to demonstrate the superiority of Buddhism over science. Within inter-Buddhist debates, meditation studies are used to argue (...) for changes in practice or belief, but also sometimes to reinforce certain traditional practices. Benjamin Zeller's threefold categorization of religious groups’ attitudes toward science and José Ignacio Cabezón's three ideal types of relationships between Buddhism and science contribute to analysis of Buddhist uses of scientific studies of meditation. Current relational phenomenologies of the Holy Mass remain on a fundamentally horizontal level. Here I develop a phenomenology of the Holy Mass and of Eucharistic devotion that explores the spiritual as well as the ethical transformations attendant on individuals of faith who engage in these practices. On the one hand, I hold as premise the traditional and magisterial teachings of the Church on the Sacrament and its devotion. On the other hand, I make use of the phenomenology of Emmanuel Levinas, (...) interpreting him in line with the minority but not unsubstantial spiritual reading of his work. After first summarizing Church teaching on the Mass and the Eucharist, I point out how the relational approach to a phenomenology of the Eucharist has been misapplied to the Sacrament. I then point out shortcomings in the phenomenology of two other Catholic writers on the Eucharist, Jean-Luc Marion and Michael Purcell. Finally, I develop a more adequate phenomenology of the Mass and the Eucharist, bringing together the spirituality and the ethics of the individual and of the Church as an ethical people. (shrink)

In this article, we explore the role that art can play in ethical reflection on risky and controversial technologies. New technologies often give rise to societal controversies about their potential risks and benefits. Over the last decades, social scientists, psychologists, and philosophers have criticized quantitative approaches to risk on the grounds that they oversimplify its societal and ethical implications. There is broad consensus amongst these scholars that stakeholders and their values and concerns should be included in decision-making about technological risks. (...) It has also been argued that the emotional responses of people can shed important light on the ethical aspects of risk and uncertainty. However, people’s emotions can be narrowly focused and biased. This article therefore assesses the role that technology-inspired artworks can play in overcoming such biases, by challenging our imagination and providing us with different perspectives on possible technological developments and their implications for society. Philosophers have not yet studied such artworks, so this constitutes an entirely new field of research for scholars of risk and moral theory. In particular, we focus on the case of BNCI technologies and related artworks. These technologies and artworks touch on questions of what it means to be human, thereby raising profound ethical and philosophical challenges. We discuss the experiences of artists, scientists, and engineers who are directly involved with BNCI technologies, and who were interviewed during a Hackathon at Amsterdam’s Waag Society in June 2016. Their views are analyzed in light of philosophical and aesthetic theories, which allows us to consider relevant ethical and conceptual issues as well as topics for further investigation. (shrink)

This article seeks to open up a discussion of issues relating to the significance of sexual difference, the thinking and politics emerging from it and how it might affect educational philosophy. It briefly examines the initial work of Luce Irigaray, which has become quite influential in parts of the English speaking world, particularly focussing on the idea that there are implications for our educational objectives if gender equality were to be put in question as one of the underlying paradigms with (...) which to measure children's performance. It then looks at the work of some groups of Italian philosophers and educationalists who have not been translated into English and are consequently less well known. Their work has been devoted to exploring Irigaray's challenge to re-think the world from the perspective of sexual difference. In particular, in tune with the theme of this special issue, this article shows how this work puts forward the practice and philosophy of relationship for consideration at different stages of the educational process, focussing particularly on Luisa Muraro's philosophical ‘invention’ of the symbolic order of the mother as a way to bring into the shared world the erased sexual difference that Irigaray had articulated. Muraro's work considers the meaning of the first relationship between mother and infant and suggests that the mother, or the one doing her work, is in fact the first and ongoing educator and transmitter of philosophy, a fact that is only partially recognised in our formal educational structures. The article introduces, finally, the idea that as the historical patterns of mainly women teaching younger children and men teaching older children are shifting, to understand the need for and argue for a more sexuate world, with both sexes participating in the educational process at all stages would allow for the possibility of a new discussion of concepts that are already central to educationalists such as equality, freedom, autonomy, authority, flourishing and the relationship with parents. I am grateful for Professor Manser's criticisms of my brief remarks on f retribution, and in particular for his concluding challenge , because they bring out the central point I was trying to make—that ‘Retribution aims at a restoration of balance by compensation’ . I interpreted ‘compensation’ widely, to include the disadvantaging a person should suffer ‘if somebody breaks the rules of a particular deal’ , in order that the proper status of the participants be restored. My chief purpose in this paper is to direct attention towards a problem which has received little attention from philosophers, but which I think has a greater claim to importance than any other problem that would naturally arise from a consideration of robots and cybernetic machines: both because it seems of greater intrinsic philosophical interest, and because it represents more nearly than any other problem the kind of worry that afflicts ordinary people. The New Existentialism is a practical and strong-willed philosophy that will renew the concept of Man as hero. It emphasises the extraordinary in us.The Age of Defeat examines the loss of the hero in Western culture and the implications of that loss (...) for humanity. When it was written in the middle of the 20th century, it was the idea of the hero that was endangered. Today it is Man, his identity and his masculinity, who is verging on extinction. The concept of Man is one of the most ambiguous and puzzling in our culture. It might be a good moment to remember what to be a Man used to imply. (shrink)
