This paper is about the semantic analysis of referentially opaque verbs like seek and owe that give rise to nonspecific readings. It is argued that Montague's categorization (based on earlier work by Quine) of opaque verbs as properties of quantifiers runs into two serious difficulties: the first problem is that it does not work with opaque verbs like resemble that resist any lexical decomposition of the seek ap try to find kind; the second one is that it wrongly predicts de (...) dicto (i.e. narrow scope) readings due to quantified noun phrases in the object positions of such verbs. It is shown that both difficulties can be overcome by an analysis of opaque verbs as operating on properties. This is a strongly modified version of a paper entitled lsquoDo We Bear Attitudes towards Quantifiers?rsquo that I have presented at conferences in Gosen (Gesellschaft für Sprachwissenschaft), Ithaca (SALT I), and Konstanz (Lexikon). BackgroundInnovations in technology have contributed to rapid changes in the way that modern biomedical research is carried out. Researchers are increasingly required to endorse adaptive and flexible approaches to accommodate these innovations and comply with ethical, legal and regulatory requirements. This paper explores how Dynamic Consent may provide solutions to address challenges encountered when researchers invite individuals to participate in research and follow them up over time in a continuously changing environment.MethodsAn interdisciplinary workshop jointly organised by the University of Oxford (...) and the COST Action CHIP ME gathered clinicians, researchers, ethicists, lawyers, research participants and patient representatives to discuss experiences of using Dynamic Consent, and how such use may facilitate the conduct of specific research tasks. The data collected during the workshop were analysed using a content analysis approach.ResultsDynamic Consent can provide practical, sustainable and future-proof solutions to challenges related to participant recruitment, the attainment of informed consent, participant retention and consent management, and may bring economic efficiencies.ConclusionsDynamic Consent offers opportunities for ongoing communication between researchers and research participants that can positively impact research. Dynamic Consent supports inter-sector, cross-border approaches and large scale data-sharing. Whilst it is relatively easy to set up and maintain, its implementation will require that researchers re-consider their relationship with research participants and adopt new procedures. (shrink)

Guidelines recommend a ‘do-not-resuscitate’ code status for inpatients in which cardiopulmonary resuscitation attempts are considered futile because of low probability of survival with good neurological outcome. We retrospectively assessed the prevalence of DNR code status and its association with presumed CPR futility defined by the Good Outcome Following Attempted Resuscitation score and the Clinical Frailty Scale in patients hospitalised in the Divisions of Internal Medicine and Traumatology/Orthopedics at the University Hospital of Basel between September 2018 and June 2019. The definition (...) of presumed CPR futility was met in 467 of 2889 patients. 866 patients had a DNR code status. In a regression model adjusted for age, gender, main diagnosis, nationality, language and religion, presumed CPR futility was associated with a higher likelihood of a DNR code status. In the subgroup of patients with presumed futile CPR, 144 of 467 had a full code status, which was independently associated with younger age, male gender, non-Christian religion and non-Swiss citizenship. We found a significant proportion of hospitalised patients to have a full code status despite the fact that CPR had to be considered futile according to an established definition. Whether these decisions were based on patient preferences or whether there was a lack of patient involvement in decision-making needs further investigation. (shrink)

In this article, I critically reassess Iris Marion Young's late works, which centre on the distinction between liability and social connection responsibility. I concur with Young's diagnosis that structural injustices call for a new conception of responsibility, but I reject several core assumptions that underpin her distinction between two models and argue for a different way of conceptualising responsibility to address structural injustices. I show that Young's categorical separation of guilt and responsibility is not supported by the writings of Hannah (...) Arendt, which Young draws on, and that it is also untenable on independent systematic grounds. Furthermore, I argue that several of Young's other criteria fail to clearly demarcate two distinct phenomena. I therefore propose to transcend Young's distinction between two models in favour of a related, but conceptually different distinction between two forms of responsibility: interactional and structural. Embracing this terminology facilitates the conceptualisation of the general features of responsibility that are shared by both forms, including their retrospective and prospective time-direction and their applicability to individual, joint and group agency. The distinction between interactional and structural responsibility also yields a more compelling general account of the role of background structures, and of blame within ascriptions of political responsibility. The internal structure of ability emotional intelligence tests at item level has been hardly studied, and if studied often the predicted structure did not show. In the present study, an a priori model for responses to EI ability items using Likert response scales with a Situational Judgement Test format is investigated with confirmatory factor analysis. The model consists of a target EI ability factor, an acquiescence factor, which is a method factor induced by the Likert response scales, and design-based error (...) covariances, which are induced by the SJT format. It is investigated whether this a priori model can account for the observed associations between the raw item responses of the Components of Emotion Understanding Test-24. The CEUT-24 is a new test developed to assess emotion understanding, a key aspect of the EI ability construct, based on the componential emotion framework. The sample consisted of 1184 participants from four European countries speaking four different languages. Findings showed that the a priori model fitted the data well in all four languages. Furthermore, measurement invariance testing gave evidence for a well-fitting configural, metric, and partial scalar invariance model. The conclusion is that within a regular CFA framework using raw observed items responses, method factors can be disentangled from the targeted EI ability factor. (shrink)

BackgroundDuring the last decade, the possibility for women to cryopreserve oocytes in anticipation of age-related fertility loss, also referred to as social egg freezing, has become an established practice at fertility clinics around the globe. In Europe, there is extensive variation in the costs for this procedure, with the common denominator that there are almost no funding arrangements or reimbursement policies. This is the first qualitative study that specifically explores viewpoints on the (lack of) reimbursement for women who had considered (...) to uptake at least one social egg freezing cycle in Belgium.MethodsTo understand the moral considerations of these women, drawing from twenty-one interviews, this paper integrates elements of a symbiotic empirical ethics approach and thematic analysis.ResultsWe identify four themes: (1) being confronted with unclear information; (2) financial costs as ongoing concern; (3) necessity of coverage; (4) extent of reimbursement. In the first theme, we found that some women were concerned about the lack of clear information about the cost of social egg freezing. In the second theme, we report moral sentiments of injustice and discrimination which some women attributed to their struggles and needs not being recognised. The third theme illustrates diverse views on reimbursement, ranging from viewing social egg freezing as an elective treatment not appropriate for reimbursement to preferences for greater public responsibility and wider access. Finally, we describe the participants’ varying proposals for partial reimbursement and the idea that it should not be made available for free.ConclusionsThis research adds important empirical insights to the bioethics debate on social egg freezing, in particular by presenting (potential) users’ views on the lack of reimbursement. While there is much more to say about the ethical and political complexities of the reimbursement of this procedure, our study highlighted the voices of (potential) users and showed that at least some of them would welcome the coverage of SEF through the public healthcare insurance. The performance of 93 children aged 3 and 4 years on a battery of different counterfactual tasks was assessed. Three measures: short causal chains, location change counterfactual conditionals, and false syllogisms—but not a fourth, long causal chains—were correlated, even after controlling for age and receptive vocabulary. Children's performance on our counterfactual thinking measure was predicted by receptive vocabulary ability and inhibitory control. The role that domain general executive functions may play in 3- to 4-year olds' counterfactual thinking development is discussed.

Objectives: To foster the development of a privacy-protective, sustainable cross-border information system in the framework of a European public health project. Materials and methods: A targeted privacy impact assessment was implemented to identify the best architecture for a European information system for diabetes directly tapping into clinical registries. Four steps were used to provide input to software designers and developers: a structured literature search, analysis of data flow scenarios or options, creation of an ad hoc questionnaire and conduction of a (...) Delphi procedure. Results: The literature search identified a core set of relevant papers on privacy. Technicians envisaged three candidate system architectures, with associated data flows, to source an information flow questionnaire that was submitted to the Delphi panel for the selection of the best architecture. A detailed scheme envisaging an “aggregation by group of patients” was finally chosen, based upon the exchange of finely tuned summary tables. Conclusions: Public health information systems should be carefully engineered only after a clear strategy for privacy protection has been planned, to avoid breaching current regulations and future concerns and to optimise the development of statistical routines. The BIRO project delivers a specific method of privacy impact assessment that can be conveniently used in similar situations across Europe. (shrink)

This paper aims to provide a description of how authors publishing in medical ethics journals have made use of empirical research data in papers on the topic of gamete or embryo donation by means of references to studies conducted by others. Rather than making a direct contribution to the theoretical methodological literature about the role empirical research data could play or should play in ethics studies, the focus is on the particular uses of these data and the problems that can (...) be encountered with this use. In the selection of papers examined, apart from being used to describe the context, empirical evidence was mainly used to recount problems that needed solving. Few of the authors looked critically at the quality of the studies they quoted, and several instances were found of empirical data being used poorly or inappropriately. This study provides some initial baseline evidence that shows empirical data, in the form of references to studies, are sometimes being used in inappropriate ways. This suggests that medical ethicists should be more concerned about the quality of the empirical data selected, the appropriateness of the choice for a particular type of data and the correct integration of this evidence in sound argumentation. Given that empirical data can be misused also when merely cited instead of reported, it may be worthwhile to explore good practice requirements for this type of use of empirical data in medical ethics. Unconscious perceptions have recently become a focal point in the debate for and against naive realism. In this paper I defend the naive realist side. More specifically, I use an idea of Martin’s to develop a new version of naive realism—neuro-computational naive realism. I argue that neuro-computational naive realism offers a uniform treatment of both conscious and unconscious perceptions. I also argue that it accommodates the possibility of phenomenally different conscious perceptions of the same items, and that it can answer (...) a further challenge to naive realism raised by Berger and Nanay. Who should be diagnosed with intellectual disability and who should not? For borderline cases, the answer to this question may be as difficult to decide on as determining the borderline between being bald or not. While going bald may be upsetting to some, it is also an inevitable and relatively undramatic course of nature. In contrast, getting a diagnosis of intellectual disability is likely to have more far-reaching consequences. This makes the question of where the cutoff point for intellectual disability (...) lies more imperative. Philosophy of science may help psychologists to understand the nature of this dilemma in a more profound manner. This article builds on the sorites paradox to explore the vagueness that surrounds the concept of intellectual disability and the consequences of this vagueness for the diagnostic process. While epistemicists argue that vagueness is a consequence of our limited knowledge of the world that we live in, semantic theorists claim that there is nothing that we do not know, but that our language allows for indecisiveness. What these different lines of understanding mean for psychologists who are diagnosing intellectual disability, is described in this article. Furthermore, the article discusses practical implications of these philosophical underpinnings. (shrink)

As early as the interwar period, several moral theologians and philosophers were preoccupied with a new and important question: what might the recently established field of social sciences mean for ethical reflection. Since the middle of the 1970’s, a group of practical theologians has reflected on the relationship between empirics and practical theology, establishing among other things the Journal of Empirical Theology in the process.The approach for the empirically oriented practical theologian remained unequivocal: the issues and goals of their research (...) were explicitly theological. Ethicist, however, were confronted with a different reality. A dynamic that had been evolving over decades in the domains of economics and medicine, for example, attracted new dialogue partners into the debate: prudent ethical judgement now presupposed interdisciplinary consultation, with input from the world of law, the economy, medicine and engineering, to name but a few.The swift advance of a host of variants related to Evidence Based reflection made the question of the relationship between empirics and ethics all the more urgent. What might empirics mean for ethical reflection and what might ethics have to offer to empirically oriented research? To what extent are we dealing here with two distinct disciplines, with unbridgeable methodological and intellectual backgrounds and points of departure?The present contribution holds a number of theoretical differences between both disciplines up to inspection and illustrates the significance thereof on the basis of the so-called ‘Kohlberg debate’. It will become clear in the course of the article, moreover, that several different theoretical responses to the question of the relationship between the two are possible, running from strict separation, through a ‘marriage of convenience’ to an appeal for integration and openness towards a hybrid approach. Ethicists who make use of empirical research in their analyses, however, clearly continue to have difficulty in being explicit and precise when it comes to the relationship between both disciplines and the significance of empirical data for ethical reflection. This article offers a contribution to the debate on rapid biodiversity loss. This loss is a problem for ecosystems and thus for the human race, and our legal system should be equipped to protect biodiversity. This article suggests a solution in the form of the attribution of limited legal personality to nonhuman species. The concept of legal personality has been altered many times throughout history to stay in line with prevalent ideas. By acknowledging nonhuman species as possessing limited legal personality, (...) the concept will be altered once more to benefit both animals and ourselves. This change will have to come from bottom-up, through attribution by domestic courts. Domestic courts can be inspired by international biodiversity conventions while assessing domestic legislation. Animal welfare nongovernmental organizations are best equipped to appear as guardians of animal species, as animals are not able to defend their own rights in court. When the attribution is a general principle as recognized by civilized nations, it will become a source of international law. (shrink)

The use of empirical research methods in bioethics has been increasing in the last decades. It has resulted in discussions about the ‘empirical turn of bioethics’ and raised questions related to the value of empirical work for this field, methodological questions about its quality and rigor, and how this integration of the normative and the empirical can be achieved. The aim of this paper is to describe the attitudes of bioethics researchers in this field towards the use of empirical research, (...) and examine their actual conduct: whether they use empirical research methods, and whether they have made attempts at integrating the empirical and the normative. An anonymous online survey was conducted to reach scholars working in bioethics/biomedical ethics/ethics institutes or centers in 12 European countries. A total of 225 bioethics researchers participated in the study. Of those, 200 questionnaires were fully completed, representing a response rate of 42.6%. The results were analysed using descriptive statistics. Most respondents indicated that they use or have used empirical methods in their work. A similar proportion of respondents reported having had at least some training in qualitative or quantitative methods, respectively. Among the ‘empirical researchers’, more than a fifth had not received any methodological training. It appears that only 6% or less of the ‘empirical researchers’ considered themselves experts in the methods that they have used. Only 35% of the scholars who have used empirical methods reported having integrated empirical data with normative analysis, whereas for their current projects, 59.8% plan to do so. There is a need to evaluate the current educational programs in bioethics and to implement rigorous training in empirical research methods to ensure that ‘empirical researchers’ have the necessary skills to conduct their empirical research in bioethics. Also imperative is clear guidance on the integration of the normative and the empirical so that researchers who plan to do so have necessary tools and competences to fulfil their goals. (shrink)

My aim in this paper is to argue that the recent philosophical defenses of revealed preference theory do not withstand scrutiny. Towards this aim, I will first outline revealed preference theory. I will then briefly present the two most common arguments that the received view offers against it. Afterwards, I will outline three argumentative strategies for rehabilitating revealed preference theory, and successively rebut each of them.

Philosophers have traditionally used thought-experiments in their endeavours to find a satisfactory account of the self and personal identity. Yet there are considerations from empirical psychology as well as related ones from philosophy itself that appear to completely undermine the method of thought-experiment. This paper focuses on both sets of considerations and attempts a defence of the method.

In our target article, we argued that the number sense represents natural and rational numbers. Here, we respond to the 26 commentaries we received, highlighting new directions for empirical and theoretical research. We discuss two background assumptions, arguments against the number sense, whether the approximate number system represents numbers or numerosities, and why the ANS represents rational numbers.

In this paper, we explore an under-investigated question concerning the class of formal models that aim at providing normative guidance. We call such models normative models. In particular, we examine the question of how normative models can successfully exert normative guidance. First, we highlight the absence of a discussion of this question – which is surprising given the extensive debate about the success conditions of descriptive models – and motivate its importance. Second, we introduce and discuss two potential accounts of (...) the success conditions of normative models. Our tentative conclusion is that the second account is more promising. (shrink)

Over the past years, a growing number of countries have legislated open-identity donation, in which donor-conceived offspring are given access to the donor’s identity once the child has reached maturity. It is held that donor anonymity creates identity problems for such children similar to the “genealogical bewilderment” described within the adoption context. The study of the social and psychological effects of open-identity donation is still very much in its infancy, but what has been left unquestioned is whether offering access to (...) the donor’s name and address is an adequate response to such effects. This study has two goals: First, we aim to provide a systematic review of the reasons why donor-conceived offspring want to know the identity of their sperm donor. Second, we examine to what extent the provision of donor-identifying information can satisfy the reasons mentioned. The most important motivations appear to be: to avoid medical risks and consanguineous relationships; to satisfy curiosity; to learn more about the self or to complete one’s identity; to learn more about what kind of person the donor is ; to form a relationship with the donor and/or his family; and to learn about one’s ancestry/genealogy. Our analysis shows that for nearly all of these reasons access to the donor’s identity is not necessary. In those cases where it is, moreover, donor identification is not sufficient. What is really needed is contact with the donor, rather than the mere provision of his name. (shrink)

Scholars disagree about the plausibility of preference purification. Some see it as a familiar phenomenon. Others denounce it as conceptually incoherent, postulating that it relies on the psychologically implausible assumption of an inner rational agent. I argue that different notions of rationality can be leveraged to advance the debate: procedural rationality and structural rationality. I explicate how structural rationality, in contrast to procedural rationality, allows us to offer an account of the guiding idea behind preference purification that avoids inner rational (...) agents. Afterward, I address two pressing challenges against preference purification that emerge under the structural rationality account. (shrink)

In this paper, I develop a novel interval-based approach to some well-known semantic puzzles related to aspect shift, in particular, to the interaction of for-adverbials with accomplishment and achievement verbs that take indefinite, bare plural, and mass noun complements. My approach is based on the insight that implicit frequentative aspect plays a central role in this interaction, a fact that was largely ignored in previous analyses. Specifically, I interpret frequentative aspect as an abstract verb-level pluractional operator that brings about aspect (...) shift and that is responsible for the distribution of subevent times and subevent participants over the event time of an atelic sentence. What Zucchi and White (2001) call "the aspectual effect of frequency adverbs" thus becomes the general rule for all frequentatively understood for-adverbial sentences. Linguistic support for silent verb-level frequentativity in English is drawn from overt frequentative aspect marking in West Greenlandic verbs. (shrink)

In the modern discussions about possibility of synthetic a priori propositions, the theory of definition has a fundamental importance, because the most definition’s theories hold that analytic judgments are involved by explicit definition . However, for Kant –first author who pointed out the distinction between analytic and synthetic propositions–many analytic judgments are made by analysis of concepts which need not first be established by definition. Moreover, for him not all a priori knowledge is analytic. The statement that not all analytic (...) judgment is derived from definition and possibility of synthetic a priori knowledge, indicates Kant didn’t believe, contrary to modern theories about analytic judgment, the definition is an essential ground of knowledge. I summarize and critically review Block's book, focusing on his format-based account of the border between perception and cognition and his argument for the phenomenal overflow of color perception.

This comprehensive history of German philosophy from its medieval beginnings to near the end of the eighteenth century explores the spirit of German intellectual life and its distinctiveness from that of other countries. Beck devotes whole chapters to four great philosophers -- Nicholas of Cusa, Leibniz, Lessing, and Kant -- and extensively examines many others, including Albertus Magnus, Meister Eckhart, Paracelsus, Kepler, Mendelssohn, Wolff, and Herder. Questioning explanations of philosophy by the racial or ethnic character of its exponents, (...) class='Hi'>Beck's conclusion is that German philosophy developed as a series of diverse responses to the historical experiences of the German people. The peculiarities of German philosophy must be viewed in the light of German political problems and educational structures. In particular he stresses the importance of the connections between philosophy and Germany's intellectual, literary, religious, and political history. (shrink)

What is the broadest significance of musical rhythm? Human attitudes to the world are reflected in it, according to Gustav Becking. Writing in the 1920s, Becking proposed a novel method of finding systematic differences of attitude between individual composers, between nations, and between historical time periods. He dealt throughout with Western classical music, from the period approximately 1600-1900. His method was to observe in fine detail the pattern of motion and pressure traced out by a small baton allowed to move (...) in sympathy with a given musical excerpt. The various patterns arising for individual composers were represented graphically, and in that form became known as -Becking curves-. Implications were touched upon in psychology, sociology and philosophy. His thesis is now published in English translation from the original German for the first time, with many annotations.". A semantics for interrogatives is presented which is based on Karttunen's theory, but in a flexible manner incorporates both weak and strong exhaustivity. The paper starts out by considering degree questions, which often require an answer picking out the maximal degree from a certain set. However, in some cases, depending on the semantic properties of the question predicate, reference to the minimal degree is required, or neither specifying the maximum nor the minimum is sufficient. What is needed is an operation (...) which defines the maximally informative answer on the basis of the Karttunen question denotation. Shifting attention to non-degree questions, two notions of answerhood are adopted from work by Heim. The first of these is weakly exhaustive and the second strongly exhaustive. The second notion of answerhood is proven to be equivalent to Groenendijk and Stokhof's interrogative semantics. On the basis of a wide range of empirical data showing that questions often are not interpreted exhaustively, it is argued that a fairly rich system of semantic objects associated with questions is needed to account for the various ways in which questions contribute to the semantics and pragmatics of the utterances in which they appear.
