On the basis of a case study of the integration of Haredi Jewish women into the Israeli high-tech industry, we explore how gender–religiosity intersectionality affects ultra-conservative women’s participation in the labor market and their ability to negotiate with employers for corporate work–family practices that address their idiosyncratic requirements. We highlight the importance of pious women’s affiliation to their highly organized religious communities while taking a process-centered approach to intersectionality and focusing on the matrix of domination formed by the Israeli state, (...) employers, and the organized ultra-orthodox community. We dub this set of actors “the unholy-trinity” and argue that it constructs a specific, religion-centric inequality regime that restrains women’s job and earning opportunities. At the same time, the “unholy trinity” also empowers women in their struggle to create a working environment that is receptive to their religiosity and what that commitment demands of them. (shrink)

This article examines the importation of new gender ideals into a highly masculine organization through top-down and bottom-up processes. We analyze how a dominant group of men undo and redo gender to reproduce their supremacy and create a new, “improved” form of masculinity. Based on qualitative research on the practice of debriefing in the Israel Air Force, we explore how new practices of masculinity are incorporated into a hegemonic masculinity by introducing so-called “soft” organizational practices and thus constructing a new (...) form of “upgraded” masculinity. We show that pilots are involved in two continual and dialectical processes of performing masculinity. The first includes top-down practices neutralizing opportunities to execute exaggerated masculine performances, including new technologies allowing recording and documenting of all flights, a safety discourse emphasizing the protection of human life, and organizational learning based on self- and group critiques aimed at improved performance. The second, a bottom-up process enacted by pilots, is aimed at restoring and mobilizing masculinity and includes rationalized professionalism, competitiveness, and patronizing. Taken together, these constitute a hybrid, “upgraded” masculinity where “soft” characteristics are appropriated by men to reinforce a privileged status and reproduce their dominance within and outside the military. Our case study focuses on the debriefing, a process in which air teams formally reflect on their performance after a particular task/event to improve it. (shrink)

The idea that some of God's past beliefs depend on our future actions has a long history, going back to Origen in the third century CE. However, it is not always clear what this idea amounts to, since it is not always clear what kind of dependence is at issue. This paper surveys five different interpretations of dependence and, in each case, considers the implications for the debate over theological fatalism. This is a paper about the nature of metaphysical laws and their relation to the phenomenon of vagueness. Metaphysical laws are introduced as analogous to natural laws, and metaphysical indeterminism is modeled on causal indeterminacy. This kind of indeterminacy is then put to work in developing a novel theory of vagueness and a solution to the sorites paradox.

The debate over persistence is often cast as a disagreement between two rival theories—the perdurantist theory that objects persist through time by having different temporal parts at different times, and the endurantist theory that objects persist through time by being wholly present at different times. This way of framing the debate over persistence involves both an important insight and an important error. Unfortunately, the error is often embraced and the insight is often ignored. Trust in science post-Covid appears to be a complex matter. On the one hand, the COVID-19 pandemic added value to the epistemic trustworthiness of scientific opinion and its potential to drive evidence-based policies, while it also spurred scientific distrust and societal polarization (e.g., vaccines), especially on social media. In this work we sought to understand the ways in which trust in science might be bolstered by adopting a multistakeholder perspective. This objective was achieved by considering stakeholders’ views on (a) _how_ (...) perceived key actors affect trust in science, and (b) _what_ proposed actions can be taken by each actor identified. Data were collected using 16 focus groups and 10 individual interviews across different European contexts with general public (_n_ = 66), journalists (_n_ = 23) and scientists (_n_ = 35), and were analysed using thematic analysis. Regarding _how_ perceived key actors affect trust in science, participants viewed policymakers, media, scientific and social media actors as occupying a dual function (facilitators and hinderers of trust in science), and pointed to the value of multi-actor collaboration. Regarding _what_ actions should be taken for enhancing trust in science, participants indicated the value of enhancing understanding of scientific integrity and practices, through science literacy and science communication, and also pointed to social media platform regulation. Implications stemming from the data are discussed, considering how multiple identified stewards of trust can contribute to an ecosystem of trust. (shrink)

Jon Elster reports that in 1940, and again in 1970, the U.S. draft lottery was challenged for falling short of the legally mandated ‘random selection’. On both occasions, the physical mixing of the lots appeared to be incomplete, since the birth dates were clustered in a way that would have been extremely unlikely if the lots were fully mixed. There appears to have been no suspicion on either occasion that the deficiency in the mixing was intended, known, or believed to (...) favor or disfavor any identifiable group. When a patient lacks decision-making capacity, then according to standard clinical ethics practice in the United States, the health care team should seek guidance from a surrogate decision-maker, either previously selected by the patient or appointed by the courts. If there are no surrogates willing or able to exercise substituted judgment, then the team is to choose interventions that promote a patient’s best interests. We argue that, even when there is input from a surrogate, patient preferences should be an additional (...) source of guidance for decisions about patients who lack decision-making capacity. This paper critically engages ethical issues in the allocation of novel, and potentially costly, health care resources to patients with disorders of consciousness. First, we review potential benefits of novel health care resources for patients and their families and outline preliminary considerations to address concerns about cost. We then address two problems regarding the allocation of health care resources to patients with disorders of consciousness: (1) the problem of uncertain moral status; and (2) the problem of accurately measuring the welfare (...) burdens these resources would relieve. We conclude by suggesting that opportunity-based frameworks might complement standard approaches for justifying resources allocation to patients with disorders of consciousness. (shrink)

There is a perpetrator historiography of the Holocaust and a Jewish historiography of the Holocaust. The former has received the lion’s share of attention in bioethics, particularly in the form of warnings about medicine’s potential for complicity in human atrocity. However, stories of Jewish physicians during the Holocaust are instructive for positive bioethics, one that moves beyond warnings about what not to do. In exercising both explicit and introspective forms of resistance, the heroic work of Jewish physicians in the ghettos (...) and concentration camps tells us a great deal about the virtues and values of medicine. In this article, we frame the stories of four of these Jewish physicians in ways that are instructive for contemporary medicine. By far, the most widely recognized and discussed figure is Viktor Frankl, whose work on hope and the meaning of suffering remains essential insofar as medicine inherently confronts disease and death. Less discussed in bioethics and medical humanities are the cases of Mark Dworzecki, Karel Fleischmann, and Gisella Perl. Dworzecki’s efforts to encourage others in the Vilna Ghetto to document their experiences illustrates the power of narrative for the human experience and the notion of ethics as narrative in the face of suffering. Fleischmann’s art underscores not only the importance of reflective practices for professionals as a form of simultaneous introspection and testimonial, but illuminates hope amid sheer hopelessness. This hope, which was comparatively implicit in much of Fleishmann’s art, is explicated as a method by Frankl, becoming a form of therapy for both physicians wrestling with their professional work, and patients wrestling with their illnesses and diseases. Finally, Perl’s resistance to Mengele’s orders highlights the importance of moral action, not just reflective reaction. The experiences of each of these figures, while certainly located in the unique horrors of Holocaust Germany, portends lessons for today’s physicians faced with moral distress and ethical dilemma in the face of suffering, interpersonal relationships, and socio-political conflicts that increasingly test the professed ideals of medicine. In this commentary, I explore the usefulness of the framework Abram Brummett and Erica K. Salter present in their article “Mapping the Moral Terrain of Clinical Deception.” Deception cases are divisive because they nearly always evoke the metadilemma of clinical ethics: a clash between duties (in these cases, truth telling) and consequences (whatever good might come of the lie). Here, I describe a patient case in which the clinical team considered deceiving a patient about his pain‐medicine dosage in exchange for (...) his allowing the clinicians to properly care for his percutaneous endoscopic gastrostomy tube stoma, so as to prevent infection. Applying the framework that Brummett and Salter have developed helped our clinical team parse the numerous complex issues involved. The nuances of our case also illustrated additional ways in which the ethics of deception needs to be further refined. (shrink)

David Lewis has long defended an analysis of counterfactuals in terms of comparative similarity of possible worlds. The purpose of this paper is to reevaluate Lewis’s response to one of the oldest and most familiar objections to this proposal, the future similarity objection.

Children’s preferences about medical treatment—like the preferences of other patients—hold moral weight in decision-making that is independent of considerations of autonomy or best interests. In light of this understanding of the moral value of patient preferences, the American Academy of Pediatrics could strengthen the ethical foundation for its formal guidance on pediatric assent.

David Lewis famously defends a counterfactual theory of causation and a non-causal, similarity-based theory of counterfactuals. Lewis also famously defends the possibility of backward causation. I argue that this combination of views is untenable—given the possibility of backward causation, one ought to reject Lewis's theories of causation and counterfactuals.

The patient preference predictor is a proposed computer-based algorithm that would predict the treatment preferences of decisionally incapacitated patients. Incorporation of a PPP into the decision-making process has the potential to improve implementation of the substituted judgement standard by providing more accurate predictions of patients’ treatment preferences than reliance on surrogates alone. Yet, critics argue that methods for making treatment decisions for incapacitated patients should be judged on a number of factors beyond simply providing them with the treatments they would (...) have chosen for themselves. These factors include the extent to which the decision-making process recognises patients’ freedom to choose and relies on evidence the patient themselves would take into account when making treatment decisions. These critics conclude that use of a PPP should be rejected on the grounds that it is inconsistent with these factors, especially as they relate to proper respect for patient autonomy. In this paper, we review and evaluate these criticisms. We argue that they do not provide reason to reject use of a PPP, thus supporting efforts to develop a full-scale PPP and to evaluate it in practice. There are no data in this work. (shrink)

In coming decades, fetal medicine may become a routine part of reproductive care. The measures pregnant women now take to protect fetal health are largely generic, like restricting their diets and using supplements. Relatively few interventions are based on specific conditions revealed by ultrasound or genetic testing. A recent finding, though, may herald a dramatic rise in “personalized” fetal medicine: certain drugs already approved by the Food and Drug Administration can apparently boost neural growth in fetuses with Down syndrome, improving (...) cognitive functioning in the future child. Many more condition‐specific findings are likely in the near future. But as commentators have frequently observed about prenatal testing, technologies that appear to increase reproductive options also complicate and constrain them. (shrink)

We are gratified by Nelson's response to our commentary. It shows, for the first time, an appreciation of the distinctive character of our criticism of individual decisions to test and terminate for fetal impairment. Although we still find much to disagree with in Nelson's characterization and critique of our views, he has given us a welcome opportunity to clarify and develop them.

Background: Previous research shows that pediatricians inconsistently utilize the ethics consultation service (ECS). Methods: Pediatricians in two suburban, Midwestern academic hospitals were asked to reflect on their ethics training and utilization of ECS via an anonymous, electronic survey distributed in 2017 and 2018, and analyzed in 2018. Participants reported their clinical experience, exposure to formal and informal ethics training, use of formal and informal ethics consultations, and potential barriers to formal consultation. Results: Less experienced pediatricians were more likely to utilize (...) formal ethics consultation and more likely to have formal ethics training. The most commonly reported reasons not to pursue formal ECS consultation were inconvenience and self-reported expertise in pediatric ethics. Conclusions: These results inform ongoing discussions about ethics consultation among pediatricians and the role of formal ethics training in both undergraduate and graduate medical education. This paper examines the moral import of a distinction between natural and social inequalities. Following Thomas Nagel, it argues for a “denatured” distinction that relies less on the biological vs. social causation of inequalities than on the idea that society is morally responsible for some inequalities but not others. It maintains that securing fair equality of opportunity by eliminating such social inequalities has particularly high priority in distributive justice. Departing from Nagel, it argues that society can be responsible for inequalities (...) not only when they are the unintended result of justifiable projects, but even when their alleviation would be very costly. Sharing Nagel’s general concept of ‘social inequality’, then, this paper proposes a far more expansive conception. We argue that many disadvantages due to disability fall under this conception. Eliminating or alleviating those disadvantages should be regarded as securing fair equality of opportunity, not improving the condition of the worst-off. (shrink)
