El artículo presenta el panorama entero de las ideas políticas del notorio conservador peruano Monseñor Bartolomé Herrera. Se trata por vez primera de un estudio exhaustivo de las redes conceptuales y filosóficas de su peculiar concepción del republicanismo, que se califica aquí de “reaccionario”. Luego de incluirlo en su contexto en la historia de las ideas en la polémica entre liberales y conservadores, el texto sostiene que, aparte de sus influencias neoconservadoras restauracionistas, Herrera, considerado hasta hoy un conservador liberal, habría (...) sido más bien un consumidor militante –pero encubierto- del pensamiento reaccionario del Conde De Maistre, el Vizconde de Bonald y, más particularmente, de Agustín Barruel, fuente reaccionaria descuidada por los especialistas en el pensamiento político peruano. Herrera habría sido un tipo peculiar de republicano: Un republicano reaccionario. Aunque de manera simulada y escondiendo sus fuentes, el Obispo de Arequipa, en tono análogo al Valdegamas de 1848, habría desarrollado una concepción anticontractualista y antiliberal de la república peruana desde una teología política contrarrevolucionaria. José Ignacio Moreno es uno de los fundadores de la independencia del Perú. En calidad de tal acompañó el proyecto del General rioplatense José de San Martín de transformar en 1822 la monarquía peruana en un reino independiente. Pero, a diferencia de la multitud de sus contemporáneos, la historiografía apenas lo presenta como un circunstante en la epopeya de la emancipación, de quien no se conserva ni un retrato. El motivo es la extraña adherencia de este personaje a las ideas (...) del ultramontanismo y su temprana cercanía con la obra del contrarrevolucionario francés Joseph de Maistre. From Fodor and Pylyshyn’s celebrated 1988 systematicity argument in favour of a language of thought , a challenge to connectionist models arises in the form of a dilemma: either these models do not explain systematicity or they are implementations of LOT. From consideration of this challenge and of systematicity in domains other than language, defenders of connectionism have mounted a parallel systematicity argument against LOT which results in a new self-defeating dilemma, what I call here the systematicity challenge challenge : (...) either LOT does not explain nonlinguistic systematicity, or it is in no better position than its rivals to explain any systematicity, even linguistic systematicity. In this paper, first, I critically examine the SCC and some considerations that seem to support it. Second, I offer a response to the SCC by: showing that LOT was never meant to be a cognitive model restricted only to linguistic systematicity, and formulating a new argument in favour of LOT from nonlinguistic systematicity. Third, I argue that there is a central assumption underlying the SCC and maintain that it is mistaken. I conclude that the classical systematicity challenge continues to be fully valid for linguistic and nonlinguistic domains. (shrink)

La plupart des autres ont pensé qu’il y avait, dans cette doctrine, tout au moins une esthétique implicite et que cette esthétique, dont ils empruntaient les traits, non à Descartes lui-même, mais à des critiques comme Boileau, d’Aubignae, Bosse, de Chambray, etc., était rigoureusement rationaliste, Descartes ayant « confondu le Beau dans le Vrai ».J’ai essayé de montrer qu’il y a (...) une esthétique cartésienne explicite : que 1° cette esthétique est moins pauvre qu’on ne Ta dit, si Ton tient compte de tout ce qui dans les Lettres du philosophe est relatif à l’art ; que 2° le Compendium musicæ est plus riche en théorie qu’on ne l’a cru et que les vues qu’y développe Descartes ne valent pas seulement pour la musique ; que 3° ces vues ne sont pas rigoureusement intellectualistes, mais que la part qui y est faite à la sensation et à l’association est au moins égale à celle revendiquée pour la raison ; que 4° s’étant posé la question de savoir ce qu’est le Beau en général, Descartes a conclu qu’il est impossible de le déterminer, qu’il n’y a pas d’évidence esthétique et que, en dernière analyse, « ce qui plaira à plus de gens pourra être nommé simplement le plus beau ». O presente artigo é uma discussão sobre a noção heideggeriana de Überwindung. Seu objetivo é duplo: por um lado, [1] mostrar a perspectiva que tal termo deve ser compreendido; por outro, [2] aprofundar esta perspectiva à luz de comentários ao aforismo I do texto Überwindung der Metaphysik. Para tanto, duas questões são postas: em que perspectiva e que questões estão implícitas quando Heidegger propõe o projeto da Überwindung der Metaphysik?; e por que uma Überwindung contém em si tantos problemas? De (...) modo a discutir e comentar tais questões, o artigo percorre dois caminhos: [1] faz-se uma análise da própria indicação heideggeriana da perspectiva de compreensão da Überwindung der Metaphysik, qual seja, revisitar, a partir de um olhar determinado, a construção da noção de história do ser. Esta, por sua vez, tem sua gênese antes mesmo da própria Kehre. Mais especificadamente, na reinterpretação que o próprio Heidegger faz de seu texto Vom Wesen der Wahrheit. A partir desta reconsideração feita por Heidegger e inserida em seu próprio texto, é possível detectar quatro teses fulcrais que traçam essencialmente a metafísica e que justificam a sua superação. São elas: [a] o fato de o ser, originariamente, se velar e provocar, historialmente, o seu esquecimento; [b] a relação entre a verdade do ser e a história, que se desenvolve como história do ser; [c] a ideia de que pertence ao ser um caráter originário de retração de si mesmo e que essa retração é um destino que pertence à história do pensamento metafísico e se configura na própria essência da metafísica; [d] afirmar que a certeza da manifestação da essência coincide com o seu fim. [2] Adentra-se, mediante uma aproximação pari passu, no aforismo I do texto Überwindung der Metaphysik, com intuito de comentar a problematicidade do termo Überwindung quando usado para repensar a metafísica à luz da perspectiva da história do ser. This paper sheds light on the incongruent findings concerning the relationship between family involvement and firms’ corporate social responsibility. While prior studies have mainly taken the perspective of families’ socioemotional wealth preservation, we approach this relationship from the perspective of behavioral agency theory, highlighting the important role played by CEOs’ family memberships. Specifically, we posit that family firms are more likely to invest in CSR when their CEOs are members of the controlling families. Furthermore, we examine how family firms can (...) employ long-term incentives to encourage non-family CEOs to act in the interests of the controlling families to preserve SEW and thus enhancing family firms’ CSR performance. We tested our hypotheses using hand-collected data of family firms included in the S&P 500 index, in the period of 2003–2010. The empirical findings support our hypotheses that family firms with family members as the CEOs have better CSR performance and family firms tend to provide a high level of long-term incentives to non-family than family CEOs. In addition, long-term incentives strongly motivate CEOs to improve firms’ CSR performance, regardless of their family memberships. (shrink)

In nature scent is important for man primarily as a marker of food and sexual attractiveness, it polarizes as objects of life and decay, death. Scent, just like touch and taste exists till subject and object get opposed to each other, it is the sphere where body is included into material world, and flesh of the world is incrusted into the body. Aesthetics in its anthropologic meaning is limited by a body- perceptible dimension. Development of such categories as the sublime, (...) tragic, comic are not possible here. Creation of compound aromas, including those which do not exist in nature, can not overstep the limits of the beautiful- -ugly opposition. There is no contradiction, nourishing the comic, the tragic or the sublime, in blending of body with the world by means of scent. The spectrum of the aesthetic in the sphere of aromas is expanded in the plane from the beautiful to the ugly: fragrant, heady, amber, garlic, carpic, putrid, hideous, stinking. (shrink)

When speaking of a form of life, we consider one different from others by way of its mode of expression, that is, by its (...) means of construction. This interpretation lends itself to a functional analysis of the material put to use and whose operations jointly express the concept we are after. Modes of expression can be plotted between a rhetorical and semantic axis (Gates 48). As such, "[t]he level of connotation of the visual sign, of its contextual reference and positioning in different discursive fields of meaning and association, is the point where already coded signs intersect with the deep semantic codes of a culture and take on additional more active ideological dimensions" (Hall 56). Coordinates within this domain encode signifying practices, revitalizing the traditional concept of signification as a function of what's signified with respect to a signifier. The content of a syntagm in this coordinate system, a point in this plane, indexes its function with respect to others. As such, we will conceive of the content of modes of expression functionally.A function is defined by pairing an element from a domain and another from a sub/co-domain whereby that pair is an element of that function. In this way, we can treat functions as abstract objects. If we treat a domain as what determines the availability of an expression, and a sub/co-domain as representative of its range of application, then the function of applying some proposition maps a movement from a domain of selection to one of composition, that is, its use with respect to others. The function of an expression, then, represents an operation over the possible worlds of its appropriate application (Taylor 201–02, 269, 276). This becomes more interesting when considering assertions whereby one subject is known to be the case for another, a concept that's modeled when a proposition from one is appearing in the object position of another (Fara 65–73). It follows that if a form of life is understood by way of its mode of expression, then its content is expressed as an ensemble of the functions of its operations. Let this ensemble of functions be called an endowment.There is a pervasive debate in cultural studies that obsesses over proprietary notions as well as the ability to locate an origin. With that in mind, let us consider a coordinate system where there are two perpendicular axes, and we define positions within the space provided at the intersection of lines drawn from each. Each axis is represented by an ordered series of markers. A line drawn from each axis indicates that the coordinates indexed at their intersection is a function of these two markers. This locates an individual at a point in that domain, indexing a relation between the axes framing that space. Therefore, that coordinate-wise space, here a domain of possible expression, is not "empty" as pessimists would claim, but is filled with functional-content, albeit functions yet applied and marked by a point in that plane.Although we are currently speaking of two-dimensional space, the same follows for as many dimensions as we want. A point's location is a function of three values in three dimensions, four in four dimensions, and so on. Forms of life, then, will be comprised of four dimensions. This allows for a space-time conception, wherein joint expressions bend space-time and that space dictates those individuals' possible movements. ABSTRACT There has been much discussion regarding the acceptable use of sedation for palliation. A particularly contentious practice concerns deep, continuous sedation given to patients who are not imminently dying and given without provision of hydration or nutrition, with the end result that death is hastened. This has been called ‘early terminal sedation’. Early terminal sedation is a practice composed of two legally and ethically accepted treatment options. Under certain conditions, patients have the right to reject hydration and nutrition, even (...) if these are life‐sustaining. Patients are also entitled to sedation as palliation for intolerable, intractable suffering. Though early terminal sedation is thought to be rare at present, the changing nature of palliative medicine suggests its use will increase. Arguments regarding early terminal sedation have failed to recognize early terminal sedation as a distinct legal and ethical entity. It can be seen as both the simple sum of treatment refusal and sedation for palliation, analogous to terminal sedation. It can also be seen as an indivisible palliative treatment, more analogous to assisted suicide or euthanasia. But ultimately, it is wholly analogous neither to terminal sedation given when death is imminent, nor to assisted suicide or euthanasia. This paper contends that early terminal sedation should be considered as a distinct entity. Such a reconception promises to provide a way forward in the debate, practice and policy regarding this contentious area of palliative medicine. (shrink)

Economic analysis is being applied by scholars to an increasing range of legal problems. This collection brings together some of the main contributions to an important area of this work, the economics of contract law. The essays and illuminating notes, questions, and introductions provided by the editor outline the Law and Economics framework for analyzing contractual relationships. The first two parts of the book present a number of useful concepts - adverse selection, moral hazard, and rent seeking - and a (...) general way of thinking about the economics of contracting and contract law. The remainder of the book considers a wide range of topics and issues. The recurring theme is that contracting parties want to assign the responsibility for adjusting to particular contingencies to the party best able to control the costs of adjustment. The adjustment problem is exacerbated by the fact that the parties might engage in various types of strategic behavior, such as opportunism, moral hazard, and rent-seeking. Many contract law doctrines can best be understood as attempts to replicate how reasonable parties might resolve this adjustment problem. (shrink)

Actions are uncontroversially public. However, the prevailing model of explanation in the debate about the de se seems to conflict with this fact by proposing agent-specific explanations that yield agent-specific types of action—i.e. types of action that no two agents can instantiate. Remarkably, this point affects both proponents and critics of the de se. In this paper, I present this kind of problem, characterise the proper level of analysis for action explanation compatible with the publicity of action—i.e. the agent-bound level—and (...) suggest that acknowledgement of this level highlights two important amendments of contemporary views. First, sceptics must accept that, when explanation is attitude-involving, the attitudes mentioned in the explanation of action must refer to the agent. Secondly, and perhaps more surprisingly, proponents of the de se should seek for accounts of de se attitudes that are not confined to a specific agent and are, therefore, sharable across agents. This article presents three interpretations of glocalization in social-scientific literature as a means of reframing the terms of scholarly engagement with the concept. Although glocalization is relatively under-theorized, two key interpretations of the concept have been developed by Roland Robertson and George Ritzer. Through a critical and comparative overview, the article offers an assessment of the advances and weaknesses of each perspective. Both demonstrate awareness regarding the differences between globalization and glocalization, but this awareness is far from explicit. Both interpretations (...) fail to draw a consistent analytical distinction between the two concepts and ultimately succumb to reductionism: either glocalization is subsumed under globalization or globalization is transformed into glocalization. Next, a third interpretation of glocalization as an analytically autonomous concept is presented. Working definitions of glocalization and of glocality as analytically autonomous from globalization and globality are developed and examples are offered. By addressing the key themes of power and temporality, this third interpretation transcends the limits of the other two interpretations. (shrink)
