The emergence of the German Jewish philosopher Ernst Cassirer as the object of scholarly attention has been both surprising and rapid. In the decades since his early death while in exile in the United States, Cassirer never fell into complete oblivion. His works remained known to specialists in German intellectual history; his participation in a famous 1929 debate with Martin Heidegger in Davos, Switzerland, one of the most iconic moments in modern Continental thought, made his name familiar to most students (...) of modern philosophy. Yet Cassirer lacked the widespread recognition given to contemporaries such as Heidegger or Walter Benjamin, and his work never became the center of historical or philosophical study. This neglect stemmed, in part, from dismissal by his peers; as Edward Skidelsky explains in his new study, Rudolf Carnap found him “rather pastoral,” Isaiah Berlin dismissed him as “serenely innocent,” and Theodor Adorno thought he was “totally gaga”. The last few years, however, have seen the rise of a remarkable new interest in Cassirer in both Germany and the English-speaking world. Among this recent literature, Edward Skidelsky's and Peter Gordon's works lead the small “Cassirer renaissance” and offer the best English-language introduction to his thought. Both Gordon and Skidelsky ambitiously seek to relocate Cassirer at the forefront of modern German and European thought. Gordon goes as far as to call him “one of the greatest philosophers and intellectual historians to emerge from the cultural ferment of modern Germany” and one of the most important thinkers of the twentieth century. In making such bold statements, Gordon and Skidelsky clearly set their sights beyond the person himself; they aspire to highlight a central strand of thought that enjoyed a powerful presence in early twentieth-century Germany but fell into neglect in the postwar era. In doing so, they seek to reevaluate the nature and legacy of Weimar thought, its complex relationship with the period's unstable politics, and its relevance today. (shrink)

This paper explores an increasingly prevalent element of board-level commitment to sustainability. We propose a theoretical framework under which the existence and associated actions of board-level sustainability committees are motivated by shared value creation, where the interests of a diverse group of stakeholders are satisfied and sufficient profit is achieved. Using hand-collected data, we find that sustainability committees are heterogeneous in focus and vary in their effectiveness. Specifically, we disaggregate the sustainability committee construct based on stakeholder group focus and find (...) that associations between sustainability committees and performance outcomes are stronger when committees focused on a specific stakeholder group are paired with relevant performance outcomes. We generally find that sustainability committees are effective at impacting relevant strengths, but do not mitigate relevant concerns. These results are consistent with the shared value framework, where committees both generate value by pursuing sustainability-related opportunities and protect value by monitoring, but not necessarily mitigating sustainability-related risks. Univariate tests suggest that effective committees are also larger, more independent, and meet more frequently. Finally, we propose a new method to classify industries based on their sensitivity to certain stakeholder groups and find that the effectiveness of committees focused on specific stakeholders is more pronounced in industries that are sensitive to these stakeholders. This paper examines whether independent directors who have social ties to management (inside directors) can effectively perform their fiduciary duty to monitor management on behalf of shareholders. Ex ante, it is not clear whether social ties will enhance or obstruct the quality of board performance. Theory suggests that directors who are socially tied to management are ineffective and would make decisions favoring management. However, social ties can increase trust and information sharing between management and independent directors, improving directors' ability and (...) effectiveness in governing the company (Westphal, J. D.: 1999, The Academy of Management Journal 42(1), 7-24). To examine these contradicting predictions I use social network analysis and construct proxies for social ties between management and independent board members. Using these proxies, I first demonstrate that social ties are associated with higher managerial compensation. Further analyses reveal that these results are driven by social ties that include members of the compensation committee. Conversely, I demonstrate that financial reporting quality is improved when social ties exist. Specifically, I find that the likelihood of material weaknesses in internal controls and the likelihood of financial restatements are lower in companies with social ties. I further observe that this improved quality of financial reporting holds only when social ties include members of the audit committee. I conclude that ethically, socially tied independent directors should disqualify themselves from serving on compensation committees where social independence is essential. However, in tasks where collaboration with management is essential, directors with social links to each other can be of added value to shareholders. (shrink)

En el presente trabajo abordo el problema de la incompatibilidad normativa entre dos principios ampliamente aceptados entre los liberales igualitarios -el principio de igualdad de oportunidades y el de autonomía familiar- en el marco de la teoría de la justicia de Rawls. Luego de hacer explícitas las diferentes vías por las cuales la autonomía de la familia inexorablemente conduce a la desigualdad de oportunidades entre los individuos, me dedico a explorar dos soluciones al problema sugeridas por Rawls en Una teoría (...) de la justicia y a mostrar por qué las mismas son fallidas. This essay analyzes the problem of the normative incompatibility between two principles which are widely accepted by liberals -the principle of equality of opportunities and that of family autonomy- and this within the framework of Rawls´s theory of justice. After specifying different ways in which the autonomy of the family necessarily leads to inequality of opportunities between individuals, I examine two different solutions suggested by Rawls in A Theory of Justice and I intend to demonstrate why they are wrong. The relative strengths of first-order theories axiomatized by transfinite induction, for ordinals less-than 0, and formulas restricted in quantifier complexity, is determined. This is done, in part, by describing the provably recursive functions of such theories. Upper bounds for the provably recursive functions are obtained using model-theoretic techniques. A variety of additional results that come as an application of such techniques are mentioned.

In this paper I identify two different lockean concepts of justice - "proprietary justice" and "justice as fairness" - and examine the relationship between each of them and charity in John Locke´s theory of property. As I try to show, in both cases Locke considers that charity may have priority over justice. This undermines the classical interpretation of Locke as a defender of unlimited capitalistic appropriation and provides additional evidence supporting Locke´s acceptation of a minimal redistributive system which should guarantee (...) the material welfare of non-appropriators. I aim to alleviate the pessimism with which some philosophers regard the 'objective attitude', thereby removing a particular obstacle which P.F. Strawson and others have placed in the way of more widespread scepticism about moral responsibility. First, I describe what I consider the objective attitude to be, and then address concerns about this raised by Susan Wolf. Next, I argue that aspects of certain attitudes commonly thought to be opposed to the objective attitude are in fact compatible with it. Finally, (...) I examine the prospects of someone who wishes to adopt the objective attitude permanently. In response to philosophers who claim that this would be psychologically impossible, I argue that our commitment to attitudes that presuppose moral responsibility can soften and fade, often without our noticing it. In the second half of the nineteenth century, France was the main site of the controversy around the so-called eoliths, supposedly human-made tools of Tertiary Europe. In contrast to the more common situation where scientists have to make sure that an object stabilized in a laboratory is not an artifact of the lab but a natural object, in the eoliths debates the opposite was the case. The eolith proponents tried to render plausible the object's artificial, that is human, origin. In (...) their case, the objects would only be of scientific interest if they were artifacts not geofacts (naturally flaked stones). The paper ties in with existing literature on the French eoliths movement and investigates the successive eoliths debates in Britain. In Bruno Latour's terms, eoliths as archaeological evidence for Tertiary Man in Europe could gain in reality through a successful enlisting of the collaboration of human and non-human actors such as scientists, theories, publications, taxonomies, technologies, institutions, etc. Indeed, networks were established among scientists, preferably of powerful institutions, the 'tools' were integrated or denied a place in existing taxonomies of prehistoric artifacts, experiments were carried out to demonstrate their chance or designed origin, and their convergence or incompatibility with a certain theoretical framework was discussed. Arguments often revolved around questions of negative evidence, since both proponents and opponents of eoliths as tools were aware of the fact that the eoliths' strongest tie to reality would be evidence of the toolmakers themselves. Several known hominid fossils, among them those of doubtful age, were thus proposed as Tertiary shapers of the 'tools'. These hypothetical 'Englishmen' and their supposed artifacts were enmeshed in particular theories of human evolution, marked as they were by the racism and nationalism widespread at the time. Con frecuencia la teoría política trata a la familia como un hecho incuestionable de la vida social. Sin embargo, y especialmente en el marco del liberalismo político, vale la pena preguntarse por su justificación. En el presente trabajo analizo la teoría de la justicia de John Rawls buscando reconstruir no sólo lo que efectivamente dice sobre esta cuestión sino también el potencial que encierra para propocionar respuestas más contundentes. Rawls parece suscribir una explicación puramente instrumental del valor de la familia, (...) centrada en su utilidad para la reproducción y estabilidad de una sociedad bien ordenada. Sin embargo, como señalaré, aunque Rawls no explora esta alternativa, una aplicación consecuente del “primer principio”, que pauta la distribución de libertades y derechos básicos de los individuos, abre el camino para una justificación normativa más concluyente. This paper develops a sympathetic critique of recent experimental work on free will and moral responsibility. Section 1 offers a brief defense of the relevance of experimental philosophy to the free will debate. Section 2 reviews a series of articles in the experimental literature that probe intuitions about the "compatibility question"—whether we can be free and morally responsible if determinism is true. Section 3 argues that these studies have produced valuable insights on the factors that influence our judgments on the (...) compatibility question, but that their general approach suffers from significant practical and philosophical difficulties. Section 4 reviews experimental work addressing other aspects of the free will/moral responsibility debate, and section 5 concludes with a discussion of avenues for further research. (shrink)

An Invitation to Formal Reasoning introduces the discipline of formal logic by means of a powerful new system formulated by Fred Sommers. This system, term logic, is different in a number of ways from the standard system employed in modern logic; most striking is its greater simplicity and naturalness. Retributive emotions and behavior are thought to be adaptive for their role in improving social coordination. However, since retaliation is generally not in the short-term interests of the individual, rational self-interest erodes the motivational link between retributive emotions and the accompanying adaptive behavior. I argue that two different sets of norms have emerged to reinforce this link: (1) norms about honor and (2) norms about moral responsibility and desert. I observe that the primary difference between these types of retribution motivators (...) lies in where the normative focus is placed after an offense. In the first form of retribution, the normative focus is on the offended party. In the second, it is on the offender. Next, I show how each class of norms is well tailored to the particular features of the environment in which these forms of retributive behavior emerge. Finally, I consider some philosophical implications of these observations. I suggest that my account, if correct, would pose tough challenges for contemporary philosophical theories of moral responsibility and punishment. (shrink)

Nietzsche no perdió la ocasión de menospreciar a Mill como el típico inglés de mentalidad pasiva, en cambio los intérpretes actuales de Nietzsche son cautelosos en este aspecto, pues el filósofo alemán leyó muy minuciosamente a Mill, en particular su obra Sobre la libertad. Cuando él propicia que Zaratustra hable acerca de «el más frío de todos los monstruos fríos», lo hace con una promesa de futuro: «Allí, donde el Estado acaba, ahí comienza el ser humano que no es superfluo (...) […]. Allí, donde el Estado acaba, — ¡miradme de este modo hacia allá hermanos míos! ¿No los veis, al arcoíris y los puentes del suprahumano?». El presente trabajo establece una comparativa entre la visión de Dios y del Estado en la época moderna y la reflexión que hace Friedrich Nietzsche en Así habló Zaratustra acerca del Estado como algo monstruoso. Para este propósito se utilizarán respectivamente pasajes de la obra de Georg Wilhelm Friedrich Hegel, Arthur Schonpenhauer, Friedrich Leopold Stolberg, Karl Marx, Max Sterner, Wilhelm von Humboldt y John Stuart Mill. 1. “All Theory is Against Free Will…” Powerful arguments have been leveled against the concepts of free will and moral responsibility since the Greeks and perhaps earlier. Some—the hard determinists—aim to show that free will is incompatible with determinism, and that determinism is true. Therefore there is no free will. Others, the “no-free-will-either-way-theorists,” agree that determinism is incompatible with free will, but add that indeterminism, especially the variety posited by quantum physicists, is also incompatible with free will. Therefore there is (...) no free will. Finally, there are the a priori arguments against free will. These arguments conclude that it makes no difference what metaphysical commitments we hold: free will and ultimate moral responsibility are incoherent concepts. Why? Because in order to have free will and ultimate moral responsibility we would have to be causa sui, or ‘cause of oneself.’ And it is logically impossible to be self-caused in this way. The last issue of this journal published an exchange between Marilyn Friedman and me that had taken place at a lively session of the American Philosophical Association in December, 1990. Friedman's paper “‘They Lived Happily Ever After’: Sommers on Women and Marriage” was a barbed critique of my views on the family. My rejoinder, “Do These Feminist Like Women?” pointed out that Friedman's orthodox brand of feminism was not sensitive to the values and aspirations of most American women. That issue (...) of the Journal of Social Philosophy also published a third paper of Friedman's “Does Sommers Like Women?” twice as long again as my rejoinder. This second critique went further into earlier writings of mine raising new issues, and criticizing me in rather unpleasant ad feminam ways. If an uncharacteristic asperity colors my response, it is because I do not find myself able to deal coolly and impersonally with the accusation that I intentionally misrepresent some of the feminist philosophers I criticize. The ji 己self is a site, storehouse, or depot of individuated allotment associated with the possession of things and qualities: wholesome and unwholesome desires (yu 欲) and aversions, emotions such as anxiety, and positive values such as humaneness and reverence. Each person's allotment is unique, and its "contents" are collected, measured, reflected on, and then distributed to others. The Analects, Mencius, Xunzi, Daodejing, and Zhuangzi each have their own vision for negotiating the space between self and other. Works as seemingly (...) dissimilar as the Analects and Daodejing both agree that positive qualities located within the self should be shared with others, and that the self can be optimized rather than maximized through sharing, emptying, or clearing. Sommer compares the ji self with other terms for body and person current in classical times. This self is strongly individuated, but it exists primarily in relation to other human beings (ren 人 ). These "others" are almost never one's own kind and are usually people who fall outside one's ascribed familial and social relationships. Negotiations between self and other often reflect apprehension regarding degrees of distance, intimacy, worth, recognition, or understanding (zhi 知) between people. (shrink)

Abstract:This essay reviews Giorgio Agamben’s Omnibus Homo Sacer, a monumental project of nine books that was recently completed after two decades. Alongside outlining the project’s key claims, the essay reflects on its uneven reception: it seeks to explain why Agamben’s claims on politics, law, and violence received enormous attention, while his writings on economics and religion were largely ignored. The essay in particular discusses the values and limits of Agamben’s work for historians.

This paper deals with the role of Judaism in Walter Benjamin's famous 1921 essay on violence and law, Zur Kritik der Gewalt. Despite the intense attention devoted to this essay, the role of Jewish myth in it has not yet been thoroughly explained. This study contends that the association between what Benjamin termed revolutionary violence and the Jewish messianic tradition, which plays a central role in the evaluation of Benjamin's text, is far more problematic than has hitherto been assumed, and (...) poses a serious challenge, which has not been fully examined in its historical context. Second, this essay claims that the subversive elements that many have supposedly found in Benjamin's text and the attempts to link these elements to messianic traditions are also unconvincing. Third, the paper contextualizes Benjamin's thought within the framework of the Jewish political–theological debate of the period. It contends that Benjamin's theory of law and justice should be understood not as a revolutionary, anti-republican text, as has been generally accepted, but as a secularized conservative orthodox one. In doing so, it seeks to shed light not only on Benjamin's early thinking and its influences, but also on the neglected element of Jewish orthodoxy within the broader topic of political theology.
