The popularity of direct-to-consumer genetic ancestry services has exploded over the past five years, with as many as 250 direct-to-consumer genetic ancestry testing companies currently operating and estimates that 1 in 5 Americans are customers of one or more of those companies. Marketing of genetic ancestry testing has consistently linked the results of DNA testing to a consumer’s racial and ethnic identity, and, because of that, can help consumers find out “who they really are.” We argue that the “biologization” of (...) race and ethnicity promoted in such marketing violates norms of marketing ethics. In particular, we show that this marketing technique violates a number of the core commitments and values of the American Marketing Association Statement of Ethics. (shrink)

Tyler Burge presents an original study of the most primitive ways in which individuals represent the physical world. By reflecting on the science of perception and related psychological and biological sciences, he gives an account of constitutive conditions for perceiving the physical world, and thus aims to locate origins of representational mind.

The American Society for Bioethics and Humanities has created a quality attestation process for clinical ethics consultants; the pilot phase of reviewing portfolios has begun. One aspect of the QA process which is particularly challenging is assessing the interpersonal skills of individual clinical ethics consultants. We propose that using case simulation to evaluate clinical ethics consultants is an approach that can meet this need provided clear standards for assessment are identified. To this end, we developed the Assessing Clinical Ethics Skills (...) tool, which identifies and specifies specific behaviors that a clinical ethics consultant should demonstrate in an ethics case simulation. The aim is for the clinical ethics consultant or student to use a videotaped case simulation, along with the ACES tool scored by a trained rater, to demonstrate their competence as part of their QA portfolio. As the field of clinical ethics consultation sets standards and moves forward with the Quality Attestation process, questions should be raised about what ethical issues really do arise in practice. There is limited data on the type and number of ethics consultations conducted across different settings. At Loyola University Medical Center, we conducted a retrospective review of our ethics consultations from 2008 through 2013. One hundred fifty-six cases met the eligibility criteria. We analyzed demographic data on these patients and conducted (...) a content analysis of the ethics consultation write-ups coding both the frequency of ethical issues and most significant, or key, ethical issue per case. Patients for whom ethics consultation was requested were typically male, white, between 50 and 69 years old, of non-Hispanic origin, and of Roman Catholic faith. Nearly half were in the intensive care unit and 44.2 % died in the hospital. The most frequent broad ethical categories were decision-making, goals of care/treatment, and end-of-life. More specifically, capacity, patient’s wishes/autonomy, and surrogate decision maker were the most frequent particular ethical issues. The most common key ethical issues were withdrawing/withholding treatment, patient wishes/autonomy, and capacity. Our findings provide additional data to inform the training of clinical ethics consultants regarding the ethical issues that arise in practice. A wider research agenda should be formed to collect and compare data across institutions to improve education and training in our field. (shrink)

AUGUSTINE'S NOVELISTIC CONVERSION Tyler Graham Syracuse University In his famous biography of St. Augustine, Peter Brown attempts to explainwhat set the Confessions "apart from the intellectual tradition to which Augustine belonged" (Augustine ofHippo 169). While he concedes that "the Confessions are a masterpiece ofstrictly intellectual autobiography" (167), he concludes that it is more important to realize that they "are, quite succinctly, the story of Augustine's 'heart,' or (...) of his 'feelings'—his affectus"(169). He continues to explain that "in the Confessions, however, the evocation of Augustine's feelings forms part of the wider study of the evolution ofhis will" (172). Thus, Brown suggests that Augustine's central anthropological concern is to determine the origin and/or causes ofhuman desire (i.e. the "evolution of will"). Augustine's "exhaustive analysis ofhis motives" (as Brown describes it) is linked to his lifetime struggle to explain the complex interaction between his free will and a divine will (grace) to transform his "sinful" desires and create a "new heart" within him. In Brown's view, the Confessions reflect Augustine's struggle to discover whether desire originates in God or man. We can agree with Brown that this theological agenda is important to Augustine, for it will resurface in all of his theological struggles stretching from his pre-Christian engagement with the Manichees to his final battle with Pelagius. Nevertheless, I will argue in this paper that the Confessions reflect another important dimension to Augustine's morphology ofdesire. Regardless 136Tyler Graham of its divine or human source, Augustine's desires often begin with the imitation of another person. In portraying examples of his life up to and including his famous conversion in the year 386 (Book VIII), Augustine consistently shows that his desires have been copies or imitations ofvarious models whom he has chosen to follow. Writers such as Brown have considered the importance ofdesire (or the will) in the Confessions, and critics like Geoffrey Harpham (whom we will address later) have examined Augustine's interest in mimesis during various scenes in the book. Yet, with the exception ofAvitol Wohlman, no one (to my knowledge) has adequately considered the combination of the two: mimetic desire. In the first book ofthe Confessions, Augustine recounts his childhood, and, by the eighth chapter, he has already introduced a theme which will haunt the entire work: the link between desire and language. My desires were internal; adults were external to me and had no means ofentering into my soul. So I threw my limbs about and uttered sounds, signs resembling my wishes. (1:8) Language is born as a result ofthe need to express desire. For Augustine, words, gestures, and all utterances connect the "internal" wants to the "external" object ofcommunication (in this case, adults). In fact, ifAugustine links desire with the soul (external adults could not "enter his soul"), then language becomes the bridge between souls: it communicates desire from soul to soul. When Augustine reaches boyhood, and he begins to learn the accepted modes of articulation, the link between language and desire remains: "By groans and various sounds and various movements of parts of my body I would endeavor to express the intentions ofmy heart to persuade people to bow to my will" (1:13). Language communicates desire, but it also seeks to transform and generate desire. Beyond simply explaining his wishes, Augustine's language is persuasive, seeking to get others to "bow to my will." Whereas some people would like to remember their childhood as a time of innocence, joy, and peace, Augustine depicts his early life as "sinful," unhappy, and fraught with tears and conflicting interests. Tyler Dalton McNabb and Michael DeVito develop a thoroughly original and Orthodox model for how Christian belief, and, even specifically Eastern Christian belief, can be warranted. They do this by creatively bringing recent work on religious experience, in the context of the Divine Liturgy, into conversation with Alvin Plantinga’s well-known explication of Reformed Epistemology. What emerges is a distinctly Eastern Christian approach to warranted Christian belief, that modifies and, arguably, improves upon Plantinga’s original model.

Tyler conducted a longitudinal study of 1,575 Chicago inhabitants to determine why people obey the law. His findings show that the law is obeyed primarily because people believe in respecting legitimate authority, not because they fear punishment. The author concludes that lawmakers and law enforcers would do much better to make legal systems worthy of respect than to try to instill fear of punishment.

Locke establishes the primary-secondary quality distinction in two steps. First, he identifies the primary qualities by means of a separability argument that involves transdictive inference about the properties of the minute, imperceptible parts of matter. Second, he identifies the secondary qualities by means of a dispensability argument that relies on the principle that bodies normally act by ‘impulse.’ I suggest this principle is also justified through transdictive inference. In Columbia, Zachary Hale Comstock and Jeremiah Fink illustrate the way the bourgeoisie may come to create and control the means of production. As the friction builds between the bourgeoisie and the proletariat, historical processes contribute to the inevitable collapse of capitalism. In BioShock Infinite, the simmering friction between (...) the upper and lower classes boils over into the rise of the Vox Populi. The functionalist perspective often casts religion as a social structure that keeps society together despite any negative costs it may have for any particular group. In order for the bourgeoisie to own the means of production and keep the working class oppressed, it uses propaganda and indoctrination as powerful agents of control. (shrink)

Since the late 1980s, in defiance of Sri Lanka’s major monastic fraternities and the government, Buddhist women and men have begun to organize across distinctions of national boundary and Buddhist tradition to reinstate a defunct bhikkhun? ordination lineage for renunciant women. Drawing on fieldwork from the winter of 2015–16, this article considers some of the strategies by which Sri Lanka’s bhikkhun?s and their supporters constitute the burgeoning lineage as both legitimate and necessary for the continued health and vitality of an (...) otherwise ailing Buddhist s?sana. I argue that Sri Lanka’s bhikkhun?s engage in highly-visible forms of adherence to vinaya rules and social expectations for ideal monastic behavior set against a popular discourse about the laxity of male renunciants. Such engagement is both political and soteriological; while it is aimed at fulfilling legitimizing gendered expectations of women’s piety, it is expressed primarily in terms of the eradication of personal and societal suffering through forms of practice that accord with the ideal of a pious monastic. Thus, in contrast to discourses which locate bhikkhun?s as subjects whose presence weakens the s?sana’s duration and strength, in this new discourse Sri Lanka’s bhikkhun?s become virtuous agents of social service and moral restoration. The article concludes by identifying emerging connections between this discourse and an alreadygendered xenophobic Buddhist nationalism. (shrink)

We take canonical theology, in its most minimal form, to be the normative thesis that the final shape of a canon ought to guide how one interprets the texts contained within the canon. Within the Christian tradition, a standard objection to canonical theology goes something like this: Given the diversity of canon lists, whose canon should we endorse? Should we prefer the Masoretic ordering or the LXX? If the Greek tradition, which Greek tradition? Call this the Problem of Canon List (...) Diversity (PCLD). Appealing to scholastic hermeneutics, especially St. Augustine and St. Thomas Aquinas, and recent developments in the theology of inspiration, we develop a successful response to PCLD. (shrink)

Background: Direct–to–consumer genetic testing (DTCGT) offers risk estimates for a variety of complex diseases and conditions, yet little is known about its impact on actual users, including their decisions about sharing the information gleaned from testing. Ethical considerations include the impact of unsolicited genetic information with variable validity and clinical utility on relatives, and the possible burden to the health care system if revealed to physicians. Aims: The qualitative study explored primary care patients’ views, attitudes, and decision making considerations regarding (...) DTCGT. This article focuses on the disclosure decisions participants made regarding participation, testing, and results of DTCGT, a topic which arose as a secondary aim of the study. Methods: Through four longitudinal interviews (pre–test, results, 3 and 12 months post–test) we examined twenty primary care patients’ decisions, expressed intentions, and actions regarding disclosure to immediate and extended family, friends and coworkers, and physicians about participation in and results of DTCGT. Individual interviews were analyzed using qualitative content analysis and a summative approach to describe the global themes. Results: Most participants disclosed to some immediate family; less than half disclosed to extended family; approximately half talked to friends. Most participants stated they would or might disclose to physicians about DTCGT and a few did. Conceptual themes that emerged from the data analysis include ambivalence about disclosure, consistency between intention and actual disclosure behavior and decisions, and conditional information sharing. Conclusions: Participants’ intentional and actual disclosure patterns offer insight into how they view DTCGT, weigh results, and the potential impact of DTCGT. (shrink)

Applying a non-developmental evolutionary metatheory to understanding the evolution of psychological capacities leads to the creation of models that mischaracterize developmental processes, misattribute genes as the source of developmental information, and ignore the myriad developmental and contextual factors involved in human decision-making. Using an evolutionary systems perspective, we argue that revenge and forgiveness cannot be understood apart from the development of foundational human psychological capacities and the contexts under which they develop.

Tyler Burge presents a collection of his seminal essays on Gottlob Frege (1848-1925), who has a strong claim to be seen as the founder of modern analytic philosophy, and whose work remains at the centre of philosophical debate today. Truth, Thought, Reason gathers some of Burge's most influential work from the last twenty-five years, and also features important new material, including a substantial introduction and postscripts to four of the ten papers. The author responds to a letter by D. Brendan Johnson in the July‐August 2023 issue of the Hastings Center Report concerning his and Joseph Clair's article “Love Your Patient as Yourself: On Reviving the Broken Heart of American Medical Ethics.”.

Tyler Roberts encourages scholars to abandon the conceptual opposition between "secular" and "religious" to better understand how human beings actively and thoughtfully engage with their worlds and make meaning. The artificial distinction between a self-conscious and critical "academic study of religion" and an ideological and authoritarian "religion," he argues, only obscures the phenomenon. Instead, Roberts calls on intellectuals to approach the field as a site of "encounter" and "response," illuminating the agency, creativity, and critical awareness of religious actors. To (...) respond to religion is to ask what religious behaviors and representations mean to us in our individual worlds, and scholars must confront questions of possibility and becoming that arise from testing their beliefs, imperatives, and practices. Roberts refers to the work of Hent de Vries, Eric Santner, and Stanley Cavell, each of whom exemplifies encounter and response in their writings as they traverse philosophy and religion to expose secular thinking to religious thought and practice. This approach highlights the resources religious discourse can offer to a fundamental reorientation of critical thought. In humanistic criticism after secularism, the lines separating the creative, the pious, and the critical themselves become the subject of question and experimentation. (shrink)

In this paper, informed by Vatican 2 and one of its premier modern day scholars, Gerald O'Collins, we will argue (1), that while the Christian evangelist should proclaim that Jesus is the only way to God, she should nonetheless be open to the possibility that Christ is saving those in non-Christian traditions as non-explicit or anonymous Christians, and, (2), that other serious religious traditions can be interpreted as doctrinally consistent with (or something nearby) the Nicene Christian tradition. In conclusion, these (...) theses will lead us to argue that in the Christian's approach to evangelism, her first step in persuading her non-Christian counterpart should be to emphasize the commonality that exists between the Christian tradition and the relevant non-Christian tradition. The evangelist then, should not see her main task as developing arguments against her interlocuter's religious tradition (though, this has its place), but rather her focus should be on proclaiming an additional truth that her interlocuter can accept alongside many of her already held religious commitments. How is God related to the state? Could the existence of robust political authority somehow be evidence for God? In this Element, the author explores these questions, pro and con, looking at various major positions. At the start of the volume, they defend a political argument for God's existence. Having motivated a theistic account of political authority, they then discuss the role God plays or could play in classical liberalism, Marxism, and postliberalism. McNabb and DeVito have recently argued that Graham Oppy’s objections to the First Way are found wanting. Specifically, they argue that Oppy has mischaracterised the argument. McNabb and DeVito then restructure the First Way on behalf of St. Thomas. More recently, Joseph Schmid and Daniel Linford argue that the restructured argument given by McNabb and DeVito is problematic. For it is either valid but unmotivated or it is plainly invalid. In this paper, I argue that McNabb and DeVito’s schematic glossing (...) of the First Way is both valid and motivated. (shrink)

The paper develops a conception of epistemic warrant as applied to perceptual belief, called "entitlement", that does not require the warranted individual to be capable of understanding the warrant. The conception is situated within an account of animal perception and unsophisticated perceptual belief. It characterizes entitlement as fulfillment of an epistemic norm that is apriori associated with a certain representational function that can be known apriori to be a function of perception. The paper connects anti-individualism, a thesis about the nature (...) of mental states, and perceptual entitlement. It presents an argument that explains the objectivity and validity of perceptual entitlement partly in terms of the nature of perceptual states–hence the nature of perceptual beliefs, which are constitutively associated with perceptual states. The paper discusses ways that an individual can be entitled to perceptual belief through its connection to perception, and ways that entitlement to perceptual belief can be undermined. (shrink)

In this study, Tyler Frick aims to display and commend the theological ontology that arises from a careful analysis of Karl Barth's understanding of divine action.

The pattern of recourse to late medieval church courts suggests how late medieval Christians imagined their Church. Their choice of defendants, crimes, and punishments allowed them to define their communities. In the case of excommunication for debt, the use of procedural excommunications announced from the choir screen after the bidding prayers permitted the exclusion of debtors from the sacramental and economic community. Phenomenologists find themselves in the unusual position of attempting to describe non-sensuously phenomenal phenomena. Intentionality is one such oddity. It is not sensuously phenomenal, yet Husserl and Heidegger both purport to be able to “read off” its necessary features. Both were well aware that such an enterprise has its difficulties. The primary difficulty is how to make intentionality into an “object.” To do so, a method for directing our “phenomenological vision” is necessary. Heidegger, however, is unable to utilise Husserl’s methods (...) for this purpose. Since the phenomenological method must “follow its matter,” and Heidegger’s matter is different from Husserl’s, Heidegger cannot merely adopt Husserl’s methods. Thus, Heidegger must develop a new method to investigate intentionality. In this paper, I show the ways in which Heidegger’s conception of intentionality diverged from Husserl’s while retaining its core sense, and why intentionality poses particularly difficult methodological problems. Finally, I investigate the new methods Heidegger develops (c. 1925–28) to deal with theseproblems—categorial intuition, a reformulated version of the reduction, and a form of objectification—and why each of these methods fails. A theorem is proved that shows the recursive Polish space structure is not found in the effectively open subsets of a space $${\mathcal {X}}$$ X, and we explore strong evidence that the effective structure is instead captured by the effectively open subsets of the product space $$\mathbb {N}\times {\mathcal {X}}$$ N × X.

In this essay, I seek to enhance eschatological perspectives on work through specific engagement with Qoheleth’s theology of time in Eccl. 2–3. I suggest that prior to a perceptual transformation in the first of the book’s so-called carpe diem passages, Qoheleth is dissatisfied with his labour because he construes it temporally-speaking within a chronology characterised by competition. Within such a construal, death poses the ultimate obstacle to the enjoyment of labour, because it strips away the promise of an immortal inheritance (...) produced by human hands. What transforms Qoheleth’s relationship to labour is a new understanding of time as kairos, defined as the opportune time in which God unexpectedly intervenes in human work ‘under the sun’ and does something paradigmatically new. Under this ‘kairological’ perspective, Qoheleth assumes a posture of receipt, declaring present labour as a gift from God, with internal as well as external goods for the worker. Qoheleth’s ‘accipe diem work ethic’ draws the eschatological ultimacy of life and peace into present labour, re-orienting eschatological understandings of work that fall prey to competitive-chronological notions of progress. This paper uses post-structural theory to critically interrogate the question: Does business and society (B&S) scholarship benefit society? Overall I argue that B&S scholarship may make productive contributions to society, but that these are limited in serious ways. Specifically, I argue that B&S scholarship is limited by its engagement with neoclassical discourse which leads to a number of problematic assumptions about how it is linked to social good.

In Burge [Disjunctivism and perceptual psychology. Philosophical Topics 33: 1–78, 2005], I criticized several versions of disjunctivism. McDowell defends his version against my criticisms in McDowell [Tyler Burge on disjunctivism. Philosophical Explorations 13: 243–55, 2010]. He claims that my general characterization fails to apply to his view. I show that this claim fails because it overlooks two elements in my characterization. I elaborate and extend my criticisms of his disjunctivism. I criticize his positions on infallibility and indefeasibility, and reinforce (...) my earlier charges that his views on perception and epistemology are hyper-intellectualized. The central point in my rejection of his disjunctivism concerns his claim that the science of perceptual psychology is irrelevant to his disjunctivist classification of perceptual states. I hold that this claim shows lack of familiarity with the science and serious misunderstanding of it. The basic deficiency in McDowell's disjunctivism is that it, like other versions, is incompatible with well-established scientific knowledge. (shrink)

The authors of this article are previous or current members of the Clinical Ethics Consultation Affairs (CECA) Committee, a standing committee of the American Society for Bioethics and Humanities (ASBH). The committee is composed of seasoned healthcare ethics consultants (HCECs), and it is charged with developing and disseminating education materials for HCECs and ethics committees. The purpose of this article is to describe the educational research and development processes behind our teaching materials, which culminated in a case studies book called (...) A Case-Based Study Guide for Addressing Patient-Centered Ethical Issues in Health Care (hereafter, the Study Guide). In this article, we also enumerate how the Study Guide could be used in teaching and learning, and we identify areas that are ripe for future work. (shrink)

Abstract: In this paper I argue that luck and fortune are distinct concepts that apply to different sets of events. I do so by suggesting that lucky events are best understood as significant events that are either modally fragile or improbable (depending on whether you accept a modal account or a probability account of luck), whereas fortunate events are best understood as significant events that are outside of our control. I call this the Pure Control Account of Fortune. I show (...) that this account of fortune forces control theorists about luck to be fortune reductionists but allows those who endorse a modal or probability account of luck to be fortune realists. Additionally, I argue that this account of fortune helps us overcome prominent counterexamples and challenges found in the luck literature. (shrink)

Non‐Humean theories of natural necessity invoke modally‐laden primitives to explain why nature exhibits lawlike regularities. However, they vary in the primitives they posit and in their subsequent accounts of laws of nature and related phenomena (including natural properties, natural kinds, causation, counterfactuals, and the like). This article provides a taxonomy of non‐Humean theories, discusses influential arguments for and against them, and describes some ways in which differences in goals and methods can motivate different versions of non‐Humeanism (and, for that matter, (...) Humeanism). In short, this article provides an introduction to non‐Humeanism concerning the metaphysics of laws of nature and natural necessity. (shrink)

This essay is a long one. It is not meant to be read in a single sitting. Its structure is as follows. In section I, I explicate perceptual anti-individualism. Section II centers on the two aspects of the representational content of perceptual states. Sections III and IV concern the nature of the empirical psychology of vision, and its bearing on the individuation of perceptual states. Section V shows how what is known from empirical psychology undermines disjunctivism and hence certain further (...) views that entail it, including naive realism. In Section VI, I raise a further point against disjunctivism. Section VII indicates how general reflection on perceptual perspective and epistemic ability supports the constraints from empirical psychology. It also explains how reflection on veridicality conditions, psychological explanation, and cognitive ability conspire to force recognition of the two kinds of representation mentioned in the preceding paragraph. Launonen and Mullins argue that if Classical Theism is true, human cognition is likely not theism-tracking, at least, given what we know from cognitive science of religion. In this essay, we develop a model for how classical theists can make sense of the findings from cognitive science, without abandoning their Classical Theist commitments. We also provide an argument for how our model aligns well with the Christian doctrine of general revelation.
