Spina bifida is a neurodevelopmental disorder that results in a broad range of disability. Over the last few decades, there have been significant advances in diagnosis and treatment of this condition, which have raised concerns regarding how clinicians prognosticate the extent of disability, determine quality of life, and use that information to make treatment recommendations. From the selective treatment of neonates in the 1970s, to the advent of maternal–fetal surgery today, the issues that have been raised surrounding spina bifida intervention (...) invoke principles of medical bioethics such as beneficence and nonmaleficence, while also highlighting how quality of life judgments may drive care decisions. Such changes in treatment norms are also illustrative of how disability is viewed both within the medical community and by society at large. An examination of the changes in spina bifida treatment provides a model through which to understand how ethically complex decisions regarding care for children with disabilities has evolved, and the challenges faced when medical information is combined with value-based judgments to guide medical decision making. The authors of this article are previous or current members of the Clinical Ethics Consultation Affairs (CECA) Committee, a standing committee of the American Society for Bioethics and Humanities (ASBH). The committee is composed of seasoned healthcare ethics consultants (HCECs), and it is charged with developing and disseminating education materials for HCECs and ethics committees. The purpose of this article is to describe the educational research and development processes behind our teaching materials, which culminated in a case studies book called (...) A Case-Based Study Guide for Addressing Patient-Centered Ethical Issues in Health Care (hereafter, the Study Guide). In this article, we also enumerate how the Study Guide could be used in teaching and learning, and we identify areas that are ripe for future work. (shrink)

This paper is the companion to the “Assessment of Coordination of Legal-Based Efforts across Jurisdictions and Sectors for Obesity Prevention and Control” paper, and the third of four papers outlining action options that policymakers can consider as discussed as part of the National Summit on Legal Preparedness for Obesity Prevention and Control. The goal of this paper is to identify potential action and policy strategies related to coordination across jurisdictions and sectors that can be adopted by policymakers and implemented by (...) practitioners to address the obesity epidemic. The paper examines collaboration among four sectors — community agencies and organizations, schools, health care institutions, and workplaces — and examines collaboration from both vertical and horizontal perspectives. This paper develops a typology of moral problems in business. The cross-classification of two fundamental dimensions of ethical conduct: judgment and motivation, is employed to distinguish four types of moral problems: genuine dilemmas, compliance problems, moral laxity, and no-problem problems. Actual cases are brought to illustrate each type of problem, and corresponding coping strategies are presented. The paper highlights the need to design a dynamic strategy that will take into account the relationships among different types of ethical problems. We develop an evidence-based theoretical account of how widely shared cultural beliefs about gender, race, and class intersect in interpersonal and other social relational contexts in the United States to create characteristic cultural “binds” and freedoms for actors in those contexts. We treat gender, race, and class as systems of inequality that are culturally constructed as distinct but implicitly overlap through their defining beliefs, which reflect the perspectives of dominant groups in society. We cite evidence for the contextually contingent interactional (...) “binds” and freedoms this creates for people such as Asian men, Black women, and poor whites who are not prototypical of images embedded in cultural gender, race, and class beliefs. All forms of unprototypicality create “binds,” but freedoms result from being unprototypical of disadvantaging rather than advantaging statuses. (shrink)

Our understanding of the nature and processing of figurative language is central to several important issues in cognitive science, including the relationship of language and thought, how we process language, and how we comprehend abstract meaning. Over the past fifteen years, traditional approaches to these issues have been challenged by experimental psychologists, linguists, and other cognitive scientists interested in the structures of the mind and the processes that operate on them. In Figurative Language and Thought, internationally recognized experts in the (...) field of figurative language, Albert Katz, Mark Turner, Raymond W. Gibbs Jr., and Cristina Cacciari, provide a coherent and focused debate on the subject. The book's authors discuss a variety of fundamental questions, including: What can figures of speech tell us about the structure of the conceptual system? If and how should we distinguish the literal from the nonliteral in our theories of language and thought? Are we primarily figurative thinkers and consequently figurative language users or the other way around? In this chapter, Dahan Katz defends relational conceptions of retribution and desert. She clarifies the ways in which such relational conceptions avoid major worries associated with retributive theory, while addressing further worries that arise distinctively with respect to such an approach. In doing so, Dahan Katz provides further defense of the response-retributive theory of punishment that she has proposed elsewhere, while defending a wider set of views within the retributive tradition.

This paper offers a response retributive theory of punishment, taking the role of the punisher as well as the relations between the parties to punishment to be central to retributive justification. It proposes that punishment is justified in terms of the ethics of appropriate response, and more precisely, in terms of the duty agents have to dissociate from the devaluation inherent in the culpable wrongdoing of others. The paper demonstrates that on such account, while the harm and suffering involved in (...) punishment are rightly imposed, they are not good, grounding a further duty to mitigate our retributive practices. The result is a moderate vision of retributive justification, which has the resources to justify, not only criminal punishment, but punishment as imposed across a wide variety of relations: private, institutional and political. Business myth is generally treated in business ethics literature as a mental obstacle that must be removed in order to prepare the ground for rational thinking on the ethical aspect of business conduct. This approach, which focuses on the content of myth, does not explicate the nature and function of myth. Based on the study of myth in the fields of humanities and social sciences, this paper develops a theoretical framework and analytical tool-the revolving-door model-for researching myth in business. The (...) proposed framework (I) offers new perspectives on myth: the consumer's, the producer's, the mythologist's, and the ethicist's; (2) explicates various distortion mechanisms ofthe myth; and (3) enables a redefinition of the relation of business myth to business ethics. The employment of foreign workers is one of the most crucial problems today in the domain of work relations. Absorbing workersfrom abroad poses serious questions concerning the moral obligations of the employers as well as the government authorities in the migrantreceiving country. Unfortunately, the moral dilemmas of foreign labor have been largely neglected by business ethics researchers. This paper develops a conceptual framework based on the multinational corporation (MNC) ethical research to help examine the moral obligations of employers and states (...) toward foreign workers, as opposed to citizens. The main argument is that domestic employers, who have the power to affect crucial aspects in the lives of migrant workers, incur obligations to these people and bear moral responsibility for their subsistence. As regards the host country in a universal social order based on the existence of nation-states, the employment of foreign workers poses a genuine ethical dilemma between two valid moral duties: the duty to improve the welfare of nationals and the duty to promote the interests of everyone, regardless of their nationality. A Conversation with Claire Katz about her book, Levinas and the Crisis of Humanism.

Rapid development of e-learning courses for ethics-and-compliance programs led to substantial success in producing engaging multimedia training toolkits aimed at breaking through barriers of indifference and distrust by combining learning with fun. However, a pleasant training experience is no guarantee of its ultimate success in improving organizational ethics. Drawing on Paivio’s Dual Coding Theory, this paper presents a model for evaluating multimedia learning from a moral viewpoint. The main argument advanced in the paper is that entertaining multimedia training modules, as (...) commonly offered in the business world, may deliver an unintended message which runs counter to the very goal of ethics training. The Rocked or Shocked? videogame—a multimedia-based ethics training module—will serve as a case study for detecting the complicated role of entertainment in ethics training and examining the ethical meanings conveyed through the pictorial/event channel. This paper offers a contemporary pan-denominational and postmodern Jewish theology. It utilizes the tools of Jewish theological scholarship within a uniquely midrashic format. This format of creative narrative text and scholarly commentary grounds these theological principles within the recognizable stylized system of traditional Jewish exegesis. Rabyam’s theology and the accompanying integral commentary reflect and elucidate feminist, postmodern theological concerns and attitudes. It is my contention that this unique theology is a vital contribution to an inclusive twenty-first century understanding of the (...) Divine. Though the principles of faith alone speak to a general audience, when combined with the annotated commentary, they fill a gap in current scholarship and contribute to a more holistic understanding of a post-modern Judaism not confined to a particular denomination or particular ethos. These principles reflect a Jewish world that is ‘fragmentary, contradictory and turbulent’, as theologian Emile Fackenheim argued. (shrink)

Chomsky's criticism of Bloomfieldian structuralism's conception of linguistic reality applies equally to his own conception of linguistic reality. There are too many sentences in a natural language for them to have either concrete acoustic reality or concrete psychological or neural reality. Sentences have to be types, which, by Peirce's generally accepted definition, means that they are abstract objects. Given that sentences are abstract objects, Chomsky's generativism as well as his psychologism have to be given up. Langendoen and Postal's argument in (...) The Vastness of Natural Languages to show that there are more than denumerably many sentences is flawed. But, with the view that sentences are abstract objects, the flaws can be corrected. Once psychologism and generativism are abandoned, the revolution against Bloomfieldian structuralism can be brought to completion and linguistics can be put on a sound philosophical basis. (shrink)

This study presents two case reports of altered states spontaneously occurring during meditation in two proficient practitioners. These states, known as fruition, are common within the Mahasi School of Theravada Buddhism, and are considered the culmination of contemplation-induced stages of consciousness. Here, electrophysiological measures of these experiences were measured, with the participant’s personal reports used to guide the neural analyzes. The preliminary results demonstrate an increase in global long-range gamma synchronization during the fruition states, compared to the background meditation. The (...) discrepancies and similarities with other neuroscientific studies of meditation-induced altered states are discussed. Albeit preliminary, the results presented here provide support for the possibility - previously raised by various authors - that long-range global gamma synchronization may offer an underlying mechanism for un-learning of habitual conditioning and mental patterns, possibly underpinning the neural correlate of the Buddhist concept of liberation. Finally, this pilot study highlights the utility of employing neuro-phenomenology, namely using first-person reports to guide neural analyzes, in the study of subtle human consciousness states. Cloth, $65.00.Peter Gordon's recent book brings together two seemingly disparate authors—Franz Rosenzweig and Martin Heidegger. Gordon intends to demonstrate that although Franz Rosenzweig is most frequently viewed as a Jewish thinker, this perspective obfuscates his German background, which (...) Gordon argues plays an even more prominent role in his thinking. His claim is that Rosenzweig should be situated within his German background and within German thought in order to gain a broader and more accurate perspective of who he was and what his work means.The book is coherently organized with a substantial introduction that lays the groundwork for the rest of the argument. Here, Gordon introduces us to Rosenzweig, Heidegger, and modern German and Jewish thought. Subsequent discussions explore primary philosophical influences on Rosenzweig's thought, for example, the roots of Rosenzweig's "New Thinking" found in Hermann Cohen and the need for a critique of totality found in Hegel. The central chapters, which offer a re-reading of Rosenzweig's Star of Redemption, are clearly written and are alone worth the time of this book.In these two chapters, Gordon outlines the significance of Rosenzweig's thought as situated within the canon of western philosophy by demonstrating that Rosenzweig's work engages central questions and concerns within the history of philosophy. Primarily, Rosenzweig believes that western philosophy has concerned itself too much with death, the death of the individual and a need to transcend completely from this world. Rosenzweig, contra the history of western philosophy, argues for a philosophical position that emphasizes life here and now—the everyday—and, more importantly, that we remain in time and the world (179). And here he draws interesting comparisons to Heidegger, indicating that these philosophers had a similar relationship to the history of philosophy, both of which were influenced by the German milieu in which they wrote and thought.Gordon ends his study of the relationship between Rosenzweig and Heidegger by drawing our attention to Rosenzweig's last writings, which were in the form of newspaper articles. These writings attended to the Davos Disputation, the now infamous debate between Heidegger and Ernst Cassirer. In these articles Rosenzweig indicates his partiality to Heidegger's position, in particular his position on redemption (285 ff.), indicating that Heidegger's philosophical stance represented most clearly Rosenzweig's New Thinking.Regardless of whether one agrees with Gordon's main thesis, this book is an original and significant contribution to philosophy and Jewish thought. Clearly Heidegger does not represent philosophy proper, since we still see grave signs of the split between analytic and "contemporary continental" philosophy; however, he does loom large as a central figure within European philosophy and specifically within German thought. To engage Rosenzweig's views with those of Heidegger brings Rosenzweig into a conversation from which he is normally excluded. And unfortuntately, when Rosenzweig is studied along with other figures such as Emmanuel Levinas, philosophers whose work is outside of Jewish thought will simply claim that Levinas is even more "Jewish" than they thought rather than admit that Rosenzweig is a philosophical thinker worthy of engagement. Although Gordon might hope that Rosenzweig scholars take more notice of the German background of Rosenzweig's thought, instead of circumscribing him within a strictly Jewish context, the engagement with Heidegger might be of more importance for Heidegger scholars and scholars of contemporary European philosophy.My sense is that Rosenzweig scholars in fact do notice the Germanic influence but also see the significance of treating Jewish philosophy as philosophy in its own right. It is "mainstream" philosophy that might need the reminder that Jewish philosophy is also philosophy. As a result, my primary concern is that Gordon's book might have de-emphasized the "Jewish" in order to make room for the "German." At the beginning of the book Gordon tells us that "Levinas was always suspicious of Heidegger." That, actually, is not true. Levinas attended the Davos debate and sided with Heidegger. This Article takes an experimental approach to test whether the salience of the law as a system that governs an interaction affects people’s preferences. I find that when the law is made salient in an interaction people’s preferences are altered: they express more future-oriented preferences and donate less money to charity, as compared to when the law is not salient in an otherwise identical interaction. When the law is salient in an interaction people also prefer ‘products’ over experiences, but this (...) gap is only marginally significant. The findings suggest that the framing of an interaction as legal tends to evoke cultural scripts and implicit rules of behavior (“common knowledge”) that incorporate the shared assumptions in society about the law. In response, participants interpret the interaction as more rational and instrumental and express preferences accordingly. (shrink)

Fodor and katz criticize cavell's position on the relation between ordinary language philosophy and empirical investigations of ordinary language, In "must we mean what we say?," _inquiry, Volume 1, Pages 172-212, And "the availability of wittgenstein's later philosophy," "philosophical review", Volume 71, Pages 67-93. Cavell holds that disagreements between ordinary language philosophers over grammar and semantics are in no sense empirical. Fodor and katz show that ordinary language philosophers are engaged in empirical investigation. (staff).

When blame is understood to be emotion-based or affective, its emotional tone is standardly identified as one of anger. We argue that this conception of affective blame is overly restrictive. By attending to cases of blame that emerge against a background of a particular kind of hope invested in others, we identify a blaming response characterized not by anger but by sadness: reactive disappointment. We develop an account of reactive disappointment as affective blame, maintaining that while angry blame and disappointed (...) blame are both condemnatory responses, they have distinct evaluative foci and occupy different but complementary roles in our accountability practices. In this paper, I address the theory of excuse, or more precisely, exculpatory excuse, and the question of what it is that justifies the category of excuse. I address different potential grounds for the law of excuse, which are often run together in ways that confound rather than clarify, focusing on the role of blamelessness and unfairness of expectations in the theory of excuse.

In recent years, the scientific study of meditation and psychedelic drugs has seen remarkable developments. The increased focus on meditation in cognitive neuroscience has led to a cross-cultural classification of standard meditation styles validated by functional and structural neuroanatomical data. Meanwhile, the renaissance of psychedelic research has shed light on the neurophysiology of altered states of consciousness induced by classical psychedelics, such as psilocybin and LSD, whose effects are mainly mediated by agonism of serotonin receptors. Few attempts have been made (...) at bridging these two domains of inquiry, despite intriguing evidence of overlap between the phenomenology and neurophysiology of meditation practice and psychedelic states. In particular, many contemplative traditions explicitly aim at dissolving the sense of self by eliciting altered states of consciousness through meditation, while classical psychedelics are known to produce significant disruptions of self-consciousness, a phenomenon known as drug-induced ego dissolution. In this article, we discuss available evidence regarding convergences and differences between phenomenological and neurophysiological data on meditation practice and psychedelic drug-induced states, with a particular emphasis on alterations of self-experience. While both meditation and psychedelics may disrupt self-consciousness and underlying neural processes, we emphasize that neither meditation nor psychedelic states can be conceived as simple, uniform categories. Moreover, we suggest that there are important phenomenological differences even between conscious states described as experiences of self-loss. As a result, we propose that self-consciousness may be best construed as a multidimensional construct, and that “self-loss,” far from being an unequivocal phenomenon, can take several forms. Indeed, various aspects of self-consciousness, including narrative aspects linked to autobiographical memory, self-related thoughts and mental time travel, and embodied aspects rooted in multisensory processes, may be differently affected by psychedelics and meditation practices. Finally, we consider long-term outcomes of experiences of self-loss induced by meditation and psychedelics on individual traits and prosocial behavior. We call for caution regarding the problematic conflation of temporary states of self-loss with “selflessness” as a behavioral or social trait, although there is preliminary evidence that correlations between short-term experiences of self-loss and long-term trait alterations may exist.
