In this paper an economics approach to assessing community values in health care priority setting is examined. The approach is based on the concept of ‘willingness to pay’ (WTP). Eighty two parents were interviewed with regard to three aspects of provision of child health services. For each aspect a choice of two courses of action was presented. Parents were asked which course of action they preferred and what was the maximum amount of money they would be prepared to pay for (...) this rather than their less preferred option. WTP responses are acceptable to the majority of respondents and appear to ‘behave’ in accordance witha priori expectations. A method of assessing the influence of ability to pay on preferences and WTP is outlined. Preferences and WTP do not appear to have been unduly distorted by ability to pay. Use of WTP data does have the potential to provide health care purchasers and providers with information on intensity as well as direction of the preferences of members of the community. (shrink)

Recent articles in biomedical ethics have begun to explore both the relevance of family interests in treatment decisions and the resultant ramifications for physicians' obligations to patients. This article addresses two important questions regarding physicians' obligations vis-a-vis family interests: (1) What should a physician do when the exercise of patient autonomy threatens to negate the patient's moral obligations to other family members? (2) Does respect for patient autonomy typically require efforts on the part of physicians to keep patients' treatment decisions (...) from being influenced by family considerations? This araticle examines elements of Jean-François Lyotard’s paradoxical negotiations with aesthetic experiences in order to characterize his critical involvement with discursivized forms of knowing and explanation. These elements are offered as salient and salutary correctives to the symmetrical dogmas of disenchanting naturalisms and culturalisms currently programming typical misprisions of the aesthetic. Lyotard’s 1971 Discourse, Figure, as well as some of his later writings on visual art and artists, are not interpretatively integrated here but instead explored in terms of an anti-discursive (...) logic that actually animates what appear to be their own anti-aesthetic commitments and conclusions. The article tracks the ambivalent, but persistent, role that perception, art-medium and sensate experience play in Lyotard’s efforts to see beyond them. This result impacts not only on the kinds of ‘demystification’ his work should be seen to espouse, but on that pervasive pseudo-category itself. (shrink)

Do both the zoo and the mental hospital induce psychosis, as humans are treated as animals and animals are treated as humans? How have we looked at animals in the past, and how do we look at them today? How have zoos presented themselves, and their purpose, over time? In response to the emergence of environmental and animal studies, anthropologists, sociologists, philosophers, theorists, literature scholars, and historians around the world have begun to explore the significance of zoological parks, past and (...) present. Carol Gilligan has delineated two ethics, the ethic of rights and the ethic of care. In this article I argue that the two ethics are part of one overall system, the ethic of care functioning as a necessary base for the ethic of rights. 1 also argue that the system is seriously flawed. Because women are held accountable to both ethics and because the two ethics frequently conflict, women recurrently find themselves in a moral double bind.

Stretching across the Roman Campagna, the tall arches of ancient aqueducts, even in their present ruined condition, are vivid reminders of the powerful state (...) and skilled engineers that built them. Scholarly interest in the geography and topography of the Campagna, with its natural and manmade wonders, had its genesis in such ancient commentators as Pliny the Elder and Strabo, but perhaps no scholars were more energetic than the early modern. Antiquarians and archaeologists perused the ruins of Rome and its countryside, among them the talented epigrapher and hunter of aqueducts, Raffaello Fabretti. A prominent figure in the learned world of seventeenth-century Rome, Fabretti published a study of the city's ancient aqueducts in 1680. It was the earliest modern topographical work to take the water system as its subject and among the most influential studies of its kind. In this paper I explore methodological approaches to Aquinas’s argument for a real distinction between essence and existence in creatures in De ente et essentia. Joseph Owens and John Wippel examine the text through three stages that, they conclude, result in a demonstration for the real distinction. I contrast this approach with R. E. Houser, who argues that Aquinas’s text, which proceeds dialectically, must be understood within the context of its sources, namely, Avicenna’s Metaphysics of the Healing and The Intentions (...) of the Philosophers by al-Ghazali. First, I will offer an evaluative judgment on the disagreement between Owens and Wippel on which stage Aquinas demonstrates a real distinction. Second, I will offer an evaluative judgment on the nature of the treatise as a whole by suggesting that the methodology of source-based contextualism offers another way to read the De ente. (shrink)

Foundational theories of mental content seek to identify the conditions under which a mental representation expresses, in the mind of a particular thinker, a particular content. Normativists endorse the following general sort of foundational theory of mental content: A mental representation r expresses concept C for agent S just in case S ought to use r in conformity with some particular pattern of use associated with C. In response to Normativist theories of content, Kathrin Glüer-Pagin and Åsa Wikforss propose a (...) dilemma, alleging that Normativism either entails a vicious regress or falls prey to a charge of idleness. In this paper, I respond to this argument. I argue that Normativism can avoid the commitments that generate the regress and does not propose the sort of explanation required to charge that its explanation has been shown to be problematically idle. The regress-generating commitment to be avoided is, roughly, that tokened, contentful mental states are the product of rule-following. The explanatory task Normativists should disavow is that of explaining how it is that beliefs and other contentful mental states are produced. I argue that Normativism, properly understood as a theory of content, does not provide this kind of psychological explanation, and therefore does not entail that such explanations are to be given in terms of rule-following. If this is correct, Normativism is not the proper target of the dilemma offered by Glüer-Pagin and Wikforss. Understanding why one might construe Normativism in the way Glüer-Pagin and Wikforss must, and how, properly understood, it avoids their dilemma, can help us to appreciate the attractiveness of a genuinely normative theory of content and the importance of paying careful attention to the sort of normativity involved in norm-based theories of content. Although many of the congenital syndromes that used to be lethal no longer are, they are still routinely referred to as “lethal anomalies.” But the label is not only inaccurate, it is also dangerous: by portraying as a medical determination what is in fact a judgment about the child's quality of life, it wrests from the parents a decision that only the parents can make.

In this paper we consider the prospects for an account of good argument that takes the character of the arguer into consideration. We conclude that although there is much to be gained by identifying the virtues of the good arguer and by considering the ways in which these virtues can be developed in ourselves and in others, virtue argumentation theory does not offer a plausible alternative definition of good argument.

The evolution of the idea of hospitality can be traced alongside the development of Western civilization. Etymologically, the host is the “master,” but this identity is established through expropriation and loss—the best host is the one who gives the most, ultimately relinquishing what defines him as master. In The Hostess, Tracy McNulty asks, What are the implications for personhood of sharing a person—a wife or daughter—as an act of hospitality? In many traditions, the hostess is viewed not as a (...) subject but as the master’s property. A foreign presence that both sustains and undercuts him, the hostess embodies the interplay of self and other within the host’s own identity. Here McNulty combines critical readings of the Bible and Pierre Klossowski’s trilogy The Laws of Hospitality with analyses of exogamous marital exchange, theological works from the Talmud to Aquinas, the writings of Kant and Nietzsche, and the theory of femininity in the work of Freud and Lacan. Ultimately, she contends, hospitality involves the boundary between the proper and the improper, affecting the subject as well as interpersonal relations. Embryo adoption is an act of artificial impregnation. Artificial impregnation is analogous to artificial insemination. The conditions under which artificial impregnation is ethically acceptable may therefore be the same as the conditions under which artificial insemination is ethically acceptable. But artificial insemination is ethically acceptable only when it assists conjugal union to attain its natural purpose. If artificial impregnation is likewise ethically acceptable only insofar as it assists and does not replace conjugal union, then the presence or absence of the (...) conjugal act itself is the fundamental moral criterion by which to judge whether to permit or exclude artificial impregnation. This essay argues that Antony and Cleopatra’s pitting of Egypt against Rome is a cipher of aesthetic resistance to modern rationality. The coordinates are Adornian. Antony’s and Cleopatra’s complex identities elude the disenchanting, nominalist machinery in which diffuse indeterminacy necessitates conceptual imposition. Here, the individuals are essentially dramatized: sensate, embodied selves composed and expressed in relations of passionate recognition. The lovers’ deaths, and especially Cleopatra’s self-conscious theatre, rewrite the ascetic, dominative, and pseudo-theatrical rationality of Octavian Rome. The protest, the passion (...) and singularity, lives mainly through its expressive emphases – such as hyperbole – and the re-functioning of the very dominative roles and norms being opposed. This reflects the restricted but critical – aesthetic – status of early modern drama, and specifies its opposition to the deepening attack on sensate knowing in its world. (shrink)

Despite the drastic differences in their views of the intellect and the location and specific function of the will both Aquinas and Averroes are able to claim that their systems allow for moral agency because they both place the will—a faculty that is of prime importance to the process of moral action—in the individual. Both philosophers think that they are following Aristotle in making their claims about the will and the intellects. This paper will examine the issue of will and (...) the related issue of the intellects as it appears in the Aristotelian texts and in the subsequent work of Averroes and Aquinas. It will argue that at least some of the divergence in Averroes and Aquinas can be attributed to an issue of translation regarding De Anima, and a difference in the role of cogitation and the intellects regarding will. The aim of this study was to understand how incivility is viewed across multiple academic programs and respondent subgroups where different institutional and cultural power dynamics may influence the way students and faculty perceive uncivil behaviors. This study used the Conceptual Model for Fostering Civility in Nursing Education as its guiding framework. The Incivility in Higher Education Revised (IHE-R) Survey and a detailed demographic questionnaire were used to gather self-assessment and personal perspective data regarding incivility in the higher education setting. (...) This approach aspired to collect a comprehensive perspective of incivility in higher education. With data from 400 students and 69 faculty, there was limited agreement between faculty and student participants about perceptions and experiences with incivility. Faculty and students did agree that the solution to incivility may be found with the creation of a code of conduct that defines acceptable and unacceptable behavior, role-modeling professionalism and civility, and taking personal responsibility and standing accountable for actions. Despite significant differences in participants’ perceptions of incivility, they shared common solutions. With a shared goal, faculty and students can work toward cultivating civility in higher education. (shrink)

Research in ethical AI has made strides in quantitative expression of ethical values such as fairness, transparency, and privacy. Here we contribute to this effort by proposing a new family of metrics called “decisional value scores” (DVS). DVSs are scores assigned to a system based on whether the decisions it makes meet or fail to meet a particular standard (either individually, in total, or as a ratio or average over decisions made). Advantages of DVS include greater discrimination capacity between types (...) of ethically relevant decisions and facilitation of ethical comparisons between decisions and decision-making systems, including across different modalities (for instance: human, machine, or coupled human–machine systems). After clarifying ambiguities in the concept of “decision” itself, including the question of how to individuate the decisions made by a system, we discuss the role and meaning of “decision” in common AI and machine learning approaches such as decision trees, neural networks, SVMs, and unsupervised classifiers. We then show how DVSs may be defined for several ethical values of interest, with an extended discussion of transparency. Finally, we explore how such metrics can be applied to real decision-making systems through two case studies: evaluations of LLMs for transparency; and evaluations of criminal risk assessment tools for utility, rights violations, fairness, and transparency.
