Using the arguments of Ludwig von Mises and Friedrich August von Hayek, I argue that private ownership solves the economic problem of corruption. Since private ownership discourages entrepreneurs from rent-seeking, and privately owned media provide objective and unbiased information to citizens, any legal reform establishing and enforcement of private ownership also solves the corruption problem.

Critical congenital heart disease screening is rapidly becoming the standard of care in the United States after being added to the Recommended Uniform Screening Panel in 2011. Newborn screens typically do not require affirmative parental consent. In fact, most states allow parents to exempt their baby from receiving the required screen on the basis of religious or personally held beliefs. There are many ethical considerations implicated with allowing parents to exempt their child from newborn screening for CCHD. Considerations include the (...) treatment of religious exemptions in our current legal system, as well as medical and ethical principles in relation to the rights of infants. Although there are significant benefits to screening newborns for CCHD, when a parent refuses for religious or personal beliefs, in the case of CCHD screening, the parental decision should stand. Algunos textos parecen pertenecer de manera exclusiva ya sea al ámbito de la filosofía o de la literatura, como si no pudiera haber hibridación; como si lo que fuera de un campo no pudiera ser leído en la clave del de otro. En este sentido, cabe preguntarse si una obra considerada literaria podría leerse filosóficamente y cómo.

The paper explains the reasons why the goal of personalization is so deeply rooted in the digital transformation. It also describes the five meanings attributable to the concept and details their philosophical underpinnings. Alonso Briceño, el primer filósofo chileno, sostuvo que, para todo x, el ser de x = la haecceitas de x y –además– que hay una distinción ‘formal’ entre el ser de x y la esencia de x. En general, hay una distinción ‘formal’ entre los ítems z y v si y solo si: (i) z  v, y (ii) z y v son mutuamente inseparables. Se sigue de estas tesis que el ‘ser’ debe tomarse como un componente ontológico específico en (...) los objetos particulares y que es idéntico con la haecceitas del objeto. Esto se denomina aquí “la intuición de Briceño”. En este trabajo se considera la relevancia que la intuición de Briceño podría tener para dos de las teorías más importantes acerca de la naturaleza de los objetos particulares: las teorías en las que los objetos particulares están constituidos por un sustrato y sus propiedades, y las teorías en las que los objetos particulares son cúmulos de tropos. Se argumenta que en ambos casos la intuición de Briceño, esto es, la idea de que hay un tropo específico de ser en el objeto particular, trae consigo ventajas sistemáticas importantes y, lo que es más, permite la unificación teórica de ambas perspectivas, normalmente consideradas como incompatibles entre sí. This article analyses 1,073 e-mails that were hacked from the Climatic Research Unit at the University of East Anglia in November 2009. The incident was popularly dubbed 'Climategate', indicating that the e-mails reveal a scientific scandal. Here we analyse them differently. Rather than objecting to the exchanges based on some idea about proper scientific conduct, we see them as a rare glimpse into a situation where scientists collectively prepare for participation in heated controversy, with much focus on methodology. This allows (...) us to study how scientists communicate informally about framing propositions of facts in the best possible way. Through the eyes of science and technology studies, the e-mails provide an opportunity to study communication as part of science in the making across disciplines and laboratories. Analysed as 'written conversation' the e-mails provide information about processes of consensus formation through 'agonistic evaluations' of other scientists' work and persuasion of others to support one's own work. Also, the e-mails contain judgements about other groups and individual scientists. Consensus-forming appeared as a precarious activity. Controversies could be quite resilient in the course of this decade-long exchange, probably reflecting the complexity of the methodological challenges involved. (shrink)

It has been lately proposed that laws of nature are causal powers. The conditions of identity of universals are the causal powers that those universals give to their instantiations. One of the main objections against this conception of laws of nature and universals is that it would lead to, either an infinite regress, or a vicious circularity. In effect, if the conditions of identity of a universal are the causal powers that the universal gives to its instantiations, then it seems (...) that the conditions of identity of a universal depend on other universals, because a causal power is the power to produce the instantiation of some universal or other. In this work it is considered if this problem can be tackled by a relaxation of some of the formal characteristics of ontological dependence, but this strategy appears inconvenient. Another more promising alternative is to suppose that universals are ontologically dependent on the network of nomological relations to which they belong. Under certain formal assumptions about the graph-theoretical structure of the nomic network the identity of a universal can be grounded by its sole position in it. The conception here defended results a form of nomic holism. (shrink)

The work presents the concept of a structural universal and the criticisms that have been leveled against it. A structural universal is a property had by an individual due to the nature of its proper parts and due to the relations obtaining between those parts. Mellor has argued that there is no reason to accept such universal in addition to the basic universals that compose them. David Lewis has argued –on the other hand– that it has not been satisfactorily explained (...) how universals are composed by other universals. The composition by which a structural universal is given cannot be a set-theoretical construction or a mereological sum. Several proposals to explain the nature of structural universals are discussed. Finally it is argued that a structural universal should be understood as a complexion of higher-order universals. Groove—defined as the pleasurable urge to move to a rhythm—depends on a fine-tuned interplay between predictability arising from repetitive rhythmic patterns, and surprise arising from rhythmic deviations, for example in the form of syncopation. The perfect balance between predictability and surprise is commonly found in rhythmic patterns with a moderate level of rhythmic complexity and represents the sweet spot of the groove experience. In contrast, rhythms with low or high complexity are usually associated with a weaker experience of groove because (...) they are too boring to be engaging or too complex to be interpreted, respectively. Consequently, the relationship between rhythmic complexity and groove experience can be described by an inverted U-shaped function. We interpret this inverted U shape in light of the theory of predictive processing and provide perspectives on how rhythmic complexity and groove can help us to understand the underlying neural mechanisms linking temporal predictions, movement, and reward. A better understanding of these mechanisms can guide future approaches to improve treatments for patients with motor impairments, such as Parkinson’s disease, and to investigate prosocial aspects of interpersonal interactions that feature music, such as dancing. The article analyzes one of the fundamental rights – the right to maintenance, which proper implementation ensures normal development of the child. This right matches with the duty of parents to maintain their minor children. Paragraph 6 of Article 38 of the Constitution of the Republic of Lithuania states that parents have a duty to educate their children to be honest people and loyal citizens, supporting them until adulthood. The obligation to maintain children is established in the first 3.192 Article (...) paragraph of the Civil Code of the Republic of Lithuania, and the responsibility for avoiding to maintain a child is provided in Article 164 of the Criminal Code. The article discusses the fact that the analysis of criminal law rate is not precise enough. Article 164 of the Criminal Code does not match with the child maintenance methods specified in the CC Article 3.196 paragraph 1. Since criminal liability is only for judgment in default in civil cases, a person shall only be liable for breaking the right to maintain a child, provided in the CC 3.196 paragraph 1. This article deeply analyzes the problematic qualification aspects of the avoidance to maintain a child. Some alternative ways of child maintenance are mentioned, as can be chosen from other law instruments (bailiffs, Guarantee child support fund) and it leads to the ultima ratio principle. On the other hand, it is not required to seek alternative remedies for affected interests, and it is possible to initiate a pre-trial investigation. Therefore, this article seeks to identify specific civil and criminal law rules delimitation. Avoidance of child maintenance is an ongoing crime. The main problem in legal practice is to determine an end of this ongoing criminal conduct. The practice of the Supreme Court of Lithuania is not unanimous. In some cases, the end of this ongoing conduct is considered to be a moment when the past judgment has entered into force, in other cases – the moment of indictment. These positions are criticized by many authors and it is suggested to follow the Supreme Court’s practice, according to which the moment when a judgment of conviction for the criminal act is passed should be considered as an end of an ongoing criminal conduct. AimIf we want to understand people’s satisfaction in their relationships, it is essential to have a valid and reliable measure of relational needs satisfaction. The aim of this study was to test the factor structure of the Czech version of the Relational Needs Satisfaction Scale as well as the scale’s measurement invariance and convergent validity.MethodIn total, 419 adults answered a battery of measures, including the RNSS, in an online survey. Confirmatory factor analysis was conducted to test the factor structure and (...) the measurement invariance of the RNSS across gender and age. A correlational analysis was conducted to assess the convergent validity.ResultsThe five-factor structure of the RNSS was confirmed. Furthermore, support for a second-order global relationship satisfaction factor was found. The hierarchical model was strictly invariant with respect to gender and age. Furthermore, the RNSS demonstrated an expected pattern of correlations with the reference instruments.ConclusionThe Czech version of the RNSS can be considered a valid and reliable method. (shrink)

Partial commentaries of Gomez Davila’s epigraphs in Scholia to an Implicit Text have been put forward by several scholars. Nevertheless, none of them has yet attempted a systematic study of their meaning and their relation to the rest of the book or the literary sources to which they allude. This article is aimed to present such a systematic analysis, thus revealing two things: first, a number of essential premises of Gómez Dávila’s thought; second, the importance of intertextuality for a thorough (...) understanding of this work: the epigraphs need an hors du texte and the scholia to be interpreted, just as the scholia need the epigraphs and an “out of the text” to be deciphered. In other words, neither is autonomous: their meaning is to be found in intertextuality. (shrink)

En una serie de trabajos Carol Cleland ha argumentado por los últimos veinte años que la búsqueda de una definición de la vida es no solo inútil sino contraproducente. Una definición en términos de condiciones necesarias y suficientes nos podría cegar para la tarea mucho más importante de desarrollar una teoría universal de la vida. La principal justificación para este alegato es que la vida es una clase natural. Términos para clases naturales no poseen definiciones ideales, porque pretenden hacer referencia (...) a rasgos objetivos del mundo y no hacer explícito el contenido de nuestro pensamiento o lenguaje. Se argumenta aquí que la vida es, en efecto, una clase natural y, luego, la semántica para el término vida no puede darse por una definición ideal con condiciones necesarias y suficientes. Sin embargo, la semántica del término vida no excluye la posibilidad de hallar una ‘definición real’ adecuada de la esencia de la vida, esto es, de qué es la vida. Un estado de cosas, sin embargo, sí está fundado en un universal, uno o varios objetos, un tiempo y un tropo que, esencialmente, es la instanciación (...) de tal universal en tal objeto, o en tales objetos, en tal tiempo. Si los estados de cosas están fundados en sus constituyentes, entonces hay una razón para admitir tropos. Finalmente, se discuten varias razones por los que los estados de cosas deben estar fundados. a state of affairs is a non-mereological structure composed by universals, objects and times. In principle, a state of affairs is not grounded in its components, for those components could exist, but not the state of affairs that they compose. The introduction of other relations of 'instantiation' doesn't improve the situation, if those relations are universal. A state of affairs, though, is grounded on a universal, object or objects, time and a trope that, essentially, is the instantiation of that universal in that object, or in those objects, in that time. If states of affairs are grounded in their constituents, then there is reason to admit tropes. Finally, several reasons by which states of affairs should be grounded are discussed. (shrink)

In 2012, the international PISA survey reinforced the observation that the French educational system is one of the most unequal among OECD countries. The observation of serious inequalities in access to educational success for pupils from disadvantaged backgrounds could lead to a pessimistic vision suggesting that any possibility of transformation of the system is doomed to failure. Thus, the fight against inequalities in access to educational success is a form of runaway object which constitutes a challenge for research which treats (...) the social context as evolving and susceptible to significant and novel transformations. Developmental work research aims to support the work of professionals in the re-elaboration of their practices by seeking to go beyond the status quo of an unequal school. Drawing on this framework within an institutional network of schools, we seek to show how the intervention has highlighted power issues inscribed in the structures and how the actors, through their commitment in the research collaborative process, seek to go beyond the power issues inscribed in their work routines and enacted during the research process by different kinds of antagonism. We will argue that the fight against educational inequality involves overcoming systemic power relations crystallized in institution. This systemic power is expressed by a form of episodic power. Our results show restrictive and constructive effect on the expansive learning process and on the construction of a collective in the formative interventions. The restrictive side of epistemic power should be linked to systemic power which is historically inherited. We discuss the results in the light of the emergence of a fourth generation of activity theory. Our research makes it possible to make conceptual and methodological progress in the construction of a fourth generation of activity theory by showing the need for analysis and expansively learn about problematic power relations in heterogeneous collectives. Con tal propósito, se hace una introducción histórica a las prácticas sexuales de carácter gnóstico y se considera el juego discursivo ambiguo entre lo exotérico y esotérico. Como ejemplo, se analizan algunas ambigüedades textuales en la obra de Javier Garrido OFM (condenado canónicamente por “falso misticismo”), a la luz de la investigación sobre los abusos sexuales de los hermanos Philippe OP y Jean Vanier. (...) Asimismo, se exploran tres coincidencias con ideas ajenas al cristianismo que divinizan la pulsión sexual. Y se concluye apelando al discernimiento y la prudencia sobre el lenguaje místico-esponsal, y a la claridad en la moral sexual. (shrink)

Se ha sostenido tradicionalmente que los predicados atribuidos a Dios y a las criaturas son análogos. Pero, ¿qué es la analogía? Varios filósofos han pensado que la analogía debe ser considerada como una forma de ambigüedad. Argumentamos aquí que los predicados atribuidos a Dios y a las criaturas no son ambiguos o vagos. Siguiendo algunas sugerencias de McDaniel, proponemos una concepción de la analogía donde el fenómeno semántico está asociado con el carácter más o menos natural de la propiedad o (...) propiedades que instancian las entidades que satisfacen el predicado análogo. Un predicado "θ" es análogo si y sólo si, la propiedad Θ, que algo instancia, si y sólo si es θ, es menos natural que cualquier propiedad Ξ tal que todo lo que instancie Ξ, instancia Θ. Además, se requiere que las entidades de las cuales el término análogo es predicado deban ser ontológica o epistémicamente dependientes unas de otras. || It has been traditionally sustained that predicates attributed to God and to the creatures are analogical predicates. But, what is analogy? Several philosophers have thought that analogy should be taken as a form of ambiguity. Here we argue that predicates attributed to God and to creatures are neither ambiguous nor vague. Following some suggestions given by McDaniel, we propose a view of analogy in which the semantic phenomenon is associated with the more or less natural character of the property or properties that the entities that satisfy the analogous predicate instantiate. A predicate "θ" is analogous if and only if the property Θ, which something instantiates, if and only if it is θ, is less natural that any property Ξ so that anything that instantiates Ξ, instantiates Θ. Furthermore, it is required that the entities of which the analogous term is predicated should be either ontologically or epistemically dependent on each other. (shrink)

Hilary Putnam's doctrine of conceptual relativity sustains that there are many different incompatible, yet equivalent, descriptions of what have to be considered "the same" phenomena. This fact is reason to justify the idea that metaphysical realism is wrong and that a better general view of reality should be something like a "pragmatic realism." Putnam sustains further that the different incompatible and equivalent descriptions have to bear the same explanatory virtue. Here it is contended that there seems to be difficulties in (...) construing this requirement in a non-question begging way in an argument designed to show that metaphysical realism should be dismissed. Different descriptions can only be deemed to have the same explanative virtue if our knowledge of, for example, structures in the natural world, seems to be simply a form to "save the phenomena," but this is a characteristic anti-realist thesis that should not be taken for granted in the dialectical setting. A ‘state of affairs’ is understood here as any kind of concrete entity that can play the role of truthmaker. Different ontologies propose different structures of entities to work as ‘states of affairs’ in this sense. Defenders of universals will propose for the role non- mereological structures of universals, objects and times. Defenders of tropes will propose tropes, either with or without universals and objects. Resemblance nominalists will propose primitive ontological facts of resemblance between objects in time. In any of (...) these cases, times are an essential component of a state of affairs. Any ontology of states of affairs, then, should clarify what times are in order to clarify what states of affairs are. An examination of the dominant reductivist conceptions of times shows that these connections have not yet been thought through carefully. In any of the dominant reductivist conceptions, times are entities that either include or describe everything that happens simultaneously at a given instant. Even in some cases they include the description of everything that happens at any time. If one introduce times taken as they are in any of these reductivist conceptions, it will be essential to a state of affairs everything that happens simultaneously with it, or even everything that happens at any time. Under some assumptions the internal relation of every state of affairs with every other state of affairs expands to the internal relation of everything with everything. This is an unhappy theoretical situation that calls for a more careful consideration of some central tenets in our ontology of time. (shrink)

Este trabajo discute el argumento presentado por Carmichael (2010) para justificar la existencia de universales trascendentes, esto es, universales que no requieren instanciaciones para existir. Se sostiene en este trabajo que una proposición puede describir correctamente un mundo posible sin existir como una parte de ese mundo, esto es, que una proposición puede ser verdadera de un mundo posible, sin ser verdadera en un mundo posible. Se sostiene, además, que las mismas premisas usadas por Carmichael permiten justificar el necesitismo.
