Higher order cognitive processes, including ethical decision making (EDM), are influenced by the experiencing of discrete emotions. Recent research highlights the negative influence one such emotion, anger, has on EDM and its underlying processes. The mechanism, however, by which anger disrupts the EDM has not been investigated. The current study sought to discover whether cognitive appraisals of an emotion-evoking event are the driving mechanisms behind the influence of anger on EDM. One primary (goal obstacle) and one secondary (certainty) appraisal of (...) anger were examined. Study results suggest that appraisals of certainty are the driving mechanism behind the negative relationship between anger and EDM. Certainty appraisals led to less application of EDM-promoting strategies and more unethical social motives. Findings further highlight the value of investigating appraisals of emotional events, given their cognitive nature, for their potential effects on cognitive operations, such as EDM. Between Wolff and Kant: Merian's Theory of Apperception UDO THIEL IT IS WELL KNOWN that the nodon of apperception or self-consciousness is central to Kant's theoretical philosophy. Kant introduces the notion in one of the crucial parts of the Critique of Pure Reason, the Transcendental Deduction of the Categories, and assigns it an important role in his critique of traditional metaphysics of the soul in the Transcendental Dialectic.' It is also well known that Kant did not invent the term "apperception." (...) Leibniz had introduced the French 'Tapperception" into philosophical terminology early in the eigh- teenth century. Kant scholars generally stress, rightly, that Kant's notion of apperception differs significandy from that of his predecessors. However, the precise relation between Kant's concept of apperception and earlier accounts has not been considered in any detail. Wolfgang Carl, for example, simply states that the main difference is that, prior to Kant, apperception was under- stood as relating only to mental acts and their contents, and not to the subject that thinks and has ideas, whereas in Kant apperception relates essentially to the thinking subject. 2 This very general thesis is questionable even in regard to some of the philosophers that Carl cites in this context . Cases have been employed across multiple disciplines, including ethics education, as effective pedagogical tools. However, the benefit of case-based learning in the ethics domain varies across cases, suggesting that not all cases are equal in terms of pedagogical value. Indeed, case content appears to influence the extent to which cases promote learning and transfer. Consistent with this argument, the current study explored the influences of contextual and personal factors embedded in case content on ethical decision-making. Cases were manipulated to include (...) a clear description of the social context and the goals of the characters involved. Results indicated that social context, specifically the description of an autonomy-supportive environment, facilitated execution of sensemaking processes and resulted in greater decision ethicality. Implications for designing optimal cases and case-based training programs are discussed. (shrink)

If we manage to incorporate their moral intuitions in ethical reasoning, we can arrive at judgements and theories that grasp a moral experience that generally cannot be found outside the said practice. To achieve this goal, we need a legitimate way to balance moral intuitions, ethical principles and general theories. In the present contribution, we describe a version of the model of Reflective (...) Equilibrium, which we call the Normative-Empirical Reflective Equilibrium . RE provides a framework for ethical thinking that includes both moral experience and normative theory.After an outline of the model, we focus on the role of empirical research and illustrate how empirical data on moral intuitions can add to the comprehensiveness of the set of moral beliefs in NE-RE. Subsequently, we describe how coherence among the elements of an NE-RE can be understood and measured. Finally, we address an important question for any method of moral reasoning: what is the status of the outcome of the reasoning process? This is a matter of justification. We argue for a so-called good reasoning-justified outcome strategy in NE-RE. This strategy is built on a reasoning process in which the reason-giving force of each element is tested and weighed. The thinker has to work towards a coherent view in which only the elements with sufficient justificatory power are retained. If the thinker decides that the elements fit together into a coherent view, a reflective equilibrium is reached. In 1783 John Michell published a note entitled ‘On the Means of Discovering the Distance, Magnitude etc. of the Fixed Stars, in Consequence of the Diminution of the Velocity of their Light’, but it was Christian Doppler who in 1842 for the first time formulated the principle : If a source of sound or light is in motion relative to an observer, or an observer in motion relative to a source, the period of the waves received by the observer will (...) be different from the period of the waves emitted by the source. The acoustical Doppler principle was verified in 1845 by Buys-Ballot's experiments and by Ernst Mach ). H. Fizeau proposed to verify the optical Doppler principle by measuring the shift of lines in the spectra of stars . This was carried out by William Huggins , and H. C. Vogel and led to exact results in 1892. The Doppler effect with canal rays was shown by Johannes Stark in 1905. (shrink)

This chapter explores Gottlob Frege's contribution to logic. Frege has been called the greatest logician since Aristotle, but he failed to gain influence on the mathematical community of his time and the depth and pioneering character of his work was acknowledged only after the collapse of his logicist program due to the Zermelo–Russell antinomy in 1902. Frege, by proving his theorem χ without recourse to Wertverläufe, exhibited an inconsistency (or at least an incoherence) in the traditional notion of the extension (...) of a concept. He prompted our awareness of a situation the future analyses of which will hopefully not only deepen our systematic control of the interplay of concepts and their extensions but also improve our understanding of the historical development of the notion of “extension of a concept” and its historiographical assessment. Respect for autonomy is well known as a core element of normative views on good care. Most often it is interpreted in a liberal way, with a focus on independence and self-determination. In this article we argue that this interpretation is too narrow in the context of care in nursing homes. With the aim of developing an alternative view on respect for autonomy in this setting we described four interpretations and investigated the moral intuitions (i.e. moral judgements) of caregivers regarding (...) these approaches. We found that these caregivers seemed to value different notions relating to respect for autonomy under different circumstances. There was no significant difference in moral judgements between men and women or between doctors and nurses. We conclude that a multidimensional understanding of this principle would best fit this context. We end this article with a description of a modest theory of respect for autonomy in nursing homes. A recurrent issue in the vast amount of literature on reasoning models in ethics is the role and nature of moral intuitions. In this paper, we start from the view that people who work and live in a certain moral practice usually possess specific moral wisdom. If we manage to incorporate their moral intuitions in ethical reasoning, we can arrive at judgements and (modest) theories that grasp a moral experience that generally cannot be found outside the practice. Reflective equilibrium (RE) (...) provides a framework for balancing moral intuitions, ethical principles and general theories. Nevertheless, persisting problems associated with the use of intuitions need to be addressed. One is the objection that moral intuitions lack the credibility necessary to guide moral reasoning. Ethicists have tried to solve this problem by formulating criteria to separate the “bad” intuitions from the “good” ones at the beginning of the reasoning process. We call this the credible input-justified outcome strategy. An example is the appeal to the common morality by Beauchamp and Childress. We think this approach is unsuccessful. As an alternative, we outline the good reasoning-justified outcome strategy. It connects to a variant of RE in which intuitions from different sources are incorporated. We argue that the elements of RE have different levels of justificatory power at the start of reasoning. In our strategy, each element can gain or lose justificatory power when it is tested in a reasoning process that meets several criteria. (shrink)

Sustainability science seeks to extend scientific investigation into domains characterized by a distinct problem-solving agenda, physical and social complexity, and complex moral and ethical landscapes. In this endeavor it arguably pushes scientific investigation beyond its usual comfort zones, raising fundamental issues about how best to structure such investigation. Philosophers of science have long scrutinized the structure of science and scientific practices, and the conditions under which they operate effectively. We propose a critical engagement between sustainability scientists and philosophers of science (...) with respect to how to engage in scientific activity in these complex domains. We identify specific issues philosophers of science raise concerning current sustainability science and the contributions philosophers can make to resolving them. Although case-based training is popular for ethics education, little is known about how specific case content influences training effectiveness. Therefore, the effects of (a) codes of ethical conduct and (b) forecasting content were investigated. Results revealed richer cases, including both codes and forecasting content, led to increased knowledge acquisition, greater sensemaking strategy use, and better decision ethicality. With richer cases, a specific pattern emerged. Specifically, content describing codes alone was more effective when combined with short-term forecasts, whereas content embedding codes (...) within context was more effective when combined with long-term forecasts, leading to greater knowledge acquisition and sensemaking strategy use. Explores the understanding of self-consciousness and personal identity - two fundamendtal features of human subjectivity - as it developed in early modern philosophy. Udo Thiel presents a critical evaluation of these features as they were conceived in the sevententh and eighteenth centuries. He explains the arguments of thinkers such as Descartes, Locke, Leibniz, Wolff, and Hume, as well as their early critics, followers, and other philosophical contemporaries, and situates them within their historical contexts. Interest in the issues of self-consciousness and (...) personal identity is in many ways characteristic [of] and even central to early modern thought, but Thiel argues here that this is also an interest that continues to this day, in a form still strongly influenced by the conceptual frameworks of early modern thought. The paper deals with some of the developments in analysis against the background of Hilbert's contributions to the Calculus of Variations. As a starting point the transformation is chosen that took place at the end of the 19th century in the Calculus of Variations, and emphasis is placed on the influence of Dirichlet's principle. The proof of the principle (the resuscitation ) led Hilbert to questions arising in the 19th and 20th problems of his famous Paris address in 1900: theexistence (...) in a generalized sense, and theregularity of solutions of elliptic partial differential equations. By this new concept Hilbert pointed out two very important issues the history of which is closely tied up with the rise of modern analysis. Further on, Hilbert'stheorem of independence of the Calculus of Variations, an important contribution to its formal apparatus as well as to its field theory, is briefly discussed. But even as Hilbert published his first essential results, he was turning his attention to another area of mathematics that differs in an important respect from the Calculus of Variations:integral equations. Hilbert did so because he recognized that in this branch by its flexibility he was coming closer to his goal of an unifying methodological approach to analysis. (shrink)

Case-based instruction is a stable feature of ethics education, however, little is known about the attributes of the cases that make them effective. Emotions are an inherent part of ethical decision-making and one source of information actively stored in case-based knowledge, making them an attribute of cases that likely facilitates case-based learning. Emotions also make cases more realistic, an essential component for effective case-based instruction. The purpose of this study was to investigate the influence of emotional case content, and complementary (...) socio-relational case content, on case-based knowledge acquisition and transfer on future ethical decision-making tasks. Study findings suggest that emotional case content stimulates retention of cases and facilitates transfer of ethical decision-making principles demonstrated in cases. (shrink)

On 5 May 1957, Leopold Löwenheim passed away in a Berlin hospital following a short but severe illness, unnoticed by the community of mathematical logicians who believed that he had perished in a Nazi concentration camp in or shortly after 1940 (the year of publication in the Journal of Symbolic Logic of his last paper before the end of World War II). The 50th anniversary of his death seems an appropriate date for the posthumous publication of a paper that was (...) supposed to appear in Fundamenta Mathematicae in 1939, the galley proofs of which Löwenheim had already seen and corrected when German troops invaded Poland on 1 September 1939. Löwenheim managed to save the proofs through the War, despite the loss of most of his possessions during the bombing of Berlin in 1943 and 1944. By another lucky chance, a copy of the proofs survived in the present author's possession, when the originals were lost during a flat clearing in Berlin as part of the estate of Johannes Teichert (1904?1994), Löwenheim's step-son, when his widow moved into a nursing-home in May 1999. Later, I will expand these short remarks slightly but seize the present opportunity to resume (and in some places add to) the extant data on Löwenheim's life and writings. (shrink)

Worries about safety of approved drugs have pushed post registration research to become the fastest growing drug research phase. Until recently, phase IV studies were mainly conducted for marketing purposes and run much like a phase III trial—at institutions with experienced investigators and a list of inclusion and exclusion criteria. Innovative phase IV studies involve ordinary physicians in research naïve communities. This brings ethical issues familiar to medical research into clinical practice. As a consequence, individual physicians are challenged to protect (...) scientific integrity and to secure the ethical conduct of research. Several ethical issues need to be addressed in the process of developing a scientifically sound and ethically high principled practice of phase IV research.PHASE IVEssential to phase IV research is the focus on how drugs work in the real world. The research goal may be to explore a specific pharmacological effect, to establish the incidence of adverse reactions, or to determine the effects of long-term administration of a drug. They may also be designed to establish a new clinical indication for a drug.1 Subjects may or may not be randomised, and the studies typically involve large numbers of patient-subjects and physicians.Doubts concerning the scientific rigor and clinical value have put postmarketing research in a poor light. However, high quality phase IV research is badly needed to further pharmaceutical science. First, because it can provide reliable data on the effectiveness, safety and optimal use of a drug in treated populations.2 3 In pre-registration clinical trials , a pharmaceutical product is studied under unrealistic circumstances. Brouwer's criticism of mathematical proofs making essential use of the tertium non datur had a surprisingly late response in logical circles. Among the diverse reactions in the mid 1920s and early 1930s, it is possible to delimit a coherent body of opinions on these questions: (1) whether Brouwer's denial of the tertium non datur meant only the abandonment of this classical law or, beyond that, the affirmation of its negation; (2) whether one or both of these alternatives were logically inconsistent; (...) and (3) whether Brouwer's line of argument was forced to take resort to the very law it was designed to refute. The controversy centred around a series of articles by Marcel Barzin and Alfred Errera who fought against the intuitionistic critique, missed their victory because of conceptual confusions and fallacious reasoning, but emerged unconvinced from the debate in the late 1930s. The controversy is of interest to the historiography of formal logic since it stimulated the clarification not only of the concepts of formal validity, decidability, many-valued systems of logic and non-classical systems generally, but also of the distinction between object and meta-level, and between a formal system and its semantics. Most important, the debate, by putting pressure on the intuitionistic camp to make their ideas more precise, seems to have given the decisive motivation towards Heyting's answer to this demand by his axiomatization of intuitionistic logic in 1930. Friedrich Albert Lange (1828-1875) author of a famous History of Materialism and Critique of Its Present Significance (1866, English transI. 1877-79, repr. 1925 with introduction by Bertrand Russell), was also interested in the epistemological foundations of formal logic. Part I of his intended two-volume Logische Studien was published posthumously in 1877 by Hermann Cohen, head of the Marburg school of neo-Kantianism. Lange, departing from Kant, claims that spatial intuition is the source of the apodeictic character not only of the truths (...) of mathematics, but also of the truths of logic. He aims at showing this by basing validity and invalidity of syllogistic inferences on an interpretation of the standard forms (of proposition in assertoric syllogistic) with the help of the five kinds of possible relations (in fact what is known today as the Gergonne-Euler relations) between extensions of concepts given to us as areas in a plane, i.e.in space. Generality is achieved by considering all possible variations within each type of spatial relation, exhibiting a connection between concept and intuition reminding Lange of the Kantian "schema". Lange is well aware of the contemporary English "algebraic" logic, but he considers its approach as the appropriate one for a logic of content (Inhaltslogik) and not for a logic of extension (Umfangslogik). Lange did not live to enjoy the recognition by some leading logicians (amongst them John Venn, to whose reference in 1881 to Lange's "admirable Logische Studien" the present paper owes it title), nor could he respond to the many critics of his proposed foundation of logic. Its radicality as well as its broad reception (and discussion up to at least 1959) seem to entitle Lange's Logische Studien to an, if modest, place in the history of logic in the 19th century. A nonfoundationalist reading of Fides et Ratio, both in its negative regard for Enlightenment reasoning and its implicit understanding of the philosophical task of justifying belief, enables an appreciation of the encyclical as a particular kind of post-Enlightenment Roman Catholic stance. A nonfoundationalist perspective, understood as a philosophical position on the justification of belief, can be instructive in the encyclical’s articulation of Credo ut intelligam. Fides et Ratio offers a contextualized understanding of justification in its treatment of universality that can (...) only be recognized, affirmed and confessed within the particularity of faith. This article explores the question of how to understand social media following the Habermasian theory of the structural transformation of the public sphere. We argue for a return to political-economic fundamentals as the basis for analysing the public sphere and seek to establish a characteristic connection between digital-behavioural control and singularised audiences in the context of proprietary markets. In the digital constellation, it is less a matter of immobilising the citizen as a consumer but rather of their political activation – (...) albeit in conditions under which commercial interests have primacy: privatisation without privatism. Current challenges to sustaining public support for health data research have directed attention to the governance of data-intensive health research networks. Accountability is hailed as an important element of trustworthy governance frameworks for data-intensive health research networks. Yet the extent to which adequate accountability regimes in data-intensive health research networks are currently realized is questionable. Current governance of data-intensive health research networks is dominated by the limitations of a drawing board approach. As a way forward, we propose a stronger focus (...) on accountability as learning to achieve accountable governance. As an important step in that direction, we provide two pathways: (1) developing an integrated structure for decision-making and (2) establishing a dialogue in ongoing deliberative processes. Suitable places for learning accountability to thrive are dedicated governing bodies as well as specialized committees, panels or boards which bear and guide the development of governance in data-intensive health research networks. A continuous accountability process which comprises learning and interaction accommodates the diversity of expectations, responsibilities and tasks in data-intensive health research networks to achieve responsible and effective governance. This study examined the role of reflection on personal cases for making ethical decisions with regard to new ethical problems. Participants assumed the position of a business manager in a hypothetical organization and solved ethical problems that might be encountered. Prior to making a decision for the business problems, participants reflected on a relevant ethical experience. The findings revealed that application of material garnered from reflection on a personal experience was associated with decisions of higher ethicality. However, whether the case (...) was viewed as positive or negative, and whether the outcomes, processes, or outcomes and processes embedded in the experience were examined, influenced the application of case material to the new problem. As expected, examining positive experiences and the processes involved in those positive experiences resulted in greater application of case material to new problems. BackgroundIn this manuscript, we argue that within the context of phase IV, physician-researchers retain their fiduciary obligation to treat the patient-participants.DiscussionWe first clarify why the perspective that research ethics ought to be differentiated from clinical ethics is not applicable in phase IV, and therefore, why therapeutic orientation is most convivial in this phase. Next, assuming that ethics guidelines may be representative of common morality, we show that ethics guidelines see physician-researchers primarily as physicians and only secondarily as researchers. We then (...) elaborate on what a fiduciary obligation is and how some of the obligations are default duties. Lastly, we look at the fiduciary obligation of the physician-researcher in phase IV interventional trials.ConclusionThe fiduciary obligation to treat is not as easily waived as in earlier trials. Assuming the entwinement of research and practice in phase IV, physician-researchers, in collaboration with other researchers, investigators, and research ethics committees, should ensure that in terms of study design, methodology, and research practice, the therapeutic value of the research to the patient-participants is not diminished. Before the trains of thought have been firmly laid down, we ask in this article about the very nature and histories of the speculative of the speculative-materialist turn. We do this from the intertwined interfaces of curious feminist materialisms, foregrounding sexual difference, post-positivist critique and posthumanist performativity such as is being done in various strands of feminist theory today. The question of speculation plays a constitutive role in feminist critique and in several new or neo-materialist traditions. In fact, many interesting (...) materialisms—Marxism, French feminism—can be named ‘speculative’. We argue that in spite of what the recent ‘speculative turn’ professes, speculative materialisms have a complex genealogy. Speculation functions transversally in a materialist genealogy -connecting the archive of feminist approaches in particular. In order to be able to imagine a different world we need to think through a stifled and sexually differentiated present from which a qualitative shift and political breakthrough can be formulated, and hopefully achieved. However, in what is currently called ‘speculative realism’ or ‘object-oriented ontologies’ neither speculation nor the speculative are reflected upon as a heritage from and alliance with feminist and politically materialist positions. What are the onto-epistemological stakes of this body of work? And what ethico-political horizons are drawn here? We stand speculative before such turn. (shrink)

Pragmatic trials aim to directly inform health care decision-making through the collection of so-called ‘real world data’ from observations of comparative treatment effects in clinical practice. In order to ensure the applicability and feasibility of a pragmatic trial, design features may be necessary that deviate from standard research ethics requirements. Examples are traditional requirements to seek written informed consent and to perform extensive data and safety monitoring. Proposals for deviations from standard research ethics practice have resulted in controversy about their (...) ethical acceptability. One of the justifications for altered procedures is the allegedly high social value of pragmatic trials. In order to properly operationalize the concept in the ethical assessment of pragmatic trial designs, specification is warranted. We identified three determinants from common claims about a pragmatic trial's social value: the extent to which the research question has real world relevance, the trial design's ability to generate a real world answer and the probability of direct uptake of the results by decision-makers in practice. Subsequently, we discuss how these determinants should be applied to the practice of pragmatic trials, and to what extent they might be applicable to explanatory trials. (shrink)

This study examined the role of key causal analysis strategies in forecasting and ethical decision-making. Undergraduate participants took on the role of the key actor in several ethical problems and were asked to identify and analyze the causes, forecast potential outcomes, and make a decision about each problem. Time pressure and analytic mindset were manipulated while participants worked through these problems. The results indicated that forecast quality was associated with decision ethicality, and the identification of the critical causes of the (...) problem was associated with both higher quality forecasts and higher ethicality of decisions. Neither time pressure nor analytic mindset impacted forecasts or ethicality of decisions. Theoretical and practical implications of these findings are discussed. (shrink)
