This paper examines the implications of the General Agreement on Trade in Services (GATS), the World Trade Organization’s agreement governing trade in health-related services, for health policy and healthcare reform in the United States. The paper describes the nature and scope of US obligations under the GATS, the ways in which the trade agreement intersects with domestic health policy, and the institutional factors that mediate trade-offs between health and trade policy. The analysis suggests that the GATS provisions on market access, (...) national treatment and domestic regulation, which are designed to eliminate ‘regulatory barriers’ to global trade in health services, limit the range of options that state and federal regulators and legislative bodies can employ to regulate the health sector and implement healthcare reforms. Recent research has linked the reduction of abnormal accruals to corporate governance metrics. The results of these studies, however, are based on samples taken from periods prior to promulgated board independence requirements. In other words, during this time period, management not only had discretion over accounting accruals, but also significant influence over the choice of membership on the board of directors. This study suggests that ethical management practices may be a correlated omitted variable in these studies, thus resulting in causal (...) inference problems in the previous research. We argue that, rather than the board of directors monitoring and reducing abnormal accruals as has been posited, management who was not engaging in abusive earnings management was attempting to signal the market regarding the quality of the firm’s financial information through its choice of board membership. During the past two decades, several reports have documented substantial support from clinicians, policy-makers, and the general public for the use of advance directives, yet studies continue to find that only a minority of individuals have completed these legal documents. Advance directives are written instructions, such as living wills or durable powers of attorney for health care, which describe an individual's medical treatment wishes in the event that individual becomes incapacitated in the future. The completion and use of advance directives (...) is one of several components of the broader activity of advance care planning, that is, the overall planning and communication of personal wishes concerning future medical care.In December 1991, the federal Patient Self-Determination Act became effective. Promoted as a federal initiative to enhance an individual's control over medical treatment decision making and, therefore, patient autonomy and self-determination, PSDA placed several new requirements on health care organizations receiving Medicare or Medicaid payments. This article takes as its starting point the observation that neoliberalism is a concept that is ‘oft-invoked but ill-defined’. It provides a taxonomy of uses of the term neoliberalism to include: (1) an all-purpose denunciatory category; (2) ‘the way things are’; (3) an institutional framework characterizing particular forms of national capitalism, most notably the Anglo-American ones; (4) a dominant ideology of global capitalism; (5) a form of governmentality and hegemony; and (6) a variant within the broad framework of liberalism as (...) both theory and policy discourse. It is argued that this sprawling set of definitions are not mutually compatible, and that uses of the term need to be dramatically narrowed from its current association with anything and everything that a particular author may find objectionable. In particular, it is argued that the uses of the term by Michel Foucault in his 1978–9 lectures, found in The Birth of Biopolitics, are not particularly compatible with its more recent status as a variant of dominant ideology or hegemony theories. It instead proposes understanding neoliberalism in terms of historical institutionalism, with Foucault’s account of historical change complementing Max Weber’s work identifying the distinctive economic sociology of national capitalisms. The series will consider factors which give rise to language contact and the consequences of such contact in a broad inter-disciplinary context. Given the prevalence of language contact in communities throughout the world, there are as yet insufficient studies to (...) permit typological generalization about the subject: this series aims to fill that gap. Bislama is the variety of Melanesian Pidgin spoken in Vanuatu. In this book Terry Crowley describes its history and development from the 1940s to the present. In the first chapters the labour history of Vanuatu is reviewed in detail in order to establish what were the contacts between speakers of various languages with one another over the period. The written record is thoroughly examined for evidence about how people communicated in the early contact period, and how the contact language developed over the time. In the later chapters the author gives a detailed treatment of selected grammatical constructions and their evolution, including syntactic developments that are currently in progress. In this discussion he addresses the controversial issue of the source of grammatical constructions in Bislama, considering in particular the possible role of substratum patterns. He concludes that while there is good evidence for substratum influence in the grammer of Bislama, the mere existence of stuctural parallels between Bislama and the substrate is not itself sufficient evidence. Taking his cue from the third century Greek historian Polybius, who argued that the rapid domination of the Mediterranean world by Rome had instituted a new phase of world history, Hegel wondered what the rise of European modernity meant for the rest of the world. In his account of the contingent paths of world history, he argued that at work (...) behind it is an eternal human struggle over justice, and that it had led to a new conception of justice in which nobody by nature had authority to rule over anybody else. Moving away from the ancient conception of justice as ordered through a cosmic system, the modern conception is based instead on freedom. This is, so Hegel argues, not an accident of history but part of the necessary development of the institutions and practices through which humans establish and maintain their changing shapes of agency. Behind it is an infinite end, justice, which as infinite is neither something which can ever be finally achieved nor a goal to which we are getting closer but which requires an infinite effort at sustaining.--. Adorno, like Hegel and Kant, addressed himself to the limits of thought, the bounds beyond which we cannot go since to go beyond them is to stop making sense at all. However, Adorno also thought, following a line of thought that flowers in Hegel and Marx, that what seem to be limits of thought can turn out in historical circumstances merely to be limitations that can be overcome with changed social and political circumstances. This is the core of Adorno's theory (...) of “non‐identity.” This in turn requires him as he recognizes to take on all the Hegelian criticisms of such a view and to show how the negative dialectic not only escapes them but offers a new paradigm of dialectical thought. This paper argues that Michel Foucault’s lectures that form The Birth of Biopolitics owe a considerable debt to the thought of Max Weber, particularly in their analysis of how different socio-legal regimes shape distinctive national forms of capitalist economies, and the role that is played by social and economic institutions in the shaping of individual identities. This is in contrast to a common interpretation of Foucault’s account of neoliberalism, which synthesizes his work into neo-Marxist notions of hegemony and capitalist domination. (...) My topic is a long-standing tension in the interpretation of religion. On the one hand, it seems undeniable — seems almost to go without saying — that liturgical and sacrificial practices, sacred dance, divination, procession and pilgrimage are intentional actions undertaken by persons. Yet there is a distinguished tradition in the study of religion according to which religious activity is typically caused by forces over which the agent has little or no control. Visible, latter-day members of this tradition include Hume, (...) Nietzsche, Marx, Durkheim, Freud, and, in some moods, Wittgenstein, but its roster is by no means limited to the religiously unmusical. (shrink)

As a professional descendant of Alexander who has been teaching the Alexander Technique (AT) for 30 years, I am glad to see Cunningham et al. including him in the list of positive influences in John Dewey's life. Hegel is one of the most often cited and least read of all major philosophers. He is alternately regarded as the best and the worst that philosophy has produced. Nobody, however, disputes his influence. In Hegel's Dialectic, Terry Pinkard offers a new interpretation of Hegel's program that assesses his conception of the role of philosophy, his method, and some of the specific theses that he defended. Hegel's dialectic is interpreted as offering explanations of the possibility of basic categories. This article argues that a positive engagement between Bourdieu’s sociology of practice and contemporary feminist theory would be mutually profitable. It compares Bourdieu’s account of the social construction of the human subject through practice with Butler’s account of subjectivity as performance. While the one, through the concept of habitus, tends towards an ‘overdetermined’ view of subjectivity in which subjective dispositions are too tightly tied to the social practices in which they were forged, the other pays insufficient attention to the social (...) conditions of performative subversion. The second half of the paper looks at feminist studies of the relationship between class and gender which have drawn fruitfully on Bourdieu’s work, particularly on his concept of ‘cultural capital’, such as those of Moi and Skeggs. It has often been thought that our knowledge of ourselves is _different_ from, perhaps in some sense _better_ than, our knowledge of things other than ourselves. Indeed, there is a thriving research area in epistemology dedicated to seeking an account of self-knowledge that would articulate and explain its difference from, and superiority over, other knowledge. Such an account would thus illuminate the descriptive and normative difference between self-knowledge and other knowledge.¹ At the same time, self- knowledge has also encountered its (...) share of skeptics – philosophers who refuse to accord it any descriptive, let alone normative, distinction. In this paper, we argue that there is at least one _species_ of self-knowledge that is different from, and better than, other knowledge. It is a specific kind of knowledge of one’s concurrent phenomenal experiences. Call knowledge of one’s own phenomenal experiences _phenomenal knowledge_.
