This book offers those who engage in college student research a framework, tool, or guide for understanding the role that theory plays in research. It is organized around five major questions which address the essence of theory, central tenants and concepts of prevailing theories, and insights for future research.

This essay describes a new ethical theory that has begun to coalesce from the works of several scholars in the international computer ethics community. I call the new theory ‚Flourishing Ethics’ because of its Aristotelian roots, though it also includes ideas suggestive of Taoism and Buddhism. In spite of its roots in ancient ethical theories, Flourishing Ethics is informed and grounded by recent scientific insights into the nature of living things, human nature and the fundamental nature of the universe – (...) ideas from today’s information theory, astrophysics and genetics. Flourishing Ethics can be divided conveniently into two parts. The first part, which I call ‚Human-Centered FE,’ is focused exclusively upon human beings – their actions, values and characters. The second part, which I call ‚General FE,’ applies to every physical entity in the universe, including humans. Rather than replacing traditional ‚great ethical theories,’ Flourishing Ethics is likely to deepen and broaden our understanding of them. (shrink)

Marx's 'production theory' of society and social change is unique in social science and functions as a powerful hypothesis. It is not a casual law. The author assesses the central difficulties encountered by the theory, and shows that it sprang from a desire not simply to interpret the world, but to change it.

This article presents a remarkable cache of five Attic curse tablets, four of which are published here for the first time. Excavated in situ in a pyre-grave outside the Athenian Long Walls, the texts employ very similar versions of a single binding curse. After situating the cache in its archaeological context, all texts are edited with a full epigraphic commentary. A discussion then follows, in which the most striking features of the texts are highlighted: in addition to the peculiar “first (...) four-year period” that the curses were meant to outlast, and the unparalleled term κυνωτόν, these texts are unusual in that they preserve over a full line of dactylic hexameter. The metrical formulae, combined with the presence of deictic language, may suggest that parts of the archetype curse underpinning these texts once circulated orally, in performative ritual contexts. The cache affords a singular glimpse into the process of curse-creation around 400 BCE, especially the ways in which a curse-writer could customize a fixed template spell to suit a client’s needs and circumstances. These tablets illuminate the shadowy process behind the creation of Athenian curse tablets, and the growing traffic in “magic” by the end of the fifth century BCE. (shrink)

Courtship conventions are premised on widespread and deeply held cultural beliefs that men and women need and want different things from their romantic relationships. Yet queer relationships challenge the notion of distinct gendered behaviors in romantic relationships, and queer people often explicitly seek to undermine conventional relationship practices. Using interview data from 40 LGBTQ-identified respondents, I examine how queer people negotiate culturally dominant gendered dating and courtship practices. My findings show that, rather than replicate heterosexual norms, respondents actively reject them, (...) seeking new and more egalitarian ways of building romantic relationships. Significantly, the narratives drawn on to justify egalitarian dating practices are similar to those used in their committed relationships. Respondents emphasized egalitarian, flexible, and non-gendered care work in committed relationships, indicating that how people date may potentially set the stage for the dynamics in their relationships. The importance placed on these alternative norms in queer communities, however, contradicts respondents’ assertions that they can create relationships free from cultural constraints, demonstrating how emerging norms can breed their own pressures for conformity. This is an introduction to a set of papers on Computer Ethics from the conference ETHICOMP95. Taken as a whole, the collection of papers provides arguments and concepts to launch a new development in computer ethics: ‘Global Information Ethics’. A rationale for globalization is provided, as well as some early efforts which move in that direction.

In this paper I shall explain what I take to be the nature of justice; and the method which I shall follow is that of attempting to infer the essential nature of justice from an examination of its actual practical operation. Perhaps the reader will be able to follow the drift of the argument more easily, and be more on his guard against possible misstatements of fact or erroneous inferences, if I mention at the outset the main conclusions to which (...) And while The Republic raised the sex issue more than two millennia ago, it has taken considerable feminist effort in recent years to get this re-centred again so that it is not just an issue about women, but an issue debated and expanded from women's perspectives on power relations in social relationships. Today this covers critical engagement with the ways that sex itself is constructed (...) as knowledge about anyone's body, the gendered hierarchies of power through which women and men are perceived and constrained, and the modes through which diverse sexualities are experienced within and projected upon the foregoing. Norman Rufus Colin Cohn, a Fellow of the British Academy, wrote three major histories around a single theme. The Pursuit of the Millennium related the apocalyptic beliefs of twentieth-century totalitarian movements, whether Nazi or Communist, to their origins in medieval heresy. Warrant for Genocide established that the key document of a Jewish world conspiracy, The Protocol of the Elders of Zion, was a nineteenth-century Tsarist forgery. Europe's Inner Demons argued that the belief in a Satanic pact was at the heart (...) of witch persecution in early modern Europe. Within a year of retiring as Director of the Columbus Centre, Cohn was invited to Concordia University, Montreal, to help launch an Institute for Genocide Studies. He regarded his three books as tied to the Columbus Centre agenda and as such compatible with Lord Dacre's own search for what it was in Germany's myths and history that Adolf Hitler's mind could have been working upon in his lost years in Vienna. Jennifer Bird-Pollan has recently argued that Nozickians are wrong to oppose the estate tax. Promising to argue from within the Nozickian framework, she presses the fundamental point that the estate tax does not violate anyone’s rights: neither the deceased nor their would-be heirs can claim a right to any holdings subject to the estate tax. This paper shows that Bird-Pollan’s discussion fails on three fronts. First, she frequently misinterprets Nozick, and thus does not defend the estate tax from a Nozickian (...) perspective. Second, even if Bird-Pollan is correct in denying that the deceased and their potential heirs have a right to the holdings in question, it does not follow that the estate tax is licit, because Nozickians can oppose it on other grounds. For example, Nozickians may hold that the enforcement of the estate tax will violate other rights people have. The government’s preemptive claims to holdings subject to estate taxes, along with the force required to enforce those claims, are unjustified. The crucial premise motivating these conclusions is the Nozickian denial that our current state possesses the authority to enforce the estate tax. This is the third front on which Bird-Pollan’s argument fails: she must show that Nozickians ought to believe government has the moral authority to enforce the estate tax, yet she makes no effort to do so. A collection of essays which considers how the personal is political. The intertwining of gender with class and ethinicity is examined along with a technological theory of gender and parenting. Emphasis is placed upon the gendered perspective in political theory in this text.

This integrative review aims to provide a synthesis of research findings of health-care professionals’ knowledge, attitudes and behaviours relating to patient capacity to consent to or refuse treatment within the general hospital setting. Search strategies included relevant health databases, hand searching of key journals, ‘snowballing’ and expert recommendations. The review identified various knowledge gaps and attitudinal dispositions of health-care professionals, which influence their behaviours and decision-making in relation to capacity to consent processes. The findings suggest that there is tension between (...) legal, ethical and professional standards relating to the assessment of capacity and consent within health care. Legislation and policy guidance concerning capacity assessment processes are lacking, and this may contribute to inconsistencies in practice. (shrink)

BackgroundDelirium is highly prevalent in the general hospital patient population, characterized by acute onset, fluctuating levels of consciousness, and global impairment of cognitive functioning. Mental capacity, its assessment and subsequent consent are therefore prominent within this cohort, yet under-explored.AimThis study of patients with delirium sought to determine the processes by which consent to medical treatment was attempted, how capacity was assessed, and any subsequent actions thereafter.MethodA retrospective documentation review of patients identified as having a delirium for the twelve months February (...) 2013 to January 2014 was undertaken. Inclusion and exclusion criteria were used; demographic and descriptive data collected. A total of n=1153 patients were identified with n=310 meeting inclusion criteria.ResultA random sample of one hundred patients were subsequently reviewed. One third of patients had documentation relating to consent, while four patients had documentation relating to capacity. Median delirium duration was three days, with treatment refusal occurring in twenty-two patients and “duty of care” being used as an apparent beneficent related treatment framework in twelve patients.ConclusionsWhile impaired decision-making was indicated, the review was unable to indicate what patient characteristics flag the need for capacity assessment. Documentation relating to consent processes appeared deficient for this cohort. (shrink)

Matt Zwolinski argues that libertarians “should see the Basic Income Guarantee (BIG)—a guarantee that all members will receive income regardless of why they need it—as an essential part of an ideally just libertarian system.” He regards the satisfaction of a Lockean proviso—a stipulation that individuals may not be rendered relevantly worse off by the uses and appropriations of private property—as a necessary condition for a private property system’s being just. BIG is to be justified precisely because it prevents proviso violations. (...) We deem Zwolinski’s argument a “Direct Proviso-Based Argument” for BIG. We argue that because this sort of argument for the BIG is in tension with other principles libertarians within the Lockean tradition hold dear, specifically prohibitions on seizing legitimately held property and forcing individuals to labor, the Direct Proviso-Based Argument fails. Many have argued that individuals should receive income in proportion to their contribution to society. Others have believed that it would be fairer if people received income in proportion to the effort they expend in so contributing, since people have much greater control over their level of effort than their productivity. I argue that those who believe this are normally also committed, despite appearances, to increasing the social product — which undermines any sharp distinction between effort- and productivity-based distributive proposals. (...) However, effort-based proposals do emphasise more the importance of people having control over factors affecting their income. The second set of problems I consider is how to implement policies which hold true to this emphasis. I show that there are major problems with the accuracy of using any objective criteria to measure the level of effort a person is expending. Moreover, once any such criteria are employed the problem of ‘moral hazard’arises because people modify their behaviour in such a way as to maximise their income while minimising their effort. This violates the original motivation for using effort. Because of this and other empirical considerations, I argue that productivity may well be a better criterion on which to distribute income even if one is motivated by the same concerns which have prompted effort-based proposals. In contrast to most literature on cosmopolitanism, which focuses on its elite forms, this article analyzes how ordinary people bridge racial boundaries in everyday life. It is based on interviews with 150 non-college-educated white and black workers in the United States and white and North African workers in France. The comparison of the four groups shows how differences in cultural repertoires across national context and structural location shape distinct anti-racist rhetorics. Market-based arguments are salient among American workers, while arguments based (...) on solidarity and egalitarianism are used by French, but not by American, workers. Minority workers in both countries employ a more extensive toolkit of anti-racist rhetoric as compared to whites. The interviewed men privilege evidence grounded in everyday experience, and their claims of human equality are articulated in terms of universal human nature and, in the case of blacks and North Africans, universal morality. Workers' conceptual frameworks have little in common with multiculturalism that occupies a central place in the literature on cosmopolitanism. We argue that for the discussion and practice of cosmopolitanism to move forward we should shift our attention to the study of multiple ordinary cosmopolitanisms. (shrink)

Aristotle's theory of human action is an impressive achievement that has served philosophy well for more than two thousand years. In every philosophical era it is explored anew--and with great profit. As a contribution to contemporary efforts in this regard, the present dissertation aims to lay out, lucidly and in detail, the various components of Aristotle's action theory. ;Since actions, according to Aristotle, constitute a sub-class of "the voluntary", the dissertation begins by examining Aristotle's account of voluntary activities. It discusses (...) the chief characteristics shared by all such activities, and compares the Nicomachean and Eudemian accounts. ;Perception is examined next, because percepts and their lingering traces , according to Aristotle, are the triggers of desire. And desire provides the impetus for animal behavior and human action. Aristotle's analysis assumes a rich array of desire-types, including appetites, passions, emotions, and wishes, all of which are analyzed in the dissertation. ;The keys to adult human action--distinguishing it from animal and child behavior--are deliberation, "choice" and the so-called "practical syllogism". The dissertation examines these in some detail and produces a model of the practical syllogism. ;Once the practical syllogism has been examined, the dissertation considers the question of whether Aristotle's theory of action provides a successful resolution of the so-called "problem of free will". Political theorists of today will in some cases recognise similar pressures and dilemmas. As a classic author, however, Hobbes has become a trope in political theory through an overt process of anachronism. The authors in this special issue – Browning, Jaede, Boyd, Prozorov – proceed from this common and canonical content, as does Prokhovnik in (...) her Introduction. The scholarly template, presumed in this discussion, focuses on the first two books of Leviathan, and on the life-and-death dilemmas posed there in relation to political power and obligation. The four articles thoroughly explore the concepts of nature and artifice within that reading strategy. The conclusion of this critical review of their work is that within broader commentary in political theory nature and artifice are themselves tropes, and that the natural life of humans is inherently artificial.
