This paper reflects on the problem of endowing Artificial Intelligence with legal subjectivity, especially with regard to civil law. It is necessary to reject the myth that the criteria of legal subjectivity are sentience and reason. Arguing that AI may have potential legal subjectivity based on an analogy to animals or juristic persons suggests the existence of a single hierarchy or sequence of entities, organized according to their degree of similarity to human beings; also, that the place of an entity (...) in this hierarchy determines the scope of subjectivity attributed to it. Rather, it is participation or presence in social life, whatever the role, that is the true criterion of subjectivity. In addition, it is clear that even if AI is not currently a significant participant in social life, it will be in the nearest future. Despite the potential dangers associated with endowing AI with some kind of subjectivity, such a course is inescapable, and should be considered sooner rather than later. (shrink)

This article probes the usefulness of selected theories from Cognitive Linguistics in the context of statutory interpretation. The presumption of legal language is a well-established rule of statutory construction in Polish legal practice that comes from the internationally recognised theory by Jerzy Wróblewski. It rests on a controversial assumption that there are different levels of generality in legal language (i.e. the language of statutes) and a single term may be given different meanings depending on the level of generality that is (...) referred to. The authors use the notion of basic level categorisation from the cognitive theory of prototypes to explain this mechanism. Legal concepts, not unlike ordinary concepts, form hierarchical taxonomies. A single term may denote concepts that are situated at different levels in different conceptual taxonomies. In the absence of special circumstances, a legal term should be given the meaning that resides at a higher level of categorisation in the respective legal taxonomy. This way, the presumption of legal language is found to be justified on both linguistic and psychological grounds. (shrink)

Researchers have theoretically proposed that humans decode other individuals' emotions or elementary cognitive appraisals from particular sets of facial action units (AUs). However, only a few empirical studies have systematically tested the relationships between the decoding of emotions/appraisals and sets of AUs, and the results are mixed. Furthermore, the previous studies relied on facial expressions of actors and no study used spontaneous and dynamic facial expressions in naturalistic settings. We investigated this issue using video recordings of facial expressions filmed unobtrusively (...) in a real-life emotional situation, specifically loss of luggage at an airport. The AUs observed in the videos were annotated using the Facial Action Coding System. Male participants ( n = 98) were asked to decode emotions (e.g., anger) and appraisals (e.g., suddenness) from facial expressions. We explored the relationships between the emotion/appraisal decoding and AUs using stepwise multiple regression analyses. The results revealed that all the rated emotions and appraisals were associated with sets of AUs. The profiles of regression equations showed AUs both consistent and inconsistent with those in theoretical proposals. The results suggest that (1) the decoding of emotions and appraisals in facial expressions is implemented by the perception of set of AUs, and (2) the profiles of such AU sets could be different from previous theories. Atypical emotion interpretation has been widely reported in individuals with borderline personality disorder ; however, empirical studies reported mixed results so far. We suggest that discrepancies in observations of emotion interpretation by iBPD can be explained by biases related to their fear of rejection and abandonment, i.e., the three moral emotions of anger, disgust, and contempt. In this study, we hypothesized that iBPD would show a higher tendency to correctly interpret these three displays of social rejection and attribute more negative (...) valence. A total of 28 inpatient iBPDs and 28 healthy controls were asked to judge static and dynamic facial expressions in terms of emotions, valence, and self-reported arousal evoked by the observed faces. Our results partially confirmed our expectations. The iBPD correctly interpreted the three unambiguous moral emotions. Contempt, a complex emotion with a difficulty in recognizing facial expressions, was recognized better by iBPD than by healthy controls. All negative emotions were judged more negatively by iBPD than by controls, but no difference was observed in the neutral or positive emotion. Alexithymia and anxiety trait and state levels were controlled in all analyses. (shrink)

The article concentrates on the analysis of the Enlightenment periods vision of science by Josef Sołtykowicz. His theories are examples of philosophical reflection of the Cracow Science Society. The starting point was the outline of the political and scientific situation from the second part of the XVII century to the first part of the XIX century also referring to the author’s biography. The main part of the article is the analysis of two Dissertations by Sołtykowicz published by the Cracow Science (...) Society their yearly publication, in 1818 and 1820. The following points were taken into account: The roots of the society’s activities, the relationship between science and faith, popularizing knowledge, criticism of Rousseau and anthropological analysis of the roots, of the negative view of knowledge. These theories are worth analysing, unfortunately so far the philosophical thought of the members of CSS, has not encouraged work on them as they deserved. At the same time we can expect that the work of the scientists from the CSS significantly impacted on the progress of the philosophical reflection in Cracow, and also the wider picture of modern polish scientific culture. The subject of agnosticism about the existence of God has emerged in many of the major conversations within analytic philosophy of religion, such as the debate on the nature of evidence for and against religious beliefs. In this article, I outline a map of the debate on agnosticism in religious epistemology—especially in relation to evidentialism—highlighting the significance of the problem of the ambiguity of evidence and connecting said problem to discussions of religious language and peer disagreement.

Max Weber’s thesis on the decisive influence of Protestant ethic on the formation and development of modern capitalism has become one of the best-known and widely shared canonical claims in social sciences. Since its publication at the beginning of the 20th century, this thesis, supported by subsequent great works by the German classic, has rarely been the subject of major controversy. The work of correcting Weber’s thesis was undertaken in the late 20th century by Michael Novak. Novak’s correction is not (...) confrontational, but complementary. The American thinker abandons the research area of minority Protestant communities, which caught Weber’s attention, and undertakes an analysis of the broader religious tradition, developing both before and after the Reformation. In particular, the achievements of Pope John Paul II, interpreted by Novak in terms of the renewal of a liberty current of Catholic social thought, provide important corrective data. (shrink)

Implications of the Level of Dogmatism and Selected Psychosocial Conditions for a Propensity for Risky Behaviour among the Soldiers of the Polish Army Land Forces The article presents the results of a study concerning a propensity for risky behaviour, conducted on regular soldiers of the Polish Army Land Forces. Its aim was to verify whether a level of dogmatism and selected psychosocial conditions were related to a propensity for risky behaviour among the soldiers. The research partially confirmed the hypothesis of (...) psychosocial determinants of a propensity for such behaviour. Young and shortserving soldiers appeared to be more inclined to undertake risky behaviour than older and long-serving ones. A tendency to avoid risky behaviour was displayed by soldiers from small towns as compared to groups of respondents from larger towns. The results of the research did not indicate a significant relationship between the propensity for risky behaviour and the level of dogmatism, education, personal corps, professional position. Among contemporary authors whose philosophical and social thought can be regarded as universalistic, Karol Wojtyła, who became the Pope John Paul II, seems to hold a particular place. An attempt to present the thought of Karol Wojtyła/John Paul II in universalistic categories has been recently made by thePolish philosopher and political scientist Arkadiusz Modrzejewski. The article discusses the advantages and drawbacks of his proposition.

Fleck’s social theory of science refers to many ethnological examples in order to explain how collective thinking and acting constructs certain systems of belief and knowing. According to Fleck, scientific concepts and practices are comparable with magic terms and ceremonies. This essay aims to identify the ethnological sources that Fleck’s epistemology is using. By confronting them with other relativistic theories that were circulating in Lemberg during the interwar period, the originality of Fleck’s own position can be contextualized and explained as (...) well. The studies of health care systems are conducted intensively on various levels. They are important because the systems suffer from numerous pathologies. The health care is analyzed, first of all, in economic aspects but their functionality in the framework of systems theory is studied, as well. There are also attempts to work out some general values on which health care systems should be based. Nevertheless, the aforementioned studies, however, are fragmentary ones. In this paper holistic approach to the philosophical basis (...) of health care is presented. The levels on which the problem can be considered are specified explicitly and relations between them are analyzed, as well. The philosophical basis on which the national health care systems could be based is proposed. Personalism is the basis for the proposal. First of all, the values, that are derived from the personalistic philosophy, are specified as the basic ones for health care systems. Then, general organizational and functional properties of the system are derived from the assumed values. The possibility of adaptation of solutions from other fields of social experiences are also mentioned. The existing health care systems are analyzed within the frame of the introduced proposal. Within contemporary philosophy, practical consequences of agnosticism about the existence of God have mostly been discussed on the margins of other topics—such as the nature of faith or the problem of divine hiddenness. The aim of this article is to present the existing views on the practical upshots of suspending one's judgment on God's existence, briefly discussing the way in which agnosticism relates to practical atheism, non‐doxastic faith, fictionalism, apophaticism, and spiritual inquiry.

Generally, the solutions based on information and communication technologies provide positive outcomes for both companies and employees. However, the process of digital transformation can be the cause of digital transformation stress, when the work demands caused by fast implementation of ICT are elevated and employees’ resources are limited. Based on the Job Demand-Resources Model we claim that DT, rapidly accelerating in the COVID-19 pandemic, can increase the level of DTS and general stress at work. To reduce these negative effects of (...) DTS, we propose the online intervention aimed to strengthen employees’ resources, such as self-efficacy. In this article we evaluate the effectiveness of the blended intervention, based on cognitive behavioral therapy and social cognitive therapy, composed of a prototyped online training and series of interactive online workshops. In a longitudinal study, we examined the change in DTS, perceived stress at work, attitudes toward DT, self-efficacy and burnout in two time points, before and after the intervention. We compared five groups of participants, three groups not qualified, and two groups qualified to intervention. Our results revealed that the designed blended intervention decreased DTS and one of the dimensions of burnout, namely disengagement. More specifically, the results showed that in the group of active participants of the blended intervention DTS significantly decreased [MT1 = 3.23, MT2 = 3.00, t = 1.96, p = 0.051], and in the group of ineligible participants DTS significantly increased [MT1 = 1.76, MT2 = 2.02, t = 4.17, p < 0.001]. This research paves way for the creation of blended online intervention which could help in addressing employee digital transformation stress before it starts having adverse effects on employee performance and well-being. The main aim of the paper is to show an existential religious model of business leadership. We want to defend the thesis that leaders, who consider existing norms and regulations, have the greatest influence on how organisational aims are achieved. Thus, based on the concept of Kierkegaard’s modes of existence, we show that the individual values and motives of leaders’ behaviour influence the shape of the leadership itself as well as the management of an organisation. On the basis of a (...) literature review, we propose the following connections: an aesthetic mode with instrumental motives which result in the shareholder perspective; an ethical mode of existence with normative motives which lead to the stakeholder perspective; and the spiritual mode of existence with transcendental motives which enable leaders to introduce a holistic perspective of management. However, we cannot link certain motives with a particular type of leadership, as leaders with different modes of existence might practice the same type of leadership (i.e., leadership based on values, authentic leadership) and combine various types of leadership in their actions. The paper might provide a theoretical basis for empirical research on leadership and managerial behaviour. (shrink)

The study analyses the readability and clarity of economic specialised texts on supplementary individual pensions. The research includes agreements on individual pension products available on the Polish market at the beginning of 2017. The level of comprehensibility of language has been assessed using the “Jasnopis” application, based, among others, on the FOG index, while the structure of the content of the agreements has been assessed by an expert linguist (the expert linguist is one of the authors of this and a (...) number of other publications on clear and understandable texts). In addition, one of the texts was subject to a survey, the so-called cloze text, which provided more accurate information about readability for a specific reader group. The results obtained allow the conclusion that the language of agreements on individual pension products is very difficult and their understanding requires higher education or expertise in the field of finance. This book examines the development and adoption of corporate social responsibility in Polish businesses and social and environmental organizations, and analyzes the corresponding impact at the strategic and operational level in these fields. It presents the status quo of CSR in Poland from three main perspectives: The first presents theoretical works based on current research and recent advances, while the next takes a closer look at empirical findings in the different fields of CSR and presents best practices from major international (...) companies operating on the Polish market. Lastly, it presents a range of case studies from small and medium companies and NGOs in Poland and gives an outlook on the future development. Readers will benefit from an in-depth discussion of the opportunities and challenges that businesses and organizations in Poland are currently facing with regard to traditional national values and the influx of new cultural and social dimensions and patterns produced by international businesses entering the Polish market. Taken together, the lessons learned, case studies and snapshots of the latest developments provide a comprehensive overview of the state of the art of CSR in Poland, as well as a blueprint that can be applied to other Eastern European countries. The introduction of Women and Gender Studies in Polish universities is intrinsically connected with the systemic transformation following 1989. This change was marked by the rejection of the communist past with its nominal sexual equality and acceptance of a conservative culture legally restricting women’s rights. Since the mid-nineties, Women and Gender Studies programs have been instituted in many state and private universities albeit on an auxiliary, extramural bases or as “specialization” within other degrees (e.g., sociology, or cultural studies). Since the (...) mid-2000s, gender studies in Poland include studies of masculinity, gender identity formation and queer theory in addition to the traditional women studies program. After Poland joined the EU, the introduction of European legal standards started to influence the progress in Poland’s gender politics towards greater recognition of minority rights. Gender Studies are in the foreground of these changes in teaching and training students and colleagues in gender issues seen as crucial for building a democratic inclusive society. (shrink)

Subject and purpose: Using annual data for the periods 2009–2019, this paper examines trade flows between China and the Visegrad Group countries. The aim of this article is to assess real changes taking place in international trade in the Visegrad Group countries over the last eleven years. The starting point for the analysis was 2009 – the time after the 2008 economic crisis, and it was compared especially to 2018 – a year marked by a significant improvement in the economy. (...) The purpose is to discuss concerns related to the differences in bilateral trade between China and Poland, Czech Republic, Hungary, and Slovak Republic. The main aim of this research is to distinguish the characteristics of bilateral trade by products between V4 and China in years 2009–2019. The purpose of this article is also to systematize and discuss points of view, rationalizing further empirical research. Two research hypotheses, resulting from the research purpose, were formulated: H1: in the V4 countries import exceeds export, and this trend seems to be growing, H2: Chinese goods imported to the V4 are much more sophisticated than those exported. Design/methodology/approach: To assess the initial and current situation on international trade between the V4 and China, the author uses variables obtained from WTO and OEC resources, diagnosing the situation in Poland, Czech Republic, Hungary, and Slovak Republic. The collected empirical data were processed using theoretical methods such as analysis, synthesis, and comparison to formulate conclusions using deductive and inductive inference methods. Practical Implications: The results can be used in scientific and expert work on diagnostic and forecast trends in bilateral trade by products between the V4 and China. Originality/value: It concerns the indication of the importance of the V4 trade with China compared to the share of the V4 countries in world trade. It was also possible to identify the top export and import products of the V4. The findings also confirm the significant change in China’s trading structure. (shrink)

National healthcare systems in all countries do not act effectively. Therefore, especially strategies for introducing organizational innovation to public organization should be considered. The problem is how to organize the research in this field. One of the generally accepted solutions is the systemic approach to healthcare systems. In this paper multiagent systems theory and autonomous systems theory are applied to the analysis of main types of healthcare systems. Such analysis allows us to consider the system properties: the level of the (...) autonomy, energy dissipation in the system, the payoff specificity, functional role of the agents in the system, the level of the agents’ cooperation, and delays in flows of money, requests, rules, and controls. As a result, some new functionalities of the healthcare system on the national level have been found and analysed. The aforementioned parameters are good tools to analyse the system functionality. Jan Wagilewicz (1811–1866), kojarzony dziś głównie z „Ruską Trójcą”, to związany z Galicją XIX-wieczny pisarz i uczony, który zasłużył się dla dwóch obecnych na tym terenie kultur: polskiej i ukraińskiej. Tworzył w dwóch językach, popierając przede wszystkim ideę wspólnoty Słowian. Ukraińcy uważają go nadal za „ojca nowoczesnej literatury ukraińskiej” i „budziciela ducha narodowego”, Polacy zapomnieli o jego zasługach. Wagilewicz, uznawany niegdyś za geniusza nauki i tytana pracy, niewiele swoich dzieł zdążył ogłosić drukiem. Artykuł jest wynikiem przeprowadzonej przeze mnie w Lwowskiej (...) Narodowej Naukowej Bibliotece imienia Wasyla Stefanyka kwerendy oraz wnikliwych studiów nad literaturą. Przedstawiam w nim dotychczasowy stan badań nad spuścizną Jana Wagilewicza w Polsce i Ukrainie oraz porządkuję wiedzę na temat publikacji uczonego i dzieł pozostających nadal w rękopisie – dołączając ich obszerny spis, którego w polskim piśmiennictwie naukowym brakowało. Artykuł wraz z bibliografią stanowi solidną podstawę, na której można oprzeć dalsze badania nad twórczością Wagilewicza, mogące również doprowadzić do edycji najważniejszych jego prac, takich jak „Symbolika” czy „Demonologia słowiańska”. Mimicry is known to produce benefits for the mimicker such as liking, increased prosocial tendencies, and trust. Little is known about the benefits or costs to the mimickee. The aim of this study is to explore this issue. Participants were mimicked or not by a confederate. The confederate then dropped pens and checked if the participants picked them up. Finally, questionnaires were administered that assessed each participant’s liking of the confederate and self-liking, and self-esteem. As expected, mimicked participants picked up (...) more pens and liked the mimicker more. Surprisingly, mimicked participants reported significantly lower self-like when compared to non-mimicked participants, and their self-esteem tended towards being lower. This research fills an important theoretical gap showing that there is a great cost to mimicry. (shrink)
