Stephanie Mills presented the following as the keynote address at the 2007 Annual Meeting of the International Association for Environmental Philosophy in Chicago. Mills addresses the readers of this journal in her role as a bioregional author and social critic. Adopting a narrative style rather than the typical format of the “philosophical essay,” she raises questions that are always and still at the core of our philosophical dialogue: What is nature? How do we humans perceive our relationship (...) with nature? And how may the blind spots of academic philosophy be discerned in traditional approaches to issues such as “nature versus humans,” the wilderness debate, and the possibility and limits of technology? Though grassroots organizations have mobilized against US environmental injustices since; the 1980s, academic definitions of environmental justice (EJ) remain limited in important ways, including: a tendency to privilege cases where activists achieve a successful, ‘tidy’ outcome; inattention to roles natural resource dependence and free market systems play in structuring environmental inequality; and a tendency to under-analyze alternative notions of EJ that result, utilized by activists who prioritize local autonomy and procedural justice in land-use decision making. Here, I argue that these (...) alternative notions of EJ help mobilize divergent forms of EJ activism-‘sites of resistance’ to industrial production systems and their risks, and ‘sites of acceptance’ to those same practices. To illustrate, I explore extensive mixed method data in the context of energy development and sites of acceptance related to uranium production in the southwestern United States. I show how alternative notions of EJ are shaped by identification with uranium production, persistent poverty and economic insecurity, and faith that increased uranium production will fuel US nuclear power production and help combat global climate change. Critical approaches to the canon of Western political and legal thought from the point of view of race or gender have developed in recent years, as have studies highlighting the connections between supposedly universalist philosophies and their role in sustaining or legitimizing imperial and colonial conquests. On social contract theory in particular, seminal works include Charles Mills’ The Racial Contract and Carole Pateman’s The Sexual Contract. The importance of this type of work cannot be understated, and Mills is (...) right to insist on the “blinding whiteness of the discipline.” In the case of Hobbes, I argue, the privilege established in his texts is better qualified as “civilizational” rather than “racial.” Hobbes’s texts construct a certain image of civilization, a form of exclusion and domination that eschews biological determinism in favor of social, historical bias. This “civilizational” thinking certainly can work – and will work later on in conjunction with modern racism and white privilege – to exclude many. The racial contract – as per Mills – is only a late installment on a more fundamental one, the civilizing contract. (shrink)

Liberalism is the political philosophy of equal persons, yet liberalism has denied equality to those it saw as black sub-persons. In Black Rights/White Wrongs: The Critique of Racial Liberalism, political philosopher Charles Mills challenges mainstream accounts that ignore this history and its current legacy in the United States today.

Although the best-known Hegelian objection against Kant's moral philosophy is the charge that the categorical imperative is an ‘empty formalism’, Hegel's criticisms also include what we might call the realizability objection. Tentatively stated, the realizability objection says that within the sphere of Kantian morality, the good remains an unrealizable ‘ought’ – in other words, the Kantian moral ‘ought’ can never become an ‘is’. In this paper, I attempt to come to grips with this objection in two steps. In the first (...) section of the paper, I provide an initial reading of the objection, according to which Hegel agrees with Kant's formulation of the realizability problem but disagrees with the specific Kantian solution, namely, with the Kantian idea of the highest good and the doctrine of the postulates. In the second section, I go on to argue that this reading is potentially too superficial and offer a more far-reaching interpretation whereby Hegel is ultimately targeting fundamental distinctions of Kant's moral theory. I end by employing these more far-reaching results of Hegel's objection to sketch some features of Hegel's alternative ethical view. (shrink)

The concept of biopolitics has been one of the most important and widely used in recent years in disciplines across the humanities and social sciences. The concept of "fitness" is a notion of central importance to evolutionary theory. Yet the interpretation of this concept and its role in explanations of evolutionary phenomena have remained obscure. We provide a propensity interpretation of fitness, which we argue captures the intended reference of this term as it is used by evolutionary theorists. Using the propensity interpretation of fitness, we provide a Hempelian reconstruction of explanations of evolutionary phenomena, and we show why charges of circularity which have been levelled (...) against explanations in evolutionary theory are mistaken. Finally, we provide a definition of natural selection which follows from the propensity interpretation of fitness, and which handles all the types of selection discussed by biologists, thus improving on extant definitions. This previously-unpublished essay by the late Charles W. Mills (1951–2021) seeks to demonstrate the racially-structured character of the universe created by J. R. R. Tolkien in The Hobbit and The Lord of the Rings. Written long before the popular film series, the essay critically examines Tolkien's novels and comments on the nature of fictional creation. Mills argues that Tolkien designs a racial hierarchy in the novels that recapitulates the central racist myth of European thought.

Issues in reproductive ethics, such as the capacity of parents to ‘choose children’, present challenges to philosophical ideas of freedom, responsibility and harm. This book responds to these challenges by proposing a new framework for thinking about the ethics of reproduction that emphasizes the ways that social norms affect decisions about who is born. The book provides clear and thorough discussions of some of the dominant problems in reproductive ethics - human enhancement and the notion of the normal, reproductive liberty (...) and procreative beneficence, the principle of harm and discrimination against disability - while also proposing new ways of addressing these. The author draws upon the work of Michel Foucault, especially his discussions of biopolitics and norms, and later work on ethics, alongside feminist theorists of embodiment to argue for a new bioethics that is responsive to social norms, human vulnerability and the relational context of freedom and responsibility. This is done through compelling discussions of new technologies and practices, including the debate on liberal eugenics and human enhancement, the deliberate selection of disabilities, PGD and obstetric ultrasound. Mills argues for a new critical theory that develops the insights of the black radical political tradition. While challenging conventional interpretations of key Marxist concepts and claims, the author contends that Marxism has been 'white' insofar as it has failed to recognize the centrality of race and white supremacy to the making of the modern world.

This essay tries to develop a “black radical Kantianism”—that is, a Kantianism informed by the black experience in modernity. After looking briefly at socialist and feminist appropriations of Kant, I argue that an analogous black radical appropriation should draw on the distinctive social ontology and view of the state associated with the black radical tradition. In ethics, this would mean working with a (color-conscious rather than colorblind) social ontology of white persons and black sub-persons and then asking what respect for (...) oneself and others would require under those circumstances. In political philosophy, it would mean framing the state as a Rassenstaat (a racial state) and then asking what measures of corrective justice would be necessary to bring about the ideal Rechtsstaat. Despite the fact that ethics consultations are an accepted practice in most healthcare organizations, many clinical ethicists continue to feel marginalized by their institutions. They are often not paid for their time, their programs often have no budget, and institutional leaders are frequently unaware of their activities. One consequence has been their search for concrete ways to evaluate their work in order to prove the importance of their activities to their institutions through demonstrating their efficiency and effectiveness.

THE following treatise on Sextus Empiricus and Greek Scepticism has been prepared to supply a need much felt in the English language by students of Greek philosophy. For while other schools of Greek philosophy have been exhaustively and critically discussed by English scholars, there are few sources of information available to the student who wishes to make himself familiar with the teachings of Pyrrhonism. The aim has been, accordingly, to give a concise presentation of Pyrrhonism in relation to its historical (...) development and the Scepticism of the Academy, with critical references to the French and German works existing on the subject. The time and manner of the connection of Sextus Empiricus with the Pyrrhonean School has also been discussed. As the First Book of the "Hypotyposes," or Pyrrhonic Sketches by Sextus Empiricus, contains the substance of the teachings of Pyrrhonism, it has been hoped that a translation of it into English might prove a useful contribution to the literature on Pyrrhonism, and this translation has been added to the critical part of the work. There is currently intense debate about the significance of user consent to data practices. Consent is often taken to legitimate virtually any data practice, no matter how invasive. Many scholars argue, however, that user consent is typically so defective as to be ‘meaningless’ and that user privacy should thus be protected by substantive legislation that does not rely (or does not rely heavily) on consent. I argue that both views rest on serious mistakes about the validity conditions for consent. User (...) consent is sufficiently impoverished that it does not guarantee legitimacy but is not so impoverished as to be ‘meaningless’; it can legitimate data practices that are independently reasonable but not those that are exploitative. Since many valuable data practices must be consented to if they are to be legitimate (or so I argue), our privacy legislation should continue emphasizing the importance of user consent, even if auxiliary protections are also desirable. Throughout the Covid-19 pandemic, people have been eager to learn what factors, and especially what public health policies, cause infection rates to wax and wane. But figuring out conclusively what causes what is difficult in complex systems with nonlinear dynamics, such as pandemics. We review some of the challenges that scientists have faced in answering quantitative causal questions during the Covid-19 pandemic, and suggest that these challenges are a reason to augment the moral dimension of conversations about causal inference. We (...) take a lesson from Martha Nussbaum—who cautions us not to think we have just one question on our hands when we have at least two—and apply it to modeling for causal inference in the context of cost-benefit analysis. In this article, we examine how regulators, prosecutors, and courts might support and encourage the efforts of organizations to not only reintegrate after misconduct but also to improve their conduct in a way that reduces their likelihood of re-offense. We explore a novel experiment in creative sentencing in Alberta Canada that aimed to try to change the behaviour of an industry by publicly airing the root causes of a failure of one the industry’s leaders. Drawing on this case and prior (...) work, we articulate a model for a responsive and restorative approach to organizational misconduct that balances the punitive role of regulators and courts with new roles in supporting and overseeing rehabilitation. In this novel re-examination of the archetype construct, philosopher Jon Mills and psychiatrist Erik Goodwyn engage in spirited dialogue on the origins, nature, and scope of what archetypes actually constitute, their relation to the greater questions of psyche and worldhood, and their relevance for Jungian studies and analytical psychology today. Arguably the most definitive feature of Jung's metapsychology is his theory of archetypes. It is the fulcrum on which his analytical depth psychology rests. With recent trends in post-Jungian and (...) neo-Jungian perspectives that have embraced developmental, relational, social justice, and postmodern paradigms, classical archetype theory has largely become a drowning genre. Despite the archetypal school of James Hillman and his contemporaries and the archetype debates that captured our attention over two decades ago, contemporary Jungians are preoccupied with the lived reality of the existential subject and the personal unconscious over the collective transpersonal forces derived from archaic ontology. Archetypal Ontology will be of interest to psychoanalysts, philosophers, transpersonal psychologists, cultural theorists, anthropologists, religious scholars, and many disciplines in the arts and humanities, analytical psychology, and post-Jungian studies. ‘Racial justice’ is a term widely used in everyday discourse, but little explored in philosophy. In this essay, I look at racial justice as a concept, trying to bring out its complexities, and urging a greater engagement by mainstream political philosophers with the issues that it raises. After comparing it to other varieties of group justice and injustice, I periodize racial injustice, relate it to European expansionism and argue that a modified Rawlsianism relying on a different version of the thought (...) experiment could come up with suitable principles of corrective racial justice. After a brief summary of the 17 essays in Sally Haslanger’s (2012) collection, Resisting Reality: Social Construction and Social Critique, I raise questions in two areas, the defense of constructionism and the definition of gender and race in terms of social oppression. I cite Robin Andreasen’s and Philip Kitcher’s essays arguing (in different ways) that races are both biologically real and socially constructed, and also Joshua Glasgow’s claim that constructionist arguments ultimately fail. I then cite Jennifer Saul’s critique that “oppression” (...) definitions of gender and race run into problematic counterexamples, and add some other points arising from the different histories of gender and racial categories and realities. As someone sympathetic to constructionism myself, my aim is not a critique of Haslanger but rather an inquiry as to how she thinks (we) constructionists should answer such challenges. (shrink)

Scientific modelling is a value-laden process: the decisions involved can seldom be made using ‘scientific’ criteria alone, but rather draw on social and ethical values. In this paper, we draw on a body of philosophical literature to analyze a COVID-19 vaccination model, presenting a case study of social and ethical value judgments in health-oriented modelling. This case study urges us to make value judgments in health-oriented models explicit and interpretable by non-experts and to invite public involvement in making them.

The most compelling arguments for ethical veganism hinge on premise-pairs linking the serious wrongness of factory farming to that of buying its products: one premise claiming that buying those products stands in a certain relation to factory farming itself, and one claiming that entering into that relation with a seriously wrong practice is itself wrong. I argue that all such “linkage arguments” on offer fail, granting the serious wrongness of factory farming. Each relevant relation is such that if it holds (...) between factory farming and buying its products, then it holds between some seriously wrong practice and economic transactions of an absurd number and breadth. Hence, all these premise-pairs would, if true, generate unacceptable moral overreach; each premise-pair contains at least one unacceptable member, and the linkage arguments for ethical veganism fail. In this article, I consider recent debates on the notion of procreative liberty, to argue that reproductive freedom can be understood as a form of positive freedom—that is, the freedom to make oneself according to various ethical and aesthetic principles or values. To make this argument, I draw on Michel Foucault’s later work on ethics. Both adopting and adapting Foucault’s notion of ethics as a practice of the self and of liberty, I argue that reproductive autonomy requires enactment to gain (...) meaning within the life contexts of prospective parents. Thus, I propose a shift away from the standard negative model of freedom that sees it solely as a matter of noninterference or nonimpedance, a view advocated by major commentators such as John Harris and John Robertson. Instead, reproduction should be understood as a deeply personal project of self-making that integrates both negative and positive freedom. (shrink)

White supremacy is the unnamed political system that has made the modern world what it is today. You will not find this term in introductory, or even advanced, texts in political theory. A standard undergraduate philosophy course will start off with plato and Aristotle, perhaps say something about Augustine, Aquinas, and Machiavelli, move on to Hobbes, Locke, Mill, and Marx, and then wind up with Rawls and Nozick. It will introduce you to notions of aristocracy, democracy, absolutism, liberalism, representative government, (...) socialism, welfare capitalism, andlibertarianism. But though it covers more than two thousand years of Western political thought and runs the ostensible gamut of political systems, there will be no mention of the basic political system that has shaped the world for the past several hundred years. And this omission is not accidental. Rather, it reflects the fact that standard textbooks and courses have for the most part been written and designed by whites, who take their racial privilege so much for granted that they do not even see it as political, as a form of domination. Ironically, the most important political system of recent global history-the system of domination by which white people have historically ruled over and, in certain important ways, continue to rule over nonwhite people-is not seen as a political system at all. It is just taken for granted; it is the background against which other systems, which we are to see as political are highlighted. This book is an attempt to redirect your vision, to make you see what, in a sense, has been there all along. (shrink)

The topic of this paper is Hegel's claim in the Philosophy of Right that, within the modern social world, human needs tend to be endlessly expanded. Unlike the role that the system of needs plays in the formation of its participants' psychological makeup and the problem of poverty and the rabble, the topic of the expansion of needs remains underdiscussed in the recent Hegel literature on the virtues and vices of civil society. My discussion of the topic aims to answer (...) the following two sets of questions: How does it come to pass that individuals' needs are endlessly expanded in this way? And is that expansion a phenomenon to be applauded or condemned? In particular, does the endless expansion of needs aid or obstruct the realization of social members' freedom? In answer to the first question, I argue that for Hegel the endless expansion of needs results from the level of specialization and division of labor distinctive of the modern market economy, the human capacity for a certain kind of abstraction, and the desire to be recognized by other participants in the market system. In answer to the second set of questions, and despite Hegel's own apparent ambivalence, I argue on his behalf that the endless expansion of needs represents an obstacle to the realization of freedom, and is on that ground a phenomenon to be condemned, for the following two reasons: First, the endless expansion of needs increases the influence or “pressure” of desire on the members of civil society that are subject to that expansion. Second, that expansion leads to widespread frustration, understood as the inability on the part of the members of civil society to ever fully realize their ends or satisfy their desires. I end by briefly considering two Hegelian solutions to the pernicious effects of the endless expansion of needs. (shrink)

This examination of gardens--particulary English gardens of the eighteenth century--offers possible links between garden design and the arts.

This article explores the philosophically neglected topic of artistic integrity, situated within the literature on personal or moral integrity more generally. It argues that artists lack artistic integrity if, in the process of creation, they place some other—competing, distracting, or corrupting—value over the value of the artwork itself, in a way that violates their own artistic standards. It also argues, however, that artistic integrity does not require adamant refusal to acknowledge or act upon commitments to values other than single‐minded devotion (...) to one's art. Artists of integrity need not be inflexible fanatics. They can seek to earn a living through their art, alter their vision of a work to reach an audience, evolve their artistic standards as they grow as artists, and balance the energy devoted to their art against energy devoted to family, friends, and self‐care; they can honor the demands of morality.
