Multi-stakeholder initiatives have become a vital part of the organizational landscape for corporate social responsibility. Recent debates have explored whether these initiatives represent opportunities for the “democratization” of transnational corporations, facilitating civic participation in the extension of corporate responsibility, or whether they constitute new arenas for the expansion of corporate influence and the private capture of regulatory power. In this article, we explore the political dynamics of these new governance initiatives by presenting an in-depth case study of an organization often (...) heralded as a model MSI: the Forest Stewardship Council. An effort to address global deforestation in the wake of failed efforts to agree a multilateral convention on forests at the Rio Summit in 1992, the FSC was launched in 1993 as a non-state regulatory experiment: a transnational MSI, administering a global eco-labeling scheme for timber and forest products. We trace the scheme’s evolution over the past two decades, showing that while the FSC has successfully facilitated multi-sectoral determination of new standards for forestry, it has nevertheless failed to transform commercial forestry practices or stem the tide of tropical deforestation. Applying a neo-Gramscian analysis to the organizational evolution of the FSC, we examine how broader market forces and resource imbalances between non-governmental and market actors can serve to limit the effectiveness of MSIs in the current neo-liberal environment. This presents dilemmas for NGOs which can lead to their defection, ultimately undermining the organizational legitimacy of MSIs. (shrink)

Human beings are the only creatures known to engage in sport. We are sporting animals, and our favourite pastime of football is the biggest sport spectacle on earth. The Philosophy of Footballpresents the first sustained, in-depth philosophical investigation of the phenomenon of football. In explaining the complex nature of football, the book draws on literature in sociology, history, psychology and beyond, offering real-life examples of footballing actions alongside illuminating thought experiments. We develop an extension of the familiar linear mixed logit model to allow for the direct estimation of parametric non-linear functions defined over structural parameters. Classic applications include the estimation of coefficients of utility functions to characterize risk attitudes and discounting functions to characterize impatience. There are several unexpected benefits of this extension, apart from the ability to directly estimate structural parameters of theoretical interest.

Connecting human minds to various technological devices and applications through brain-computer interfaces (BCIs) affords intriguingly novel ways for humans to engage and interact with the world. Not only do BCIs play an important role in restorative medicine, they are also increasingly used outside of medical or therapeutic contexts (e.g., gaming or mental state monitoring). A striking peculiarity of BCI technology is that the kind of actions it enables seems to differ from paradigmatic human actions, because, effects in the world are (...) brought about by devices such as robotic arms, prosthesis, or other machines, and their execution runs through a computer directed by brain signals. In contrast to usual forms of action, the sequence does not need to involve bodily or muscle movements at all. A motionless body, the epitome of inaction, might be acting. How do theories of action relate to such BCI-mediated forms of changing the world? We wish to explore this question through the lenses of three perspectives on agency: subjective experience of agency, philosophical action theory, and legal concepts of action. Our analysis pursues three aims: First, we shall discuss whether and which BCI-mediated events qualify as actions, according to the main concepts of action in philosophy and law. Secondly, en passant, we wish to highlight the ten most interesting novelties or peculiarities of BCI-mediated movements. Thirdly, we seek to explore whether these novel forms of movement may have consequences for concepts of agency. More concretely, we think that convincing assessments of BCI-movements require more fine-grained accounts of agency and a distinction between various forms of control during movements. In addition, we show that the disembodied nature of BCI-mediated events causes troubles for the standard legal account of actions as bodily movements. In an exchange with views from philosophy, we wish to propose that the law ought to reform its concept of action to include some, but not all, BCI-mediated events and sketch some of the wider implications this may have, especially for the venerable legal idea of the right to freedom of thought. In this regard, BCIs are an example of the way in which technological access to yet largely sealed-off domains of the person may necessitate adjusting normative boundaries between the personal and the social sphere. It is a constitutional demand for judges to be objective. Ethical codes show that objectivity depends on rules enabling individuals to counter their subjectivity. Yet these codes focus on judges’ general behaviour while methodology strives for objectivity in the judges’ core task of applying the law on a specific case. Various methods are examined whether they guarantee or at least contribute to an objective interpretation of the law within the existing margin of interpretation. Conscious application of methodology is elaborated upon (...) as a demand of a democratic state under the rule of law. While the principle of judicial independence already limits control of the external result of the adjudication process, it is almost impossible to control the internal process of applying the law that takes place only inside the judge’s head. Thus, it is up to each judge to ensure objectivity by internally binding themselves to a conscious application of methods - therefore constituting an ethical demand. (shrink)

The “Freedom Agenda” of President George W. Bush for the Middle East assumed that the liberation of Iraq from the dictatorship of Saddam Hussein and the start of political change would trigger the process of democratization of the entire region. Encouraged by financial and economic support, Arab countries should have been willing to implement political and educational support, which would lead to the creation of civil society and grassroots political changes initiated by society itself. A number of mistakes made by (...) the Bush administration in Iraq has not only caused the mission of the democratization of Iraq to be a failure, but also influenced the situation that today Iraq is closer to being a failed state than a democracy. To commemorate 40 years since the founding of the Journal of Business Ethics, the editors in chief of the journal have invited the editors to provide commentaries on the future of business ethics. This essay comprises a selection of commentaries aimed at creating dialogue around the theme Ethics at the centre of global and local challenges. For much of the history of the Journal of Business Ethics, ethics was seen within the academy as a peripheral aspect of business. However, in (...) recent years, the stakes have risen dramatically, with global and local worlds destabilized by financial crisis, climate change, internet technologies and artificial intelligence, and global health crises. The authors of these commentaries address these grand challenges by placing business ethics at their centre. What if all grand challenges were framed as grand ethical challenges? Tanusree Jain, Arno Kourula and Suhaib Riaz posit that an ethical lens allows for a humble response, in which those with greater capacity take greater responsibility but remain inclusive and cognizant of different voices and experiences. Focussing on business ethics in connection to the grand challenge of environmental emergencies, Steffen Böhm introduces the deceptively simple yet radical position that business is nature, and nature is business. His quick but profound side-step from arguments against human–nature dualism to an ontological undoing of the business–nature dichotomy should have all business ethics scholars rethinking their “business and society” assumptions. Also, singularly concerned with the climate emergency, Boudewijn de Bruin posits a scenario where, 40 years from now, our field will be evaluated by its ability to have helped humanity emerge from this emergency. He contends that Milieudefensie v. Royal Dutch Shell illustrates how human rights take centre stage in climate change litigation, and how business ethics enters the courtroom. From a consumer ethics perspective, Deirdre Shaw, Michal Carrington and Louise Hassan argue that ecologically sustainable and socially just marketplace systems demand cultural change, a reconsideration of future interpretations of “consumer society”, a challenge to the dominant “growth logic” and stimulation of alternative ways to address our consumption needs. Still concerned with global issues, but turning attention to social inequalities, Nelarine Cornelius links the capability approach to global and corporate governance, arguing that CA will continue to lie at the foundation of human development policy, and, increasingly, CSR and corporate governance. Continuing debate on the grand challenges associated with justice and equality, Laurence Romani identifies a significant shift in the centrality of business ethics in debates on managing differences, positing that dialogue between diversity management and international management can ground future debate in business ethics. Finally, the essay concludes with a commentary by Charlotte Karam and Michelle Greenwood on the possibilities of feminist-inspired theories, methods, and positionality for many spheres of business ethics, not least stakeholder theory, to broaden and deepen its capacity for nuance, responsiveness, and transformation. In the words of our commentators, grand challenges must be addressed urgently, and the Journal of Business Ethics should be at the forefront of tackling them. (shrink)

Bayesian approaches for estimating multilevel latent variable models can be beneficial in small samples. Prior distributions can be used to overcome small sample problems, for example, when priors that increase the accuracy of estimation are chosen. This article discusses two different but not mutually exclusive approaches for specifying priors. Both approaches aim at stabilizing estimators in such a way that the Mean Squared Error of the estimator of the between-group slope will be small. In the first approach, the MSE is (...) decreased by specifying a slightly informative prior for the group-level variance of the predictor variable, whereas in the second approach, the decrease is achieved directly by using a slightly informative prior for the slope. Mathematical and graphical inspections suggest that both approaches can be effective for reducing the MSE in small samples, thus rendering them attractive in these situations. Using 2015 International Social Survey Program (ISSP) data on 38,179 individuals from 36 countries in 9 relatively homogeneous global regions, we analyze the gender differences and the gender gap in perceived workplace harassment (PWH) with particular attention to gender equality's and gender egalitarianism's roles in molding these differences. We find that despite large regional differences, women in most countries are more likely than men to perceive workplace harassment, although this likelihood is higher in countries that score favorably on our gender (...) equality measures. Hence, political empowerment and better economic opportunities alter women's perceptions of workplace harassment, increasing the probability of their experiencing it. Our results also underscore the important roles of values and gender egalitarian practices. Whereas enhanced gender egalitarianism values increase women's perceptions of workplace harassment, concrete practices tend to reduce them. Especially for management, this result highlights the importance of actually implementing gender equality policies at a corporate level, because a discrepancy between corporate values and practices on this issue will only accentuate the perception of harassment. We propose a method for estimating subjective beliefs, viewed as a subjective probability distribution. The key insight is to characterize beliefs as a parameter to be estimated from observed choices in a well-defined experimental task and to estimate that parameter as a random coefficient. The experimental task consists of a series of standard lottery choices in which the subject is assumed to use conventional risk attitudes to select one lottery or the other and then a series of betting choices in (...) which the subject is presented with a range of bookies offering odds on the outcome of some event that the subject has a belief over. Knowledge of the risk attitudes of subjects conditions the inferences about subjective beliefs. Maximum simulated likelihood methods are used to estimate a structural model in which subjects employ subjective beliefs to make bets. We present evidence that some subjective probabilities are indeed best characterized as probability distributions with non-zero variance. (shrink)

W pierwszej części zostało nakreślone pojmowanie fenomenu w horyzoncie pytania o Heideggerowskie Sein i Sartre’owskie être. Z kolei część druga umieszcza w tym samym horyzoncie zagadnienia istoty i szeroko ujmowanej zrozumiałości. W toku analiz w projekcie francuskiego filozofa została wyodrębniona sfera fenomenalna i metafizyczna, które następnie są zestawione z poziomem ontycznym i ontologicznym, obszarami, które wyłaniają się w myśli niemieckiego fenomenologa dzięki wypracowaniu różnicy (...) ontologicznej. Wniosek, który płynie z prezentowanego artykułu, zamyka się w konstatacji, że rdzeniem rzeczywistości pozostaje dla Sartre’a absurdalny, lokujący się poza fenomenem i zrozumiałością (oraz całkowicie od nich niezależny) metafizyczny grunt, podczas gdy według Heideggera jądro rzeczywistości stanowi pre-fenomenalne (nie poza-fenomenalne) źródło sensu, „będące” i dziejące się tylko poprzez dynamikę fenomenu i zrozumiałości. Celem tego artykułu jest analiza powiązań jakie zachodzą pomiędzy fenomenami metodyczności i etyczności we wczesnej filozofii Martina Heideggera. Nie pojmuje się tu ani metody jako procedury badawczej prowadzącej do określonych rezultatów, ani etyki jako odrębnej dyscypliny filozoficznej posiadająca własne pole przedmiotowe. Chodzi o dwa wymiary bycia, które wzajemnie się implikują. Na początku badana jest fenomenologia jako sposób pytania o bycie, a następnie zostaje wydobyty metodyczny sens postępowania, które Heidegger określa mianem formalnego wskazywania. W rezultacie metodyczność zostaje odsłonięta jako droga prowadząca (...) do bycia jako źródła sensu, droga, którą zapewnia samo to bycie. W dalszej kolejności analizowany jest fenomen filozofowania, który Heidegger interpretuje jako wyraźne transcendowanie. Transcendowanie to ostatecznie okazuje się wolnością, której fundamentalny charakter stanowi pozwolić-być, kładące jednocześnie fundament pod odpowiedzialność. Odpowiedzialność zaś jest odpowiedzią udzielaną na wezwanie bycia i przyjmuje postać (zobo)wiązania Dasein wobec bytu, któremu pozwoliło ono być. Etyczność odsłania się tym samym jako domaganie się takiej odpowiedzi na wezwanie bycia, która sprosta ciężarowi jego przesłania. W tym miejscu na jaw wychodzi spotkanie etyczności z metodycznością – ta ostatnia jest drogą do otwartości bycia zapewnioną przez samą tę otwartość, by postulat etyczności mógł zostać spełniony. Oznacza to, że etyczność domaga się metodyczności, a metodyczność (a wraz z nią filozofowanie) niesie ze sobą konsekwencje etyczne dla rozumienia bycia i bytu. Our outline points out three aspects of a new post-modern methodology in psychology: liberal, pluralistic, and more tolerant: liberal because it rejects rules that are too strict in favor of more freedom in the choice of method, pluralistic because it conveys an “almost anything goes” attitude toward methods, and more tolerant because mutual tolerance among researchers is vital for a pluralism of methods. Psychological phenomena are complex and can best be understood by using different methods. However, to get things working, (...) tolerance must actively be lived. Of course, much depends on our own willingness as researchers but also on the system’s arrangements. Psychology could be more colorful, and we could all have more fun if we were to be more committed to such a methodology. (shrink)

In this discussion paper, I seek to challenge Hylarie Kochiras’ recent claims on Newton’s attitude towards action at a distance, which will be presented in Section 1. In doing so, I shall include the positions of Andrew Janiak and John Henry in my discussion and present my own tackle on the matter . Additionally, I seek to strengthen Kochiras’ argument that Newton sought to explain the cause of gravity in terms of secondary causation . I also provide some specification on (...) what Kochiras calls ‘Newton’s substance counting problem’ . Der Band diskutiert ausgewählte Positionen der Theoriebildung Ernesto Laclaus, die in den letzten Jahren im Kontext demokratietheoretischer Debatten zwar in politik-, kultur- und sozialwissenschaftlichen Feldern rezipiert wurde, deren Aufnahme in erziehungswissenschaftlichen Debatten aber eher als 'handverlesen' bezeichnet werden könnte. Die Rezeption beschränkt sich häufig auf spezifische Einsätze rund um die gemeinsam mit Chantal Mouffe in Hegemonie und radikale Demokratie entwickelte und an Antonio Gramsci ansetzende Hegemonietheorie. We exhibit a finite lattice without critical triple that cannot be embedded into the enumerable Turing degrees. Our method promises to lead to a full characterization of the finite lattices embeddable into the enumerable Turing degrees.

In this paper, I argue that machines can create works of art. My argument is based on an analysis of the so-called creative machines and focuses on technical functions and intentions. If my proposal is correct, then creative machines are technical artifacts with the proper function to bring about works of art. My account is based on sensible conceptual connections between makers, technical artifacts, intentions, and the creation of art. One upshot of the account presented here is that we do (...) not need a new conceptual framework or dubious assumptions about artistic agency on part of machines in order to arrive at the conclusion that creative machines make art. I will conclude the paper with some remarks regarding the artistic value of items produced by creative machines. (shrink)

People share their emotions on social media and evidence suggests that in times of crisis people are especially motivated to post emotional content. The current Coronavirus pandemic is such a crisis. The online sharing of emotional content during the Coronavirus crisis may contribute to societal value change. Emotion sharing via social media could lead to emotional contagion which in turn could facilitate an emotional climate in a society. In turn, the emotional climate of a society can influence society’s value structure. (...) The emotions that spread in the current Coronavirus crisis are predominantly negative, which could result in a negative emotional climate. Based on the dynamic relations of values to each other and the way that emotions relate to values, a negative emotional climate can contribute to societal value change towards values related to security preservation and threat avoidance. As a consequence, a negative emotional climate and the shift in values could lead to a change in political attitudes that has implications for rights, freedom, privacy and moral progress. Considering the impact of social media in terms of emotional contagion and a longer-lasting value change is an important perspective in thinking about the ethical long-term impact of social media technology. Aesthetics is today widely seen as the philosophy of art and/or beauty, limited to artworks and their perception. In this paper, I will argue that today's aesthetics and the original programme developed by the German Enlightenment thinker Alexander Gottlieb Baumgarten in the first half of the eighteenth century have only the name in common. Baumgarten did not primarily develop his aesthetics as a philosophy of art. The making and understanding of artworks had served in his original programme only as an (...) example for the application of his philosophy. What he really attempts to present is an alternative philosophy of knowledge that goes beyond the purely rationalist, empiricist, and sensualist approaches. In short, Baumgarten transcends the old opposition between rationalism and sensualism. His core theme is the improvement (perfectio) of human knowledge and cognition and the ways to reach this goal. The study of Baumgarten's foundational works on aesthetics should not be undertaken merely out of antiquarian interest. I will argue, instead, that Baumgarten's importance and contemporary relevance lies in this: that his Aesthetica may serve as a profound contribution to the philosophy of the cultural sciences and humanities. Revisiting Baumgarten's original idea of aesthetics will lead us to a more inclusive concept of that philosophical discipline. (shrink)

In this essay, I attempt to assess Henk de Regt and Dennis Dieks recent pragmatic and contextual account of scientific understanding on the basis of an important historical case-study: understanding in Newton’s theory of universal gravitation and Huygens’ reception of universal gravitation. It will be shown that de Regt and Dieks’ Criterion for the Intelligibility of a Theory (CIT), which stipulates that the appropriate combination of scientists’ skills and intelligibility-enhancing theoretical virtues is a condition for scientific understanding, is too strong. On the basis of this case-study, it will be shown that scientists can understand each others’ positions qualitatively and quantitatively, despite their endorsement of different worldviews and despite their convictions as what counts as a proper explanation. Unlike conceptual analysis, conceptual engineering does not aim to identify the content that our current concepts do have, but the content which these concepts should have. For this method to show the results that its practitioners typically aim for, being able to change meanings seems to be a crucial presupposition. However, certain branches of semantic externalism raise doubts about whether this presupposition can be met. To the extent that meanings are determined by external factors such as causal histories or microphysical (...) structures, it seems that they cannot be changed intentionally. This paper gives an extended discussion of this ‘externalist challenge’. Pace Herman Cappelen’s recent take on this issue, it argues that the viability of conceptual engineering crucially depends on our ability to bring about meaning change. Furthermore, it argues that, contrary to first appearance, causal theories of reference do allow for a sufficient degree of meaning control. To this purpose, it argues that there is a sense of what is called ‘collective long-range control’, and that popular versions of the causal theory of reference imply that people have this kind of control over meanings. In this paper I argue against a criticism by Matthew Weiner to Grice’s thesis that cancellability is a necessary condition for conversational implicature. I argue that the purported counterexamples fail because the supposed failed cancellation in the cases Weiner presents is not meant as a cancellation but as a reinforcement of the implicature. I moreover point out that there are special situations in which the supposed cancellation may really work as a cancellation.

R. Suszko’s Sentential Calculus with Identity \( SCI \) results from classical propositional calculus \( CPC \) by adding a new connective \(\equiv \) and axioms for identity \(\varphi \equiv \psi \) (which we interpret here as ‘propositional identity’). We reformulate the original semantics of \( SCI \) using Boolean prealgebras which, introduced in different ways, are known in the literature as structures for the modeling of (hyper-) intensional semantics. We regard intensionality here as a measure for the discernibility of (...) propositions (and hyperintensionality as a high degree of intensionality). As concrete examples of \( SCI \) -based intensional modeling, we review and study algebraic semantics of some Lewis-style modal logics in the vicinity of \( S3 \) and present conditions under which those modal systems can be restored, in a precise sense, as certain axiomatic extensions of \( SCI \). This generalizes work of Suszko which is focused on the modal systems \( S4 \) and \( S5 \). Our approach is particularly intended as a proposal to consider and to further study \( SCI \) (and its extensions) as a general framework for the modeling of (hyper-) intensional semantics. Zusammenfassung In dem Beitrag wird untersucht, wie Trainer im Spitzensport mit Konflikten umgehen und wie sie versuchen, diese strategisch, das heißt in Orientierung am übergeordneten Ziel des sportlichen Erfolgs, zu regulieren. Ausgehend von der systemtheoretischen Konflikttheorie Messmers, der Sach-, Beziehungs- und Machtkonflikte unterscheidet, werden auf der Basis empirischer Daten, die Video- und Audioaufzeichnungen unterschiedlicher Trainings- und Wettkampfkommunikationen sowie Interviews mit Trainern und Spielern umfassen, authentische Konfliktbeispiele aus den Sportarten Handball und Hockey analysiert. Die Ergebnisse dieser Analysen münden in Empfehlungen an (...) Trainer zur effektiven Regulierung von Konflikten. (shrink)

Die Beiträge aus den unterschiedlichsten Wissenschaftsdisziplinen zeigen, dass Ideologien von jeher Wahrheitsansprüche formulierten, die im Verlauf ihrer Wirkungsgeschichte entweder als Irrtümer buchstäblich "Lügen gestraft" wurden oder von zeitgenössischen ideologischen Gegenentwürfen als solche bezeichnet wurden.

It is often suggested that social media is a hostile environment for critical thinking and that a major source for epistemic problems concerning social media is that it facilitates emotions. We argue that emotions per se are not the source of the epistemic problems concerning social media. We propose that instead of focusing on emotions, we should focus on the affective scaffolding of social media. We will show that some affective scaffolds enable desirable epistemic practices, while others obstruct beneficial epistemic (...) practices, or enable hostile epistemic practices. Particularly, we will show that emotions play a crucial role in the epistemic practice of critical thinking and that the affective scaffolding of social media can support, or hinder, online critical thinking. This commentary draws critical attention to the ongoing commodification of trust in policy and scholarly discourses of artificial intelligence (AI) and society. Based on an assessment of publications discussing the implementation of AI in governmental and private services, our findings indicate that this discursive trend towards commodification is driven by the need for a trusting population of service users to harvest data at scale and leads to the discursive construction of trust as an essential good on a par with data (...) as raw material. This discursive commodification is marked by a decreasing emphasis on trust understood as the expected reliability of a trusted agent, and increased emphasis on instrumental and extractive framings of trust as a resource. This tendency, we argue, does an ultimate disservice to developers, users, and systems alike, insofar as it obscures the subtle mechanisms through which trust in AI systems might be built, making it less likely that it will be.
