Ethical approval must be obtained before medical research can start. We describe the differences in EA for an pseudonymous, non-interventional, observational European study. Sixteen European national coordinators of the international study on very old intensive care patients answered an online questionnaire concerning their experience getting EA. N = 8/16 of the NCs could apply at one single national ethical committee, while the others had to apply to various regional ECs and/or individual hospital institutional research boards. The time between applying for (...) EA and the first decision varied between 7 days and 300 days. In 9/16 informed consent from the patient was not deemed necessary; in 7/16 informed consent was required from the patient or relatives. The upload of coded data to a central database required additional information in 14/16. In 4/16 the NCs had to ask separate approval to keep a subject identification code list to de-pseudonymize the patients if questions would occur. Only 2/16 of the NCs agreed that informed consent was necessary for this observational study. Overall, 6/16 of the NCs were satisfied with the entire process and 8/16 were unsatisfied. 11/16 would welcome a European central EC that would judge observational studies for all European countries. Variations in the process and prolonged time needed to get EA for observational studies hampers inclusion of patients in some European countries. This might have a negative influence on the external validity. Further harmonization of ethical approval process across Europe is welcomed for low-risk observational studies. Die Verfasserin (Verf.) hat sich bestens in die internationale Literatur zu den aus einer Sprache A stammenden, in eine oder mehrere andere Sprachen (B, evtl. C usw.) entlehnten und schließlich in (...) ein jüngeres Stadium von A zurückentlehnten Wörter eingearbeitet: Ihre Literaturliste (S. 265–273) umfasst nicht weniger als 146 griech., engl., französ., italien., deutsche und türk. Titel. Das Thema ist für das Gesamtgriechische von besonderem Interesse, da während seiner so besonders langen und gut dokumentierten Existenz naturgemäß eine erkleckliche Zahl von Lexemen zurückgewandert sind, offensichtlich mehr als in jede andere Sprache Europas. So hat denn die Verf. nach eigener Angabe 170, realiter ca. 200 solche RW zusammengestellt und deren Geschichte meist ausführlich und überzeugend dokumentiert und damit ein Kapitel neugriechischer Etymologie geschrieben. Sinnvollerweise hat sie dabei auf eine Behandlung der immer uferloser werdenden gräkogenen Internationalismen in Technik und Wissenschaften verzichtet und sich auf das Alltagsvokabular beschränkt. It is often presumed that the laws of nature have special significance for scientific reasoning. But the laws' distinctive roles have proven notoriously difficult to identify--leading some philosophers to question if they hold such roles at all. This study offers original accounts of the roles that natural laws play in connection with counterfactual conditionals, inductive projections, and scientific explanations, and of what the laws must be in order for them to be capable of playing these roles. Humean accounts of natural lawhood have often been criticized as unable to account for the laws’ characteristic explanatory power in science. Loewer has replied that these criticisms fail to distinguish grounding explanations from scientific explanations. Lange has replied by arguing that grounding explanations and scientific explanations are linked by a transitivity principle, which can be used to argue that Humean accounts of natural law violate the prohibition on self-explanation. Lange’s argument has been sharply criticized by Hicks and van (...) Elswyk, Marshall, and Miller. This paper shows how Lange’s argument can withstand these criticisms once the transitivity principle and the prohibition on self-explanation are properly refined. The transitivity principle should be refined to accommodate contrasts in the explanans and explanandum. The prohibition on self-explanation should be refined so that it precludes a given fact p from helping to explain why some other fact q helps to explain why p. In this way, the transitivity principle avoids having counterintuitive consequences in cases involving macrostates having multiple possible microrealizations. The transitivity principle is perfectly compatible with the irreducibility of macroexplanations to microexplanations and with the diversity of the relations that can underwrite scientific explanations. The institution of the family and its importance have recently received considerable attention from political theorists. Leading views maintain that the institution’s justification is grounded, at least in part, in the non-instrumental value of the parent-child relationship itself. Such views face the challenge of identifying a specific good in the parent-child relationship that can account for how adults acquire parental rights over a particular child—as opposed to general parental rights, which need not warrant a claim to parent one’s biological progeny. (...) I develop a view that meets this challenge. This Project View identifies the pursuit of a parental project as a distinctive non-instrumentally valuable good that provides a justification for the family and whose pursuit is necessary and sufficient for the acquisition of parental rights. This view grounds moral parenthood in a normative relation as opposed to a biological one, supports polyadic forms of parenting, and provides plausible guidance in cases of assisted reproduction. It has often been argued that Humean accounts of natural law cannot account for the role played by laws in scientific explanations. Loewer (Philosophical Studies 2012) has offered a new reply to this argument on behalf of Humean accounts—a reply that distinguishes between grounding (which Loewer portrays as underwriting a kind of metaphysical explanation) and scientific explanation. I will argue that Loewer’s reply fails because it cannot accommodate the relation between metaphysical and scientific explanation. This relation also resolves a puzzle (...) about scientific explanation that Hempel and Oppenheim (Philosophy of Science 15:135–75, 1948) encountered. (shrink)

Unlike explanation in science, explanation in mathematics has received relatively scant attention from philosophers. Whereas there are canonical examples of scientific explanations, there are few examples that have become widely accepted as exhibiting the distinction between mathematical proofs that explain why some mathematical theorem holds and proofs that merely prove that the theorem holds without revealing the reason why it holds. This essay offers some examples of proofs that mathematicians have considered explanatory, and it argues that these examples suggest a (...) particular account of explanation in mathematics. The essay compares its account to Steiner's and Kitcher's. Among the topics that arise are proofs that exploit symmetries, mathematical coincidences, brute-force proofs, simplicity in mathematics, merely clever proofs, and proofs that unify what other proofs treat as separate cases. Many philosophers argue that explanatoriness plays no special role in confirmation – that “inference to the best explanation” (IBE) incorrectly demands giving hypotheses extra credit for their potential explanatory qualities beyond the credit they already deserve for their predictive successes. This paper argues against one common strategy for responding to this thought – that is, for trying to fit IBE within a Bayesian framework. That strategy argues that a hypothesis’ explanatory quality (its “loveliness”) contributes either to its prior probability or (...) to its likelihood. This paper argues that this strategy fails because it must give different treatments to two hypotheses that are unlovely for the very same reason. The strategy therefore loses the insight into scientific reasoning that its reconstruction in terms of IBE is supposed to provide. The paper then provides a Bayesian account of the confirmatory role of explanatoriness that represents explanatory quality as having an impact in the same place for two hypotheses that are unlovely for the very same reason. This approach works by “putting explanation back into IBE” – that is, by invoking hypotheses that refer explicitly to scientific explanation and by invoking the agent's background opinions regarding the kind of explanation that the evidence is liable to have. On this approach, there is no list of “explanatory virtues” the possession of which always helps to make an explanation better. Rather, for different facts, there are different characteristics that our background knowledge of other explanations gives us some reason to expect the given fact's explanation to possess. (shrink)

Many philosophers endorse the Transparency Thesis, the claim that by introspection one cannot become aware of one's experience. Recently, some authors have suggested that the Transparency Thesis is challenged by introspective states reached under mindfulness. We label this the Mindfulness Opacity Hypothesis. The present paper develops the hypothesis in important new ways. First, we motivate the hypothesis by drawing on recent clinical psychology and cognitive science of mindfulness. Secondly, we develop the hypothesis by describing the implied shift in experiential perspective, (...) the scope of introspectable qualities, and the level of skill. Thirdly, we defend the hypothesis against various philosophical arguments. We conclude that the Mindfulness Opacity Hypothesis is empirically and theoretically well motivated and supported. (shrink)

Partiality is the special concern that we display for ourselves and other people with whom we stand in some special personal relationship. It is a central theme in moral philosophy, both ancient and modern. Questions about the justification of partiality arise in the context of enquiry into several moral topics, including the good life and the role in it of our personal commitments; the demands of impartial morality, equality, and other moral ideals; and commonsense ideas about supererogation. This paper provides (...) an overview of the debate on the ethics of partiality through the lens of the domains of permissible and required partiality. After outlining the conceptual space, I first discuss agent-centred moral options that concern permissions not to do what would be impartially optimal. I then focus on required partiality, which concerns associative duties that go beyond our general duties to others and require us to give special priority to people who are close to us. I discuss some notable features of associative duties and the two main objections that have been raised against them: the Voluntarist and the Distributive objections. I then turn to the justification of partiality, focusing on underivative approaches and reasons-based frameworks. I discuss the reductionism and non-reductionism debate: the question whether partiality is derivative or fundamental. I survey arguments for ‘the big three’, according to which partiality is justified by appeal to the special value of either projects, personal relationships, or individuals. I conclude by discussing four newly emerging areas in the debate: normative transitions of various personal relationships, relationships with AI, epistemic partiality, and negative partiality, which concerns the negative analogue of our positive personal relationships. Hempel and Giere contend that the existence of provisos poses grave difficulties for any regularity account of physical law. However, Hempel and Giere rely upon a mistaken conception of the way in which statements acquire their content. By correcting this mistake, I remove the problem Hempel and Giere identify but reveal a different problem that provisos pose for a regularity account — indeed, for any account of physical law according to which the state of affairs described by a law-statement presupposes (...) a Humean regularity. These considerations suggest a normative analysis of law-statements. On this view, law-statements are not distinguished from accidental generalizations by the kind of Humean regularities they describe because a law-statement need not describe any Humean regularity. Rather, a law-statement says that in certain contexts, one ought to regard the assertion of a given type of claim, if made with justification, as a proper way to justify a claim of a certain other kind. We propose a ‘Moral Imagination’ methodology to facilitate a culture of responsible innovation for engineering and product teams in technology companies. Our approach has been operationalized over the past two years at Google, where we have conducted over 50 workshops with teams from across the organization. We argue that our approach is a crucial complement to existing formal and informal initiatives for fostering a culture of ethical awareness, deliberation, and decision-making in technology design such as company principles, ethics and privacy (...) review procedures, and compliance controls. We characterize some distinctive benefits of our methodology for the technology sector in particular. (shrink)

Fine and Rosen have argued that normative necessity is distinct from and weaker than metaphysical necessity. The first aim of this paper is to specify what it would take for this view to be true—that is, what normative necessity would have to be like. The author argues that in order for normative necessity to be weaker than metaphysical necessity, the metaphysical necessities must all be preserved under every counterfactual antecedent with which they are all collectively logically consistent—even when their preservation (...) requires that a normative necessity fail to be preserved. By exhibiting some examples that fail to display this pattern of counterfactual invariance, the author argues against the view that normative necessity is weaker than metaphysical necessity. This paper examines some recent attempts that use counterfactuals to understand the asymmetry of non-causal scientific explanations. These attempts recognize that even when there is explanatory asymmetry, there may be symmetry in counterfactual dependence. Therefore, something more than mere counterfactual dependence is needed to account for explanatory asymmetry. Whether that further ingredient, even if applicable to causal explanation, can fit non-causal explanation is the challenge that explanatory asymmetry poses for counterfactual accounts of non-causal explanation. Recently, biologists and computer scientists who advocate the "strong thesis of artificial life" have argued that the distinction between life and nonlife is important and that certain computer software entities could be alive in the same sense as biological entities. These arguments have been challenged by Sober (1991). I address some of the questions about the rational reconstruction of biology that are suggested by these arguments: What is the relation between life and the "signs of life"? What work (if any) (...) might the concept of "life" (over and above the "signs of life") perform in biology? What turns on scientific disputes over the utility of this concept? To defend my answers to these questions, I compare "life" to certain other concepts used in science, and I examine historical episodes in which an entity's vitality was invoked to explain certain phenomena. I try to understand how these explanations could be illuminating even though they are not accompanied by any reductive definition of "life.". (shrink)

Why do forces compose according to the parallelogram of forces? This question has been controversial; it is one episode in a longstanding, fundamental dispute regarding which facts are not to be explained dynamically. If the parallelogram law is explained statically, then the laws of statics are separate from and “transcend” the laws of dynamics. Alternatively, if the parallelogram law is explained dynamically, then statical laws become mere corollaries to the dynamical laws. I shall attempt to trace the history of this (...) controversy in order to identify what it would be for one or the other of these rival views to be correct. I shall argue that various familiar accounts of natural law not only make it difficult to see what the point of this dispute could have been, but also improperly foreclose some serious scientific options. I will sketch an alternative account of laws that helps us to understand what this dispute was all about. (shrink)

Why do relationships of friendship and love support partiality, but not relationships of hatred or commitments of racism? Where does partiality end and why? I take the intuitive starting point that important cases of partiality are meaningful. I develop a view whereby meaning is understood in terms of transcending self-limitations in order to connect with things of external value. I then show how this view can be used to distinguish central cases of legitimate partiality from cases of illegitimate partiality and (...) how it puts pressure on the traditional way of thinking about partiality. Batterman and Rice offer an account of “minimal model explanations” and argue against “common features accounts” of those explanations. This paper offers some objections to their proposals and arguments. It argues that their proposal cannot account for the apparent explanatory asymmetry of minimal model explanations. It argues that their account threatens ultimately to collapse into a “common features account.” Finally, it argues against their motivation for thinking that an explanation appealing to “common features” would have to explain the common features’ (...) own prevalence. An increasing number of regulations propose the notion of ‘AI audits’ as an enforcement mechanism for achieving transparency and accountability for artificial intelligence (AI) systems. Despite some converging norms around various forms of AI auditing, auditing for the purpose of compliance and assurance currently have little to no agreed upon practices, procedures, taxonomies, and standards. We propose the ‘criterion audit’ as an operationalizable compliance and assurance external audit framework. We model elements of this approach after financial auditing practices, and argue (...) that AI audits should similarly provide assurance to their stakeholders about AI organizations’ ability to govern their algorithms in ways that mitigate harms and uphold human values. We discuss the necessary conditions for the criterion audit, and provide a procedural blueprint for performing an audit engagement in practice. We illustrate how this framework can be adapted to current regulations by deriving the criteria on which ‘bias audits’ for hiring algorithms can be performed, as required by the recently effective New York City Local Law 144 of 2021. We conclude by offering critical discussion on the benefits, inherent limitations, and implementation challenges of applying practices of the more mature financial auditing industry to AI auditing where robust guardrails against quality assurance issues are only starting to emerge. Our discussion as informed by experiences in performing these audits in practice highlights the critical role that an audit ecosystem plays in ensuring the effectiveness of such methodology. Existing discussions of partiality have primarily examined special personal relationships between family, friends, or co-nationals. The negative analogue of such relationships – for example, the relationship of enmity – has, by contrast, been largely neglected. This chapter explores this adverse relation in more detail and considers the special reasons generated by it. We suggest that enmity can involve justified negative partiality, allowing members to give less consideration to each other’s interests. We then consider whether the negative partiality of enmity can (...) be justified through projects or the value inherent in the relationship, following two influential views about the justification of positive partiality. We argue that both accounts of partiality can be conceptually extended to the negative analogue, but doing so brings into focus the problems with such accounts of the grounds of partiality. (shrink)

Roche and Sober have offered a new argument for the view that a hypothesis H is not confirmed by its capacity to explain some observation O. Their argument purports to work by showing that O screens H off from the fact that H would explain O. This paper offers several objections to this argument. Firstly, the screening-off test cannot identify whatever evidential contribution Hs explanatoriness may make. Secondly, that H would explain O may be logically necessary, eluding the screening-off test. (...) The concept of transliminality (''a hypothesized tendency for psychological material to cross thresholds into or out of consciousness'') was anticipated by William James (1902/1982), but it was only recently given an empirical definition by Thalbourne in terms of a 29-item Transliminality Scale. This article presents the 17-item Revised Transliminality Scale (or RTS) that corrects age and gender biases, is unidimensional by a Rasch criterion, and has a reliability of .82. The scale defines a probabilistic hierarchy of items that address magical (...) ideation, mystical experience, absorption, hyperaesthesia, manic experience, dream interpretation, and fantasy proneness. These findings validate the suggestions by James and Thalbourne that some mental phenomena share a common underlying dimension with selected sensory experiences (such being overwhelmed by smells, bright lights, sights, and sounds). Low scores on transliminality remain correlated with ''tough mindedness'' in on Cattell 16PF test, as well as ''self-control'' and ''rule consciousness,'' whereas high scores are associated with ''abstractedness'' and an ''openness to change'' on that test. An independent validation study confirmed the predictions implied by our definition of transliminality. Implications for test construction are discussed. (shrink)

This paper proposes an account of why proof is the only way to acquire knowledge of some mathematical proposition’s truth. Admittedly, non-deductive arguments for mathematical propositions can be strong and play important roles in mathematics. But this paper proposes a necessary condition for knowledge that can be satisfied by putative proofs (and proof sketches), as well as by non-deductive arguments in science, but not by non-deductive arguments from mathematical evidence. The necessary condition concerns whether we can justly expect that if (...) the mathematical proposition is actually false, despite the evidence for its truth, then this fact has an explanation. Among the niftiest arguments for scientific anti-realism is the ‘pessimistic induction’ (also sometimes called ‘the disastrous historical meta-induction’). Although various versions of this argument differ in their details (see, for example, Poincare 1952: 160, Putnam 1978: 25, and Laudan 1981), the argument generally begins by recalling the many scientific theories that posit unobservable entities and that at one time or another were widely accepted. The anti-realist then argues that when these old theories were accepted, the evidence for them was quite (...) persuasive – roughly as compelling as our current evidence is for our best scientific theories positing various unobservable entities. Nevertheless, the anti-realist argues, most of these old theories turned out to be incorrect in the unobservables they posited. Therefore, the anti-realist concludes that with regard to the theories we currently accept, we should believe that probably, most of them are likewise incorrect in the unobservable entities they posit. (This argument appeals to what our best current theories say about unobservables in order to show that the entities posited by some earlier theory are not real. So the argument takes the form of a reductio of the view that the apparent success of some scientific theory justifies our believing in its accuracy regarding unobservables.) Of course, this argument has been criticized on many grounds. Some have argued, for instance, that the scientific theories we currently accept are much better supported than were earlier scientific theories at the time they were accepted. The merits of David Lewis’s Best System Account of natural law are frequently debated. But to my knowledge, the prospects for extending the BSA to cover meta-laws have never been examined. I shall identify two obstacles facing the most natural way of extending the BSA to cover meta-laws. The BSA’s fans should consider how these obstacles are to be overcome. Meta-laws are laws about laws. For example, Einstein’s special theory of relativity incorporates a meta-law: The content of the [special] relativity (...) theory can … be summarized in one sentence: all natural laws must be so conditioned that they are covariant with respect to Lorentz transformations. [The special theory of relativity] is not a theory in the usual sense but is better regarded as a second-level theory, or a theory of theories that constrains first-level theories. The principle of relativity is an example of a symmetry principle: a principle requiring that the first-order laws be unchanged under a given transformation. Long before Einstein proposed the principle of relativity, other spacetime symmetries were widely believed to be meta-laws: that the first-order laws are covariant under arbitrary spatial displacements, temporal displacements and spatial rotations. These spacetime symmetries require the laws to treat all spatial locations and directions alike and all moments alike. For instance, symmetry under temporal displacements rules out a fundamental force law specifying that a given force declines with the inverse-square of the distance before a given moment but with the inverse-cube of the distance at and after that moment. This article examines corporate social responsibility (CSR) through the lens of political ontology. We contend that CSR is not only a discursive mean of legitimization but an inherently ontological practice through which particular worlds become real. CSR enables the politics of place-making, connecting humans and nonhumans in specific territorial configurations in accordance with corporate needs and interests. We discuss three CSR mechanisms of singularization that create a particular corporate ontology in place: (1) community engagements that form ‘stakeholders’; (2) CSR standards (...) and certifications that produce singular sustainable environments; and (3) CSR reporting that erases ontological conflicts and enables the singularized representation (of the environment and the community) to travel to other locations of the corporate world. We argue that these ontological CSR practices obscure the pluriverse of other world and place-making practices that would create different kinds of sustainabilities based on less extractive and non-corporate ways of being in place. I here settle a recent dispute between two rival theories in distributive ethics: Restricted Prioritarianism and the Competing Claims View. Both views mandate that the distribution of benefits and burdens between individuals should be justifiable to each affected party in a way that depends on the strength of each individual’s separately assessed claim to receive a benefit. However, they disagree about what elements constitute the strength of those individuals’ claims. According to restricted prioritarianism, the strength of a claim is determined (...) in ‘prioritarian’ fashion by both what she stands to gain and her absolute level of well-being, while, according to the competing claims view, the strength of a claim is also partly determined by her level of well-being relative to others with conflicting interests. I argue that, suitably modified, the competing claims view is more plausible than restricted prioritarianism. (shrink)
