Linsky and Zalta try to explain how we can refer to mathematical objects by saying that this happens through definite descriptions which may appeal to mathematical theories. I present two issues for their account. First, there is a problem of finding appropriate pre-conditions to reference, which are currently difficult to satisfy. Second, there is a problem of ensuring the stability of the resulting reference. The psychoanalyical notion of the unconscious is often considered as being out of reach for phenomenological thinking. When Merleau-Ponty refl ects on it, he takes the unconscious as the realm, in bodily life, that being not yet conscious, is likely to become conscious. He formulates it in his Résumés de cours with the famous sentence “The unconscious is the sensing itself”. Lacan, facing this interpretation, explains that Merleau-Ponty fails to recongnize the essential discontinuity between consciousness and the unconscious. From that (...) criticism, it is possible to follow the reflection of Félix Guattari who develops, both alone and in collaboration with Gilles Deleuze, a conception of the “machinic unconscious”, a notion that can be read as an attempt to articulate the merleau-pontian and the lacanian approaches and to sketch out a theory of the becoming-subject. My aim in this paper, in speaking about “Merleau-Ponty Tomorrow”, consists therefore in appropriating some of his suggestions in this regard and to detect them in an unexpected context, thereby also noting the differences between them. Through this dialogue, I get to a position where it is possible to outline a critique of the contemporary “theory of the self”, which in myview is unaware of the fact that the self is always already caught in power relations. The article uses embodiment and the experiential basis of conceptual metaphor to argue for the metaphorical essence of abstract legal thought.concepts like ‘law’ and ‘justice’ need to borrow from a spatial, bodily, or physical prototype in order to be conceptualised, seen, for example, in the fact that justice preferably is found ‘under’ law. Three conceptual categories of how law is conceptualised is examined: law as an object, law as a vertical relation, and law as an area. The Google Ngram Viewer, (...) based on the massive library of books that Google has scanned, has been used to study legally relevant conceptions over time within each of these three categories, from 1800 to 2000. In addition, the article suggests a type of analytical method of ‘metaphor triangulation,’ that is, the replacement of prevailing metaphors with unusual ones in order to increase the level of awareness of what conceptual content the prevailing metaphors involve. Carl Schmitt verfügt heute über eine so breite und stets wachsende internationale Leserschaft wie kein anderer deutscher Staatsrechtslehrer des vergangenen Jahrhunderts. Sein Werk wird dabei freilich meist isoliert betrachtet und allenfalls auf den staatsrechtlichen Kontext bezogen. Im Mittelpunkt dieses Buches steht dagegen der politische Intellektuelle, der weit über die Grenzen seines Faches hinauswirkte. Besondere Aufmerksamkeit gilt dabei den Anfangs- und den Endjahren der Weimarer Republik. Während Schmitt in München Strategien zur Zähmung der Revolution entwickelte, setzte er sich in seinen Berliner (...) Jahren für eine autoritäre Transformation der Verfassung ein, die neben der äußersten Linken auch die äußerste Rechte von der Macht fernhalten sollte. Das geschah nicht nur in der Form der verfassungsrechtlichen Expertise für Regierungskreise, sondern auch durch publizistische Interventionen, bei denen der in Bonn gebildete Schülerkreis Schmitts eine tragende Rolle spielte. Zeitschriften wie Der Ring und das Deutsche Volkstum standen in der Endkrise der Weimarer Republik zeitweise vollständig unter dem Einfluß Schmittscher Ideen, und auch im breiteren Umfeld waren sie präsent, etwa in den Organen der Bündischen Jugend oder in der vielgelesenen Tat. Selbst Kritiker Schmitts konnten sich diesem Einfluß nicht entziehen, wie am Beispiel Otto Kirchheimers, Franz Neumanns, Ernst Fraenkels, Waldemar Gurians und anderer gezeigt wird. Gestützt auf nachgelassene Korrespondenzen und eine umfassende Auswertung der zeitgenössischen Publizistik gibt das Buch Aufschluß über Schmitts Netzwerk und seine politischen Strategien. (shrink)

Abstract: We are all familiar with the way in which social roles, such as mother, father, professor, club football coach, citizen, and so on, confront us with clusters of duties that purport to bind us. Though we generally experience these role-duties as normatively binding, we might question this. What reason do role-occupants have for conforming to the duties that define their roles? I argue that the agent who identifies with her role thereby has a weighty and important justificatory reason for (...) conforming to the role's defining duties: namely, the identifying agent realizes the fundamental goods of meaning and self-determination by doing so. This is an important normative ground of role-duties because it, unlike the grounds of natural duty or voluntary assumption, ensures that the duties it grounds are not alien impositions but rather are elements of the identifying agent's wellbeing. I also argue that role-identification provides a reason that shares many of the characteristics of a moral reason, and I argue that role-identification in tandem with the principle of fair play grounds a moral duty to conform to one's role-duties. There are several important criticisms against the unificationist model of scientific explanation: Unification is a broad and heterogeneous notion and it is hard to see how a model of explanation based exclusively on unification can make a distinction between genuine explanatory unification from cases of ordering or classification. Unification alone cannot solve the asymmetry and irrelevance problems. Unification and explanation pull in different directions and should be decoupled, because for good scientific explanation extra ad explanandum information is often required. I (...) am presenting a possible solution to those problems, by focusing on an often overlooked but important element of how theoretic unification is achieved—the conceptual frameworks of theories. The core conceptual assumptions behind theories are decisive for discriminating between explanatory and non-explanatory unification. The conceptual framework is also flexible enough to balance the tension between informativeness and maximum systematization in constructing explanatory inferences. A short case study of orthogenetic and Darwinian explanations in paleontology is presented as an illustration of how my addition to the unificationist model is applicable to a historical debate between rival explanations. This commentary on Dipesh Chakrabarty’s Climate of History initially frames the work in the context of the ongoing transdisciplinary project of creating synergies or more precisely “consilience” between the sciences and humanities. When this project is engaged in on the premises of the humanities (and the social sciences), we end up with the Earth system and the planetary as the basic lifeblood of human society—what foregrounds existence in common. Drawing on ethical and legal frameworks in the Netherlands, the United States and France, we examine whether physicians are expected to inform patients about potentially relevant opportunities for expanded access to investigational drugs. While we found no definitive legal obligation, we argue that physicians have a moral obligation to discuss opportunities for expanded access with patients who have run out of treatment options to prevent inequality, to promote autonomy, and to achieve beneficence.

A vernacular fifteenth-century sermon tells us, in order to warn of the threats to spiritual welfare posed by dance, that cyclic motion and centering of sensory impressions – amongst them intimate conversation – are essential elements of dance. When blending out the parenesis, implicit poetics of medieval dance can be distilled from that sermon. The way how these essential elements of dance are used for generating disruptions within literary plots will be demonstrated in three literary texts dating from the thirteenth (...) to the fifteenth century: Disruptions in connection with dance occur when contrary concepts of motion clash with each other, for example the linearity of the chivalrous way through the Other World with the cyclicity of round dances. ‚Der Württemberger‘, however, collides two contrary concepts of time which can be paraphrased as spatial metaphors, namely the linearity of earthly life which collides with the cyclicity of eternal damnation, a collision symbolized by the expulsion of life out of the dance of the death. Finally in ‚Ritter Sociabilis‘, dance generates a virtual space which subverts the courtly society. The protagonists of all these texts differently manage to resolve disruptions, namely by redemption, by repentance, or by continuing disruptions which they have caused themselves. (shrink)

I start from a relatively simple idea: the human being is constantly making a multiple experience of truth (once again, in reference to Gadamer's statement), both scientifical and technical, as well as religious or aesthetic. Still, what is the relationship between those experiences of truth? Can they express somehow, precisely by their multiplicity, a neutral ethos of today's man, or do they manage to take part in a larger and more elevated experience of truth? In the following paper I will (...) try to bring into focus precisely such issues. I return to the meaning given by Gadamer to the experience of truth. Then I make the distinction between the common sense and the proper sense of alternative. The later concerns the correlation - sometimes paradoxical - of different experiences of truth. For instance, the correlation between the technical and the religious experience. So one can understand that religious experience is above all an experience of human finitude. (shrink)

More than 50 years ago, Bongard introduced 100 visual concept learning problems as a challenge for artificial vision systems. These problems are now known as Bongard problems. Although they are well known in cognitive science and artificial intelligence, only very little progress has been made toward building systems that can solve a substantial subset of them. In the system presented here, visual features are extracted through image processing and then translated into a symbolic visual vocabulary. We introduce a formal language (...) that allows representing compositional visual concepts based on this vocabulary. Using this language and Bayesian inference, concepts can be induced from the examples that are provided in each problem. We find a reasonable agreement between the concepts with high posterior probability and the solutions formulated by Bongard himself for a subset of 35 problems. While this approach is far from solving Bongard problems like humans, it does considerably better than previous approaches. We discuss the issues we encountered while developing this system and their continuing relevance for understanding visual cognition. For instance, contrary to other concept learning problems, the examples are not random in Bongard problems; instead they are carefully chosen to ensure that the concept can be induced, and we found it helpful to take the resulting pragmatic constraints into account. Scientific progress is achieved not only by continuous accumulation of knowledge but also by paradigm shifts. These shifts are often necessitated by anomalous findings that cannot be incorporated in accepted models. Two important methodological principles regulate this process and complement each other: Ockham's Razor as the principle of parsimony and Plato's Life Boat as the principle of the necessity to 'save the appearances' and thus incorporate conflicting phenomenological data into theories. We review empirical data which are in conflict with some (...) presuppositions of accepted mainstream science: Clinical and experimental effects of prayer and healing intention, data from telepathy, psychokinesis experiments and precognition, and anecdotal reports of macro-psychokinesis. Taken together, the now well documented possibility of these events suggests that such phenomena are anomalies that challenge some widely held beliefs in mainstream science. On the other hand, scientists often fear that by accepting the reality of these phenomena they also have to subscribe to world-models invoking ontological dualism or idealism. We suggest accepting the phenomena as real, but without questionable ontologies commonly associated with them. We outline how this might work. (shrink)

The author of 'Betrachtungen eines Unpolitischen' (1918) is usually regarded as one of the founding fathers of the so-called 'Conservative Revolution'. But Thomas Mann's understanding of this concept does not at all coincide with the definition established by Armin Mohler, mainly in that it is not Nietzschean. Nor do the ties with the George circle furnish grounds for assigning Mann to the 'Conservative Revol ution', any more than to the 'aesthetic fundamentalism' which was cul tivated there. Moreover, it can be (...) shown that Mann's political views differ significantly from the 'new nationalism' propagated in the circle around Arthur Moeller van den Bruck, and that they have more affini ties to old liberalism than to a 'Conservative Revolution'. This essay analyzes the tensions that the rise of “Nordic racism” associated with Hans F. K. Günther triggered within the völkisch movement in the 1920s. Using the examples of the “Deutschbund,” the völkisch wing of the German youth movement “Bündische Jugend” and the German Aristocrats' Association “Deutsche Adelsgenossenschaft,” this essay shows that the reception of the Nordic idea was partially based on misunderstandings and distortions but was also met with open disagreement.

We present the negative phenomena of understanding in relation to scientific explanations. We begin by formulating the distinction between genuine understanding and lack of understanding, to define the epistemic category of misunderstanding. We illustrate misunderstanding with a short meta-philosophical study on the current debates about distinctively mathematical explanations.
