Equal Justice explores the role of the idea of equality in liberal theories of justice. The title indicates the book’s two-part thesis: first, I claim that justice is the central moral category in the socio-political domain; second, I argue for a specific conceptual and normative connection between the ideas of justice and equality. This pertains to the age-old question concerning the normative significance of equality in a theory of justice. The book develops an independent, systematic, and comprehensive theory of equality (...) and egalitarianism. The principal question is about the importance of equality in a theory of justice. More precisely, we should pose questions in four contracting circles: 1. Is justice the supreme value guiding our setup of the basic structure of society, or are there other, equally important values, such as recognition, care, communal belonging? 2. If justice is the highest guiding principle, which competing ideals—especially equality and freedom—ought to have precedence in a policy oriented toward justice? What status does the ideal of equality have in that framework? 3. If equality is a basic ideal of just policy, how should it be practically realized? What sort of equality (equal opportunity, equality of welfare, resource equality) should be demanded? 4. What patterned distribution of which specific goods does the ideal of equality demand? Which principles of distribution can be justified according to our justice ideal? To conclude and summarize: 5. What is the essential core of an egalitarian theory of justice, as opposed to an inegalitarian theory? These five questions structure the work’s order of argumentation. Part A elaborates the conceptual foundations and basic moral principles of justice and equality. Chapter I sets out to install justice as the central moral category in the socio-political domain. At the beginning of the first chapter, the conceptual foundations of justice are clarified. While not eliminating the classical distinctions between different forms of justice, I argue that the distributive paradigm is of primary importance. The primacy of justice in the socio-political domain is developed out of a confrontation with alternative positions, those which maintain either that justice generally, or distributive justice in particular, are subsidiary virtues. At the end of Chapter I, the first of the questions mentioned above is answered in a way that establishes justice as the guiding normative concept for the foundation and evaluation of any social order. To clarify the role of equality in a theory of justice, Chapter II separates the idea of equality into four different principles. They are organized in a way that begins with the most general and uncontroversial principle of equality, and progresses towards increasingly detailed and contested principles. There are two theses that articulate and defend the significance of equality for justice: First there is a conceptual connection between justice and equality, in that principles of formal and proportional equality are necessary in order to explicate the concept of justice. These two principles establish an unbreakable bond between justice and equality. Justice can only be explained—or so I argue—by reference to these and other (normative) principles of equality. The second thesis posits a normative relationship between justice and equality, which is disclosed by three substantive principles of equality: moral equality, the presumption of equality, and the principle of responsibility. I argue that the normative core of an egalitarian theory of justice is expressed by the latter two principles, which are themselves based on the first principle, that of moral equality. When we view one another as persons, what form of equality or equal treatment is normatively demanded? I argue that the answer to this question is given by the procedural principle of the presumption of equality: regardless of their apparent differences, all persons deserve strictly equal treatment, unless certain kinds of differences have whatever particular relevance would justify, on generally acceptable grounds, unequal treatment or unequal distribution. The justification of the presumption of equality is central to this work and has considerable importance. If the presumption principle’s validity can be justified by enlisting the principle of general justification, then the primacy of equality, and the essential argument for an egalitarian theory of justice, is established. This would likewise provide a procedure for the construction of a material theory of justice. The second question is answered thereby at the end of Chapter II: Equality should have primacy over competing ideals within a justice-oriented policy. The presumption of equality establishes this primacy and, at the same time, offers an appropriate metric and guideline for the construction of a material theory of distributive justice. The presumption of equality in Part B offers an elegant procedure for the development of a theory of distributive justice. Chapter III clearly sets out the necessary prerequisites that a theory of distribution must satisfy in order to determine a liberal-egalitarian distributional framework. We need to specify in which situation the distribution takes place; which goods are and are not to be distributed; in which respect the presumptive equality is to be produced; and by and to whom, and for what period, the relevant goods are to be distributed. The distribution is based on resources understood as general-purpose means. It is necessary to divide goods into different categories, since the justification for unequal treatment in one domain will not carry over into another. This makes presumptive equality necessarily complex. To that end, four spheres of justice are distinguished: (1) the political sphere, which involves allocating rights through the distribution of civil liberties; (2) the democratic sphere, in which political power and the rights of political participation are regulated; (3) the economic sphere, in which income and property are distributed; (4) the social sphere, in which social positions and opportunities are distributed. This framework of distributive justice answers the third of our guiding questions, about the nature of equality, in terms of equality of resources. Chapters IV and V set out the egalitarian distributive criteria for each sphere. I argue that the generally accepted, fundamental rights of classical liberalism are more effectively reconstructed by reference to the equal resource distribution presumptively required in those spheres. Chapter IV shows that when it comes to the first two spheres, those involving basic rights and freedoms and entitlement political participation, there can be no justified exceptions to the equal distribution of the relevant goods. That section argues, contrary to what we commonly find in theories of freedom or popular sovereignty, that the value of freedom and self-determination as the political basis of autonomy is best realized through the presumption of equal distribution. Chapter V deals with the other two spheres, those of economic goods and social positions, and argues for justified exceptions to equal distribution. In the economic sphere we find one principal reason favouring unequal distribution of resources, and three restrictions and compensations limiting that inequality. The basic exception to equal economic distribution arises from the unequal consequences of personal responsibility. From a suitably egalitarian standpoint, the principle of responsibility is the normative principle that determines which reasons justify economic inequality. Here the basic idea is that unequal shares of social goods are fair if they result from the choices and deliberate actions of the relevant parties. That individuals have to bear the costs of their own choices is a condition of autonomy. However, benefits or disadvantages arising from arbitrary and unmerited differences in social circumstances or natural endowments is unfair. The unequal consequences of independent decision-making and action must therefore be limited by compensating first for preferences, secondly for disadvantages, and thirdly by redistributing wealth in aid of the worse-off. I situations of emergency, compensating for disadvantages has priority over all other claims, owing to the urgency of the situation. Social inequalities go beyond the permissible limit if it is possible to improve the long-term social or economic situation of the worse-off by redistributing wealth to them. These exceptions lead to a complex system of free economic action within a framework of compensatory tax and transfer mechanisms. Finally, in the social sphere, the distribution of social positions, offices and opportunities must be structured to ensure that equally talented and motivated citizens have roughly equal chances of obtaining those offices or positions, irrespective of their economic or social class backgrounds. This compromise is permissible for reasons of freedom and prudence, and it makes a certain measure of inequality acceptable. The fourth of our guiding questions is answered accordingly. There are five principles of justice for the basic structure of society, and five legal principles that govern the special distribution of goods in the respective spheres—all are ranked according to their most defensible grounds of priority, ensuring that everyone is accorded equal justice. Chapter VI recapitulates the initial question of equality’s value. The conception of equal justice developed in this work postulates five principles of equality and five principles of law; these constitute an egalitarian framework because they support and promote social justice. Equality has value with respect to them, but is not given any independent, intrinsic value. That is why I call the account developed here a form of constitutive egalitarianism: justice is realized through the realization of equality, itself accomplished by applying the five postulates of equality and five distributive principles of law. This is an egalitarianism on two levels. The first level is involves the claim that morality or justice is conceptually connected with equality. The second level gives equality a substantial weight in what is conceptually validated at the first level, namely the presumption of equality, and constructs an appropriate interpretation and conception of distributive justice through principles of distribution for the individual spheres. The weight and importance of equality is shown by the distributive criteria applied to those spheres. This answers our final guiding question about the nature of an egalitarian theory. (shrink)

A measure of coherence is said to be reliability conducive if and only if a higher degree of coherence (as measured) results in a higher likelihood that the witnesses are reliable. Recently, it has been proved that several coherence measures proposed in the literature are reliability conducive in a restricted scenario (Olsson and Schubert 2007, Synthese 157:297–308). My aim is to investigate which coherence measures turn out to be reliability conducive in the more general scenario where it is any finite (...) number of witnesses that give equivalent reports. It is shown that only the so-called Shogenji measure is reliability conducive in this scenario. I take that to be an argument for the Shogenji measure being a fruitful explication of coherence. Integrating the study of human diversity into the human evolutionary sciences requires substantial revision of traditional conceptions of a shared human nature. This process may be made more difficult by entrenched, 'folkbiological' modes of thought. Earlier work by the authors suggests that biologically naive subjects hold an implicit theory according to which some traits are expressions of an animal's inner nature while others are imposed by its environment. In this paper, we report further studies that extend and refine our account (...) of this aspect of folkbiology. We examine biologically naive subjects' judgments about whether traits of an animal are 'innate', 'in its DNA' or 'part of its nature'. Subjects do not understand these three descriptions to be equivalent. Both innate and in its DNA have the connotation that the trait is species-typical. This poses an obstacle to the assimilation of the biology of polymorphic and plastic traits by biologically naive audiences. Researchers themselves may not be immune to the continuing pull of folkbiological modes of thought. (shrink)

The fact that the standard probabilistic calculus does not define probabilities for sentences with embedded conditionals is a fundamental problem for the probabilistic theory of conditionals. Several authors have explored ways to assign probabilities to such sentences, but those proposals have come under criticism for making counterintuitive predictions. This paper examines the source of the problematic predictions and proposes an amendment which corrects them in a principled way. The account brings intuitions about counterfactual conditionals to bear on the interpretation of (...) indicatives and relies on the notion of causal (in)dependence. (shrink)

This article considers the prospects of inference to the best explanation as a method of confirming causal claims vis-à-vis the medical evidence of mechanisms. I show that IBE is actually descriptive of how scientists reason when choosing among hypotheses, that it is amenable to the balance/weight distinction, a pivotal pair of concepts in the philosophy of evidence, and that it can do justice to interesting features of the interplay between mechanistic and population level assessments.

I argue that difference-making should be a crucial element for evaluating the quality of evidence for mechanisms, especially with respect to the robustness of mechanisms, and that it should take central stage when it comes to the general role played by mechanisms in establishing causal claims in medicine. The difference- making of mechanisms should provide additional compelling reasons to accept the gist of Russo-Williamson thesis and include mechanisms in the protocols for Evidence- Based Medicine (EBM), as the EBM+ research group (...) has been advocating. Zusammenfassung Die Einführung von Impfprogrammen bei einer immun-naiven Bevölkerung in Europa spielte eine wesentliche Rolle für den Verlauf der COVID-19 Pandemie. Vor allem zu Beginn waren Impfprogramme jedoch durch einen Mangel an Impfdosen gekennzeichnet. Bei einer Zuteilung geringer Dosen an Krankenhäuser in der Initialphase, waren Krankenhausleitungen durch eine möglichst faire Verteilung dieser Impfdosen unter dem Krankenhauspersonal gefordert. Der Beitrag dokumentiert das Vorgehen im ersten Quartal 2021 an fünf deutschen Krankenhäusern in einem Klinikverbund. Wir berichten über einen regel-konsequentialistischen Ansatz auf der (...) strategischen Ebene, der durch einen egalitären Ansatz auf der taktischen Ebene ergänzt wurde. Es erfolgte die ethisch begleitete Entwicklung eines hybriden Schemas unter Verzicht auf klassische Verteilungsmuster, wie dem First-Come-First-Served Schema. Die Kombination des strategischen regel-konsequentialistischen Schemas mit egalitärer Verteilung auf der taktischen Ebene war vollständig funktional und unter den Mitarbeitenden des Klinikverbundes gut akzeptiert. In Zeiten von Pandemien und knappen Ressourcen spielt die Verteilung von medizinischen Gütern für die Funktionalität medizinischer Einrichtungen eine wichtige Rolle. Die Verteilung von Gütern, die durch den Staat bereitgestellt werden, bedarf jedoch einer Anpassung an die jeweiligen Gegebenheiten der Institutionen. Dieser Bericht zeigt eine mögliche Option für die Verteilung knapper Impfdosen auf, die nicht nur unter Personen der Zielgruppe verteilt wurden, sondern die auch die Funktionalität der medizinischen Versorgung in einer Region sicherte. In this paper I offer an anti-Humean critique to Williamson and Russo’s approach to medical mechanisms. I focus on one of the specific claims made by Williamson and Russo, namely the claim that micro-structural ‘mechanisms’ provide evidence for the stability across populations of causal relationships ascertained at the (macro-) level of (test) populations. This claim is grounded in the epistemic account of causality developed by Williamson, an account which—while not relying exclusively on mechanistic evidence for justifying causal judgements—appeals nevertheless to (...) mechanisms, and rejects their anti-Humean interpretation in terms of capacities, powers, potencies, etc. By using (and expanding on) Cartwright’s basic critique against Humean mechanisms, I suggest that, in order to move beyond the level of plausibility, Williamson and Russo’s position is in need of a clarification as to the occurent reading of the components, functioning and interferences of mechanisms. Relatedly, as concerns Williamson’s epistemic account of causation, I argue that this account is in need of a more straightforward answer as to what truth-makers its causal claims should have. The topic of this thesis is axiological uncertainty – the question of how you should evaluate your options if you are uncertain about which axiology is true. As an answer, I defend Expected Value Maximisation (EVM), the view that one option is better than another if and only if it has the greater expected value across axiologies. More precisely, I explore the axiomatic foundations of this view. I employ results from state-dependent utility theory, extend them in various ways and interpret (...) them accordingly, and thus provide axiomatisations of EVM as a theory of axiological uncertainty. In this article we focus on how the language of developmental psychology shapes our conceptualisations and understandings of childrearing and of the parent-child relationship. By analysing some examples of contemporary research, policy and popular literature on parenting and parenting support in the UK and Flanders, we explore some of the ways in which normative assumptions about parenthood and upbringing are imported into these areas through the language of developmental psychology. We go on to address the particular attraction of developmental psychology (...) in the field of parenting and upbringing within our current cultural context. Drawing on the work of (among others) Zygmunt Bauman, we will show how developmental psychology, as one of the instruments that contributes to a breaking down of our existential condition into a series of well-defined, and thus apparently manageable, tasks and categories, displaces rather than confronts the possibly limitless depth of the enormity of the reality of ‘being a parent’. The globalization movement in recent decades has meant rapid growth in trade, financial transactions, and cross-country ownership of economic assets. In this article, we examine how the globalization of national business systems has influenced the framing of corporate social responsibility (CSR). This is done using text analysis of CEO letters appearing in the annual reports of 15 major corporations in Sweden during a period of transformational change. The results show that the discourse about CSR in the annual reports has changed (...) from a national and communitarian view of social responsibility (cf. a negotiated view of CSR) toward an international and individualistic view of social responsibility (cf. a self-regulating view of CSR). The article contributes theoretically (1) by adding a national–global dimension to previous conceptualizations of CSR and (2) by showing that the rise of CSR discourse and activities in the last 10 years does not have to imply an increased commitment and interest in corporate responsibility per se, only that there are increased societal expectations that corporations should develop the capability to act more independently as moral agents. Scientific progress is achieved not only by continuous accumulation of knowledge but also by paradigm shifts. These shifts are often necessitated by anomalous findings that cannot be incorporated in accepted models. Two important methodological principles regulate this process and complement each other: Ockham's Razor as the principle of parsimony and Plato's Life Boat as the principle of the necessity to 'save the appearances' and thus incorporate conflicting phenomenological data into theories. We review empirical data which are in conflict with some (...) presuppositions of accepted mainstream science: Clinical and experimental effects of prayer and healing intention, data from telepathy, psychokinesis experiments and precognition, and anecdotal reports of macro-psychokinesis. Taken together, the now well documented possibility of these events suggests that such phenomena are anomalies that challenge some widely held beliefs in mainstream science. On the other hand, scientists often fear that by accepting the reality of these phenomena they also have to subscribe to world-models invoking ontological dualism or idealism. We suggest accepting the phenomena as real, but without questionable ontologies commonly associated with them. We outline how this might work. (shrink)

Much recent work in Cognitive Linguistics and neighbouring disciplines has adopted a so-called usage-based perspective in which generalizations are based on the analysis of authentic usage data provided by computerized corpora. However, the analysis of such data does not always utilize methodological findings from other disciplines to avoid analytical pitfalls and, at the same time, generate robust results. A case in point is the strategy of using corpus frequencies. In this paper, we take up a recently much debated issue from (...) construction grammar concerning the association between verbs and argument-structure constructions, and investigate a construction, the English as-predicative, in order to test the predictive power of different kinds of frequency data against that of a recent, more refined corpus-based approach, the so-called collexeme analysis. To that end, the results of the application of these corpus-based approaches to an analysis of the as predicative are compared with the results of a sentence-completion experiment. Concerning the topic under consideration, collexeme analysis is not only shown to be superior on a variety of theoretical and methodological grounds, it also significantly outperforms frequency as a predictor of subjects’ production preferences. We conclude by pointing out some implications for usage-based approaches. (shrink)

The pivotal role of the relation part-of in the description of living organisms is widely acknowledged. Organisms are open systems, which means that in contradistinction to mechanical artifacts they are characterized by a continuous flow and exchange of matter. A closer analysis of the spatial relations in biological organisms reveals that the decision as to whether a given particular is part-of a second particular or whether it is only contained-in the second particular is often controversial. We here propose a rule-based (...) approach which allows us to decide on the basis of well-defined criteria which of the two relations holds between two anatomical objects, given that one spatially includes the other. We discuss the advantages and limitations of this approach, using concrete examples from human anatomy. (shrink)

Throughout his philosophical work, Schelling came to increasingly emphasize his conviction that the ultimate principles of philosophy are essentially practical: the ego formally conceived as act in early philosophy, creation as the unfolding of structurally rich action in late philosophy. It remained unclear, however, exactly what constituted the practicality of these principles, namely which concept of action Schelling used and how it is being integrated into the totality of his system. The task this study sets itself is to investigate into (...) these issues in respect to his middle and late philosophy. With the doctrine of potencies serving as point of departure, spirit is first reconstructed as practical consciousness. Creation as an ontotheological original act with the historical world as the space of human action is then systematically developed. Freedom, foresight, purposefulness, intentionality and futurity prove to be the central practical attributes of both human and divine action. Their connection is manifested in the religious consciousness of man and instantiated metaphysically in the relationship of time and eternity. Schelling's positive philosophy shows that these practical aspects are the irreducable prerequisites to render the historical world process intelligible. (shrink)

The number of people with dementia is increasing worldwide. At the same time, family and professional caregivers’ resources are limited. A promising approach to relieve these carers’ burden and assist people with dementia is assistive technology. In order to be useful and accepted, such technologies need to respect the values and needs of their intended users. We applied the value sensitive design approach to identify values and needs of patients with dementia and family and professional caregivers in respect to assistive (...) technologies to assist people with dementia in institutionalized care. Based on semi-structured interviews of residents/patients with cognitive impairment, relatives, and healthcare professionals (10 each), we identified 44 values summarized by 18 core values. From these values, we created a values’ network to demonstrate the interplay between the values. The core of this network was caring and empathy as most strongly interacting value. Furthermore, we found 36 needs for assistance belonging to the four action fields of activity, care, management/administration, and nursing. Based on these values and needs for assistance, we created possible use cases for assistive technologies in each of the identified four action fields. All these use cases already are technologically feasible today but are not currently being used in healthcare facilities. This underlines the need for development of value-based technologies to ensure not only technological feasibility but also acceptance and implementation of assistive technologies. Our results help balance conflicting values and provide concrete suggestions for how engineers and designers can incorporate values into assistive technologies. (shrink)

Inference to the Best Explanation is usually employed in the Scientific Realism debates. As far as particular scientific theories are concerned, its most ready usage seems to be that of a theory of confirmation. There are however more uses of IBE, namely as an epistemological theory of testimony and as a means of categorising and justifying the sources of evidence. In this paper, I will present, develop and exemplify IBE as a theory of the quality of evidence - taking examples (...) from medicine and showing that IBE can thereby provide the epistemological underpinning and justify the criteria of grading quality of mechanistic evidence that have been recently provided in the Clarke et al. paper on how evidence of medical mechanisms is to be construed alongside population studies. This book assembles leading legal, political, and moral philosophers to examine the legacy of the work of Ronald Dworkin. They provide the most comprehensive critical treatment of Dworkin's accomplishments focusing on his work in all branches of philosophy, including his theory of value, political philosophy, philosophy of international law, and legal philosophy. The book's organizing principle and theme reflect Dworkin's self-conception as a builder of a unified theory of value, and the broad outlines of his system can be found throughout (...) the book. This publication, however, is not a handbook of classical metaethics but a kind of generalization of ethical theories ordering in a way, all known until now ethical systems within philosophy. Thus, Czeżowski does not offer his metaethics as a section of traditional ethics but also as a kind of generalization of all ethics until now, and therefore, all systems worked out within (...) itself. In its essence “Metaethical considerations” is the concept of scientific ethics, regardless of anything that does not pass verification, subject of which are e.g. empirical science research results. Körper, Seele und Geist. Aus welchen Teilen besteht der Mensch? Mit dieser Fragestellung hat sich die Anthropologie schon seit Jahrhunderten beschäftigt. Vorliegendes Buch arbeitet diese Frage anhand der Epoche der Romantik und des damaligen wissenschaftlichen Diskurses der Anthropologie auf. Zwischen den Anthropologen gab es große Meinungsunterschiede. Die Schule der Dualisten behauptete, dass der Mensch aus einer Seele und einem Körper bestehe. Die genuin christlich inspirierten Trinitarier gingen hingegen von einem Gott analogen Menschenbild mit den Merkmalen Geist, Seele und Körper aus.

In ?155 of his New Theory of Vision Berkeley explains that a hypothetical ?unbodied spirit? ?cannot comprehend the manner wherein geometers describe a right line or circle?.1The reason for this, Berkeley continues, is that ?the rule and compass with their use being things of which it is impossible he should have any notion.? This reference to geometrical tools has led virtually all commentators to conclude that at least one reason why the unbodied spirit cannot have knowledge of plane geometry is (...) because it cannot manipulate a ruler or a compass. In this article I will show that such an interpretation is flawed. I will instead argue that Berkeley's understanding of Euclidian geometry was based on Isaac Barrow's account of the foundations of geometry. On this view geometrical objects are conceived in terms of the idealized motion that generates the objects of geometry. Uzquiano (Analysis 70:39–44, 2010 ) showed that the Hardest Logic Puzzle Ever ( HLPE ) [in its amended form due to Rabern and Rabern (Analysis 68:105–112, 2008 )] has a solution in only two questions. Uzquiano concludes his paper by noting that his solution strategy naturally suggests a harder variation of the puzzle which, as he remarks, he does not know how to solve in two questions. Wheeler and Barahona (J Philos Logic, to appear, 2011 ) formulated a three question (...) solution to Uzquiano’s puzzle and gave an information theoretic argument to establish that a two question solution for Uzquiano’s puzzle does not exist. However, their argument crucially relies on a certain conception of what it means to answer self-referential yes–no questions truly and falsely . We propose an alternative such conception which, as we show, allows one to solve Uzquiano’s puzzle in two questions. The solution strategy adopted suggests an even harder variation of Uzquiano’s puzzle which, as we will show, can also be solved in two questions. Just as all previous solutions to versions of HLPE , our solution is presented informally. The second part of the paper investigates the prospects of formally representing solutions to HLPE by exploiting theories of truth. (shrink)
