This article investigates corporate governance reform in South Africa in the context of the country’s international links with Anglo-American corporate governance and domestic pursuit of socioeconomic development. Two key questions are evaluated. (a) How has divergence within the Anglo-American model influenced corporate governance reform in South Africa? (b) Can South Africa’s historical closeness to the Anglo-American model be combined with increasing attention to stakeholder issues to produce a hybrid “African model” of corporate governance? Evaluating these questions, the following issues are (...) explored in turn: the contrast between shareholder and stakeholder models, divergence between U.S. and U.K. approaches to corporate governance as exemplified by Sarbanes-Oxley, locating a South African approach in context of the Anglo-American model, the King reports and an emerging “African” model of corporate governance, and the role of international and domestic factors in shaping South Africa’s ongoing reform process. Users of sociotechnical systems often have no way to independently verify whether the system output which they use to make decisions is correct; they are epistemically dependent on the system. We argue that this leads to problems when the system is wrong, namely to bad decisions and violations of the norm of practical reasoning. To prevent this from occurring we suggest the implementation of defeaters: information that a system is unreliable in a specific case (undercutting defeat) or independent information that (...) the output is wrong (rebutting defeat). Practically, we suggest to design defeaters based on the different ways in which a system might produce erroneous outputs, and analyse this suggestion with a case study of the risk classification algorithm used by the Dutch tax agency. In the past few decades, a growth in ethical consumerism has led brands to increasingly develop conscientiousness and depict ethical image at a corporate level. However, most of the research studying business ethics in the field of corporate brand management is either conceptual or has been empirically conducted in relation to goods/products contexts. This is surprising because corporate brands are more relevant in services contexts, because of the distinct nature of services and the key role that employees have in the (...) services sector. Accordingly, this article aims at empirically examining the effects of customer perceived ethicality in the context of corporate services brands. Based on data collected for eight service categories using a panel of 2179 customers, the hypothesized structural model is tested using path analysis. The results show that, in addition to a direct effect, customer perceived ethicality has a positive and indirect effect on customer loyalty, through the mediators of customer affective commitment and customer perceived quality. Further, employee empathy positively influences the impact of customer perceived ethicality on customer affective commitment, and customer loyalty positively impacts customer positive word-of-mouth. The first implication of these results is that corporate brand strategy needs to be aligned with human resources policies and practices if brands want to turn ethical strategies into employee behavior. Second, corporate brands should build more authentic communications grounded in their ethical beliefs and supported by evidence from actual employees. (shrink)

Bis heute wirken der Stil seines Philosophierens und seine Radikalität auf viele philosophisch außerordentlich inspirierend. Hinzu kommt das Schillernde seiner von Anekdoten umrankten Persönlichkeit, die in etlichen biographischen Werken aufgearbeitet wurde. Stefan Majetschak gibt einen konzisen Überblick über Leben und Gesamtwerk dieser Jahrhundertfigur und spürt ihren Wirkungen nach.

In this paper, I focus on life-threatening medical conditions and argue that from the point of view of natural properties, induction(s), and participation in laws, at least some of the ill organisms dealt with in somatic medicine form natural kinds in the same sense in which the kinds in the exact sciences are thought of as natural. By way of comparing two ‘divisions of nature’, viz., a ‘classical’ exact science kind (gold) and a kind of disease (Graves disease), I show (...) that there is no justifiable ‘ontological gap’ between disease kinds and exact sciences kinds. There is no consensus as to whether a Liar sentence is meaningful or not. Still, a widespread conviction with respect to Liar sentences (and other ungrounded sentences) is that, whether or not they are meaningful, they are useless . The philosophical contribution of this paper is to put this conviction into question. Using the framework of assertoric semantics , which is a semantic valuation method for languages of self-referential truth that has been developed by the author, we show that certain (...) computational problems, called query structures , can be solved more efficiently by an agent who has self-referential resources (amongst which are Liar sentences) than by an agent who has only classical resources; we establish the computational power of self-referential truth . Proceeding from our absolute space-time conceptions, we obtain the formula for the gravitational frequency shift in an extremely simple way. Using our “burst” model for photons, we show that the different rates of clocks placed in spatial regions with different gravitational potentials appear as a direct result of the gravitational frequency shift and the axiomatic assumption that at any space point the time unit is to be defined by light clocks with equal “arms,” i.e., that at any space point the (...) light velocity (in moving frames the “there-and-back” velocity) has the same numerical valuec. Considering the principle of equivalence, we come to the logical conclusion that the kinematic (Einstein-Lorentz) time dilation is an absolute phenomenon. (shrink)

Topic of the paper is Q-logic – a logic of agency in its temporal and modal context. Q-logic may be considered as a basal logic of agency since the most important stit-operators discussed in the literature can be defined or axiomatized easily within its semantical and syntactical framework. Its basic agent dependent operator, the Q-operator (also known as Δ- or cstit-operator), which has been discussed independently by F. v. Kutschera and B. F. Chellas, is investigated here in respect of its (...) relation to other temporal and modal operators. The main result of the paper, then, is a completeness result for a calculus of Q-logic with respect to a semantics defined on the tree-approach to agency as introduced and developed by, among others, F. v. The ocean’s properties and processes are now mostly known through distributed sensor networks. Among the most widespread of such networks are those that connect wave-measuring buoys. Buoys have been deployed and consulted by national meteorological organizations, state militaries, multinational corporations, and citizens. This paper zeroes in on the Directional Waverider, the most widely used buoy, manufactured since 1961 in the Netherlands by Datawell. I am interested in this buoy’s material qualities and networks of use, its life within legal frameworks, and (...) its media ecology. Staging my account against the metaphysical Italian author Italo Calvino’s “Reading a Wave,” I explore what it means to “read” a sensing technology. (shrink)

In this book, Patrick G. Stefan argues that the subversive message of resurrection was instrumental in Christianity’s expansion. Using Foucault’s analysis of how material conditions shape and create individual subjects, Stefan shows how the idea of resurrection undermined Caesar’s control over those living in his domain.

The analytical tension between legal norms, moral values, and national interests seems no uncharted territory in political science, but has found very little interest in legal academia. For lawyers, moral values and national interests are largely “unknowns,” dealt with by other disciplines. Looking a bit deeper, the picture becomes more nuanced, however. As part of a roundtable on “Balancing Legal Norms, Moral Values, and National Interests,” this essay argues that norms, values, and interests are not different universes of legal normativity, (...) morality, and specific interests, but are interrelated concepts. Values clearly influence norms and often underpin them, while seemingly concrete norms (rules) are themselves often fragile constructs trying to balance competing interests. Value systems are quite diverse within societies, and this is even truer for interests; each society is a dynamic system of social interaction where conflicting interests are constantly playing out. In a way, underlying conflicts of values and interests are constantly being renegotiated in the legal system, with the norms enshrined in the text of statutes and treaties serving to constitute transitory reference points. This manuscript describes the institutional and clinical considerations that apply to the question of whether to mandate opioid dose reduction in patients who have received opioids long-term. It describes how a calamitous rise in addiction and overdose involving opioids has both led to a clinical recalibration by healthcare providers, and to strong incentives favoring forcible opioid reduction by policy making agencies. Neither the 2016 Guideline issued by the Centers for Disease Control and Prevention nor clinical evidence can justify or promote (...) such policies as safe or effective. (shrink)

This special issue of Science, Technology, & Human Values critically explores a new stage in which the life sciences and biomedical practices have entered. This new stage is marked by postgenomic developments and an increased interest of life sciences in the everyday lives of people outside laboratories and clinical settings. Furthermore, particular attention is given to many chronic and degenerative disorders such as cardiovascular disease, Alzheimer’s disease, or developmental disorders. These developments coincide—or have become entangled—with a new set of interests (...) that an anthropologically inclined science and technology studies is bringing to the analyses of biomedical practices. An increased interest is observed in the anthropologically inclined STS in studying phenomena on different scales and in exploring fields that are not readily dominated by technoscientific rationality in practice. The introduction to the special issue examines briefly these developments and situates them in a broader genealogy of different movements that have taken place in the anthropologically inclined subfield of STS since the late 1970s and early 1980s. Given the increasing potential of automation in the primary and industrial sectors of the economy, it is helpful to take a mesoeconomic, i. e. sectoral, look at the concept of a basic income. We present a thought experiment centred on societies in which labour takes place only in the service sector. We identify service sectors like prostitution in which it may be advantageous to shift away from the market and sectors like health services where public involvement is indispensable. Introducing a (...) basic income may also generate social capital, which usually accompanies service provision in the sphere of cooperation. (shrink)

In following paper an attempt will be made to analyse the statistical relationships between variables as the functions of causal relations existing between them. Our basic assumption here is that statistical relationships between traits, events, or characteristics of objects, may be logically derived from the pattern of their mutual causal connections, if this pattern is described by appropriate concepts and with sufficient precision. The first part of the paper presents basic concepts, which according to author's view may serve for the (...) description of different patterns of causal relations in such a way, that statistical relationships corresponding to each pattern may be derived. It gives also examples of such a derivation for some less complicated cases. The second part of the paper is an attempt of application of proposed method to the understanding and critical consideration of some standard techniques of statistical analysis, especially those mostly used in social sciences. Many people think that if you're uncertain about which moral theory is correct, you ought to maximize the expected choice-worthiness of your actions. This idea presupposes that the strengths of our moral reasons are comparable across theories – for instance, that our reasons to create new people, according to total utilitarianism, can be stronger than our reasons to benefit an existing person, according to a person-affecting view. But how can we make sense of such comparisons? In this article, I introduce (...) a constructivist account of intertheoretic comparisons. On this account, such comparisons don't hold independently of facts about morally uncertain agents. They're simply the result of an ideal deliberation in terms of certain epistemic norms about what you ought to do in light of your uncertainty. If I'm right, this account is metaphysically more parsimonious than some existing proposals, and yet has plausible and strong implications. (shrink)

Starting from the hypothesis that the predominant church, religion and belief in Romania (i.e. the Romanian Orthodox Church, the Orthodox religion and the Orthodox belief) are paradigms that help understand politics, we will highlight in the present article three major aspects of the political phenomenon in post-communist Romania: de-symbolizing the democratic function, institutionalizing “democratism” and manifesting integralism in the public space. Our analysis is based on a communicational approach which postulates the conceptual oppositions as a fundament of understanding. The interpretation (...) of these oppositions has lead us to discovering a series of coherent actions, behaviors, facts, etc., but also a series of incoherent, at some point irrational situations in the relation between the religious and the political spheres. The importance of this article lies in the fact that, once highlighted, these structures allow us to take into consideration the possibility of analyzing the meaning of the relation between the religious and the political spheres. In ?155 of his New Theory of Vision Berkeley explains that a hypothetical ?unbodied spirit? ?cannot comprehend the manner wherein geometers describe a right line or circle?.1The reason for this, Berkeley continues, is that ?the rule and compass with their use being things of which it is impossible he should have any notion.? This reference to geometrical tools has led virtually all commentators to conclude that at least one reason why the unbodied spirit cannot have knowledge of plane geometry is (...) because it cannot manipulate a ruler or a compass. In this article I will show that such an interpretation is flawed. I will instead argue that Berkeley's understanding of Euclidian geometry was based on Isaac Barrow's account of the foundations of geometry. On this view geometrical objects are conceived in terms of the idealized motion that generates the objects of geometry. Consequently, that what the unbodied spirit cannot do in this context is to form an idea of motion rather than being unable to handle geometrical tools. 1All references to Berkeley are from, A. A. Spatestens seit dem emotional turn in den Kulturwissenschaften zu Anfang dieses Jahrhunderts ist die Leibphanomenologie von Hermann Schmitz kein Geheimtipp mehr. Die Zahl der Studien, die sich mit ihr auseinandersetzen, ist heute kaum uberschaubar. Der Band versucht nach knapp einem halben Jahrhundert Wirkungsgeschichte eine Art Zwischenbilanz zu ziehen. Er fragt, inwiefern und in welchen Kontexten sich die von Schmitz erarbeiteten Kategorien des eigenleiblichen Spurens bewahrt haben. Die Beitrage erortern die gespurte Leiblichkeit in ihrer Verflechtung mit Sachverhalten wie Geschichte, Kultur, Person, (...) Geschlecht sowie als Aktionsfeld leiblicher Kommunikation und zeugen davon, dass das von Schmitz begonnene Projekt uber die Philosophie hinaus auch von anderen Wissenschaften stetig erganzt und weiterentwickelt wird. Vor dem Hintergrund eines sich am Leitmodell des sicht- und tastbaren Korpers orientierenden Denkens konnten sprachliche Ausdrucke fur leibliches Erleben nur als Skandal der Metapher (Strub) begriffen werden. Die Leibphanomenologie bietet dagegen einen alternativen Zugang, dem aber der Korper, wie Schmitz sagt, zum Skandal wird. Diesem schwierigen Verhaltnis von Leib und Korper geht der Band nach, um das Skandalose theoretisch einzuholen. Examines widespread myths about transhumanism and explores the most pressing ethical issues in the debate over technologically assisted human enhancement.

In this paper I try to elucidate the differences between theoretical and practical endeavors in philosophy, and then to show that in a sense philosophy has to be theoretical, but— if it claims to be viable—it must be practical as well. First I consider the meaning of the terms theoretical, practical, abstract, and concrete. Then, with the help of Whitehead’s ideas on this topic, I briefly reflect on the method, aims and role of philosophy. I hold that a properly established (...) philosophical approach should have its roots in concrete experience and should include concrete applications. Thus, abstract ideas can be (and indeed often are) transformed into our daily life practices, being applied to solve real problems—personal, social, environmental, etc. The ideas are conveyed from the sphere of philosophy to that of ordinary life. In the next stage I demonstrate this principle using a concrete example, Whitehead’s philosophical system and how it can be fruitfully applied to the sphere of deep ecology. There are many other examples that could be mentioned, but giving a proper demonstration of this application principle requires more space and so I concentrate only on one of these examples. In assessing the welfare of dairy cows and laying hens, longevity has recently been introduced as an indicator. This paper presents recent attempts to transfer the normative power of longevity to non-human animals and evaluates this choice systematically. It first shows that the normative power of longevity can be justified by utilitarianism but not by rights-based approaches. The case of the ban to kill day-old chicks in Germany is then used to show that public opinion leans neither to the utilitarian (...) approach nor to the rights-based one but draws a firm line between killing animals before and after reaching an adult age. This may be not so much a desire for longevity among farmed animals but a first sign of empathy that may transform our relationship with farmed animals. (shrink)

This essay analyzes the tensions that the rise of “Nordic racism” associated with Hans F. K. Günther triggered within the völkisch movement in the 1920s. Using the examples of the “Deutschbund,” the völkisch wing of the German youth movement “Bündische Jugend” and the German Aristocrats' Association “Deutsche Adelsgenossenschaft,” this essay shows that the reception of the Nordic idea was partially based on misunderstandings and distortions but was also met with open disagreement.

Clarke and Beck argue that the ANS doesn't represent non-numerical magnitudes because of its second-order character. A sensory integration mechanism can explain this character as well, provided the dumbbell studies involve interference from systems that segment by objects such as the Object Tracking System. Although currently equal hypotheses, I point to several ways the two can be distinguished.

Approaching this kind of subject implies an exigency of understanding that aims at the conditions of possibility of the status of the modern person. Starting with the Euro- pean Illuminist Age, this is represented by the acknowl- edgment of the other as a person, based on a certain rational conditioning of the community. One should not confine religion to a “black-hole”, by separating it from the political, but should rather try to see the middle-way between the radical solution of atheism, (...) on the one hand, and the legitimating of a political religion, on the other. The second part of this essay is an analysis of the double modern conditioning of art (understood as the expression of the creative faculty): first, of the political aspect of the Modern Age; secondly, of the religious problems connected to politics. Seen as a whole, this area of artistic production implies two types of funda- mental relationships: 1) an analysis of art as the expres- sion of the self and of its status in the world; 2) a direct connection between art and the social and political as- pects of the contemporary age.
