The author reviews recent books by Alasdair MacIntyre and Garrett Barden that critique the impulse to foundational theory and transhistorical argumentation in moral theory; these arguments are then set in relation to books by Franklin Gamwell and Karl-Otto Apel that seek, in new ways, to defend that impulse. Although far more sympathetic to the latter perspective, the author maintains that all four of these second-order theoretical discussions lack an appropriate understanding of and engagement with the post-Enlightenment tradition of moral theorizing.

She proposes to fill this lacuna (...) through a theological exploration of what constitutes a just revolution. While Scheid maintains a consistent [End Page 212] preference for nonviolent resistance against tyranny, she remains open to the possibility of revolutionary warfare.The author articulates four stages of a just revolution. The first stage is jus ante, nonviolent resistance against a tyrannical government. Here the opposition develops a democratic and revolutionary vision of society that respects human rights, models that vision within its organizations, and resists through nonviolent acts. Second is jus ad, the stage where a tyrannical government eliminates all avenues for negotiation and represses peaceful resistance. This forces the revolutionary opposition to consider armed resistance as a last resort. Here Scheid grapples with two limitations of traditional just war theory. The first reserves the authority to start a war with governments. She argues that the legitimacy for a just revolution comes from a revolutionary organization's ability to envision and model a just society. Because a tyrannical government's authority is illegitimate, a revolutionary movement's just vision and practices gain for it a de facto legitimate authority. This legitimacy is reinforced by a revolutionary movement's ultimate intention to effect reconciliation with their oppressors postwar. The second limitation is the reasonable hope of success. Scheid analyzes the history of this criterion and demonstrates how it supports defensive wars despite the uncertainty of success. Oppressed persons, as the subjects of their own hope of liberation, ought to decide what constitutes the probability for success in fighting tyranny. Throughout this stage, revolutionary warfare must be practiced in tandem with continuing nonviolent resistance.The third stage is jus in, the justice practiced during armed revolutionary resistance. Fighting is deemed necessary to force a tyrannical government to negotiations. Meanwhile, revolutionary military units would work to minimize violence and loss of life. The last stage is jus post, the reconciliation needed to prevent revolutionary warfare from spiraling into revenge. Here the exercise of restorative justice—where responsibility for past injustices is assumed by all sides and a just resolution developed for social reconciliation and the development of a new, democratic society that respects human rights—is all important. Throughout the book, Scheid uses the African National Congress's revolutionary struggle against the South African apartheid government as a successful example of her theory in practice.Scheid's well-argued proposal deserves careful consideration by ethicists. Students will profit from her excellent summary of just war theory, where she brilliantly recovers some of its forgotten features. On the other hand, her concluding chapter considering the Arab Spring's potential for just revolution would have been stronger if she extended beyond a comparison to South Africa to incorporate similar features found in other successful revolutions. The 1986 Philippine People Power Revolution, the 1989 collapse of Eastern European Communist regimes, and the 1974 Carnation Revolution in Portugal come to mind. Moreover, important for South Africa's success was the durability of the [End Page 213] political institutions the British left behind. These institutions provided the framework that handled the transition of power from the pro-apartheid National Party to the post-apartheid African National Congress government. The relationship between law and morality is a topic which receives special importance and attention, especially in "liberal democracies" in which the law is supposed to regulate highly pluralized and fragmented societies. Under conditions of plurality of values, many social forces and legal theories require a certain kind of neutrality from the legal system, a means of compatibility of the many "world views" and "moral systems" that are present within the same social space. Such a conciliating commitment sounds (...) particularly relevant in times of the doctrinal ubiquity of ideas such as "peace based on human rights". This was the title of the 28th World Congress of the IVR in Lisbon, with the special workshop "Law and Morals" on which this book is based. The use of mathematical models to support decision making is proliferating in both the public and private sectors. Advances in computer technology and greater opportunities to learn the appropriate techniques are extending modeling capabilities to more and more people. As powerful decision aids, models can be both beneficial or harmful. At present, few safeguards exist to prevent model builders or users from deliberately, carelessly, or recklessly manipulating data to further their own ends. Perhaps more importantly, few people understand or appreciate (...) that harm can be caused when builders or users fail to recognize the values and assumptions on which a model is based or fail to take into account all the groups who would be affected by a model's results. This volume provides a setting for a dialogue about ethics and shows the need to continue and define a vocabulary for exploring ethical concerns. Many hold that the so-called golden era of antibiotic discovery has passed, leaving only a limited clinical pipeline for new antibiotics. A logical conclusion of such arguments is that we need to reform the current system of antibiotic drug research—including clinical trials and regulatory requirements—to spur activity in discovery and development. The United States Congress in the past few years has debated a number of bills to address this crisis, including the 2012 Generating Antibiotic Incentives Now Act and the 2016 (...) 21st Century Cures Act. Experts have also sought to advance antibiotic development by encouraging greater use of trials with noninferiority hypotheses, which are thought to be easier to conduct. The goal underlying these proposals is to stave off the post-antibiotic era by expanding the pharmaceutical armamentarium as quickly as possible. But although new antibiotic agents are necessary to combat the long-term threat of drug-resistant disease, we argue that these research policies, which effectively lower the bar for antibiotic approval, are ethically problematic. Rather, given broader public health considerations related to the full lifecycle of antibiotic use—including development of resistance—we should reject an overly permissive approach to new antibiotic approval and instead set the bar for regulatory approval at a point that will naturally direct research resources toward the most transformative chemical or social interventions. From a giant of health care policy, an engaging and enlightening account of why American health care is so expensive -- and why it doesn't have to be. Uwe Reinhardt was a towering figure and moral conscience of health care policy in the United States and beyond. Famously bipartisan, he advised presidents and Congress on health reform and originated central features of the Affordable Care Act. In Priced Out, Reinhardt offers an engaging and enlightening account of today's U.S. health care (...) system, explaining why it costs so much more and delivers so much less than the systems of every other advanced country, why this situation is morally indefensible, and how we might improve it. The problem, Reinhardt says, is not one of economics but of social ethics. There is no American political consensus on a fundamental question other countries settled long ago: to what extent should we be our brothers' and sisters' keepers when it comes to health care? Drawing on the best evidence, he guides readers through the chaotic, secretive, and inefficient way America finances health care, and he offers a penetrating ethical analysis of recent reform proposals. At this point, he argues, the United States appears to have three stark choices: the government can make the rich help pay for the health care of the poor, ration care by income, or control costs. Reinhardt proposes an alternative path: that by age 26 all Americans must choose either to join an insurance arrangement with community-rated premiums, or take a chance on being uninsured or relying on a health insurance market that charges premiums based on health status. An incisive look at the American health care system, Priced Out dispels the confusion, ignorance, myths, and misinformation that hinder effective reform. (shrink)

This essay combines information on the recent ISUD Sixth World Congress Humanity at the Turning Point: Rethinking Nature, Culture, and Freedom and some reflections inspired by presentations and discussions at the congress. It is focused on the presentation of one of the keynote speakers, Karl-Otto Apel, entitled “Discourse Ethics, Democracy, and International Law: Toward a Globalization of Practical Reason”. Apel argued that the transcendental-pragmatic foundation of morality serves as the ultimate basis for the universal conception of law, e.g., of (...) human rights. It establishes the transcendental basis of the idea of democracy, and at the same time establishes a regulative principle for a possible critique of the democratic states. Apel discussed the question of a political order of law able to represent the idea of human rights. In his approach to it, he referred to Kant’s idea of “a federation of free states” (as opposite to a “world state”) in the solution of the problem of a cosmopolitan system He noticed the tension between two orientations of international law: one towards “human rights” and hence a cosmopolitan law of single citizens and the other towards the sovereignty of single states. He asserted that the universal conception of law cannot be reduced to the legislative autonomy of any state. Consequently, the universal conception of human rights cannot be adequately realized either by particular democratic states or by a world state as a despotic superpower. Apel concluded that an adequate institution for the current debate regarding the issues of global peace and security can only be a federation of nations like the UN, the meta-institution of global discourse and the political representation of international law. At the heart of the essay is Kant’s cosmopolitan ideal and its relevance for today’s discussions about peace and security. Attention is paid to the attempts to rethink Kant by Karl-Otto Apel, Jürgen Habermas, Jaques Derrida, Martha Nussbaum, and David Held, among others. Some of the authors indicate the tension between the sovereignty ofstates and the universality of human rights. Other authors criticize cosmopolitanism as overly unifying in contrast to the socio-cultural diversity of societies. The essay draws a contrast between two tendencies concerning international relations. One is the current neoconservative course toward American domination throughout the world. An alternative to this is the philosophers’ call for “the cosmopolitan model of democracy” and strengthening the network of transnational grass-roots movements and international institutions, including the UN. The seven social sins that he has listed are as follows: Politics without principle, Wealth without wor, Pleasure without conscience, Knowledge without character, Commerce without morality, Science without humanity, and Worship without sacrifice. Absence of morality will take away humane and just character altogether. Wealth in itself is not bad, but acquiring wealth for its own sake, that too by unjust means, would go against the spirit ofmorality. This is because; the means and ends are inherently related to each other. Hence, the role of business in enhancing human life will be fulfilled if various means adopted by are basically humane and therefore, moral. Establishing acceptable norms of behavior and consistent standards of conduct has been part of the human enterprise since the dawn of time. Without principles of ethics and the moral rules that affect individual behavior, humankind would plunge into a state of chaotic indifference, insecurity, and unending fear. But while few question the need for moral guidance, a growing number of people believe that the only ethic worth considering must rest on a biblical foundation. Is morality dependent upon God and (...) "revealed truths" found in scripture? Must this claim be accepted without question lest we risk the torment of eternal damnation for questioning it? Without critical evaluation and careful scrutiny, there is little hope of distinguishing truth from unfounded belief. How valuable is the Bible as a source for ethical truth? Do the scriptures truly have the insight needed to guide humankind safely through the moral dilemmas of modern society? What constitutes a biblical ethic? Should the Bible be construed as the only basis for moral teaching? Is it really the final authority on moral issues, or are there secular alternatives that can serve as guides to acceptable conduct within the human community? For several decades, tourism has mainly been identified as an activity that helps people escape their everyday routines, contributes to understanding between cultures, and promotes economic wellbeing. These assumptions have been questioned in both the public sphere and academic research, however. In this context, tourism research is increasingly drawing on ethical frameworks to support its criticism of tourism. Some of the most outstanding research on this issue is by Dean MacCannell, Emeritus Professor at the University of California at Davis and (...) author of one of the seminal works of the social theory of tourism: The Tourist: A New Theory of the Leisure Class (1976). MacCannell examines the moral and ethical aspects of tourism in all his writing, but they are the focal point of his book The Ethics of Sightseeing (2011), in which he identifies the tourists’ responsibility to mediate between their understanding of their own pleasure and the ethical repercussions of the late modern imperative, “Enjoy!”. Existing social disparities in the United States are inconsistent with the promise of democracy; therefore, there was a need for critical conceptualization of the first principles that undergird American democracy and the genesis of democratic social change in America. This constructivist grounded theory study aimed to construct a grounded theory that provides an understanding of the process of American democratic social change as it emerged from the nation’s founding documents. A post hoc polytheoretical framework including Foucault’s, Bourdieu’s, (...) and Marx and Engels’s theories of power was used to understand power dynamics. The research question focused on understanding the process of democratic social change in America. The sample comprised the Articles of Confederation, the U.S. Declaration of Independence, The Federalist Papers, and the U.S. Constitution. The documents were retrieved from the National Archives and Library of Congress. The data analysis plan incorporated successive comparison, situational and dramaturgical analysis, deconstruction, and perspective taking as strategies. The result was the construction of a democratic social change process theory preceded by five grounded theories: (a) first principles of democracy, (b) first principles of democracy conceptual framework, (c) socio-ethical principles of democracy, (d) demoralizing process, and (e) either-or approach to democracy. Positive social change implications include applying a democratic social change process to future social change endeavors across domains and levels of analysis, a normative framework for a republican form of government, and a tool to analyze and minimize the latent consequences of social justice policies. Two fundamental problems in all thought can be identified: One, life and world affirmation and second, life and world negation. Indian approach is characterized as the second and hence it is claimed that moral problems have not been persistently pursued and successfully tackled in India. Points like the advaita concept of liberation, law of karma, the system of social stratification, stages of life and duties associated with them are picked up to show that theIndian system is ethically bankrupt. But (...) along with the science of salvation, the science of statecraft (arthasastra) and four objectives of human life are emphasized. The two functions of knowledge namely, theoretical and practical (arthaparicchiti and phalaprapti) referring to fact and value are recognized and it is held that knowledge of facts lead to the pursuit of values. Value is taken as the ‘object of desire’. The concept of svadharma and ahimsa are basic to it. The ‘ought of ethics’ (Dharma) is foundational to all Indian thought. A comprehensive value system consisting of spiritual, moral, material and social values and the distinction between instrumental and intrinsic values are recognized. Contemporary ethical issues relating to human rights and women, suicide, abortion and the host of problems thrown open by science and biotechnology find proper place in it. (shrink)

In recent years, applied ethics has taken on board the various dimensions of public reason that can no longer be reduced to the political construction of a common will. While the question of a just society has traditionally been found in the political dimension, the state and its institutions, current globalization has broken this state monopoly over what is public, opening the way for other institutional actors with the same or greater power to intervene in the public space, actors (...) that have little or nothing to do with representation, majority rule, etc. As the current financial downturn clearly demonstrates, states are pandering to the markets, striving to ‘get their houses in order’ to meet the demands imposed by the global financial magnates. It seems, at least to most citizens, that public politics, like the state’s capacity to deal with social and economic rights, no longer depends on either governments or their ability to govern. So should they be left out of a public reason that is capable of explaining whether they are just or otherwise? The ethical perspective –known to be a critical perspective– cannot remain silent about this new scenario. The present proposal attempts to combine applied ethics, which takes in the logic of social practices, with new contributions from institutional design theories that set out to analyse the power and responsibility of these institutions from ‘inside’, as institutional actors. In this short paper my analysis focuses on the ethical dimension of institutional design, specifically in a proposal for an institutional ethics that is a fundamental part of any applied ethics. The paper aims to explain in what way we can speak of an institutional morality to demonstrate that these civil society institutional actors hold some of the responsibility for facing the problems of defining and managing what is public. Can modern economics adequately embrace ethical issues or does its theoretical apparatus prohibit such a relationship? In December 1994, social scientists from the fields of economics, philosophy, political science and anthropology attended a workshop to discuss the current state of the economics-ethics nexus by way of examining both past and contemporary practice. The proceedings of this conference presented a wide variety of attitudes and includes an examination of economics and ethics from an economist and a philosopher's perspective, (...) in order to assess the contemporary implications of the relationship, and in the late nineteenth century against the background of a long utilitarian tradition. In Rethinking Applied Ethics Today, this paper would like to advance the concept of Ethics Consulting as a means of applying Applied Ethics in the practice of Bioethics. Applied Ethics is frequently described as a discipline of Philosophy that concerns itself with the application of moral theories such as deontology andutilitarianism to real world dilemmas. These applications however often remain restricted to the academic world and rarely reach the actual practice of those in urgent need of (...) ethical guidance. Ethics Consulting is an emerging concept in the field of Applied Ethics, but has already shown great potential in extending the gains of academic thought to everyday deliberations on ethical dilemmas. Connected to the Coherence and Common-Morality Theories in Bioethics, the focusof Ethics Consulting has since the mid-1980’s shifted from issues of content to those of process - from what the ethicist knows to what the ethicist does or enable. This shift not only remodelled the ethicist’s role to that of a facilitator in an inherently social process of moral inquiry, but also added the responsibility of keeping moral reflective spaces open where sound and shared processes of ethical deliberation can take place. Applying these developments in the Namibian context has already proved to be of great value to patients and Medical Aid Funds and also holds great potential in addressing the ethical demands placed on medical practitioners and clinics. This study examines the endogenous relation between corporate social responsibility and tax avoidance by focusing on a common strategy of corporate tax avoidance, i.e., establishing entities in offshore tax havens. Using hand-collected data on a sample of U.S. firms, we find that firms’ CSR ratings increase substantially in the two years after they first open tax haven affiliates. We provide evidence by using the controlled foreign corporations look-through rule enacted by Congress in 2006 that facilitates offshore profit shifting. We (...) find that firms that are affected by the CFC legislation increase their CSR practices in response. Overall, our results are consistent with the risk management theory, which argues that firms hedge against the potential negative consequences of aggressive tax avoidance practices through an increase in positive CSR activities. The 3rd Pan-African Ethics Human Rights and Medical Law (3rd EHRML) conference was held in Johannesburg on July 7, 2013, as part of the Africa Health Congress. The conference brought together bioethicists, researchers and scholars from South Africa, Zimbabwe, Kenya and Nigeria working in the field of bioethics as well as students and healthcare workers interested in learning about ethical issues confronting the African continent. The conference which ran with a theme of "Bioethical and legal perspectives in biomedical research (...) and medical practice in Africa with a focus on: Informed consent, HIV-AIDS & Tuberculosis, leadership & organizational ethics, patients and healthcare workers rights," was designed to expand the dialogue on African bioethics beyond the traditional focus on research ethics and the ethical dilemmas surrounding the conduct of biomedical research in developing countries. This introductory article highlights some of areas of focus at the conference including issues of leadership, organizational ethics and patients and healthcare workers rights in Africa. We analyze the importance of free speech, public debate of issues, argumentation and the need to introduce the teaching and learning of ethics to students in Africa in accordance with UNESCO guidelines. This article also focuses on other challenges confronting Africa today from an ethical standpoint, including the issues of poor leadership and organizational ethics which are main contributors to the problems prevalent in African countries, such as poverty, poor education and healthcare delivery systems, terrorism, social inequities, infrastructural deficits and other forms of 'structural violence' confronting vulnerable African communities. We believe that each of the eight articles included in this supplement, which have been rigorously peer-reviewed are a good example of current research on bioethics in Africa, and explore some new directions towards broadening the African bioethics agenda as we move forward to a new dawn for Africa in the 21st century. Political insider trading has brought substantial attention to ethical considerations in the academic literature. While the Stop Trading on Congressional Knowledge (STOCK) Act prohibits members of Congress and their staff from leveraging non-public information to make investment decisions, political insider trading still prevails. We discuss political ethics and social contract theory to re-engage the debate on whether political insider trading is _unethical_ and raises the issues of conflict of interest and social distrust. Empirically, using a novel measure (...) of information risk, we find that senator trades are associated with substantially high levels of information asymmetry. Moreover, based on inside political information, senators earn significant market-adjusted returns (4.9% over 3 months). Thus, our results do not support the prediction made by social contract theory and thereby provide a potential resolution to the ongoing debate on banning stock trading for members of Congress. Information cultures consist of the values, beliefs and behaviour relating to information ownership and management, while information ethics applies to the moral application of data. The author’s experience of Russia and its information culture provides a striking case study of the disastrous social and business consequences of an absence of information ethics. In the history of ethical thoughts of China and the West, ethical relations are always regarded as social relations among people, and the objects to which ethical norms apply are targeted for social business or man’s behavior. What traditional ethics concerns is ethical relationship among people or ethical feature of socialbusiness or man’s behavior. By comparison with it, environmental ethics has a good reputation for its research on ethical relationship between human being and natural environment. It (...) has been discussing and reconstructing ethical relationship between man and nature from the very beginning, and requires ethical solicitude or moral concern for natural environment. As a result, environmental ethics has to answer the question how it is possible. However, the mainstream views in environmental ethics, based on the position of moral expansion and non-anthropocentrism, can't and won't explain how environmental ethics is possible. What environmental ethics deals with is no other than the ethical relationship between man and man represented by the relationship between man and nature, what it confirms is no other than our obligations and duties to others and next generations when dealing with the relationship between man and nature, and finally, the criterion of evaluation it pursues in dealing with the man-nature relationship is no other than the integrated and long-run interest of all human beings. All these are the ground on which the contemporary environmental ethics stands possibly. (shrink)

Proponents of care ethics tend to reject the ideals of historical republicanism and the enlightenment because they do not take into account the centrality of the roles played by carers or caregivers in society. Furthermore this is irremediable because of enlightenment’s prizing of reason over and above emotions and of independence over relationships. In this paper I argue that such a wholesale rejection is misguided because it is based on a fundamental misunderstanding of the ideals of enlightenment and republicanism (...) which did value both the emotions and relationships. I focus on the example of one feminist republican writer of the eighteenth century, Sophie de Grouchy, and argue that her response to Adam Smith’s Theory of Moral Sentiments, the Letters on Sympathy provide a model for a feminist republican social reform. I discuss de Grouchy’s arguments on the relationship between sympathy and morality, and on the kind of social and political reforms which are needed in order to ensure that sympathy can operate freely as a regulator of human interactions. I also show how her claim that sympathy originates in the first human relationships, namely between a child and the woman who feeds them means that in this republican account, mothering is identified as central to the well-functioning of human society. Ethics in sport demand not only that we respect ourselves and others, but also that we respect sport itself. But the question of respecting sport seems to create a kind of moral dilemma between the obligation to “play one’s best” by maximizing performance, and the obligation to follow rules and traditions that ban the use of ergogenic aids. It is often argued that bans on performance-enhancing substances, equipment, and training techniques are paternalistic and violate athletes’ liberty to rationally accept (...) risks in their pursuit of excellence. Against advocates for the legalization of ergogenic aids, however, I argue in this paper that such bans must be respected because they are an essential part of the nature of sport. Whether one understands sports metaphysically to be Suits’ “voluntary attempt to overcome unnecessary obstacles” or a MacIntyrean social practice, inefficiency of means is an essential component sport that demands respect from all participants. The performance principle in sport is ontologically posterior to the prescription of inefficiencies upon which sport depends, so ethical respect for sport demands that we limit the efficiencies provided by ergogenic aids.
