(Oxford Classical Monographs)The four decades between the accession of Diocletian on 20 November 284 and the abdication of Licinius on 19 September 324 witnessed profound changes in the government and administrative structure (...) of the Roman world. These changes are naturally reflected in the legislation of the period, which survives in relative abundance—indeed, a larger proportion of the emperors’ legal decisions and enactments probably survives from these four decades than from any previous period of forty years in the history of the Roman Empire. The high rate of survival is due in part to the activity of the commissioners who compiled the Theodosian Code in the 430s and the Codex Justinianus in the sixth century: the former set out to collect general laws and edicts of the Christian Roman Empire since the conversion of Constantine, while the latter included in their compilation a large part of two Diocletianic collections of imperial rescripts, the Codex Gregorianus and the Codex Hermogenianus. But the legislation of Diocletian and his imperial colleagues and successors is also known from a wide variety of other sources—papyri, inscriptions, nonofficial collections of laws, Lactantius’ account of the decade of Christian persecution from 303 to 313 in his On the Deaths of the Persecutors, and Eusebius’ Ecclesiastical History. Moreover, Eusebius’ Life of Constantine quotes important documents from the last months of 324.Simon Corcoran includes all this varied and historically significant material in his purview, and he provides a reliable guide to it. His monograph is a revised version of an Oxford doctoral thesis which he began in 1987 under the supervision of Fergus Millar and completed in 1992 under that of John Matthews, and he has also taken advice from Tony Honoré. His work is technically proficient. I have not noticed any careless errors of any consequence, and Corcoran has used my work on the period of Diocletian and Constantine in the spirit in [End Page 145] which I intended it to be used: he has understood the underlying principles upon which it rests, then applied them critically, sometimes to reach conclusions which not only differ from my own but are superior to them.Corcoran begins with two introductory chapters which succinctly survey the subject and the evidence available. On interpolation in legal texts, he is cautious and sensible. He proceeds on the assumption that though “the transmitted texts are seldom identical with what the imperial chancery originally issued,” they have seldom undergone drastic alteration: “abbreviation is the most common fate of constitutions in the legal sources” (19). Yet he provides a salutary reminder and example of what can happen (16–18): whereas a rescript in the Fragmenta Vaticana denies that the temporary gift of estates subject to tax is valid (Frag. Vat. 283, si stipendariorum proprietatem dono de-disti,... donatio inrita est), the same rescript in the Codex Justinianus directly contradicts and asserts that such a gift is valid (CJ 8.54.2, si praediorum proprietatem dono dedisti,... donatio valet). On a priori grounds alone, it seems highly probable that something similar has happened to some texts which are known only through the Codex Justinianus—and where the alteration may not be at all obvious.What of the date and contents of the two Diocletianic codes? Corcoran confronts the problems of dating and attribution squarely and honestly. Most of his conclusions may not be new, but his discussion has been able to proceed from the fact that an Aurelius Hermogenianus, who can hardly be anyone other than the jurist, is now securely attested as praetorian prefect between 293 and 305 with Julius Asclepiodotus as his colleague (AE 1987, 456). Corcoran argues that Gregorius published the Codex Gregorianus in 291/2 or ca. 292, after serving as magister libellorum with Diocletian from 285 to 290: he accounts for the ascription of some later constitutions to this code by postulating a second edition compiled ca. 306, possibly at the court of Maximinus or... The return to religion has perhaps become the dominant cliche of contemporary theory, which rarely offers anything more than an exaggerated echo of a political reality dominated by religious war. Somehow, the secular age seems to have been replaced by a new era, where political action flows directly from metaphysical conflict. The Faith of the Faithless asks how we might respond. Following Critchley's Infinitely Demanding, this new book builds on its philosophical and political framework, also venturing into the questions of (...) faith, love, religion and violence. Should we defend a version of secularism and quietly accept the slide into a form of theism--or is there another way? From Rousseau's politics and religion to the return to St. Paul in Taubes, Agamben and Badiou, via explorations of politics and original sin in the work of Schmitt and John Gray, Critchley examines whether there can be a faith of the faithless, a belief for unbelievers. The authors challenge the reigning “causal power framework” as an explanation for whether a particular outcome was actually caused by a specific potential cause. They test a new measure of causal attribution in two experiments by embedding the measure within the Structure Induction model of Singular Causation (SISC, Stephan & Waldmann, 2016).

This article investigates the prospects of deliberative democracy through the analysis of small-scale deliberative events, or mini-publics, using empirical methods to understand the process of preference transformation. Evidence from two case studies suggests that deliberation corrects preexisting distortions of public will caused by either active manipulation or passive overemphasis on symbolically potent issues. Deliberation corrected these distortions by reconnecting participants’ expressed preferences to their underlying “will” as well as shaping a shared understanding of the issue.The article concludes by using these (...) insights to suggest ways that mini-public deliberation might be articulated to the broader public sphere so that the benefits might be scaled up. That mini-public deliberation does not so much change individual subjectivity as reconnect it to the expression of will suggests that scaling up the transformative effects should be possible so long as this involves communicating in the form of reasons rather than preferred outcome alone. While most large companies around the world now have a code of ethics, reported ethical malpractice among some of these does not appear to be abating. The reasons for this are explored, using academic studies, survey reports as well as insights gained from the Institute of Business Ethics' work with large corporations. These indicate that there is a gap between the existence of explicit ethical values and principles, often expressed in the form of a code, and the attitudes and behaviour (...) of the organisation. The paper suggests that two basic reasons appear to be at the heart of the problem: ineffective ethics programmes and deficiencies in corporate culture. The paper concludes that successfully embedded corporate ethical values requires well-designed ethics policies, sustained ethical leadership and incorporation of ethics in organisational processes and strategy as part of an ethical culture at all levels of the organisation. Physicians make some medical decisions without disclosure to their patients. Nondisclosure is possible because these are silent decisions to refrain from screening, diagnostic or therapeutic interventions. Nondisclosure is ethically permissible when the usual presumption that the patient should be involved in decisions is defeated by considerations of clinical utility or patient emotional and physical well-being. Some silent decisions - not all - are ethically justified by this standard. Justified silent decisions are typically dependent on the physician's professional judgment, experience and (...) knowledge, and are not likely to be changed by patient preferences. We condemn the inappropriate exclusion of the patient from the decision-making process. However, if a test or treatment is unlikely to yield a net benefit, disclosure and discussion are at times unnecessary. Appropriate silent decisions are ethically justified by such considerations as patient benefit or economy of time. (shrink)

The relational approach to tense holds that the now, passage, and becoming are to be understood in terms of relations between events. The debate over the adequacy of this framework is illustrated by a comparative study of the sense in which physical theories, (in)deterministic and (non)relativistic, can lend expression to the metaphysics at issue. The objective is not to settle the matter, but to clarify the nature of this metaphysics and to establish that the same issues are at stake in (...) the relational approach to value-definiteness and probability in quantum mechanics. Interventions that are designed to stem plagiarism do not always override the motivation of individuals to cheat and, therefore, may not diminish misconduct. To inform more effective approaches, we conducted a systematic review to clarify the psychological causes of plagiarism. This review of 83 empirical papers showed that a specific blend of circumstances may foster plagiarism: an emphasis on competition and success rather than development and cooperation coupled with impaired resilience, limited confidence, impulsive tendencies, and biased cognitions. I develop a challenge for the view that 'believe' is a propositional attitude verb based on two observations: (i) 'believe' can embed 'in O', and (ii) 'in O' does not denote a proposition. To develop my challenge, I argue (section 2) that 'believe' is not homonymous or polysemous between a propositional belief-that and non-propositional belief-in interpretation, and (section 3) that type-shifting 'in O'’s denotation to a proposition falsely predicts that belief-in and belief-that reports are equivalent.

This paper examines the process through which micro-businesses ‘go green’. It builds upon previous studies that have identified the different drivers of this greening process. However, rather than a static focus on specific drivers, the study articulates the evolution of environmental practices over time. The paper uses comparative case studies of six micro-businesses to build a composite sequence analysis that plots the greening process from its roots through to large-scale and ambitious ecological projects. The study identifies three distinct stages that (...) businesses pass through during this greening process. This has important implications for policy-makers and advisors as it was found that the support needed by the businesses changed as they passed through these different stages. In particular, it was found that appropriate support is currently lacking at certain key points of the businesses' greening development. The paper therefore adds to current understanding of small business ecological responsibility by showing how activities and drivers change with the level of engagement. I show that frequentism, as an explanation of probability in classical statistical mechanics, can be extended in a natural way to a decoherent quantum history space, the analogue of a classical phase space. The result is a form of finite frequentism, in which Gibbs’ concept of an infinite ensemble of gases is replaced by the quantum state expressed as a superposition of a finite number of decohering microstates. It is a form of finite and actual frequentism (as opposed to hypothetical (...) frequentism) insofar as all the microstates exist, in keeping with the decoherence-based Everett interpretation, and some versions of pilot-wave theory. John Cook Wilson is an important predecessor of contemporary knowledge first epistemologists: among other parallels, he claimed that knowledge is indefinable. We reconstruct four arguments for this claim discernible in his work, three of which find no clear analogues in contemporary discussions of knowledge first epistemology. We pay special attention to Cook Wilson’s view of the relation between knowledge and forms of thinking (like belief). Claims of Cook Wilson’s that support the indefinability of knowledge include: that knowledge, unlike belief, straddles (...) an active/passive divide; that, rather than entailing belief, knowledge excludes belief; and that understanding forms of thinking other than knowledge (such as belief) depends on understanding knowledge. Reflecting on Cook Wilson’s framework highlights underappreciated concerns relevant to any attempt to define knowledge. (shrink)

In this paper we argue that the consensus around normative standards for the ethics of research in clinical trials, strongly influenced by the Declaration of Helsinki, is perceived from various quarters as too conservative and potentially restrictive of research that is seen as urgent and necessary. We examine this problem from the perspective of various challengers who argue for alternative approaches to what ought or ought not to be permitted. Key themes within this analysis will examine these claims and argue (...) they have implications for the interests of the research subject, research governance and regulation. Using our work with TREAT-NMD, the neuromuscular clinical trials network, we posit that there is a place for advancing the discourse of moral rights and moral duties in the context of research, especially from the perspective of patients and their families, and for including the politics of patient activism and empowerment. At the same time we remain vigilant to the danger that the therapeutic misconception and other serious vulnerabilities for the patient population in clinical trials, are at risk of being overlooked. Based on two qualitative case studies undertaken in Switzerland, this article compares the positioning of Climate Strike activists and construction workers on questions of climate change, so as to analyse the impact of work practices on environmental orientations. Building on a praxeological approach, the article argues that communities of practice in workplaces and educational institutions influence environmental orientations. Everyday practice in schools and universities fosters the scientific environmental knowledge that is central to the orientations of climate activists. By contrast, the (...) practice of construction workers inculcates an embodied environmental knowledge which accompanies an orientation that takes environmental problems as not primarily a question of conservation, but rather as inherently linked to workplace matters. By way of conclusion, the article argues for an expanded notion of environmental concerns, beyond the acceptance of scientific facts on ecological crisis and towards embracing the embodied environmental knowledge more broadly prevalent among manual workers. Over the past few years the use of stimulants such as methylphenidate and modafinil among the student population has attracted considerable debate in the pages of bioethics journals. Under the rubric of cognitive enhancement, bioethicists have discussed this use of stimulants—along with future technologies of enhancement—and have launched a sometimes forceful debate of such practices. In the following paper, it is argued that even if we focus solely upon current practices, the term cognitive enhancement encompasses a wide range of ethical (...) considerations that can usefully be addressed without the need for speculation. In taking this position it is suggested that we divide cognitive enhancement into a series of empirically-constructed frameworks—medical risks and benefits, self-medication and under-prescription, prescription drug abuse and over-medication, and finally, the intention to cognitively enhance. These are not mutually exclusive frameworks, but provide a way in which to identify the scope of the issue at hand and particular ethical and medical questions that may be relevant to enhancement. By a process of elimination it is suggested that we can indeed talk of cognitive enhancement as an observable set of practices. However, in doing so we should be aware of how academic commentaries and discussion may be seen as both capturing reality and reifying cognitive enhancement as an entity. (shrink)

The concept of indistinguishable particles in quantum theory is fundamental to questions of ontology. All ordinary matter is made of electrons, protons, neutrons, and photons and they are all indistinguishable particles. Yet the concept itself has proved elusive, in part because of the interpretational difficulties that afflict quantum theory quite generally, and in part because the concept was so central to the discovery of the quantum itself, by Planck in 1900; it came encumbered with revolution. I offer a deflationary reading (...) of the concept ‘indistinguishable’ that is identical to Gibbs’ concept ‘generic phase’, save that it is defined for state spaces with only finitely-many states of bounded volume and energy. That, and that alone, makes for the difference between the quantum and Gibbs concepts of indistinguishability. This claim is heretical on several counts, but here we consider only the content of the claim itself, and its bearing on the early history of quantum theory rather than in relation to contemporary debates about particle indistinguishability and permutation symmetry. I develop a challenge for a widely suggested knowledge-first account of belief that turns, primarily, on unknowable propositions. I consider and reject several responses to my challenge and sketch a new knowledge-first account of belief that avoids it.

Although the therapeutic misconception (TM) has been well described over a period of approximately 20 years, there has been disagreement about its implications for informed consent to research. In this paper we review some of the history and debate over the ethical implications of TM but also bring a new perspective to those debates. Drawing upon our experience of working in the context of translational research for rare childhood diseases such as Duchenne muscular dystrophy, we consider the ethical and legal (...) implications of the TM for parental consent to research. In this situation, it is potentially the parent who is vulnerable to TM. In our analysis we not only consider the context of informed consent for research but also the wider environment in which the value of research is promoted, more broadly through the media but also more specifically through the communication strategies of patient organizations. All dissemination about developments in research for health runs the risk of portraying an overly optimistic view of the promise of biotechnological solutions and has the potential to encourage a ‘collective’ TM. In this paper we consider the challenge that TM presents to parents as well as explore the ethical and legal responsibilities of researchers to ensure an appropriately informed consent: compatible with a hopeful disposition of parents who consent for the their children whilst avoiding a blind and misleading optimism. Since the advent of accessible online computing, the digital divide existed, it exists today and it will exist tomorrow. It means that almost every aspect of life will be affected, particularly for those who are most vulnerable for whatever reason. It is important that research-informed action addresses this unacceptable state. In this special issue, a number of perspectives are taken to consider different aspects of the digital divide. In total, they illustrate the synergistic value of crossing disciplinary boundaries and adopting (...) a plethora of research methods and philosophies. Abstract:This paper offers a short account of Prospect-Refuge theory, Jay Appleton's pioneering contribution to landscape aesthetics published as The Experience of Landscape in 1975. I discuss the theory's influence on a variety of writers, and introduce the photographic exhibition that Professor Appleton and I produced in the year before his death, featuring views of Britain that articulate his key principles. The paper ends with the suggestion that current phenomenological approaches in the Humanities give a new relevance to Appleton's work, which (...) always stressed the significance of the imagination interpreting and recreating the world. Narratives of supply chains and raw materials are a poor fit for early modern Europeans’ “thrifty” habit of reusing and reworking goods into new forms. This essay stresses the importance of such habits for early modern work using the example of paper, as a medium, instrument, and epistemic resource in various domestic and scientific spheres. Thrifty perspectives challenge not only linear supply narratives but also enduring accounts of the identities of materials themselves.
