In Free Will and Luck, Mele presents a case of an agent Ernie, whose zygote was intentionally designed so that Ernie A-s in 30 years, bringing about a certain event E. Mele uses this case of original design to outline the zygote argument against compatibilism. In this paper I criticize the zygote argument. Unlike other compatibilists who have responded to the zygote argument, I contend that it is open to the compatibilist to accept premise one, that Ernie does not act (...) freely and is not morally responsible for anything he does. I argue that compatibilists should deny premise two. Diana’s effective intention to create Ernie’s zygote such that Ernie A-s in 30 years and her intervention to bring about his A-ing mark a significant difference between Ernie and normal agents in a deterministic universe with regard to how their zygotes were created that affects whether those agents act freely and are morally responsible for so acting. In Against Moral Responsibility, Bruce Waller launches a spirited attack on a system that is profoundly entrenched in our society and its institutions, deeply rooted in our emotions, and vigorously defended by philosophers from ancient times to the present. Waller argues that, despite the creative defenses of it by contemporary thinkers, moral responsibility cannot survive in our naturalistic-scientific system. The scientific understanding of human behavior and the causes that shape human character, he contends, leaves no room for moral (...) responsibility. Waller argues that moral responsibility in all its forms--including criminal justice, distributive justice, and all claims of just deserts--is fundamentally unfair and harmful and that its abolition will be liberating and beneficial. What we really want--natural human free will, moral judgments, meaningful human relationships, creative abilities--would survive and flourish without moral responsibility. In the course of his argument, Waller examines the origins of the basic belief in moral responsibility, proposes a naturalistic understanding of free will, offers a detailed argument against moral responsibility and critiques arguments in favor of it, gives a general account of what a world without moral responsibility would look like, and examines the social and psychological aspects of abolishing moral responsibility. In this article the author makes the case for a hybrid sourcehood–leeway compatibilist account of free will. To do so, she draws upon Lehrer’s writing on free will, including his preference-based compatibilist account and Frankfurt-style cases from the perspective of the cognizant agent. The author explores what distinguishes kinds of intentional influence in manipulation cases and applies this distinction to a new perspectival variant of Frankfurt cases, those from the perspective of the counterfactual intervenor. She argues that it matters what (...) kind of intentional influence is at issue in the counterfactual intervention and, further, that our judgments about desert of praise are affected by occupying the POV of the counterfactual intervenor. The author concludes that such attention to perspectival variants of Frankfurt cases supports the view that compatibilist sourcehood accounts of moral responsibility require an additional compatibilist could-have-done-otherwise condition to capture a more robust sense of moral responsibility. The great biologist Louis Pasteur suppressed 'awkward' data because it didn't support the case he was making. John Snow, the 'first epidemiologist' was doing nothing others had not done before. Gregor Mendel, the supposed 'founder of genetics' never grasped the fundamental principles of 'Mendelian' genetics. Joseph Lister's famously clean hospital wards were actually notorious dirty. And Einstein's general relativity was only 'confirmed' in 1919 because an eminent British scientist cooked his figures. These are just some of the revelations explored in (...) this book. Drawing on current history of science scholarship, Fabulous Science shows that many of our greatest heroes of science were less than honest about their experimental data and not above using friends in high places to help get their ideas accepted. It also reveals that the alleged revolutionaries of the history of science were often nothing of the sort. Prodigiously able they may have been, but the epithet of the 'man before his time' usually obscures vital contributions made their unsung contemporaries and the intrinsic merits of ideas they overturned. These distortions of the historical record mostly arise from our tendency to read the present back into the past. The patient's right to informed consent is grudgingly acknowledged by medical professionals, firmly established in law, and brandished as a shibboleth by most bioethicists. But questions remain concerning genuine patient autonomy, and the doctrine of informed consent offers inadequate answers. In addition to the continuing controversy over what counts as “informed,” the passive acquiescence implied by “consent” seems a pale shadow of genuine autonomy.

Analogies come in several forms that serve distinct functions. Inductive analogy is a common type of analogical argument, but critical thinking texts sometimes treat all analogies as inductive. Such an analysis ignores figurative analogies, which may elucidate but do not argue; and also neglects a priori arguments by analogy, a type of analogical argument prominent in law and ethics. A priori arguments by analogy are distinctive, but--contrary to the claims of Govier and Sunstein-they are best understood as deductive, rather than (...) a special form of non deductive reasoning. Moving beyond the retributive system requires clearing away some of the basic assumptions that form the foundation of that system: most importantly, the assumption of moral responsibility, which is held in place by deep and destructive belief in a just world. Efforts to justify moral responsibility typically appeal to some version of self-making, and that appeal is only plausible through limits on inquiry. Eliminating moral responsibility removes a major impediment to deeper inquiry and understanding of the biological, social, and environmental (...) causes of both vicious and virtuous behavior. The resources for moving beyond the moral responsibility are already being developed in social democratic corporatist cultures as well as in workplace management models that nurture commitment and reject blame and shame. Without moral responsibility we must face the unpleasant fact that although punishment is sometimes unavoidable it is always unjust. That unpleasant fact motivates difficult but beneficial changes that minimize both the extent and the severity of punitive measures. (shrink)

Cognitive hearing science is mainly about the study of how cognitive factors contribute to speech comprehension, but cognitive factors also partake in speech processing to infer non-linguistic information from speech signals, such as the intentions of the talker and the speaker’s age. Here, we report two experiments on age estimation by “naïve” listeners. The aim was to study how speech rate influences estimation of speaker age by comparing the speakers’ natural speech rate with increased or decreased speech rate. In Experiment (...) 1, listeners were presented with audio samples of read speech from three different speaker age groups (young, middle aged, and old adults). They estimated the speakers as younger when speech rate was faster than normal and as older when speech rate was slower than normal. This speech rate effect was slightly greater in magnitude for older (60–65 years) speakers in comparison with younger (20–25 years) speakers, suggesting that speech rate may gain greater importance as a perceptual age cue with increased speaker age. This pattern was more pronounced in Experiment 2, in which listeners estimated age from spontaneous speech. Faster speech rate was associated with lower age estimates, but only for older and middle aged (40–45 years) speakers. Taken together, speakers of all age groups were estimated as older when speech rate decreased, except for the youngest speakers in Experiment 2. The absence of a linear speech rate effect in estimates of younger speakers, for spontaneous speech, implies that listeners use different age estimation strategies or cues (possibly vocabulary) depending on the age of the speaker and the spontaneity of the speech. Potential implications for forensic investigations and other applied domains are discussed. (shrink)

If the physical constants, initial conditions, or laws of nature in our universe had been even slightly different, then the evolution of life would have been impossible. This observation has led many philosophers and scientists to ask the natural next question: why is our universe so "fine-tuned" for life? The debates around this question are wide-ranging, multi-disciplinary, complicated, technical, and heated. This study is a comprehensive investigation of these debates and the many metaphysical and epistemological questions raised by cosmological fine-tuning. (...) Waller's study reaches two significant and controversial conclusions. First, he concludes that the criticisms directed at the "multiverse hypothesis" by theists and at the "theistic hypothesis" by naturalists are largely unsuccessful. Neither of these options can plausibly be excluded. Choosing between them seems to turn on primitive metaphysical intuitions. Second, in order to break the philosophical deadlock, Waller moves the debate from the level of universes to the level of possible worlds. Arguing that possible worlds are also "fine-tuned" in an important and interesting sense, Waller concludes that the only plausible explanation for the fine-tuning of the actual world is to posit the existence of some kind of "God-like-thing.". Many nonhuman animals produce facial expressions which sometimes bear clear resemblance to the facial expressions seen in humans. An understanding of this evolutionary continuity between species, and how this relates to social and ecological variables, can help elucidate the meaning, function, and evolution of facial expression. This aim, however, requires researchers to overcome the theoretical and methodological differences in how human and nonhuman facial expressions are approached. Here, we review the literature relating to nonhuman facial expressions and suggest future directions (...) that could facilitate a better understanding of facial expression within an evolutionary context. Neuroscientists have located brain activity that prepares or encodes action plans before agents are aware of intending to act. On the basis of these findings and broader agency research, activity in these regions has been proposed as the neural realizers of practical intention. My aim in this paper is to evaluate the case for taking these neural states to be neural representations of intention. I draw on work in philosophy of action on the role and nature of practical intentions to (...) construct a framework of the functional profile of intentions fit for empirical investigation. With this framework, I turn to the broader empirical neuroscience literature on agency to assess these proposed neural representations of intention. I argue that while these neural states in some respects satisfy the functions of intention in planning agency prospective of action, their fit with the role of intention in action execution is not well supported. I close by offering a sketch of which experimental task features could aid in the search for the neural realizer of intention in action. (shrink)

The aim of this dissertation is to respond to a collection of conceptual and scientific threats to compatibilist accounts of free will, particularly reasons-responsive views. Compatibilists hold that free will is compatible with the truth of determinism. Some compatibilists also claim that some actual agent at least sometimes acts freely, where it is true that she acts freely in virtue of her satisfying a specific set of control and epistemic conditions. These conditions often include the possession of certain capacities, such (...) as the capacity to recognize reasons for acting and to act on the basis of those reasons. First, I address two pressing philosophical objections to the adequacy of compatibilist accounts of free will: Are reasons-responsive accounts of free will too permissive in their class of free agents? Must reasons-responsive theorists - and compatibilists more generally - concede that some agents who are manipulated or intentionally designed by others are none the less acting freely and morally responsible for their actions? I then survey a widely proposed scientific threat to compatibilist accounts of free will - and to any account of free will that requires the same basic capacities as compatibilists do: Even if the compatibilist account accurately captures the basic capacities that an agent requires to act freely, does neuroscientific work on practical decision-making and action production limit - or worse, speak against -- our actual exercise of free will, as compatibilists conceive of it? I argue that the compatibilist need not yield to these philosophical challenges to the adequacy of their accounts of free will and to their claim that some actual agents act freely, sketching plausible compatibilist-friendly reasons to doubt the potency of each challenge. Finally, I argue that the extant incompatibilist accounts of free will suffer from a previously undiagnosed, serious problem: that there is an irreconcilable tension between the way in which philosophers motivate the incompatibilist ability to do otherwise and the way in which they formally express it. I conclude by offering a diagnosis for the future of the free will debate given the arguments advanced. (shrink)

Music’s sanctioned role in the day-to-day running of the ‘late-modern’ prison is to ensure wellbeing and compliance of prisoners, with most regimes facilitating access to music through the form of radios, cd’s, and cassette players. As a result, music often comes tied to judgements by the regime about prisoners’ conduct, with incentive systems allowing the regime to confiscate earned possessions under certain conditions. In this way, the role of music in prison is often continuous with the mechanisms of carceral control, (...) with its ‘humanising’ or ‘therapeutic’ effects being defined as a luxury to be earned through good behaviour and critical engagement with one’s moral and psychological treatment. By tracing the history of music during the birth of the modern prison in the nineteenth century, this paper asks how music became incorporated into the discourse and technology of the emerging carceral state. Drawing principally on the work of Michel Foucault, this paper seeks to explore the relationship between music and ‘the self’ as it is applied to carceral subjects. Foucault shows how the expansion of the carceral state at the end of the nineteenth century relied on the production of knowledge about the subject through the application of disciplinary techniques. By exploring the construction of the self through the discourse of music at the end of the eighteenth century and in the published works of carceral reformers at the end of the nineteenth century, this paper seeks to explore the role that music played within this period of carceral expansion. The discussion will focus on the ways in which music acts as a conduit for forms of carceral power through its relationship with the self. (shrink)

Waller Keywords freedom, locus of control, psychoanalysis, self-efficacy, volition Cognitive behavioral research on locus of control and self-efficacy has produced an extensive body of empirical results that might prove useful to psychoanalytic researchers endeavoring to strengthen the empirical foundation of psychoanalytic therapy. Cognitive-behaviorists and psychoanalysts share a common (...) interest in the importance of perspectives and belief systems and their impact on individual freedom, and comparative research on therapeutic effectiveness could yield benefits for both therapeutic approaches.Locus of control and self-efficacy are central elements in cognitive-behavioral psychology, and they play an important role in cognitive-behavioral therapy. Although the psychoanalytic approach does not explicitly employ those concepts, psychoanalytic therapists are obviously concerned with problems of effective action and internal obstacles to action. Attention to these two perspectives and their overlapping interests offers potential benefits for both the cognitive-behavioral and the psychodynamic approaches to psychological research and therapy.One potential benefit is the development of useful tools for advancing empirically based research on psychoanalysis. As Lehrer (1999) states, it is advantageous to ground psychoanalysis in "firm empirical evidence whenever possible." Although there have obviously been significant positive steps in that direction (Singer 2003; Weiss 1995, 1988; Weiss and Sampson 1986), psychoanalytic researchers have recognized that one source of difficulty is in finding clearly measurable research objectives and hypotheses (Burgin 2002). Cognitive-behavioral research on locus of control and self-efficacy has produced an extensive body of research using clear measurement standards that could prove useful in the empiricist approach to psychodynamic theories. In particular, those cognitive-behavioral research findings might offer a means of extending empirical investigation of psychodynamic theory in a direction usually regarded as difficult to test empirically: the study of psychoanalytic effectiveness to "change your way of seeing" (Lieberman 1999). Shifting locus of control or efficacy expectations in specific domains (Bandura 1997) [End Page 125] would empirically confirm the effectiveness of psychoanalytic techniques. It might well be that some efficacy expectations are enhanced more effectively by psychodynamic processes than by cognitive-behavioral therapy, or that psychoanalysis is effective in enhancing some specific efficacy expectations but not others. This could potentially extend the empirical examination of psychoanalytic theory as well as provide a base of comparison with cognitive-behavioral therapy techniques.Although self-efficacy enhancement might be a fruitful empirical test for psychodynamic therapy, therapeutic intervention to modify locus of control potentially could be even more productive. Current research indicates that one's orientation toward locus of control is a relatively stable characteristic, although it can be modified (Holyrod et al. 1984; Rotter 1979; Sadow and Hopkins 1993). One reason for locus of control stability may be that the locus of control imposes a perspective on the conceptualization of all one's experiences: from a strong internal locus of control perspective I view failures and successes as largely my own doing, whereas from an external locus perspective even my most effective efforts are seen as events that were outside my control: "I guess it was just my time to do well on a math exam," rather than "My hard work for that exam really paid off." (Lieberman makes this phenomenon quite clear in his excellent discussion of transparency.) Although locus of control is not easily modified, it is important to find effective means of helping subjects to achieve such changes, because research shows that a strong internal locus of control is positively correlated with success in work, sports, studies, marriage, and psychological adjustment (Lefcourt 1981, 1992), as well as with better health care behavior and better health (Bandura 1977; Schorr and Rodin 1982; Schulz 1976; Schulz and Hanusa 1978; Wallston 1993). Those deeply enmeshed in an external locus of control enjoy less real freedom and suffer severe disadvantages.How does one effect a shift in such a basic orientation? Not easily.
