BackgroundUse of modified texture diets—thickening of liquids and modifying the texture of foods—in the hope of preventing aspiration, pneumonia and choking, has become central to the current management of dysphagia. The effectiveness of this intervention has been questioned. We examine requirements for a valid informed consent process for this approach and whether the need for informed consent for this treatment is always understood or applied by practitioners.Main textValid informed consent requires provision of accurate and balanced information, and that agreement is (...) given freely by someone who knows they have a choice. Current evidence, including surveys of practitioners and patients in different settings, suggests that practice in this area is often inadequate. This may be due to patients’ communication difficulties but also poor communication—and no real attempt to obtain consent—by practitioners before people are ‘put on’ modified texture diets. Even where discussion occurs, recommendations may be influenced by professional misconceptions about the efficacy of this treatment, which in turn may poison the well for the informed consent process. Patients cannot make appropriate decisions for themselves if the information provided is flawed and unbalanced. The voluntariness of patients’ decisions is also questionable if they are told ‘you must’, when ‘you might consider’ is more appropriate. Where the decision-making capacity of patients is in question, inappropriate judgements and recommendations may be made by substitute decision makers and courts unless based on accurate information.ConclusionResearch is required to examine the informed consent processes in different settings, but there is ample reason to suggest that current practice in this area is suboptimal. Staff need to reflect on their current practice regarding use of modified texture diets with an awareness of the current evidence and through the ‘lens’ of informed consent. Education is required for staff to clarify the importance of, and requirements for, valid informed consent and for decision making that reflects people’s preferences and values. (shrink)

The idea that incompatibilism is intuitive is one of the key motivators for incompatibilism. Not surprisingly, then philosophers who defend incompatibilism often claim that incompatibilism is the natural, commonsense view about free will and moral responsibility (e.g., Pereboom 2001, Kane Journal of Philosophy 96:217–240 1999, Strawson 1986). And a number of recent studies find that people give apparently incompatibilist responses in vignette studies. When participants are presented with a description of a causal deterministic universe, they tend to deny that people (...) are morally responsible in that universe. Although this suggests that people are intuitive incompatibilists, Eddy Nahmias and Dylan Murray, in a recent series of important papers, have developed an important challenge to this interpretation. They argue that people confuse determinism with bypassing, the idea that one’s mental states lack causal efficacy. Murray and Nahmias present new experiments that seem to confirm the bypassing hypothesis. In this paper, we use structural equation modeling to re-examine the issue. We find support instead for an incompatibilist explanation of the bypassing results, i.e., incompatibilist judgments seem to cause bypassing judgments. We hypothesize that this phenomenon occurs because people think of decisions as essentially indeterministic; thus, when confronted with a description of determinism they tend to think that decisions do not even occur. We provide evidence for this in three subsequent studies which show that many participants deny that people make decisions in a deterministic universe; by contrast, most participants tend to allow that people add numbers in a deterministic universe. Together, these studies suggest that bypassing results don’t reflect a confusion, but rather the depth of the incompatibilist intuition. (shrink)

In ‘Rethinking Nature,’ Shaun Gallagher makes the case for a non-reductive, naturalized phenomenology. In doing so, he seeks to close the metaphysical gap between world and mind by pursuing a ‘world > mind’ strategy, conforming the natural world to the world of reason and experience. Here I assess the merits of this approach by comparison with the alternative ‘mind > world’ strategy, whereby the the world of reason and experience is conformed to the natural world. This latter approach is (...) exemplified by the method of ‘triangulating’ the mind through the integration of experiential, psychological, and neurophysiological evidence. While sympathetic to Gallagher’s ambition and aspects of his approach, I raise some doubts about the anti- or non-representational model of mind that he believes his revisionist metaphysics of nature supports. Arguably, representational assumptions are built into the concepts of perception, the senses, and the mind itself. Thus, even if the metaphysical gap between mind and world can be closed, the epistemic gap between an agent and its environment must still be bridged by the engine of representation that is the extended and embodied mind. Eddy Nahmias and Dylan Murray have recently argued that when people take agents to lack responsibility in deterministic scenarios, they do so because they take agents’ beliefs, desires and decisions to be bypassed, having no effect on their actions. This might seem like an improbable mistake, but the Bypass Hypothesis is bolstered by intriguing experimental data. Moreover, if the hypothesis is correct, it provides a straightforward error theory for incompatibilist intuitions. This chapter argues that the Bypass Hypothesis, although promising (...) and potentially highly significant, does not provide the best explanation of the data. Results from two new studies strongly suggest that subjects with incompatibilist intuitions do not take determinism to imply that belief, desires, and decisions are bypassed. Together with an independently motivated account of judgments of moral responsibility, the Explanation Hypothesis, they instead suggest, first, that subjects have incompatibilist intuitions because they see agents in deterministic scenarios from an explanatory perspective in which mental states and decisions provide no independent input into what happens, and, second, that this explains why subjects seem to think that these states and decisions are causally bypassed. The results also undermine the suggestion, by David Rose and Shaun Nichols, that subjects make what seems like bypass judgments because they take determinism to exclude he existence of decisions. Volume 11 brings together all of Dewey's writings for 1918 and 1919. A Modern Language Association Committee on Scholarly Editions textual edition. Dewey's dominant theme in these pages is war and its after-math. In the Introduction, Oscar and Lilian Handlin discuss his philosophy within the historical context: The First World War slowly ground to its costly conclusion; and the immensely more difficult task of making peace got painfully under way. The armi-stice that some expected would permit a return to normalcy (...) opened instead upon a period of turbulence that agitated fur-ther a society already unsettled by preparations for battle and by debilitating conflict overseas. After spending the first half of 1918-19 on sabbatical from Columbia at the University of California, Dewey traveled to Japan and China, where he lectured, toured, and assessed in his essays the relationship between the two nations. From Peking he reported the student revolt known as the May Fourth Move-ment. The forty items in this volume also include an analysis of Thomas Hobbe's philosophy; an affectionate commemorative tribute to Theodore Roosevelt, our Teddy; the syllabus for Dewey's lectures at the Imperial University in Tokyo, which were later revised and published as Reconstruction in Philosophy; an exchange with former disciple Randolph Bourne about F. Mat-thias Alexander's Man's Supreme Inheritance; and, central to Dew-ey's creed, Philosophy and Democracy. His involvement in a study of the Polish-American community in Philadelphia--resulting in an article, two memoranda, and a lengthy report--is discussed in detail in the Introduction and in the Note on the Confidential Report ofConditions among the Poles in the United States. Ecological psychologists and enactivists agree that the best explanation for a large share of cognition is nonrepresentational in kind. In both ecological psychology and enactivist philosophy, then, the task is to offer an explanans that does not rely on representations. Different theorists within these camps have contrasting notions of what the best kind of nonrepresentational explanation will look like, yet they agree on one central point: instead of focusing solely on factors interior to an agent, an important aspect of cognition (...) is found in the link or coupling between an agent and the external world. This link is fluid, dynamic, and active in a variety of ways, and we do not need to add any internal extra something in the perception-action-cognition process. At the same time, even devout defenders of ecological psychology and enactivism recognize that plenty happens inside an agent during cognition. In particular, no one denies that the brain plays an important role. What, then, is the role of the brain if it’s not in the game of representing the environment? One possible option is to describe the brain as a resonant organ instead of a representational organ. In this paper we consider the history of resonance in more detail. Particular focus will be placed on two different sets of approaches that have developed the concept of resonance: a representational reading of resonance and a nonrepresentational, dynamic account of resonance. We then apply these accounts to a case study on music performance, specifically in the context of standard tonal jazz. From this application, we propose that a nonrepresentational resonance account consistent with both enactivism and ecological psychology is a viable way of explaining jazz performance. We conclude with future considerations on research regarding the brain as a resonant organ. (shrink)

Recent significant research in a number of disciplines centers around the concept of the sense of agency. Because many of these studies cut across disciplinary lines there is good reason to seek a clear consensus on what ‘sense of agency’ means. In this paper I indicate some complexities that this consensus might have to deal with. I also highlight an important phenomenological distinction that needs to be considered in any discussion of the sense of agency, regardless of how it gets (...) defined, and I offer some critical comments on some current models tied to the notion that the sense of agency has an ambiguous phenomenology. Components from a variety of existing theories combine with insights from the author's research to create an original theory of moral development.

The question of the ontological status of social wholes has been formative to the development of key positions and debates within modern social theory. Intrinsic to this is the contested meaning of the concept of emergence and the idea that the collective whole is in some way more than the sum of its parts. This claim, in its contemporary form, gives exaggerated importance to a simple truism of re-description that concerns all wholes. In this paper I argue that a better (...) way to test the ontological status of wholes is to ask whether their causal properties can be reduced to the qualities of their parts. If reduction is possible the ontological status of emergent wholes is diminished. A close analysis of William Wimsatt's definition, conceptualisation, and characterisation of emergent phenomena provides an understanding of the relationship between wholes and their parts and suggests, also, that the properties of collective phenomena of a social kind reduce to the activities of people. Social wholes and their parts reside in the same mode (or level) of organisation. This paper concludes by employing Jaegwon Kim's method of ‘functional reduction’ to demonstrate how to reduce the qualities of wholes to those of their parts. (shrink)

In the first part of this two-part article, I argued that, unlike the asocial classical labour theory of value, Marx's labour theory of value is a ‘truly social’ one. In fact, it is a purely social one. Marx's theory of value is nothing but his theory of the social forms distinctive of the capitalist mode of production. Thus, we may speak of those forms as value-forms, the commodity, money, capital, wage-labour, surplus-value and its forms of appearance, and more. The labour (...) that produces value, then, is labour of a peculiar social sort. This thought is entirely foreign to the classical labour theory of value, and, likewise, to Marxist accounts of value theory that mistake it for a radical version of Ricardian value theory. The gulf between the classical and the Marxian labour theories of value is wide. (shrink)

Decisions are performatives - or at least, they share important features with performative utterances that can elucidate our theory of what type of thought they are, and what they do. Namely, decisions have an analogous force to that of performatives, where the force of a propositional attitude or utterance is constituted by (i) its point, or purpose, which is mainly a matter of its direction-of-fit, and (ii) its felicity conditions. The force of both decisions and performatives (...) is to bring into being the states of affairs represented in their intentional contents, merely in virtue of the decision or performative’s occurrence and the satisfaction of the felicity conditions they presuppose. This volume presents articles which focus on the ethical evaluation of performance-enhancing technologies in sport. The collection considers whether drug doping should be banned; the rationale of not banning ethically contested innovations such as hypoxic chambers; and the implications of the prospects of human genetic engineering for the notion of sport as a development of 'natural' talent towards human excellence. The essays demonstrate the significance of the principles of preventing harm, ensuring fairness and preserving meaning to appraise whether a particular (...) performance enhancer is acceptable in the context of sport. Selected essays on various forms of human enhancement outside of sport that highlight other principles and concepts are included for comparative purpose. Sport enhancement provides a useful starting point to work through the ethics of enhancement in other human practices and endeavors, and sport enhancement ethics should track broader bioethical debates on human enhancement. As a whole, the volume points to the need to consider the values and meanings that people seek in a given sphere of human activity and their associated principles to arrive at a morally grounded and reasonable approach to enhancement ethics. The difference between the two is both substantial and significant; it is the difference between the rule of arbitrary power and the rule of law. This paper will seek to trace the genesis of an independent judicial power, in both theory and practice, through an examination of sections of The Constitutions of Clarendon, The Assize of Clarendon, Hobbes’ Leviathan, Locke’s Second (...) Treatise, Montesquieu’s Spirit of the Laws, as well as The Federalist Papers. Moreover, it will seek to establish its executive nature and to explain why it is so often (at least presently) misunderstood to be akin to the legislative power. (shrink)

With the rapid recent growth of naturalized metaethics, Richard Joyce’s paper sounds an appropriate cautionary note. It’s easy to be overwhelmed by sexy new data and to neglect the difficulties in using the data to draw major philosophical conclusions. One of the central views in the sights of naturalists has been moral rationalism. Jonathan Haidt (2001), Joshua Greene (this volume), Jesse Prinz (forthcoming), and I (2002, 2004b) have all used recent empirical findings to challenge moral rationalist views. Although Joyce is (...) not himself a moral rationalist (see Joyce 2002), he deftly works to beat back our attacks on moral rationalism. Here my goal is to uphold the view that empirical work can challenge moral rationalism in the aftermath of Joyce’s insightful discussion. (shrink)

Chapter 5 is an essay on the methodology of equilibrium theory. In the course of examining recent controversies concerning lawlike claims and "assumptions" in economic theory, I reach a position similar to J. S. Mill's. Neo-classical economics is what Mill would call "a separate science." It follows a deductive method, since its basic laws supported by everyday experience. In its general equilibrium formulation, equilibrium theory possesses, however, no explanatory worth and very little explanatory importance, since its idealizations are not legitimate. (...) General equilibrium theory ought fundamentally to be regarded as an explanation of how economic equilibrium is possible. ;In conclusion I argue that Sraffa's contribution is a legitimate form of economic theorizing. Those methodological views, like Lionel Robbins', which would proscribe the sort of piecemeal theorizing Sraffa exemplifies, are, as methodological strictures, unjustified. In fact they involve an ideological distortion. Given the weaknesses in general equilibrium theory identified in Chapters 3 and 5, one has good reason to be eclectic. The Austrian theory, despite the Cambridge criticisms, may be useful in some investigations. A much more segmented economics built around Sraffa's work may have a great deal to teach us. Theories of capital, interest and exchange value currently are underdeveloped, unsupported, and subject to ideological influence. ;In Chapter 3 one special formulation of intertemporal general equilibrium theory is examined. I argue that general equilibrium theory may be taken as a theory of the rate of interest to which the Cambridge criticisms do not apply. Puzzles remain, however, concerning both the apparently lawlike claims and the unrealistic stipulations concerning background conditions that general equilibrium theory makes. ;In Chapter 4 Sraffa's system in The Production of Commodities by Means of Commodities is presented and tentatively assessed. I argue that it is consistent with equilibrium theory, but may be combined with other claims that are not consistent with equilibrium theory. What is puzzling but, I argue, methodologically legitimate in Sraffa's work is that he takes as givens factors like the composition of output, that are themselves subject to further economic analysis. Sraffa's work, when properly understood, can prove valuable to Marxian economists. ;Chapter 1 establishes a contrast between physical cost and marginal utility theories of exchange value and examines why issues concerning capital and interest are theoretically central to both theories. I point out that physical cost theories of value are not tenable. ;Chapter 2 is concerned with simplified aggregate capital theories, especially Wicksell's Austrian theory of capital, and with the Cambridge criticisms of such theories. The Cambridge criticisms show, I conclude, that aggregative capital theories make unwarranted economic claims. ;This dissertation examines from both an economic and a philosophical perspective controversies concerning the theory of capital and interest and the relationship of capital and interest to exchange value. The fundamentals of the neo-classical and neo-Ricardian approaches to economic theory are made explicit and compared. The neo-Ricardian approach is partially defended. (shrink)

This paper presents an empirical account of mediatization from a Bourdieuian perspective, based on the development of a number of new concepts, such as cross-field effects and the rescaling of such effects as linked to processes of globalization. Built on an Australian empirical case relating to educational policy and the knowledge based economy, this paper argues that mediatization can be understood in relation to the cross-field effects of different fields of journalism on subsequent fields, which have their genesis in forms (...) of practice that cross different social fields. Specifically, the case analysis details interactions between the field of print journalism and the field of policy over the course of an Australian science capability review, chaired by the then chief scientist, Dr Robin Batterham, which led to Australia adopting a national version of the knowledge economy. The empirical case also leads us to consider the impact of both global and national fields of journalism on fields of educational policy in relation to mediatization. (shrink)

This is the first book-length study of wartime Confucianism in any language, providing new insights into key developments in Confucian thought and ideology in East Asia in the 1930s and 1940s. In standard scholarship on the ideologies driving nation-building and imperialism during the era of Japanese expansionism that began in 1931, Confucianism is rarely referenced and relegated to the background. This volume brings together the work of scholars who argue for a revision of this standard view. It includes studies of (...) Japanese, Chinese, colonial Manchurian and Korean intellectuals and reformers who contributed to expansionist, collaborationist or nationalist ideology-building during the war. Contrary to the assumption that Confucianism was an anachronism rendered irrelevant by the Westernising political reforms and revolutions of the early twentieth century, the chapters in this book show that Confucianism remained a potent, and also contested cultural resource for promoting national cohesion, war mobilisation and expansionism in East Asia between the Japanese invasion of Manchuria in 1931 and the end of World War II in 1945. This book will appeal to scholars and students of Asian studies, nationalism studies, postcolonial studies, religious studies and philosophy. In particular, it is essential reading for those interested in nationalism and modern Confucian thought in East Asia. (shrink)
