On June 5, 2024, the Australian Capital Territory passed a law to permit voluntary assisted dying (“VAD”). The Australian Capital Territory became the first Australian jurisdiction to permit nurse practitioners to assess eligibility for VAD. Given evidence of access barriers to VAD in Australia, including difficulty finding a doctor willing to assist, the Australian Capital Territory’s approach should prompt consideration of whether the role of nurses in VAD should be expanded in other Australian jurisdictions. Drawing on lessons from Canada, which (...) currently permits nurse practitioners to assess patient eligibility, we argue that the time has come for Australian jurisdictions to expand the role of nurses in VAD systems. This would be an important step in ensuring access to VAD for patients in practice. Attention, however, must also be paid to ensuring adequate remuneration of nurses (and doctors) if this goal of promoting access is to be achieved in practice. (shrink)

The nascent church in Jerusalem represented in Acts 6 verses 1–3 was promptly challenged by the problem of inequity and lack of fair play among the various stakeholders and such disaffection reached a situation of murmur and open agitation. This challenge to the apostles was a threat to the consolidation of the already established Christian community in Jerusalem and its spread to the whole world. Something must be done to arrest the situation or the Church runs the risk of disintegration. (...) Having some moral lessons drawn from the pericope at the back of the mind, one notices that recently there has been a clamour by the different geopolitical groups in Nigeria to restructure the Nigerian political system. The clamour is based on the failed position of post-war federalism to give all parts of Nigeria’s pluralistic society a fair and equal representation which hitherto was meant to stop Nigeria from another civil war or the cry for cessation by one region or another. The church, as an impartial umpire in the art of politics, should, in the midst of the turmoil, serve as the conscience of the masses, pressing hard to the actualisation of the demands of the masses. The study, through historical-critical method of biblical scholarship with Form criticism, analysed that situation of agitation to inequality and gross misrepresentation in the book of Acts 6:1–3, pressing to offer vital lessons to Nigeria in her quest for political restructuring. It concluded by finding out that Nigeria’s pluralistic nature, when restructured, should be a catalyst for global vision attainment and sustainable development. (shrink)

In April 2020, in the midst of its first pandemic lockdown, the Dutch government announced plans to develop a contact tracing app to help contain the spread of the coronavirus – the _Coronamelder._ Originally intended to address the problem of the overburdening of manual contract tracers, by the time the app was released six months later, the problem it sought to solve had drastically changed, without the solution undergoing any modification, making it a prime example of technosolutionism. While numerous critics (...) have mobilised the concept of technosolutionism, the questions of how technosolutionism works in practice and which specific harms it can provoke have been understudied. In this paper we advance a thick conception of technosolutionism which, drawing on Evgeny Morozov, distinguishes it from the notion of technological fix, and, drawing on constructivism, emphasizes its constructivist dimension. Using this concept, we closely follow the problem that the Coronamelder aimed to solve and how it shifted over time to fit the Coronamelder solution, rather than the other way around. We argue that, although problems are always constructed, technosolutionist problems are _badly_ constructed, insofar as the careful and cautious deliberation which should accompany problem construction in public policy is absent in the case of technosolutionism. This can lead to three harms: a subversion of democratic decision-making; the presence of powerful new actors in the public policy context – here Big Tech; and the creation of “orphan problems”, whereby the initial problems that triggered the need to develop a (techno)solution are left behind. We question whether the most popular form of technology ethics today, which focuses predominantly on the _design_ of technology, is well-equipped to address these technosolutionist harms, insofar as such a focus may preclude critical thinking about whether or not technology should be the solution in the first place. Within the psy- disciplines, Foucauldian discourse analysis has shown that those who exercise power in defining psychological experiences seek to maintain existing power hierarchies through this labeling. In that way, it is a fitting method to examine how the use of specific language constructs reality for individuals and society as a whole. Currently, the use of the word "triggered" has proliferated beyond the common mental health usage to refer to posttraumatic stress disorder or a re-experiencing symptom of a trauma. In (...) this qualitative investigation, we analyze "triggered" experiences written about in participants' vignettes to explore how using the word "triggered" does something in terms of power, hierarchy, and expression of vulnerability for individuals, and how this is impacted by the way they position themselves and others in speaking about their experiences. We understand the experience of being "triggered" to be constructed differently depending on the source of the trigger. The difference is particularly salient for those who use "triggered" to refer to a microaggression as opposed to those who are referring to a sexual assault. We discuss the tension between supporting a psychiatric status quo regarding trauma and the subversion of this status quo via the expanded use of the word "triggered.". (shrink)

This chapter begins with a brief review of the theory of parent-offspring conflict and considers the role of this conflict in the cognitive development of human infants. It then discusses the evolution of theory of mind — which is taken to have its origins in human evolution — and considers how this human cognitive specialization might have interacted with existing parent-offspring dynamics. How the epigenetic systems of infants might have responded is shown by elaborating upon existing cognitive and behavioural systems, (...) or by canalizing later developing ones earlier into development, in order to recruit higher degrees of parental investment. The merits of this framework is assessed in the context of the development of behaviours considered by some researchers to be indicative of a certain degree of social understanding, namely, gaze-following, pointing, social smiling, and neonatal imitation. The chapter concludes by showing how this proposal makes several longstanding theoretical and methodological difficulties for the field of cognitive development even more vexing. (shrink)

Policy decisions regarding immunization during a pandemic are informed by the ethical understandings of policy makers. With the possibility that a vaccine might soon be available to mitigate the deadly COVID-19 pandemic, policy makers can consider learnings from past pandemic immunization campaigns. This critical analysis of three policy decisions made in Alberta, Canada, during the 2009 H1N1 influenza pandemic demonstrates the predominance of distributive justice principles and the problems that this created for vulnerable groups. Vulnerable groups identified in Alberta include (...) rural and First Nations populations. A growing body of research has demonstrated significant heterogeneity of hospital ethics committee (HEC) size, membership and training requirements, length of appointment, institutional support, clinical and policy roles, and predictors of self identified success. Because these studies have focused on HECs at a single point in time, however, little is known about how the composition of HECs changes over time and what impact these changes have on committee utilization. The current study presents 20 years of data on the evolution of (...) the Massachusetts General Hospital HEC. Between 1993 and 2012, the average number of committee members per year was 38 ± 3 and the average length of membership was 4.8 ± 0.4 years. During that time, the committee performed 934 consults, averaging 47 ± 3 per year. Attendance rates fell from 61.5 to 23.8 % over the study period and were inversely correlated with the total number of members. Between 1993 and 2012, the committee saw substantial growth in the diversity of the professional backgrounds of its members. Multivariate analysis, however, suggests that substantial changes in committee composition did not impact its utilization and that other factors are more likely to explain fluctuations in consultation volume. In many ways set theory lies at the heart of modern mathematics, and it does powerful work both philosophical and mathematical – as a foundation for the subject. However, certain philosophical problems raise serious doubts about our acceptance of the axioms of set theory. In a detailed and original reassessment of these axioms, Sharon Berry uses a potentialist approach to develop a unified determinate conception of set-theoretic truth that vindicates many of our intuitive expectations regarding set theory. Berry further (...) defends her approach against a number of possible objections, and she shows how a notion of logical possibility that is useful in formulating Potentialist set theory connects in important ways with philosophy of language, metametaphysics and philosophy of science. After surveying the strengths and weaknesses of several well-known approaches to wisdom, I argue for a new theory of wisdom that focuses on being epistemically, practically, and morally rational. My theory of wisdom, The Deep Rationality Theory of Wisdom, claims that a wise person is a person who is rational and who is deeply committed to increasing his or her level of rationality. This theory is a departure from theories of wisdom that demand practical and/or theoretical knowledge. The Deep Rationality (...) Theory salvages all that is attractive, and avoids all that is problematic, about theories of wisdom that require wise people to be knowledgeable. (shrink)

Since the outbreak of COVID-19, governments have turned their attention to digital contact tracing. In many countries, public debate has focused on the risks this technology poses to privacy, with advocates and experts sounding alarm bells about surveillance and mission creep reminiscent of the post 9/11 era. Yet, when Apple and Google launched their contact tracing API in April 2020, some of the world’s leading privacy experts applauded this initiative for its privacy-preserving technical specifications. In an interesting twist, the tech (...) giants came to be portrayed as greater champions of privacy than some democratic governments. This article proposes to view the Apple/Google API in terms of a broader phenomenon whereby tech corporations are encroaching into ever new spheres of social life. From this perspective, the advantage these actors have accrued in the sphere of the production of digital goods provides them with access to the spheres of health and medicine, and more worrisome, to the sphere of politics. These sphere transgressions raise numerous risks that are not captured by the focus on privacy harms. Namely, a crowding out of essential spherical expertise, new dependencies on corporate actors for the delivery of essential, public goods, the shaping of public policy by non-representative, private actors and ultimately, the accumulation of decision-making power across multiple spheres. While privacy is certainly an important value, its centrality in the debate on digital contact tracing may blind us to these broader societal harms and unwittingly pave the way for ever more sphere transgressions. New biotechnologies have propelled the question of what it means to be human - or posthuman - to the forefront of societal and scientific consideration. This volume provides an accessible, critical overview of the main approaches in the debate on posthumanism, and argues that they do not adequately address the question of what it means to be human in an age of biotechnology. Not because they belong to rival political camps, but because they are grounded in a humanist ontology that (...) presupposes a radical separation between human subjects and technological objects. The volume offers a comprehensive mapping of posthumanist discourse divided into four broad approaches-two humanist-based approaches: dystopic and liberal posthumanism, and two non-humanist approaches: radical and methodological posthumanism. The author compares and contrasts these models via an exploration of key issues, from human enhancement, to eugenics, to new configurations of biopower, questioning what role technology plays in defining the boundaries of the human, the subject and nature for each. Building on the contributions and limitations of radical and methodological posthumanism, the author develops a novel perspective, mediated posthumanism, that brings together insights in the philosophy of technology, the sociology of biomedicine, and Michel Foucault's work on ethical subject constitution. In this framework, technology is neither a neutral tool nor a force that alienates humanity from itself, but something that is always already part of the experience of being human, and subjectivity is viewed as an emergent property that is constantly being shaped and transformed by its engagements with biotechnologies. Mediated posthumanism becomes a tool for identifying novel ethical modes of human experience that are richer and more multifaceted than current posthumanist perspectives allow for. The book will be essential reading for students and scholars working on ethics and technology, philosophy of technology, poststructuralism, technology and the body, and medical ethics. (shrink)

The lottery paradox has been discussed widely. The standard solution to the lottery paradox is that a ticket holder is justified in believing each ticket will lose but the ticket holder is also justified in believing not all of the tickets will lose. If the standard solution is true, then we get the paradoxical result that it is possible for a person to have a justified set of beliefs that she knows is inconsistent. In this paper, I argue that the (...) best solution to the paradox is that a ticket holder is not justified in believing any of the tickets are losers. My solution avoids the paradoxical result of the standard solution. The solution I defend has been hastily rejected by other philosophers because it appears to lead to skepticism. I defend my solution from the threat of skepticism and give two arguments in favor of my conclusion that the ticket holder in the original lottery case is not justified in believing that his ticket will lose. Antisthenes was famous in antiquity for his studies of Homer's poems, his affiliation with Gorgias and the sophistic movement, his pure Attic writing style, and his inspiration of Diogenes of Sinope, who founded the Cynic philosophical movement. Antisthenes stands at two of the greatest turning points in ancient intellectual history: from pre-Socraticism to Socraticism, and from classical Athens to the Hellenistic period. Antisthenes' works form the path to a better understanding of the intellectual culture of Athens that shaped Plato and (...) laid the foundations for Hellenistic philosophy and literature. Antisthenes of Athens keeps in mind the goals and polemics framing each philosophical and textual discussion. The volume considers the ancient traditions about Antisthenes' rejection of Plato's “Theory of Forms,” his assertion of the paradox, “It is impossible to gainsay,” and his denial that definition of essence is possible, as well as the plausible intentions of Antisthenes. In cases where these questions are not easily settled, and where modern interpretation has varied, Susan H. Prince identifies the roots of the disagreements. In this article, I discuss a trivialization worry for Hartry Field’s official formulation of the access problem for mathematical realists, which was pointed out by Øystein Linnebo (and has recently been made much of by Justin Clarke-Doane). I argue that various attempted reformulations of the Benacerraf problem fail to block trivialization, but that access worriers can better defend themselves by sticking closer to Hartry Field’s initial informal characterization of the access problem in terms of (something like) general epistemic norms of (...) coincidence avoidance. In this book Sharon Krause argues that moral and political deliberation must incorporate passions, even as she insists on the value of impartiality.

The concept of social structure is crucial in social analysis, yet sociologists' use of the term is often ambiguous and misleading. Contributing to the ambiguity is a tendency to imply the meaning of "social structure" either by opposing it to agency or by contrasting it to culture, thus reducing "structure" to pure constraint and suggesting that "culture" is not structured. Even more damaging is the tendency to conflate these two contrasts. To add to the confusion, these contrasts are often mapped (...) inappropriately onto other dichotomies prevalent in social theorizing, including material versus ideal, external versus internal, static versus active, and objective versus subjective, to produce a conceptual prism in which structure, agency, and culture are all poorly understood. This article attempts to disentangle these concepts from the aforementioned system of contrasts, to specify the connections between structure and agency, and to make a case for the inclusion of culture in the sociological conception of social structure. The recognition and incorporation of evidence-based neuroscientific concepts into creative arts therapeutic knowledge and practice seem valuable and advantageous for the purpose of integration and professional development. Moreover, exhilarating insights from the field of neuroscience coincide with the nature, conceptualization, goals, and methods of Creative Arts Therapies, enabling comprehensive understandings of the clinical landscape, from a translational perspective. This paper contextualizes and discusses dynamic brain functions that have been suggested to lie at the heart of intra- and inter-personal processes. Touching (...) upon fundamental aspects of the self and self-other interaction, the state-of-the-art neuroscientific-informed views will shed light on mechanisms of the embodied, predictive and relational brain. The conceptual analysis introduces and interweaves the following contemporary perspectives of brain function: firstly, the grounding of mental activity in the lived, bodily experience will be delineated; secondly, the enactive account of internal models, or generative predictive representations, shaped by experience, will be defined and extensively deliberated; and thirdly, the interpersonal simulation and synchronization mechanisms that support empathy and mentalization will be thoroughly considered. Throughout the paper, the cross-talks between the brain and the body, within the brain through functionally connected neural networks and in the context of agent-environment dynamics, will be addressed. These communicative patterns will be elaborated on to unfold psychophysiological linkage, as well as psychopathological shifts, concluding with the neuroplastic change associated with the formulation of CATs. The manuscript suggests an integrative view of the brain-body-mind in contexts relevant to the therapeutic potential of the expressive creative arts and the main avenues by which neuroscience may ground, enlighten and enrich the clinical psychotherapeutic practice. Harman and Lewis credit Kripke with having formulated a puzzle that seems to show that knowledge entails dogmatism. The puzzle is widely regarded as having been solved. In this paper we argue that this standard solution, in its various versions, addresses only a limited aspect of the puzzle and holds no promise of fully resolving it. Analyzing this failure and the proper rendering of the puzzle, it is suggested that it poses a significant challenge for the defense of epistemic closure.

In their vulnerability to arbitrary, exploitative uses of human power, many of Earth’s nonhuman parts are subject to environmental domination. People too are subject to environmental domination in ways that include but also extend beyond the special environmental burdens borne by those who are poor and marginalized. Despite the substantial inequalities that exist among us as human beings, we are all captured and exploited by the eco-damaging collective practices that constitute modern life for everyone today. Understanding the complex, interacting dynamics (...) of environmental domination can orient us to a more liberatory approach to our environmental problems and to one another, both human and nonhuman. To make good on this potential, however, we need to move beyond existing conceptions of domination. This essay reconstructs the concept of domination to illuminate the multiple ways that the human domination of nature interacts with the domination of people, and it identifies changes that could support more emancipatory forms of political order, a politics of non-domination for people and the Earth. Contemporary realist theories of value claim to be compatible with natural science. In this paper, I call this claim into question by arguing that Darwinian considerations pose a dilemma for these theories. The main thrust of my argument is this. Evolutionary forces have played a tremendous role in shaping the content of human evaluative attitudes. The challenge for realist theories of value is to explain the relation between these evolutionary influences on our evaluative attitudes, on the one hand, and the (...) independent evaluative truths that realism posits, on the other. Realism, I argue, can give no satisfactory account of this relation. On the one hand, the realist may claim that there is no relation between evolutionary influences on our evaluative attitudes and independent evaluative truths. But this claim leads to the implausible skeptical result that most of our evaluative judgements are off track due to the distorting pressure of Darwinian forces. The realist’s other option is to claim that there is a relation between evolutionary influences and independent evaluative truths, namely that natural selection favored ancestors who were able to grasp those truths. But this account, I argue, is unacceptable on scientific grounds. Either way, then, realist theories of value prove unable to accommodate the fact that Darwinian forces have deeply influenced the content of human values. After responding to three objections, the third of which leads me to argue against a realist understanding of the disvalue of pain, I conclude by sketching how antirealism is able to sidestep the dilemma I have presented. Antirealist theories of value are able to offer an alternative account of the relation between evolutionary forces and evaluative facts —
an account that allows us to reconcile our understanding of evaluative truth with our understanding of the many non-rational causes that have played a role in shaping our evaluative judgements. (shrink)

Crowdsourced regulation has been discussed to date by legal and social science scholars mainly in the context of legislation and rulemaking, without paying sufficient attention to non-legislative regulatory functions. This article provides a richer theory of crowdsourced regulation which extends to all regulatory functions, focusing on monitoring and enforcement. Regulatory agencies worldwide harness the power of the public using digital platforms to carry out monitoring and enforcement tasks in regulated markets and sectors. For example, agencies operate online complaint databases that (...) invite the public to report mistreatment of consumers and environmental nuisances by regulated firms. Agencies also publish information concerning corporate misbehavior to publicly shame companies into compliance. Crowdsourcing regulatory monitoring and enforcement can help minimize some prominent ailments of the regulatory task, such as poor resources, diminishing deterrence, declining legitimacy, and capture. It can also promote goals and values such as public participation, increased transparency, public trust in regulators, administrative efficiency, and effectiveness in achieving regulatory objectives. However, crowdsourcing regulatory monitoring and enforcement is subject to a new set of legal, administrative, and democratic failures that need to be acknowledged and addressed. The article develops a theory of crowdsourced regulation that supplies justifications and rationales for crowdsourced regulatory monitoring and enforcement, points out its main pitfalls, and normatively evaluates law and policy implications. Mais en va-t-il de même concernant la réception des œuvres : la perception du spectateur s’exerce-t-elle par répétition et variation des expériences esthétiques? L’objet de cet article est de montrer qu’il existe un type d’exercice dont le mécanisme repose plutôt sur la déstabilisation des habitudes de perception. À partir des réflexions valéryennes sur l’informe dans l’_Introduction à la méthode de Léonard de (...) Vinci_ et _Degas, Danse, Dessin_, nous proposons de penser un exercice de la perception qui passe par la décomposition de ses mécanismes. Cette idée trouve sa réalisation dans des dispositifs artistiques labyrinthiques tels que l’exposition _Contact_ d’Olafur Eliasson qui, en perturbant les échelles d’espace et de temps, oblige le récepteur à produire consciemment le travail de cohérence de la synthèse perceptive. Robert Nozick's experience machine thought experiment is often considered a decisive refutation of hedonism. I argue that the conclusions we draw from Nozick's thought experiment ought to be informed by considerations concerning the operation of our intuitions about value. First, I argue that, in order to show that practical hedonistic reasons are not causing our negative reaction to the experience machine, we must not merely stipulate their irrelevance (since our intuitions are not always responsive to stipulation) but fill in the (...) concrete details that would make them irrelevant. If we do this, we may see our feelings about the experience machine becoming less negative. Second, I argue that, even if our feelings about the experience machine do not perfectly track hedonistic reasons, there are various reasons to doubt the reliability of our anti-hedonistic intuitions. And finally, I argue that, since in the actual world seeing certain things besides pleasure as ends in themselves may best serve hedonistic ends, hedonism may justify our taking these other things to be intrinsically valuable, thus again making the existence of our seemingly anti-hedonistic intuitions far from straightforward evidence for the falsity of hedonism. This article tracks Corporate Social Responsibility (CSR) as an emergent organizational process that places the employee at its center. Predominantly, research on CSR tends to focus on external pressures and outcomes leading to a neglect of CSR as a dynamic and developing process that relies on the involvement of the employee as a major stakeholder in its co-creation and implementation. Utilizing case study data drawn from a study of a large multinational energy company, we explore how management relies on employees' (...) interaction with CSR as the process of initiation → implementation → maturation develops. Employee involvement grows from a minor element in the CSR initiation stage to a vital contributory factor in CSR's success in the later stages of the process. The article offers new insights into a processual and interactional approach to CSR that accounts for the actions of different actors involved at each stage. Most unusually, it also recognizes the dual impact this has on broader issues concerning the management and involvement of employees through CSR actions, and gaining legitimacy in the eyes of not only external stakeholders but internal too. The datafication and digitalization of health and medicine has engendered a proliferation of new collaborations between public health institutions and data corporations like Google, Apple, Microsoft and Amazon. Critical perspectives on these new partnerships tend to frame them as an instance of market transgressions by tech giants into the sphere of health and medicine, in line with a “hostile worlds” doctrine that upholds that the borders between market and non-market spheres should be carefully policed. This article seeks to outline the (...) limitations of this common framing for critically understanding the phenomenon of the Googlization of health. In particular, the mobilization of a diversity of non-market value statements in the justification work carried out by actors involved in the Googlization of health indicates the co-presence of additional worlds or spheres in this context, which are not captured by the market vs. non-market dichotomy. It then advances an alternative framework, based on a multiple-sphere ontology that draws on Boltanski and Thevenot’s orders of worth and Michael Walzer’s theory of justice, which I call a normative pragmatics of justice. This framework addresses both the normative deficit in Boltanski and Thevenot’s work and provides an important emphasis on the empirical workings of justice. Finally, I discuss why this framework is better equipped to identify and to address the many risks raised by the Googlization of health and possibly other dimensions of the digitalization and datafication of society. Because human beings are a part of nature, the human domination of nature circles back to confine and exploit people as well—and not only the poor and marginalized but also the privileged and affluent, even in the (...) world’s most prosperous societies. Although modern democracy establishes constraints intended to protect people from domination as the arbitrary exercise of power, it offers few such protections for nonhuman parts of nature. The result is that, wherever we fall in human hierarchies, we inevitably find ourselves both complicit in and entrapped by a system that makes sustainable living all but impossible. It confines and exploits not only nature but people too, albeit in different ways. In Eco-Emancipation, Sharon Krause argues that we can find our way to a better, freer life by constraining the use of human power in relation to nature and promoting nature’s well-being alongside our own, thereby releasing the Earth from human domination and freeing us from a way of life that is both exploitative and exploited, complicit and entrapped. Eco-emancipation calls for new, more-than-human political communities that incorporate nonhuman parts of nature through institutions of representation and regimes of rights, combining these new institutional arrangements with political activism, a public ethos of respect for nature, and a culture of eco-responsibility.
