Does justice require that individuals get what they deserve? Serena Olsaretti brings together new essays by leading moral and political philosophers examining the relation between desert and justice; they also illuminate the nature of distributive justice, and the relationship between desert and other values, such as equality and responsibility.

This book is a philosophical analysis of the ethical treatment of refugees and stateless people, a group of people who, though extremely important politically, have been greatly under theorized philosophically. The limited philosophical discussion of refugees by philosophers focuses narrowly on the question of whether or not we, as members of Western states, have moral obligations to admit refugees into our countries. The compensatory desert argument is an argument that purports to justify inequalities in (some) incomes generated by a free labour market. It holds, first, that the principle of compensation is a principle of desert; second, that a distribution justified by a principle of desert is just; and third, that (some) rewards people reap on a free labour market are compensation for costs they incur. It concludes that therefore, a distribution of (some) rewards generated by a free labour market is just. (...) In this chapter I criticise the first two premises of this argument. I argue that the principle of compensation is not a principle of desert (sections 3 and 4), and that a distribution of deserved compensatory payments may be unjust (sections 5 and 6). Before developing my critique of the compensatory desert argument, I start by illustrating further that argument in the version of it which has been defended by Julian Lamont (section 1), and to dispel two objections that have been moved against the view that compensation is a principle of desert. Drawing from extensive, eye-opening first-person accounts, No Refuge puts a spotlight on the millions of refugees worldwide who have to leave home but find nowhere to resettle. As political philosopher Serena Parekh argues, this is not just a problem for politicians. Citizens also have a moral duty to help resolve the global refugee crisis and to end the suffering and denial of human rights that refugee are forced to endure, often for years. While the media usually focus on the (...) challenges that Western states have with the arrival of large numbers of asylum seekers and refugees, the real problem is that millions are stuck in inhumane conditions in refugee camps and urban centers, with little chance of finding a more permanent solution. In this paper I argue that we should not frame the debate over whether or not we have duties to help refugees in terms of duties of rescue. This way of framing the issue, where Western states are depicted as rescuing refugees from harms unconnected to them, does not adequately represent the reality experienced by refugees in the 21 st century. I suggest that we need a framework that includes the secondary harms experienced by refugees as they try to seek (...) refuge in camps, urban spaces and via asylum. These secondary harms constitute serious violations of human rights and prevent refugees from accessing the minimum conditions of human dignity. As a result, the rescue metaphor is inappropriate and, perhaps more importantly, prevents us from having a proper debate about the obligations of states in general, and Western states in particular, to refugees. Are inequalities of income created by the free market just? In this book Serena Olsaretti examines two main arguments that justify those inequalities: the first claims that they are just because they are deserved, and the second claims that they are just because they are what free individuals are entitled to. Both these arguments purport to show, in different ways, that giving responsible individuals their due requires that free market inequalities in incomes be allowed. Olsaretti argues, however, that neither (...) argument is successful, and shows that when we examine closely the principle of desert and the notions of liberty and choice invoked by defenders of the free market, it appears that a conception of justice that would accommodate these notions, far from supporting free market inequalities, calls for their elimination. We propose a novel, ontological approach to studying mathematical propositions and proofs. By “ontological approach” we refer to the study of the categories of beings or concepts that, in their practice, mathematicians isolate as fruitful for the advancement of their scientific activity (like discovering and proving theorems, formulating conjectures, and providing explanations). We do so by developing what we call a “formal ontology” of proofs using semantic modeling tools (like RDF and OWL) developed by the computer science community. In this (...) article, (i) we describe this new approach and, (ii) to provide an example, we apply it to the problem of the identity of proofs. We also describe open issues and further applications of this approach (for example, the study of purity of methods). We lay some foundations to investigate rigorously and at large scale intellectual moves and attitudes that underpin the advancement of mathematics through cognitive means (carving out investigationally valuable concepts and techniques) and social means (like communication, collaboration, revision, and criticism of specific categories, inferential patterns, and levels of analysis). Our approach complements other types of analysis of proofs such as reconstruction in a deductive system and examination through a proof-assistant. (shrink)

_Hannah Arendt and the Challenge of Modernity_ explores the theme of human rights in the work of Hannah Arendt. Parekh argues that Arendt's contribution to this debate has been largely ignored because she does not speak in the same terms as contemporary theoreticians of human rights. Beginning by examining Arendt’s critique of human rights, and the concept of "a right to have rights" with which she contrasts the traditional understanding of human rights, Parekh goes on to analyze some of the (...) tensions and paradoxes within the modern conception of human rights that Arendt brings to light, arguing that Arendt’s perspective must be understood as phenomenological and grounded in a notion of intersubjectivity that she develops in her readings of Kant and Socrates. Phenomenological psychology has typically avoided the "importation" of such concepts as social class from sociology.Within the epoche, such terminology is bracketed on the grounds that it brings with it excess theoretical baggage and threatens the return to experience in itself. Yet, in uncovering the lifeworld of university students who—in what in Britain is still predominantly a preserve of the privileged—come from relatively economically disadvantaged homes, "class" or some cognate concept is found to be necessary to capture the range of modes (...) of alienation and disjunction experienced. Following Casey's discussion of the way in which Bourdieu's notion of habitus relates to Merleau-Ponty's description of the interpenetration of the natural and the cultural in the lived body, social class is shown to bring together students' accounts of their multi-faceted sense that "University is not for the likes of us"—encompassing issues of identity, sociality, and spatio-temporal dislocation. Distributive justice has come to the fore in political philosophy: how should we arrange our social and economic institutions so as to distribute benefits and burdens fairly? Thirty-two leading figures from philosophy and political theory present specially written critical assessments of the key issues in this flourishing area of research.

The pharmaceutical industry plays an increasingly dominant role in healthcare, raising concerns about “conflicts of interest” on the part of the medical professionals who interact with the industry. However, there is considerable disagreement over the extent to which COI is a problem and how it should be managed. Participants in debates about COI have become entrenched in their views, which is both unproductive and deeply confusing for the majority of medical professionals trying to work in an increasingly commercialized environment. We (...) used a modified meta-narrative review method to analyse debates about COI in the academic and grey literature. We found two Discourse Models: The Critical Discourse Model sees COI in health and biomedicine as a major problem that both can and should be addressed, while the Defensive Discourse Model argues that current efforts to control COIs are at best unnecessary and at worst harmful. Each model is underpinned by profoundly differing views about how society should be organized—in particular whether market forces should be encouraged or curtailed—and how the dangers associated with market forces should be managed. In order to make any headway, academics and policymakers must recognize that these debates are underpinned by profoundly differing worldviews. (shrink)

Contemporary egalitarian theories of justice constrain the demands of equality by responsibility, and do not view as unjust inequalities that are traceable to individuals' choices. This paper argues that, in order to make non-arbitrary determinate judgements of responsibility, any theory of justice needs a principle of stakes , that is, an account of what consequences choices should have. The paper also argues that the principles of stakes seemingly presupposed by egalitarians are implausible, and that adopting alternative principles of stakes amounts (...) to fleshing out the demands of responsibility rather than imposing limits on them. A central question for assessing the merits of Amartya Sen's capability approach as a potential answer to the “distribution of what”? question concerns the exact role and nature of freedom in that approach. Sen holds that a person's capability identifies that person's effective freedom to achieve valuable states of beings and doings, or functionings, and that freedom so understood, rather than achieved functionings themselves, is the primary evaluative space. Sen's emphasis on freedom has been criticised by G. A. Cohen, according (...) to whom the capability approach either uses too expansive a definition of freedom or rests on an implausibly active, indeed “athletic,” view of well-being. This paper defends the capability approach from this criticism. It argues that we can view the capability approach to be underpinned by an account of well-being which takes the endorsement of valuable functionings as constitutive of well-being, and by a particular view of the way in which endorsement relates to force and choice. The first issue of Artificial Intelligence and Law journal was published in 1992. This paper offers some commentaries on papers drawn from the Journal’s third decade. They indicate a major shift within Artificial Intelligence, both generally and in AI and Law: away from symbolic techniques to those based on Machine Learning approaches, especially those based on Natural Language texts rather than feature sets. Research into television's ethical value has mostly focused on scandal genres, such as Big Brother, Jersey Shore, and Jerry Springer. Only recently have researchers started to explore television's moral content with a broader focus. In this study we explore and describe the types of morality and moral content of a night of Dutch prime time television with an open and inductive approach through a qualitative content analysis. Our results revealed 13 types of morality and a basic differentiation between morals that (...) react on violations and transgressions, focusing on restricting behavior, and morals that are focused on ideals and values and stimulate social behavior. Lastly, we differentiated three moral meta-themes that permeate all genres, as well as six moral themes that arose only in specific genre-clusters. (shrink)

Infinite time Turing machines represent a model of computability that extends the operations of Turing machines to transfinite ordinal time by defining the content of each cell at limit steps to be the lim sup of the sequences of previous contents of that cell. In this paper, we study a computational model obtained by replacing the lim sup rule with an ‘eventually constant’ rule: at each limit step, the value of each cell is defined if and only if the content (...) of that cell has stabilized before that limit step and is then equal to this constant value. We call these machines weak infinite time Turing machines. We study different variants of wITTMs adding multiple tapes, heads, or bidimensional tapes. We show that some of these models are equivalent to each other concerning their computational strength. We show that wITTMs decide exactly the arithmetic relations on natural numbers. (shrink)

En este artículo describiremos la vitalidad del sistema fonológico del mapudungun hablado por escolares pewenches de la Provincia del Biobío, VIII Región. Específicamente, nos hemos propuesto: a) Determinar los fonos/fonemas, y su fonotaxis, que se relevan como indicadores de vitalidad, b) Identificar las transferencias fonético-fonológicas presentes en la fonología del pewenche hablado por estos escolares y c) Interpretar las transferencias encontradas en términos del grado de vitalidad de la fonología de la lengua. La muestra está conformada por un grupo de (...) 20 escolares bilingües de entre 12 y 15 años de edad, que se encuentran cursando 7° y 8° año básico en escuelas rurales pertenecientes a dos comunidades pewenches del valle del Queuco, en la comuna de Alto Biobío. Para la recolección del material fonológico, se aplicó a los participantes una lista léxica de 65 ítems, material que se complementó con la narración oral en mapudungun de un cuento. Según nuestros datos, hemos podido constatar la existencia de una serie de rasgos fónicos en el mapudungun hablado por los escolares pewenches que obedece a la influencia de las estructuras fonológicas del castellano. Sin embargo, el grado y la difusión de los fenómenos de transferencia se desarrollan de manera heterogénea en ambas comunidades en estudio, debido, entre otros factores, a la intensidad del contacto. In this article we will describe the vitality of the phonological system Mapudungun spoken by Pewenche schoolchildren from the Biobío province, VIII Region. We intend: a) To determine the phones/phonemes, and their phonotactics, which are revealed as vitality markers. b) To identify the phonetic-phonological transferences which are present in the Pewenche spoken by these schoolchildren, and, c) To interpret the transferences found in terms of the degree of the language phonological vitality. The sample is composed of 20 bilingual schoolchildren from 12 to 15 years old, who are in 7th and 8th grade in rural primary schools belonging to two Pehuenche comunities from Valle del Queuco, in the city of Alto Biobío. To collect the phonological material, we applied a 64-item lexical list, which was complemented with the oral narration of a tale in Mapudungun. According to our data, we have been able to verify the existence of a series of phonic features in the Mapudungun spoken by Pewenche schoolchildren, which originate because of the influence of the Spanish phonological structure. However, the degree and spread of the transference phenomena develop in a heterogeneous way in both of the studied communities. due to the contact intensity, among other possible factors. (shrink)

Resumen: El presente trabajo intenta analizar los elementos críticos a la base de aquella suerte de prescripción que Edward Said formulara a los intelectuales bajo la célebre consigna de “decir las verdades al poder”, esto es, de interpelar públicamente al poder -político, económico, religioso, militar- frente a toda evidencia de injusticia, inconsistencia o turbia manipulación en su operar. En tanto tal, y a partir de nuestra lectura de Said, delimitamos cinco dilemas que el intelectual ha de resolver, en tanto requisitos (...) para decir las verdades al poder: orientación intramundana versus extramundana, rol profético versus sacerdotal, libertad universalista versus organicidad, racionalidad sustantiva versus instrumental y arrojo versus temor. Se comentan las implicaciones de estos dilemas a la luz de los desafíos y oportunidades que las sociedades contemporáneas -en particular, las latinoamericanas- presentan para el rol del intelectual.: This work analyzes the critical foundations of that quasi-rule posed by Edward Said to intellectuals through the famous motto “speaking truth to power”, that is, of publicly interpellating to power -political, economic, religious, military- whenever its exercise may involve injustice, inconsistency or underhanded manipulation. So, according to our interpretation of Said’s work, we identify five dilemmas the intellectual should resolve in order to be able to speak truth to power: a worldliness orientation versus an otherworldliness one, a prophetic role versus a priestly one, universalist freedom versus organic compromise, a substantive rationality versus an instrumental one, and courage versus fear. Involvements of these dilemmas are discussed according to the challenges and opportunities posed by current societies -in particular, the Latin American ones- to the intellectual’s role. (shrink)

I argue in this paper that Hannah Arendt can make a valuable contribution to the debate over global justice and our obligations to the global poor. I maintain that Arendt's work helps us to see how we might be able to combine the best impulses of both partialists and impartialists, and find a middle ground between taking seriously the importance of community as a human good, and the pressing ethical demands of noncitizens. I demonstrate that throughout her corpus, we see (...) both impulses at work. Arendt's appreciation for communitarianism is evident in a number of features of her political philosophy: the undesirability of a world state, and the necessity of a political community to secure human rights, a public sphere, and freedom. By contrast, Arendt's cosmopolitanism is rooted in two features of her political phenomenology: that political action is about the world , a love of the world, and not particular people; and that human togetherness underlies action while human solidarity is its primary motivation. In addition to these two seemingly contradictory threads in Arendt's work there is a third element: Arendt's attempt to mediate between these two impulses through her concept of judgment. To judge means to start from your position within a community, and to take into consideration all other relevant perspectives, regardless of nationality. In this manner, we are able to take seriously what we owe to both our compatriots and people in dire need who are not fellow citizens. In short, in judging, though we begin from our partialist commitments, we must take on a larger cosmopolitan perspective, and ultimately mediate between the two perspectives. Consequently, I hope to show that Arendt can indeed make a contribution to the ongoing debate over our moral obligations to noncitizens in situations of dire necessity. (shrink)

This essay explores recent scholarship on Hannah Arendt's contribution to the field of global justice. I show that many of Arendt's ideas have been brought to bear fruitfully on some of the most pressing global issues of our day. I turn first to the area in which Arendt has, arguably, been most influential, namely human right. I then look at recent scholarship on Arendt and various issues in global justice, including immigration, statelessness, human security, global poverty, political reconciliation, and global (...) democracy. This essay offers a critical analysis of the ways that Arendt's work has been employed in discussions of global justice and highlights the contributions that she has made to this field of thought.© 2013 John Wiley & Sons Ltd. In this essay, the highly original contribution made by Rudolf Haller to aesthetic studies and the philosophy of art is analysed. In particular, the volume Facta und Ficta (1986) is examined, which takes as its starting point the contrast between real and imaginary objects, including works of art. According to Haller, it is problematic to give a definition of a work of art because one can refer to very different creations, from poetic compositions to architectural structures and musical scores. Therefore, (...) in post-Hegelian aesthetics, a dynamic consideration of art is important, which leaves room for empirical multiplicity and artistic variety without aprioristic preclusions. (shrink)
