During the COVID-19 epidemic, draconian countermeasures forbidding nonessential human activities have been adopted in several countries worldwide, providing an unprecedented setup for testing and quantifying the current impact of humankind on climate and for driving potential sustainability policies in the postpandemic era from a perspective of complex systems. In this study, we consider heterogeneous sources of environmental and human activity observables, considered as components of a complex socioenvironmental system, and apply information theory, network science, and Bayesian inference to analyze their (...) structural relations and nonlinear dynamics between January 2019 and August 2020 in northern Italy, i.e., before, during, and after the national lockdown. The topological structure of a complex system strongly impacts its collective behavior; therefore, mapping this structure is essential to fully understand the functions of the system as a whole and its fragility to unexpected disruptions or shocks. To this aim, we unravel the causal relationships between the 16 environmental conditions and human activity variables, mapping the backbone of the complex interplay between intervening physical observables—such as NO2 emissions, energy consumption, intervening climate variables, and different flavors of human mobility flows—to a causal network model. To identify a tipping point during the period of observation, denoting the presence of a regime shift between distinct network states, we introduce a novel information-theoretic method based on statistical divergence widely used in statistical physics. We find that despite a measurable decrease in NO2 concentration, due to an overall decrease in human activities, locking down a region as a climate change mitigation is an insufficient remedy to reduce emissions. Our results provide a functional characterization of socioenvironmental interdependent systems, and our analytical framework can be used, more generally, to characterize environmental changes and their interdependencies using statistical physics. It has often been claimed, e.g. by William James or Aldous Huxley, that mystical experiences across times and cultures exhibit a striking similarity. Even though the words and images we use to describe them are different, underneath the surface we find a common experiential core. Others have rejected this claim and argued that all experiences are intrinsically shaped by the mystics’ pre-existing religious concepts. Against these constructivist objections, I defend the idea of a common core by arguing that even if (...) all experience is interpreted through concepts, there could still be a common core. Those who reject the common core thesis usually argue that no distinction between experience and interpretation can be made since all experience is per se already interpreted. The notion of an uninterpreted experience is self-defeating. Drawing on current research on nonconceptual mental content, I argue that experiences can have nonconceptual content; that interpretation must be understood as conceptualization and that conceptualization presupposes a raw mental content that is not conceptualized. This raw content is not experienced as nonconceptual. Rather, the nonconceptual, uninterpreted common core is an abstraction which shows itself only through reflection. Thus, the existence of a common core is compatible with the fact that all experiences are interpreted. (shrink)

Should artificial agents (such as robots) be granted moral status? This seems like an important question to resolve, given that we will encounter a growing number of increasingly sophisticated artificial agents in the not too distant future. However, many will think that before we can even start to tackle questions about the moral status of artificial agents, we first need to solve tricky issues in the philosophy of mind. After all, most orthodox views about moral status imply that only entities (...) with a mental life are eligible for moral status. But, whether an unfamiliar entity like an artificial agent has a mental life raises controversial questions in the philosophy of mind. Given this, one might hope that we can resolve questions about the moral status of robots via “minimalist” views that give sufficient conditions for granting moral status to an entity that we can know to be satisfied without knowing whether the entity in question has a mind. This paper argues that we should be pessimistic about the prospects of minimalist views avoiding controversial questions in the philosophy of mind, by arguing that minimalist sufficient conditions are only plausible if combined with assumptions in the philosophy of mind. This paper critically discusses the argument from objectification – as recently presented by Elizabeth Shaw – against mandatory direct brain interventions targeting criminal offenders’ values as part of rehabilitative or reformative schemes. Shaw contends that such DBIs would objectify offenders because a DBI “excludes offenders by portraying them as a group to whom we need not listen” and “implies that offenders are radically defective with regard to one of the most fundamental aspects of their agency”. To ensure that offenders are (...) not objectified, Shaw first maintains that we should restrict rehabilitative/reformative schemes to attempts at rational dialogue because such an approach respects the offender’s personhood. Second, Shaw claims that we should not portray offenders as radically defective because such treatment would only negatively impact offenders’ already tenuous relationship with society. Third, Shaw contends that we should not confer the state the power to change an offender’s values because the state lacks insight into what constitutes the right values. I contend that none of these arguments should prevent the use of value-targeting DBIs. First, I show that the dialogue requirement for rehabilitative schemes is insufficient ground from which to oppose the use of these DBIs. Second, I show that it is doubtful that the use of DBIs as proposed would damage the relationship between offenders and society. Finally, although the state may often lack insight into what constitutes the correct values, this lack of insight should not by itself prevent value-targeting DBIs from being employed on certain groups of offenders. Political practices often aim to reach valuable outcomes through democratic processes. However, philosophical considerations and democratic deliberations sometimes support different conclusions about what a valuable outcome would be. This paper contributes to a research agenda that aims to reconcile recommendations that follow from these different bases. The setting for this research agenda is capabilitarian. It affirms the idea that what we should distribute are substantive freedoms to be and do things that people have reason to value. Disagreements about these valuable (...) outcomes become particularly problematic in urgent situations such as pandemics, floods, and wildfires. These situations are urgent since they are time-sensitive and involve an impending loss of well-being. A method of compromise would help mitigate losses of well-being while respecting the aim of reaching valuable outcomes through democratic processes. I thus offer an equitable and decisive method of compromise that helps integrate philosophical considerations with democratic deliberations. (shrink)

Vitalism is understood as impacting the history of the life sciences, medicine and philosophy, representing an epistemological challenge to the dominance of mechanism over the last 200 years, and partly revived with organicism in early theoretical biology. The contributions in this volume portray the history of vitalism from the end of the Enlightenment to the modern day, suggesting some reassessment of what it means both historically and conceptually. As such it includes a wide range of material, employing both historical and (...) philosophical methodologies, and it is divided fairly evenly between 19th and 20th century historical treatments and more contemporary analysis. Assisted dying and human dignity are two extremely contested topics in Bioethics. This volume offers the first book-length attempt to bring both together. Its authors develop detailed philosophical analyses of dignity, and how it relates to assisted suicide and euthanasia.

One way to seek to reduce the risk of potential offenders engaging in certain types of crime in a public or semi-public area is to make it much more difficult, or even impossible, for them to gain access to the area in question and subject them to a sanction if they do enter the area. This paper considers whether preventive exclusion of this kind should be considered a pro tanto morally impermissible means of crime prevention because it violates the agency (...) of those excluded. Several variants of this agency objection to preventive exclusion are identified and critically assessed. It is argued that none persuasively show preventive exclusion to be pro tanto morally wrong. All forms of cognition, whether natural or artificial, are subject to constraints of their computing architecture. This assumption forms the tenet of virtually all general theories of cognition, including those deriving from bounded optimality and bounded rationality. In this letter, we highlight an unresolved puzzle related to this premise: what are these constraints, and why are cognitive architectures subject to cognitive constraints in the first place? First, we lay out some pieces along the puzzle edge, such as computational tradeoffs inherent (...) to neural architectures that give rise to rational bounds of cognition. We then outline critical next steps for characterizing cognitive bounds, proposing that some of these bounds can be subject to modification by cognition and, as such, are part of what is being optimized when cognitive agents decide how to allocate cognitive resources. We conclude that these emerging views may contribute to a more holistic perspective on the nature of cognitive bounds, as well as their alteration subject to cognition. (shrink)

Diese Arbeit untersucht die Frage, ob der aktuelle Schutz des geistigen Eigentums bei Arzneimitteln in Deutschland moralisch zu rechtfertigen ist. Die Untersuchung orientiert sich dabei am aktuellen Diskurs und ordnet die bestehenden Positionen entsprechend ihrer Abstraktheit. Dabei bilden Argumente gegen einen Schutz geistigen Eigentums die allgemeinste Ebene, und Argumente, die sich spezifisch gegen deutsche Arzneimittelpatente richten, die konkreteste Ebene. Ich werde zeigen, dass starke deontologische und konsequentialistische Positionen existieren, welche die realpolitischen Auswirkungen von Arzneimittelpatenten kritisieren. Die konsequentialistische Position argumentiert in (...) erster Linie mit den jüngsten Wirtschaftsdaten, während die deontologische Position die bürgerlichen Autonomieansprüche betont. (shrink)

En definitiva queremos hacer una apología de los pobres, marginados y excluidos en el mundo y, en particular, en las democracias occidentales que se abrogan y llevan a gala el título de democracias incluyentes, que ayude a estas personas a tener una nueva oportunidad (...) que les saque de la pobreza. Diese Aufsatzsammlung ist der erste ausführliche Versuch, eine Verbindung zwischen dem Denken der klassischen deutschen Philosophie und Husserls Phänomenologie herzustellen. Vorliegender Band versammelt eine Reihe neuer kritischer Artikel sowohl von etablierten Forschern wie jüngeren Philosophen aus beiden Traditionen, um diese Forschungslücke, als welche sie von beiderlei Forschungsrichtungen anerkannt ist, zu schließen. Dieser Band wirft neues Licht auf beide Traditionen und hebt ihre Bedeutung für die Philosophie der Gegenwart hervor, sowohl in historischer wie systematischer Hinsicht. Die in diesem Band behandelten Hauptthemen (...) sind Erkenntnistheorie, Moralphilosophie und die Geschichte der Philosophie, wobei diese Themen auf der Basis von mehreren Subthemen (Objekt, Idealismus/Realismus, Subjektivität/Intersubjektivität, Ethik, Geschichte, Kultur) diskutiert werden. Hierdurch wird das grundsätzliche Koordinatensystem für einen spekulativen Vergleich zwischen Husserl und der klassischen deutschen Philosophie präsentiert, indem die wichtigsten Deutungslinien verfolgt werden, um sowohl die Kontinuität wie auch die Diskontinuität beider Traditionen wertschätzen zu können. Eine Sektion des Bandes ist insbesondere der Rezeption der Husserl’schen Phänomenologie und der klassischen deutschen Philosophie gewidmet. Leibniz repeatedly states that there is a very close connection between reflection and rationality. In his view, reflective acts somehow lead to self-consciousness, reason, the knowledge of necessary truths, and even to the moral liability of the respective substances. Whereas it might be relatively easy to see how reflective acts lead to self-consciousness, it is much harder to understand how they are connected to rationality. Why should a substance which is able to produce reflective acts therefore be rational? How can (...) the having of reflective acts be responsible for the substance’s ability to reason correctly and to acquire knowledge of necessary and eternal truths? The aim of my paper is to understand better the required mechanisms and to make thus conceivable Leibniz’s bold claim that reflective acts lead to rationality. In order to accomplish this, I will proceed in three steps. First, I will specify what kind of self-consciousness is, according to Leibniz, produced by reflective acts. A substance must recognize itself as a unitary substance bearing perceptions. Second, I will argue that this type of self- consciousness can be seen as the basis for the ability to form judgments. This is possible because the subject-predicate structure of judgments is mirrored by the ontology of substances and their modifications. Third, I will point out that, together with the idea of identity (which we also acquire by reflection), the combination of judgments allows us to make inferences. This ability, in turn, is sufficient for rationality. Thus, I can explain how reflective acts and rationality are connected with each other. (shrink)

Digital media, such as cellphones and tablets, are a common part of our daily lives and their usage has changed the communication structure within families. Thus, there is a risk that the use of DM might result in fewer opportunities for interactions between children and their parents leading to fewer language learning moments for young children. The current study examined the associations between children’s language development and early DM exposure.Participants: Ninety-two parents of 25months olds recorded their home sound environment during (...) a typical day [Language ENvironment Analysis ] and participated in an online questionnaire consisting of questions pertaining to daily DM use and media mediation strategies, as well as a Swedish online version of the MacArthur Communicative Development Inventory, which includes a vocabulary scale as well as a grammar and pragmatics scale.Results: Through correlations and stepwise regressions three aspects of language were analyzed. The child’s vocabulary was positively associated with interactional turn-taking. The child’s vocabulary and grammar were negatively associated with the likelihood of parent’s device use during everyday child routines and the amount of TV watched by the child. The child’s pragmatic development was also positively associated with the parent’s device use in child routines but also with the parent’s joint media engagement, as well as the child’s gender.Conclusion: Our study confirms that specific aspects of the 2-year old’s DM environment are associated with the child’s language development. More TV content, whether it is viewed on a big screen or tablet, is negatively associated with language development. The likelihood of parents’ use of DM during everyday child routines is also negatively associated with the child’s language development. Positive linguistic parental strategies such as interactional turn-taking with the child, JME, and book reading, on the other hand, are positively associated with the child’s language development. The important question of the legality of the state obliging trial incompetent defendants to receive competency-restoring treatment against their wishes, is one that has received much attention by legal scholars. Surprisingly, however, little attention has been paid to the, in many ways more fundamental, moral question of whether the state ought to administer such treatments. The aim of this paper is to start filling this gap in the literature. I begin by offering some reasons for thinking it morally acceptable to, (...) at least sometimes, oblige trial-incompetent defendants to receive competency-restoring treatments. The paper then discusses whether three prominent arguments (and their variations) offered by legal scholars against using non-consensual treatment to restore trial competence provide grounds for thinking there to be a general moral prohibition against these treatments. Con el objetivo de cuestionar aquellas interpretaciones que identifican la comprensión liberal del Estado con una estructura organizativa reducida a su mínima expresión cuyo desempeño debe quedar supeditado a las dinámicas económico-productivas, el presente artículo se propone revisar críticamente las propuestas de dos figuras destacadas dentro de la tradición del liberalismo: Adam Smith y Friedrich Hayek. Para ello se compara el modo en el que estos autores articulan el concepto de Estado sobre un plano operativo, en particular, en lo referido (...) al principio de “gobierno limitado”. Se identifican las funciones adjudicadas a las instituciones públicas y se caracteriza el modo en el que se presentan las relaciones entre la órbita estatal y la órbita social. Por último, se destacan continuidades y diferencias entre ambas posturas. Sobre esa base, se proponen algunas reflexiones en torno a la eventual distinción entre un liberalismo ético-político y un liberalismo económico. (shrink)

This essay attempts to spell out what might be left of Husserlian phenomenology when one leaves behind Husserl's own grounding ambitions. Husserl construes transcendental phenomenology as first philosophy. In a pragmatist vein of leaving it behind in the interest of something other, I discuss what would happen if one were to 'pragmatize' phenomenology. After first laying out Husserl's vision, in a second part I reconstruct the motives that led to it in reaction to a 'Cartesian anxiety' of not securing an (...) indubitable ground of knowledge. After that, the article spells out some pragmatic reflections on what phenomenology would be, without the need to secure foundations of knowledge. Such a liberation would in effect enable phenomenology to more fully make true on the ideals of the Enlightenment (which Rorty, too, underwrites) of emancipating oneself of one of the last vestiges of a dogmatic slumber. En este trabajo nos proponemos, en primer lugar, reconstruir brevemente el análisis de Michel Foucault acerca de la episteme moderna, para luego analizar algunos rastros que identificamos en ciertos textos del pensador francés sobre la episteme contemporánea. A los fines de lograr este cometido, en tercer lugar, analizamos algunos textos de algunos pensadores del posestructuralismo francés y de la Mass Communication Research. Finalmente, concluimos que el acontecimiento que da lugar a la reconfiguración del saber occidental y a la conformación de (...) la episteme contemporánea está relacionado con las cuestiones del sentido y de la información, que contribuyen a delinear los contornos de las características del hombre y el lenguaje en la nueva episteme. This edited volume examines women's voices in phenomenology, many of which had a formative impact on the movement but have be kept relatively silent for many years. It features papers that truly extend the canonical scope of phenomenological research. Readers will discover the rich philosophical output of such scholars as Edith Stein, Hedwig Conrad-Martius, and Gerda Walther. They will also come to see how the phenomenological movement allowed its female proponents to achieve a position in the academic world few women (...) could enjoy at the time. The book explores the intersection of social ontology, phenomenology, and women scholars in phenomenology. The papers offer a fresh look at such topics as the nature of communities, shared values, feelings, and other mental content. In addition, coverage examines the contributions of Jewish women to the science, who were present at the beginning of the phenomenological movement. This remarkable anthology also features a paper on Gerda Walther written by Linda Lopez McAlister, former editor of the feminist journal Hypatia, who had met Walther in 1976. This book features work from the conference “Women Phenomenologists on Social Ontology,” held at the University of Paderborn. Der vorliegende Beitrag beginnt mit dem Bericht eines männlichen Analysanden über heterosexuellen Geschlechtsverkehr, den er als zutiefst lustvoll und gleichzeitig verstörend erlebt. Bei der Analyse der berichteten Erfahrung entsteht ein zunächst verwirrendes Bild von Geschlechtlichkeit jenseits der Binaritäten des penetrierenden Mannes und der penetrierten Frau. Beim Versuch einer theoretischen Einordnung wird die habituelle männliche Verleugnung der passiven Position im Geschlechtsverkehr und die Betonung der aktiv penetrierenden Phallizität als Abwehrformation gegen übermäßige sexuelle Erregung verstanden. Unter Rückgriff auf Laplanches Theorie der Konstitution (...) der infantilen Sexualität als Übersetzung rätselhafter elterlicher Botschaften wird Sex als zentraler Schauplatz der Aufsprengung rigider Geschlechterstereotype und gleichzeitiger Reproduktion selbiger verstanden. Die Untersuchung will unter Einbeziehung psychoanalytischer, aber auch queertheoretischer Überlegungen einen Beitrag zum Verständnis männlicher Heterosexualität leisten, indem rigide Phallizität als eine mögliche Abwehrformation gegen eine »fluidere« und gleichzeitig verstörendere Sexualität verstanden wird. Die vorliegende Arbeit untersucht Herkunft und Inhalt des Musikbearbeitungsrechts und ordnet dieses dogmatisch den urheberrechtlichen Regeln zu. Weiter wird die Frage der Wahrnehmungsgrenzen der GEMA bezüglich des Bearbeitungsrechts thematisiert, und die Folgen für konkrete Nutzungshandlungen werden herausgearbeitet. Die Probleme der Klingeltonnutzung, der Coverversionseinspielungen, Werkteilnutzungen sowie der Nutzung von Musik im Bereich der Werbung, des Theaters und des Films werden im Hinblick auf das Bearbeitungsrecht und die Wahrnehmungskompetenz der GEMA analysiert. Der Autor führt mit der vorliegenden Arbeit die Grauzonen der GEMA-Wahrnehmung (...) aufgrund neuer dogmatischer Ansätze einer einheitlichen Lizenzierung zu, um die Problemfälle der Praxis zu beseitigen. Bodily and mental self-ascriptions are forms of first-person thought where a subject attributes physical properties and psychological states to herself. The body-ownership view argues that a necessary and sufficient condition on such self-ascriptions is the existence of causal links between a spatio-temporal body and the self-ascribed properties or states. However, since P.F. Strawson’s influential attack, this view has been dismissed as a bad philosophical idea. The goal of this brief piece is to outline the body-ownership view and neutralise two classic (...) lines of objection against it: on the one hand, that the stance is incoherent; and, on the other, that it has counterintuitive implications.
