Für viele stellt das Instrumentalisierungsverbot, wonach man andere Menschen nie blo als Mittel behandeln darf, eine fundamentale moralische Wahrheit dar. Dieses Buch ist der Versuch, diese Ansicht näher zu fassen und zu begründen. Das Instrumentalisierungsverbot spielt nicht nur in unserer Alltagsmoral, sondern auch in moraltheoretischen Diskussionen eine wichtige Rolle. Verschiedenste Praktiken werden mit der Begründung als unzulässig kritisiert, dass mit ihnen Menschen instrumentalisiert würden. Doch was heit es, die anderen blo als Mittel zu behandeln? Es besteht, so wird in diesem (...) Buch argumentiert, ein Zusammenhang zwischen unzulässiger Instrumentalisierung und Verletzung der Würde von Personen. In der Explikation des Würdebegriffs wird dieser Zusammenhang entfaltet. Die unzulässige Instrumentalisierung von Personen verletzt in bestimmten Fällen deren Würde, in anderen Fällen Ansprüche, die in der Würde von Personen begründet sind. Die Würde von Personen wird dabei als Anspruch auf Selbstachtung gefasst. Selbstachtung wird nicht im Sinne der Selbstwertschätzung verstanden. Im Blick steht vielmehr ein normatives Verständnis von Selbstachtung, wonach Personen ein Leben in Selbstachtung führen, sofern ihr Selbstverfügungsrecht von anderen und ihnen selbst geachtet wird. Der Anspruch auf Selbstachtung wird als Anspruch darauf begriffen, über wesentliche Bereiche des eigenen Lebens verfügen zu können. Diese Überlegungen zu Würde und Selbstachtung werden moraltheoretisch eingeordnet und abschlieend auf paradigmatische Fälle der praktischen Ethik angewendet, bei denen es um die Instrumentalisierung von Menschen geht. By giving consent, we sometimes give permission or make it the case that we are not wronged. What does it take for an act to be an act of consent? This is the question this paper deals with. The question does not presuppose the view that consent is a communicative act. For those who take it as a mental state, the question is what does it take to express consent? It will be argued that an act is an act of (...) consent if and only if the consent-giver believes she gives someone permission to do or omit something by performing the act. A normative intention is not required for consent. It is further argued that this view also bears on the question of what falls within the scope of consent and shows how it differs from the evidential account advocated by Tom Dougherty. I also argue that the view defended in this paper does not imply – as some think – that the consent-receiver could wrong the consent-giver without being able to know that this is the case. (shrink)

This paper deals with the wrongness of having sex with someone without her valid consent. There are good reasons to think that deception about deal-breakers invalidate consent to sex and that acting without valid consent wrongs the consenter. Tom Dougherty argues that it is always seriously wrong to deceive another person into sex by deceiving her. We should on his view therefore reject the view that doing so is in certain cases only a minor wrong. It will be argued here (...) that we should accept this view. I will argue against Dougherty that the lenient view does not presuppose an unacceptably moralistic view of sexuality. In addition, the lenient view can be defended by what I call the harm view of the wrongness of having sex without valid consent. If no or only mild harm is caused deceiving someone into sex is only a minor wrong. (shrink)

The paper deals with the question of whether poverty as such violates the dignity of persons. It is argued that it does. This is, it is argued, not due to a lack of basic goods, nor to the fact that poverty prevents persons from enjoying the rights they have, particularly the right to bodily integrity. Poverty does violate dignity, so it is argued, insofar as poor people are dependent on others in a degrading way.

Wir haben die Pflicht, bestimmte Dinge zu tun, andere zu unterlassen. Wenn wir Pflichten haben, sprechen Gründe dafür, sie zu erfüllen. Wie aber verhalten sich Gründe und Pflichten genau zueinander? Im vorliegenden Aufsatz wird dafür argumentiert, dass a) es keine Pflichten gibt, für deren Erfüllung keine moralischen Gründe sprechen; und dass b) moralische Gründe stark genug sein müssen, um uns unter eine Pflicht zu stellen, und eine Pflicht in bestimmten Fällen bloß durch die Ausübung einer normativen Fähigkeit entstehen kann.

Many will refuse to be vaccinated against Covid-19 once the vaccine will be available. Many think that there are good reasons to refuse to do so. I will argue in this paper that there is a moral duty to be vaccinated against Covid-19. It is something we do not owe ourselves it is something we owe others. In addition, it is also argued that the state should enforce this duty. How do we change the normative landscape by making requests? It will be argued that by making requests we create reasons for action if and only if certain conditions are met. We are able to create reasons if and only if doing so is valuable for the requester, and if they respect the requestee. Respectful requests have a normative force – it will be argued – because it is of instrumental value to us that we all have the normative power (...) of creating reasons by making requests. The normative power has the potential for creating and shaping valuable interactions and relationships for the requester and the requestee. This potential could not be realized if we did not have the normative power of making requests. It will also be shown why this account of the normative force of requests should be preferred to the two alternative accounts of the reason-giving force of requests that have been put forward by James H.P. Consent that is voluntary, informed and given by a competent person sometimes transforms a wrong into a right act. How does consent that meets these requirements change the moral property of an act, namely that of being a wronging of a person? This is the question this paper will deal with. Some authors argue that valid consent changes the moral property of an act by changing the reasons which speak against the act. This account of the normative force of consent (...) will be critically examined and rejected. An alternative model will then be put forward and defended according to which consent changes the moral property of an act if and only if the wrong‐making property of the act is that it is not consented to. The upshot will be that consent does not eliminate the wrong‐making property if the unconsented act is wrong for other reasons than not being consented to. (shrink)

This paper discusses the volenti non fit injuria maxim. The volenti maxim states that a person is not wronged by that to which she consents, provided her consent is valid. I will argue, however, that the volenti maxim does not apply to all instances of valid consent. In some cases the consenter is wronged even if his consent is valid. Valid consent can only release others from consent-sensitive duties, not from consent-insensitive duties. If the consentee flouts a consent-insensitive duty the (...) consentee wrongs the consenter and thereby commits a wrong. (shrink)

In diesem Aufsatz soll gezeigt werden, dass diese These falsch ist. Es wird ein Begriff von Würde vorgestellt, der sich nicht auf den Begriff des Respekts vor der Autonomie von Personen reduzieren lässt. Anhand der Diskussion um ein Sterben in Würde soll auch deutlich (...) werden, dass auf den Begriff der Würde auch in der Medizinethik nicht verzichtet werden kann. (shrink)

Some authors think that humanitarian interventions are always morally wrong. Others think that they are sometimes justified. In this paper, I argue that the international community has a moral duty to humanitarian intervention when it comes to mass murder, mass rape, genocide, ethnic cleansing, and deliberate starvation. It is argued that we all have good reasons to endorse an intervention norm protecting basic rights.

Es geht in diesem Aufsatz um die Frage, was es heißt, eine andere Person zu achten. Im Zentrum steht dabei die moralische Achtung, nicht die Achtung im Sinne der Wertschätzung einer anderen Person. Ein wohlfahrts- und ein autonomietheoretisches Verständnis moralischer Achtung werden dargestellt und zurückgewiesen. Es wird für ein Verständnis moralischer Achtung argumentiert, wonach eine Person genau dann geachtet wird, wenn ihr authentischer Wille ernst genommen wird. Die Achtung schulden wir dabei der Würde der Person. Achtung vor der Würde der (...) Person ist Achtung vor dem, was die Selbstachtung von Personen ermöglicht. Die Würde von Personen ist unantastbar sowohl in der anderen wie auch in der eigenen Person. Der authentische Wille von Personen darf entsprechend bloß dann geachtet werden, wenn er mit dieser Würde sich verträgt. (shrink)

Im August 2002 trafen sich Philosophinnen und Philosophen zu einer Tagung in Frankfurt, um uber Grundlagen der Ethik zu diskutieren. Dabei ging es um Wahrheit in der Moral, um Ontologie und Moral, um das Verhaltnis von Metaethik und normativer Ethik, um die Natur praktischer Grunde und nicht zuletzt auch um Grundelemente einer inhaltlichen Moraltheorie. Mit dem Begriff ›Instrumentalisierung‹ steht eine Praxis im Blick, die dadurch charakterisiert ist, dass andere jeweils als Mittel behandelt werden. Das tun wir, wenn wir uns von einem Taxifahrer zum Bahnhof fahren lassen, wenn wir uns im Supermarkt vom Verkäufer beraten lassen und vom Kollegen einen Aufsatz lesen und kommentieren lassen. Wenn wir andere als Mittel benutzen, dienen sie bestimmten Zwecken, die wir verfolgen. Diese Zwecke müssen nicht notwendigerweise die eigenen sein. Ich kann jemanden fragen, wo die Stadtbibliothek sei, weil (...) ich damit einem Kollegen einen Gefallen erweisen möchte. Der Kollege möchte das wissen. Die Zwecke, die dabei verfolgt werden, sind nicht Zwecke, welche die als Mittel benutzte Person verfolgt. Es sind ihr fremde Zwecke. Wenn wir jemanden als Mittel behandeln, dann tun wir etwas mit der betroffenen Person. Sie ist nicht Mittel zu ihr fremden Zwecken, wenn sie keinen Beitrag zur Realisierung des Zwecks leistet. Dabei muss sie selbst nicht wissen, dass sie das tut. Fraglich ist, ob man bloß dann davon reden kann, dass ich eine andere Person als Mittel behandelt habe, wenn ich das absichtlich tue. Nehmen wir an, jemand würde mir im obigen Beispiel sagen, wo sich die Stadtbibliothek befindet, ohne dass ich sie vorgängig gefragt habe. Diese Person leistet ohne Zweifel einen Beitrag zur Realisierung meines Zwecks, aber habe ich sie auch als Mittel behandelt? Samuel Kerstein meint, dass man einen anderen dann als Mittel behandelt, wenn die Weise, wie man ihn behandelt, von der Absicht getragen wird, dass er oder sie etwas tut, was zur Realisierung meines Zwecks beiträgt: »Sie muss beabsichtigen [...], dass die Anwesenheit oder Mitwirkung des Anderen auf die eine oder andere Weise zur Realisierung des Zwecks beiträgt«. Jemand wird danach als Mittel behandelt, wenn eine andere Person beabsichtigt, seine Anwesenheit oder sein Tun zur Realisierung eines ihm fremden Zwecks zu benutzen. (shrink)

ZusammenfassungIm Blick auf ein Recht auf assistierten Suizid ist nicht nur umstritten, ob es ein solches Recht gibt, es ist auch umstritten, worauf ein solches Recht denn ein Recht wäre. Der vorliegende Artikel versucht deutlich zu machen, dass das, worum es in dieser Diskussion um den selbstbestimmten Suizid geht, die Frage ist, was Entscheidungen von Menschen achtungswürdig macht. Der Artikel plädiert für eine Idee von Achtungswürdigkeit, für welche die selbstbestimmte Ausübung von Rechten über sich selbst leitend ist, eine Idee, die (...) auch in unserer Rechtspraxis wirksam ist. To respect the autonomous choices of persons is an important moral principle. There is, however, little agreement about its nature and its normative importance. This is due to the fact that the concept of autonomy as well as the moral relevance of autonomy are contested. It is argued in this paper that the debate about autonomy is at its core a debate about the reasons for respecting decisions. Decisions of persons are to be respected as their decisions, and they have (...) to be respected as determining the deontic properties of situations. This, however, can only be understood against the background of persons having rights over themselves. Their decisions determine the deontic properties as exercises of their rights. Thus, respect for the autonomous choice of persons turns out to be respect for their rights. (shrink)

It is a widely held view in moral philosophy that reasons for action are based on desires. This view should be rejected. Reasons for action are never provided by desires. Desires provide us with motives, whereas reasons for action are based on valuable facts which obtain independently of our desires. The recognition of these reasons does not necessarily motivate us. Motives depend on desires, for instance the motive for moral actions on the desire to do the morally right thing.

Es gibt unterschiedliche Auffassungen, was unter Paternalismus zu verstehen ist. Nach der klassischen Auffassung stellen paternalistische Handlungen Eingriffe in die Freiheit eines Menschen dar, die in dessen Interesse sind. Den Eingriffen in die Freiheit liegt die Absicht zugrunde, jemanden daran zu hindern, etwas zu tun, das für ihn schlecht ist.
