Although sovereign power is often defined as transcending legal and religious norms, the work of historians like Prodi and Agamben has drawn our attention to the ways in which modern accounts of sovereignty depend fundamentally upon the fusion and transformation of these norms. In Latin Christendom, this process was enabled by the juridical quality of ecclesiastical authority, its expression through laws similar in form and structure to those of civil power. There was, however, an important strand of Catholic thinking from (...) the late-sixteenth century which emphasised the centrality of sacrifice, rather than law or jurisdiction, in creating communities. For Catholic polemicists like Rossaeus (William Reynolds) sacrifice came before law and the juridical organisation of human society was secondary to the ritual and ceremonial. This article will examine the roots of this claim in post-Tridentine discussions of the Mass as a sacrifice and will go on to show how it was used to defend the primacy of the Catholic Church, particularly in 1590s France. It will consider the impact of this argument and suggest its importance in provoking new and more powerful articulations of both royal sovereignty and papal power. (shrink)

The goal of this paper is both modest and ambitious. The modest goal is to show that intercountry adoption should be considered by ethicists and healthcare providers. The more ambitious goal is to introduce the many ethical issues that intercountry adoption raises. Intercountry adoption is an alternative to medical, assisted reproduction option such as in vitro fertilization (IVF), intracytoplasmic sperm injection, third party egg and sperm donation and surrogacy. Health care providers working with assisted reproduction are in a unique position (...) to introduce their clients to intercountry adoption; however, providers should only do so if intercountry adoption is ethically equal or superior to the alternatives. This paper first presents a brief history of intercountry adoption. The second section compares intercountry adoption with medical alternatives. The third section examines the unique ethical challenges that are not shared by other medical alternatives. The final section concludes that it is simplistic for a healthcare provider to promote intercountry adoption unconditionally; however, in situation where intercountry adoption is practiced conscientiously it poses no greater ethical concern than several medical alternatives. This paper aims to offer a new argument in defence bacterial species pluralism. To do so, I shall first present the particular issues derived from the conflict between the non-theoretical understanding of species as units of classification and the theoretical comprehension of them as units of evolution. Secondly, I shall justify the necessity of the concept of species for the bacterial world, and show how medicine and endosymbiotic evolutionary theory make use of different concepts of bacterial species due to their (...) distinctive purposes. While the great medieval philosopher, theologian, and physician Maimonides is acknowledged as a leading Jewish thinker, his intellectual contacts with his surrounding world are often described as related primarily to Islamic philosophy. Maimonides in His World challenges this view by revealing him to have wholeheartedly lived, breathed, and espoused the rich Mediterranean culture of his time.Sarah Stroumsa argues that Maimonides is most accurately viewed as a Mediterranean thinker who consistently interpreted his own Jewish tradition in contemporary multicultural terms. Maimonides (...) spent his entire life in the Mediterranean region, and the religious and philosophical traditions that fed his thought were those of the wider world in which he lived. Stroumsa demonstrates that he was deeply influenced not only by Islamic philosophy but by Islamic culture as a whole, evidence of which she finds in his philosophy as well as his correspondence and legal and scientific writings. She begins with a concise biography of Maimonides, then carefully examines key aspects of his thought, including his approach to religion and the complex world of theology and religious ideas he encountered among Jews, Christians, Muslims, and even heretics; his views about science; the immense and unacknowledged impact of the Almohads on his thought; and his vision of human perfection.This insightful cultural biography restores Maimonides to his rightful place among medieval philosophers and affirms his central relevance to the study of medieval Islam. Justice, Gender and the Politics of Multiculturalism explores the tensions that arise when culturally diverse democratic states pursue both justice for religious and cultural minorities and justice for women. Sarah Song provides a distinctive argument about the circumstances under which egalitarian justice requires special accommodations for cultural minorities while emphasizing the value of gender equality as an important limit on cultural accommodation. Drawing on detailed case studies of gendered cultural conflicts, including conflicts over the 'cultural defense' in criminal law, (...) aboriginal membership rules and polygamy, Song offers a fresh perspective on multicultural politics by examining the role of intercultural interactions in shaping such conflicts. In particular, she demonstrates the different ways that majority institutions have reinforced gender inequality in minority communities and, in light of this, argues in favour of resolving gendered cultural dilemmas through intercultural democratic dialogue. The Spanish Jesuit Francisco Suarez was an eminent philosopher and theologian whose _Disputationes Metaphysicae_ was first published in Spain in 1597 and was widely studied throughout Europe during the seventeenth century. The _Disputationes Metaphysicae_ had a great influence on the development of early modern philosophy and on such well-known figures as Descartes and Leibniz. This is the first time that Disputations 17, 18, and 19 have been translated into English. The _Metaphysical Disputations_ provide an excellent philosophical introduction to the medieval (...) Aristotelian discussion of efficient causality. The work constitutes a synthesis of monumental proportions: problematic issues are lucidly delineated and the various arguments are laid out in depth. Disputations 17, 18, and 19 deal explicitly with such issues as the nature of causality, the types of efficient causes, the prerequisites for causal action, causal contingency, human free choice, and chance. Esta comunicación examina cómo la pandemia de la COVID-19 ha impactado en la ya existente brecha de género en la trayectoria académica de las investigadoras y docentes de nuestras universidades. Para examinar dicho impacto, se realiza una revisión de varias investigaciones realizadas en España y en Portugal durante el periodo de confinamiento derivado de la pandemia. Los resultados recabados indican que durante el confinamiento creció la producción científica de los varones, y disminuyó la de las mujeres, entre otras diferencias relacionadas (...) con el trabajo académico en general (docencia, gestión, investigación). Una de las principales causas apunta a la brecha de cuidados existente. Esta situación requiere la necesidad de ampliar las medidas para evitar la desigualdad de género en la academia. (shrink)

This article examines how migration impacts power dynamics and gender norms for women left behind living in rural Southern Punjab, Pakistan, a site where patriarchal customs and religion are interwoven to confine women’s mobility and agency. Based on qualitative interviews and focus groups with women left behind from 2015 through 2018, this article explores how local rural-to-urban male migration patterns impact the decision-making powers of women who are left behind and must make sense of the family structure and gender dynamics (...) in their homes after their husbands’ exit. This study finds that in the absence of her migrant husband, a woman left behind is still subject to patriarchal norms and surveillance by the remaining in-laws, including other women. Citing specific examples from the field, I explain why women left behind remain close to the very families that confine and monitor their movement, and why, in some cases, women left behind turn a blind eye toward their husband’s second or third marriage. Through an examination of behind-the-scenes negotiations that women left behind make, I argue that women maintain for themselves at surface level the gendered expectations that patriarchy sets for them, but given the opportunity, they can negotiate and bargain their positionality in subtle ways without disrupting the status quo that could otherwise jeopardize their physical safety and social reputation. Australia is witnessing a political, social and cultural renaissance of public debate regarding violence against women, particularly in relation to domestic and family violence (DFV), sexual assault and sexual harassment. Women's voices calling for law reform are central to that renaissance, as they have been to feminist law reform dating back to nineteenth-century campaigns for property and suffrage rights. Although feminist research has explored women’s voices, speaking out and storytelling to highlight the exclusions and limitations of the legal and criminal (...) justice systems in responding to women’s experience, less attention has been paid to how women's voices are elicited, received and listened to, and the forms of response they have received. We argue that three recent public inquiries in Australia reveal an urgent need for a victim-survivor-centred theory of listening to women’s voices in law reform seeking to address violence against women. We offer a nascent theory of a victim-survivor-centred approach grounded in openness, receptivity, attentiveness and responsiveness, and argue that in each of our case studies, law reform actors failed to adequately listen to women by silencing and refusing to listen to them; by hearing them but failing to be open, receptive and attentive; and by selectively hearing and resisting transformation. We argue that these inquiries signal an acute need for attention to the dynamics of listening in law reform processes, and conclude that a victim-survivor-centred theory of listening is a critical foundation for meaningful change to address violence against women. Therefore, we propose that human cooperation and fairness depend on self-regulation. Evidence shows reductions in fairness and other prosocial tendencies when self-regulation fails.

La música popular ha funcionado en numerosas ocasiones como una herramienta para articular discursos y lanzar mensajes que desafían los valores de una sociedad. Más allá de repertorios musicales con un explícito mensaje político, existen numerosos ejemplos que desde el mainstream y a través de estrategias más sutiles envían mensajes que resultan subversivos y generan debates sobre convenciones que han sido normalizadas en nuestra cultura. En los últimos años, la proliferación de las redes sociales ha incrementado el papel de la (...) música en las discusiones políticas, y el crecimiento del consumo musical audiovisual a través de YouTube y las redes sociales ha convertido a los videoclips en un soporte fundamental para dar forma a estos mensajes. En este artículo analizamos cómo se utiliza el espacio urbano en la música mainstream para articular discursos capaces de generar debate en la sociedad. Partimos de una concepción dual (física y simbólica) del espacio urbano para entenderlo como un constructo social cargado se significados, y abordamos su funcionamiento en la música popular estudiando casos recientes, como la representación de espacios e imaginarios religiosos en los videoclips mainstream. Do not attempt cardiopulmonary resuscitation decisions (DNACPR) are considered good medical practice for those dying at the end of natural life. They avoid intrusive and inappropriate intervention. Historically, informing patients of these decisions was discretionary to avoid undue distress. Recent legal rulings have altered clinical guidance: disclosure is now all but obligatory. The basis for these legal judgments was respect for the patient’s autonomy as an expression of their human rights. Through critical analysis, this paper explores other bioethical considerations and (...) the potential harms if they are ignored. Arguably, disclosure of DNACPR status on its own will do little to improve patient experience. A focus on good communication with those identified as approaching end-of-life will facilitate personalized care. Discussions around DNACPR may still occur, but only if likely to be beneficial and at a patient-appropriate pace (not dictated by the need to activate the decision). (shrink)

In this essay, Sarah Stitzlein and Amy Rector-Aranda, drawing on John Dewey's theoretical suggestions regarding how to best form publics capable of bringing about change through deliberation and action, offer teachers guidance on how to form and navigate spaces of political protest and become more effective advocates for school reform. Using Aaron Schutz's analysis of teacher activism as a point of departure, Stitzlein and Rector-Aranda argue for the development in schools of “small publics,” that is, Deweyan democratic spaces within (...) which teachers can dialogue and exchange ideas about the problems they face in the classroom. While Schutz treats this type of space merely as a stepping stone toward the real locus of political action, the power public, Stitzlein and Rector-Aranda argue that small publics are themselves important spaces where teachers can work together to frame problems and build coalitions and solidarity with other groups in order to take action in the wider public sphere and bring about change in schools. Horkheimerian’s critique of the Enlightenment, shows the process whereby the demystification of the world is triggered by way of an “an act of sovereignty” of reason. There the man lost for reason his possibility of self-criticism, causing it to be in instrumental reason. Since its inception, the Enlightenment, as myth, mutilated reason, over the pursuit of truth –theoretical truth and moral truth–, there was a renounce to sense. The dream of Enlightenment rationality was reduced to the 'instrumentalization'. This dialectic not (...) only reveals the irreversible crisis of reason, but leaves in place, in the discussion of critical theory, the idea of the 'social pathology of reason', from which a “normative horizon” can be proposed, hinting at the scene of the ethical discussion the lack of rationality of societies.
