The purpose of this article is to investigate how cultural meanings associated with the left ventricular assist device inform acceptance and experience of this innovative technology when it is used as a destination therapy. We conducted open-ended, semistructured interviews with family caregivers and patients who had undergone LVAD-DT procedures at six U.S. hospitals. A grounded theory approach was used for the analysis. Thirty-nine patients and 42 caregivers participated. Participants described a sense of obligation to undergo the procedure because of its (...) promise for salvation. However, once the device was implanted, patients described being placed into a liminal state of being neither sick nor healthy, with no culturally scripted role. Consideration of end-of-life decisions was complicated by the uncertainties about how patients with LVADs die. Pre-implantation communications among patient, family, and clinicians should take into account the impact of the technology on meaning, identity, and patient experience. (shrink)

Though many argue over root causes, few dispute the existence of gender disparities across our societal landscape. Patriarchal norms consistently obstruct the flourishing of those who identify themselves as women, those who are identified by others as women, and generally those who gender-identify in ways that challenge the norms of heterosexual cis-gender male privilege. The past few years have brought significant breakthroughs in understanding human genetics. This knowledge has been used to develop ‘polygenic scores’ (or ‘polygenic risk scores’) which provide probabilistic information about the development of polygenic conditions such as diabetes or schizophrenia. They are already being used in reproduction to select for embryos at lower risk of developing disease. Currently, the use of polygenic scores for embryo selection is subject to existing regulations concerning embryo testing and selection. Existing regulatory approaches include ‘disease-based' (...) models which limit embryo selection to avoiding disease characteristics (employed in various formats in Australia, the UK, Italy, Switzerland and France, among others), and 'laissez-faire' or 'libertarian' models, under which embryo testing and selection remain unregulated (as in the USA). We introduce a novel 'Welfarist Model' which limits embryo selection according to the impact of the predicted trait on well-being. We compare the strengths and weaknesses of each model as a way of regulating polygenic scores. Polygenic scores create the potential for existing embryo selection technologies to be used to select for a wider range of predicted genetically influenced characteristics including continuous traits. Indeed, polygenic scores exist to predict future intelligence, and there have been suggestions that they will be used to make predictions within the normal range in the USA in embryo selection. We examine how these three models would apply to the prediction of non-disease traits such as intelligence. The genetics of intelligence remains controversial both scientifically and ethically. This paper does not attempt to resolve these issues. However, as with many biomedical advances, an effective regulatory regime must be in place as soon as the technology is available. If there is no regulation in place, then the market effectively decides ethical issues. (shrink)

This article considers the appropriate limits of legal regulation through an analysis of the 2010 French law banning the wearing of full-face veils in public. The author examines the law from the perspective of John Stuart Mill's harm principle and Patrick Devlin's legal moralism. The author concludes that neither position provides a convincing justification for the French law.

The doctor-patient relationship has evolved to respect “the autonomy and patients’ rights”. One of the cornerstones in such autonomy is the opportunity for patients to draw living wills, also known as advance directives. However, information about AD available to patients remains scarce largely due to the lack of involvement of General practitioners for several reasons. The aim of our study was to evaluate current general practitioner residents’ behavior concerning their role in informing their patients about AD. We built a French (...) nationwide survey from GPR class of 2012 to 2014. Two thousand three hundred ten residents completed our survey. 89.8% declared their willingness to offer patients the opportunity of writing AD. When asked about the usefulness of AD, 73.6% of residents responded that these are a suitable help for patients, but 19.7% considered that AD are essentially geared towards frail patients. Among residents who want to inform patients about AD, 14.7% wanted to involve all patients. Only 20.5% thought that elderly people should be systematically informed about AD. When the question involves other frail people in various disease areas, information seems relevant for 60.1% of GPR considering patient with cancer or malignant hematologic disease and for 56.2% about patients affected by neurodegenerative disease. When considering the routine use of AD, 20.5% of GPR would take them into account only if they are in agreement with the patient’s decision. The results of the survey indicate that GPR would rather choose to decide who should be informed about AD, and when to take AD into account for ethical concerns. (shrink)

This article argues, contra-Derrida, that Foucault does not essentialize or pre-comprehend the meaning of life or bio- in his writings on biopolitics. Instead, Foucault problematizes life and provokes genealogical questions about the meaning of modernity more broadly. In The Order of Things, the 1974-75 lecture course at the Collège de France, and Herculine Barbin, the monster is an important figure of the uncertain shape of modernity and its entangled problems. Engaging Foucault’s monsters, I show that the problematization of life (...) is far from a “desire for a threshold,” à la Derrida. It is a spur to interrogating and critiquing thresholds, a fraught question mark where we have “something to do.” As Foucault puts it in “The Lives of Infamous Men,” it an ambiguous frontier where beings lived and died and they appear to us “because of an encounter with power which, in striking down a life and turning it to ashes, makes it emerge, like a flash [...].”. This paper discusses the contribution of Madame Du Châtelet to the reception of Newtonianism in France prior to her translation of Newton’s Principia. It focuses on her Institutions de physique, a work normally considered for its contribution to the reception of Leibniz in France. By comparing the different editions of the Institutions, I argue that her interest in Newton antedated her interest in Leibniz, and that she did not see Leibniz’s metaphysics as incompatible with Newtonian science. Her Newtonianism (...) can be seen to be in the course of development between 1738 and 1742 and it was shaped by contemporary French debates and the achievement of French Newtonians like Maupertuis in confirming his theories. Ivo of Chartres (1040–1115) offers a case study about how objects – ivories in particular – knitted together social relations and established kinship networks across medieval France. An active reformer amidst the Investiture Controversy, Ivo is best known today for his lively and compelling correspondence. This article, however, argues that Ivo should also be remembered for the carved ivories in his possession. At least three ivories from the late eleventh century (although two are now lost) can be associated with (...) Ivo: a comb, a set of tablets (probably a diptych), and his crosier, which is now in Florence’s Bargello Museum. Interweaving Ivo’s written reflections on the role of ivory objects in his life as reformer, bishop, politician, and friend, the essay further traces the history of Ivo’s crosier as it was passed to following generations of reform-minded canons. Teilhard had recognized, the Secretary-General explained, that "humanity is undergoing a metamorphosis, a transformation toward a planetary society that is united in its roots and more and more diversified in its component parts and individual lives."1 And this insight made him "the French philosopher who has had the greatest influence on the metaphysical and planetary evolution of the United Nations."2 Pérez de Cuéllar was by no means alone in his thinking. As its charter makes clear, the United Nations is a secular institution. But in recent years, historians have begun to probe the crucial contributions that religious actors made to the drafting of the Universal Declaration on Human Rights in 1948.3 Others have shown how American ecumenical Protestants such as John Foster Dulles contributed to shaping the creation of the UN by means of a highly successful domestic lobbying campaign.4 In both cases, the scholarship has tended to focus on the way religious actors shaped human rights discourse at the UN. For its part, the social-scientific literature on the UN's engagement with religion has tended to emphasize the role of faith-based organizations (religious NGOs), which have proliferated since the 1990s.5 Among the most important of these is the Catholic Church, which holds a unique status; as the only religious institution that is also a state, it has been recognized as a permanent observer state since 1964.6 What is missing from both the historical and social-scientific literature, however, is an account of the distinctive spirituality of the UN itself. Quite apart from the organization's relationship to religious institutions or the influence of religious actors on human rights activism, how have religious ideas informed the way leading UN diplomats have imagined the institution's mission of global governance?This article explores this question by examining the reception of Teilhard de Chardin's Catholic cosmology, and especially his account of globalization—or [End Page 828] "planetization," as he called it—at the UN. Trained as both a Jesuit priest and a professional geologist and paleontologist, Teilhard elaborated a controversial theory of evolution that encompassed everything from inorganic matter to human life to religious salvation. Teilhard's theory that human life on Earth was converging at both a biological and spiritual level earned him the suspicion of Vatican authorities, but it also found an enthusiastic reception at the highest echelons of the UN Secretariat and at UNESCO. What attracted UN bureaucrats to the Jesuit's worldview was precisely its synthetic ambition—the way it promised to reconcile science and religion—and its account of a pan-human convergence capable of preserving the distinct value of local cultures and individual persons. The fascination with Teilhard at the UN was by no means confined to Catholics, however. If the Jesuit's ideas appealed to both Catholics and non-Catholics, it was precisely because they seemed to transcend their author's Catholicism and point toward a universal spirituality that merged the insights of the great "world religions." Yet some practitioners consider meditation and other forms of Asian spirituality as enhancing rather than replacing worship of God.This book presents essays by twelve authors that explore similarities and differences between Buddhist meditation and Christian prayer. The book reprints pieces that originally appeared in the journal Buddhist-Christian Studies in 2001 and 2002. It is thoroughly dialogical in format. Part 1 contains five Christian reflections on Buddhist spiritual practice followed by two Buddhist responses, while part 2 consists of five Buddhist reflections on Christian spiritual practice with two Christian responses. Many of the contributors are connected with the Society for Buddhist-Christian Studies. Importantly, they combine academic and experiential knowledge of the two religions. The collection is framed by an introduction by Terry Muck and a conclusion by Rita Gross, the book's editors, who are Christian and Buddhist practitioners, respectively. The symmetry of the chapter layout is pleasing and apt.Sociologically, the major impetus for this dialogue is the fact that a growing number of Christians have found Buddhist meditation fruitful. However, these Christians have not left behind their original religious identification. As they interact with Buddhists, dialogue has emerged comparing the two traditions. Clearly for Christians practicing some Buddhism, the emphasis is on mutual appreciation and commonality. To examine the motivation for interreligious dialogue, it is fitting to ask, whose interests does the dialogue serve? First and foremost, the interests are Christian. While Christian authors have gained from Buddhist spiritual practice, Buddhists have not adapted Christian prayer techniques in return. But although the genealogy of dialogue has Christian origins, the editors intend to take a neutral approach. They frame the topic broadly and invite [End Page 204] contributors to remark on any facet of the other tradition, including critical points.In part 1, Frances Adeney, Mary Frohlich, Paul Ingram, Terry Muck, and Bardwell Smith express how aspects of Buddhist meditation have enriched their Christian spirituality. Adeney learned techniques of Buddhist silent meditation from a Jesuit priest in Indonesia that enable heightened awareness of God's presence. Frohlich belongs to a Catholic religious order for women and finds Buddhism helpful for developing discipline in prayer. For Ingram, Buddhist meditation is one ingredient in a spiritual journey focused on social liberation and discovering God's presence. Muck has found reflection on Theravada teaching about morality (sila) to be an impetus to overcome the theological dichotomy between faith and works and to develop the importance of spiritual readiness that cuts across religious traditions. Smith's participation in interfaith pilgrimage and meditation illustrates the spiritual discipline that Buddhism offers.There are many overlapping insights among these chapters that Grace Burford helpfully summarizes in her response essay: first, Buddhist practice can confirm aspects of Christian practice, such as silent prayer; second, the encounter with Buddhism can lead Christians to uncover untapped streams within Christianity, especially monastic and mystical traditions; third, Buddhism can offer unique new techniques to Christians, such as zazen, which provide rigor in developing mental concentration. Christian appreciation of Buddhism blurs religious boundaries but never requires abandonment of church or creed. Robert Thurman's response concludes with a comment on the postmodern insecurity about boundaries, and praises these Christian authors for resisting the hardening of religious identities. He reminds readers of the Dalai Lama's exhortation that conversion to Buddhism is not generally the best option for non-Buddhists drawn to his Tibetan tradition. Rather, he advises taking what seems good in Buddhism to enrich one's original religion, thus remaining integrated with family members, communities, and local customs.In part 2, the contributions of Buddhist authors display more academic distance because of the fact that the authors are not engaged in Christian practices in their Buddhist lives. The book situates the works and reception of the French scholar Pierre de la Ramée (Petrus Ramus) in a variety of European cultural and educational contexts, from Britain and France to Eastern Europe, from Germany to the Iberian peninsula, and from Scandinavia to the Netherlands. Pierre de la Ramée or Petrus Ramus (1515-1572) has long been a controversial figure in educational reform and innovation, from the moment of his first public academic statements in the 1530s, to his reception among (...) scholars in the twentieth and twenty-first centuries. What is beyond dispute, however, is the vast reach of his influence throughout Europe. Ramus's ideas were disseminated through copious editions and translations of his own textbooks, and in wave after wave of adaptations and re-imaginings of his ideas that swept across the continent. This volume embarks on a European tour of Ramism, using a wide range of previously unpublished or untranslated archival evidence from throughout the continent to examine the dissemination of Ramus's works and his intellectual influence in geographic and in disciplinary terms. The ten chapters explore the spread of Ramism from his home country of France to Protestant strongholds in Germany, Holland, and Britain, and in the Catholic context of the Iberian peninsula. The ArgumentThe vine lousePhylloxera vastatrixbecame a “pest” as it was transferred from North America and from France to Germany during the 1870s. Embodying the “invading alien,” it assumed a cultural position that increasingly gained importance in Imperial Germany. In this process, the minute insect, living invisibly underground, was made visible and became constitutive of the scientific-technological object, “pest,” pertaining to a scientific discipline, modern economic entomology. The “pest” phylloxera emerged by being made visible in a way that enabled control (...) measures against it. Thus, visibility functioned as a prerequisite for control measures. I differentiate between social visibility and physical visibility, as well as between social control and physical control of the “introduced pest.” The object phylloxera emerged at the intersection of techniques of social control such as surveillance, techniques of physical control such as disinfection, and representational practices of the sciences such as mathematics and graphics. The space of its visibility was not the vineyard as property of a vintner but the vineyard as national territory, where German (viti-) culture was defended against foreign infiltration and destruction. Many vintners had alternate visions of the grapevine disease, they resented the invasion and destruction of their vineyards by government officers, and thus they did not participate in the social and epistemic constitution of the “pest.” By 1914, the “introduced pest” had not yet become an effective “machinery.” However, the “pest” as an object of scientific knowledge emerged together with economic entomology. The field became organized as a discipline in Germany in 1913, forty years after the phylloxera had first aroused the minds of some worried Wilhelmians, and, together with its nationalistic images, the field of “pest” control became organized towards a redefinition of German society and its perceived dangers. We see legalized space itself as the foundation for social relationships significantly impacted through the ‘new normal’ of social/physical distancing guidelines. This paper will explore the positionalities of bodies that contribute to the transformation of cultural spaces and social interactions against the legalized backdrop of combatting viral spread (...) of Covid-19 in the United States, France, and Poland. Cette analyse permettra de faire des hypothèses cliniques quant à la défaillance des fonctions maternelles et paternelles dans la construction d’un devenir femme et de mettre en lumière l’absence ou l’exclusion du tiers et la tentative de séparation avortée menant vers des positions radicales. Although sovereign power is often defined as transcending legal and religious norms, the work of historians like Prodi and Agamben has drawn our attention to the ways in which modern accounts of sovereignty depend fundamentally upon the fusion and transformation of these norms. In Latin Christendom, this process was enabled by the juridical quality of ecclesiastical authority, its expression through laws similar in form and structure to those of civil power. There was, however, an important strand of Catholic thinking from (...) the late-sixteenth century which emphasised the centrality of sacrifice, rather than law or jurisdiction, in creating communities. For Catholic polemicists like Rossaeus (William Reynolds) sacrifice came before law and the juridical organisation of human society was secondary to the ritual and ceremonial. This article will examine the roots of this claim in post-Tridentine discussions of the Mass as a sacrifice and will go on to show how it was used to defend the primacy of the Catholic Church, particularly in 1590s France. It will consider the impact of this argument and suggest its importance in provoking new and more powerful articulations of both royal sovereignty and papal power. (shrink)

This open-ended anthology is a journey into the very canon that Mary Daly has argued to be patriarchal and demeaning to women. This volume deauthorizes the official canon of Western philosophy and disrupts a related story told by some feminists who claim that Daly’s work is unworthy of re-reading because it contains fatal errors. The editors and contributors attempt to prove that Mary Daly is located in the Western intellectual tradition. Daly may be highly critical of conventional Western epistemological and (...) theological traditions, but she nevertheless appropriates themes “out-of-context” for the building of her own systematic philosophy. The following are just a few of the many themes explored in this volume: • the question of subjectivity understood as an ongoing process of be-coming • the ambiguity of the need for feminists of colonial nations to speak out about violence against women in other parts of the world while that speaking carries with it the stamp of a colonial location • the territoriality of lesbian and women’s space • the theological dimensions of twentieth-century Western philosophy. Les auteurs de cet ouvrage se sont donné pour tâche de relire l'œuvre de Giorgio Agamben en refusant de la convertir en simple objet d'analyse. Ils essayent plutôt d'entendre " l'héritage de la puissance " à laquelle la littérature comme phénomène semble nous engager, en retraçant un chemin dont les haltes se situent au cœur de la méditation agambenienne sur notre époque : l'avènement possible d'un sujet qui descendrait d'une " puissance pure ", irréductible à l'identification, dépouillé de toute substance, (...) sinon du mouvement par lequel il s'approprie lui-même en tant que puissance sans objet. Chacun des auteurs tente ainsi de potentialiser certaines propositions d'Agamben à partir de ce qu'on appelle " littérature ". Comment, à l'heure où celle-ci semble faire l'épreuve d'une neutralisation de son destin historique, penser sa relation au temps messianique? Au moment où plusieurs œuvres se vouent au recueillement de l'innommé, de l'insignifiant et des heures mortes comme au seul territoire qui leur serait préservé, comment penser l'articulation philologique entre le reste et la résistance? Pourrait-on conférer à la littérature un statut d'exception politique, voire de zone d'anomie constitutive du politique?
