Taking the title of his book from Isaiah Berlin's famous essay distinguishing a negative concept of liberty connoting lack of interference by others from a positive concept involving participation in the political realm, Samuel Fleischacker explores a third definition of liberty that lies between the first two. In Fleischacker's view, Kant and Adam Smith think of liberty as a matter of acting on our capacity for judgment, thereby differing both from those who tie it to the satisfaction of our (...) desires and those who translate it as action in accordance with reason or "will." Integrating the thought of Kant and Smith, and developing his own stand through readings of the Critique of Judgment and The Wealth of Nations, Fleischacker shows how different acting on one's best judgment is from acting on one's desires--how, in particular, good judgment, as opposed to mere desire, can flourish only in favorable social and political conditions. At the same time, exercising judgment is something every individual must do for him- or herself, hence not something that philosophers and politicians who reason better than the rest of us can do in our stead. For this reason advocates of a liberty based on judgment are likely to be more concerned than are libertarians to make sure that government provides people with conditions for the use of their liberty--for example, excellent standards of education, health care, and unemployment insurance--while at the same time promoting a less paternalistic view of government than most of the movements associated for the past thirty years with the political left. In this article, I explore how the ideas of French philosopher Emmanuel Levinas offer insights into a debate often held today in the field of corporate governance, concerning the relative merits of statutory and voluntary approaches to the regulation of business. The philosophical position outlined by Levinas questions whether any rule-based systematisation of ethical responsibility, either statutory or voluntary, can ever equate to a genuine responsibility for the other person. I reflect on how various authors have adapted Levinas’s philosophy to (...) form a critique of bureaucracy and rule following in business, and the lack of ethical authenticity in corporate codes. However, this article also considers the question of whether a theoretical separation can be made between an ethical responsibility based on sensibility (as is suggested by Levinas) and a rational conceptualisation of how one is required to act. Considering the difficulty of disentangling these notions of ethics, I return to the problem of corporate governance and suggest an approach to stakeholder conflict based on mediation and dialogue, which rules out neither principles of conduct nor an openness of responsibility to the Other. Modern notions of empathy often celebrate its ability to bridge divides, to unite humankind. But how do we square this with the popular view that we can never truly comprehend the experience of being someone else? In this book, Samuel Fleischacker delves into the work of Adam Smith to draw out an understanding of empathy that respects both personal difference and shared humanity. After laying out a range of meanings for the concept of empathy, Fleischacker proposes that what Smith (...) called “sympathy” is very much what we today consider empathy. Smith’s version has remarkable value, as his empathy calls for entering into the perspective of another—a uniquely human feat that connects people while still allowing them to define their own distinctive standpoints. After discussing Smith’s views in relation to more recent empirical and philosophical studies, Fleischacker shows how turning back to Smith promises to enrich, clarify, and advance our current debates about the meaning and uses of empathy. There is a mystery at the heart of Plato's Parmenides. In the first part, Parmenides criticizes what is widely regarded as Plato's mature theory of Forms, and in the second, he promises to explain how the Forms can be saved from these criticisms. Ever since the dialogue was written, scholars have struggled to determine how the two parts of the work fit together. Did Plato mean us to abandon, keep or modify the theory of Forms, on the strength of Parmenides' (...) criticisms? Samuel Rickless offers something that has never been done before: a careful reconstruction of every argument in the dialogue. He concludes that Plato's main aim was to argue that the theory of Forms should be modified by allowing that forms can have contrary properties. To grasp this is to solve the mystery of the Parmenides and understand its crucial role in Plato's philosophical development. (shrink)

Of all Plato’s dialogues, the Parmenides is notoriously the most difficult to interpret. Scholars of all periods have disagreed about its aims and subject matter. The interpretations have ranged from reading the dialogue as an introduction to the whole of Platonic metaphysics to seeing it as a collection of sophisticated tricks, or even as an elaborate joke. This work presents an illuminating new translation of the dialogue together with an extensive introduction and running commentary, giving a unified explanation of the (...) Parmenides and integrating it firmly within the context of Plato's metaphysics and methodology. Scolnicov shows that in the Parmenides Plato addresses the most serious challenge to his own philosophy: the monism of Parmenides and the Eleatics. In addition to providing a serious rebuttal to Parmenides, Plato here re-formulates his own theory of forms and participation, arguments that are central to the whole of Platonic thought, and provides these concepts with a rigorous logical and philosophical foundation. In Scolnicov's analysis, the Parmenides emerges as an extension of ideas from Plato's middle dialogues and as an opening to the later dialogues. Scolnicov’s analysis is crisp and lucid, offering a persuasive approach to a complicated dialogue. This translation follows the Greek closely, and the commentary affords the Greekless reader a clear understanding of how Scolnicov’s interpretation emerges from the text. This volume will provide a valuable introduction and framework for understanding a dialogue that continues to generate lively discussion today. (shrink)

This dissertation is an experiment: what happens if we treat proper names as anaphoric expressions on a par with pronouns? The first thing to notice is that a name's 'antecedent' can occur in a discourse prior to the one containing the name. An individual may be introduced and tagged with a name in one context, and then retrieved using the name in a later context. To allow for discourse crossing anaphora, in addition to the usual cross-sentential anaphora, a revision of (...) discourse semantics is in order. Essentially, we must countenance discourse referents that span contexts, and think of contexts, not as islands, but as nodes connected to each other by the discourse referents they share. Discourse semantics gives rise to a new notion of content determined by discourse reference rather than pure reference. In a space of contexts structured by shared discourse referents, discourse content becomes transmissable. For a piece of content may be sent from one context to another whenever the discourse referents bundled up in the content are held in common by the two contexts. The final step is to treat the cognitive state of an agent as just another kind of context, and so a potential recipient of discourse content. Discourse content is more fine-grained than traditional 'singular' content, and so is a better fit for our pretheoretic intuitions about communication and attitude reporting. This is illustrated by applying the theory to Frege's puzzle, a puzzle of Loar's about communication, Kripke's puzzle about belief, Geach's intentional identity and new breed of 'mixed' de re-de dicto sentence. Gils-Schmidt and Salloch recognise that human and climate health are inextricably linked, and that mitigating healthcare-associated climate harms is essential for protecting human health.1 They argue that physicians have a duty to consider how their own practices contribute to climate change, including during their interactions with patients. Acknowledging the potential for conflicts between this duty and the provision of individual patient care, they propose the application of Korsgaard’s neo-Kantian account of practical identities to help navigate such scenarios. In this commentary, (...) we argue that by focusing attention on this physician–patient level, the authors overlook the complexity of climate change, both within the healthcare sector and beyond. We recognise the importance of individual agency in tackling this issue, and we also recognise that the authors do briefly acknowledge the importance of considering these broader complexities; however, we emphasise the need for climate and health discussions/action to be situated in a wider framework of systemic change. Our concern is that overemphasis on patient-level interactions risks normalising the prioritisation of individual-level approaches to addressing climate change, detracting from such a broader approach. Physician training emphasises the need for trust, confidentiality and shared decision-making in the doctor–patient relationship. …. (shrink)

In this collection of essays Samuel Wheeler discusses Derrida and other “deconstructive” thinkers from the perspective of an analytic philosopher willing to treat deconstruction as philosophy, taking it seriously enough to look for and analyze its arguments. The essays focus on the theory of meaning, truth, interpretation, metaphor, and the relationship of language to the world. Wheeler links the thought of Derrida to that of Davidson and argues for close affinities among Derrida, Quine, de Man, and Wittgenstein. He also (...) demonstrates the propinquity of Plato and Derrida and shows that New Criticism shares deconstruction’s conception of language. Of the twelve essays in the collection, four are published here for the first time. The fundamental resemblance between Derrida and such analytic thinkers as Quine, Wittgenstein, and Davidson, the author argues, is that they deny the possibility of meanings as self-interpreting media constituting thoughts and intentions. Derrida argues that some form of magic language has determined the very project of philosophy, and his arguments work out the consequences of denying that there are such self-interpreting mental contents. In addition, Derrida and Davidson agree in denying any “given.” Without a given, questions about realism and idealism cease to have a point. Derrida and Davidson are both committed to the textuality of all significant marks, whether in neurons or on paper. They argue that there is no mode of representation more direct than language. Cognitive theorists routinely disagree about the evidence supporting claims in cognitive science. Here, we first argue that some disagreements about evidence in cognitive science are about the evidence available to be drawn upon by cognitive theorists. Then, we show that one’s explanation of why this first kind of disagreement obtains will cohere with one’s theory of evidence. We argue that the best explanation for why cognitive theorists disagree in this way is because their evidence is what they rationally grant. Much contemporary metaphysics, moved by an apparent necessity to take reality to consist of given beings and properties, presents us with what appear to be deep problems requiring radical changes in the common sense conception of persons and the world. Contemporary meta-ethics ignores questions about logical form and formulates questions in ways that make the possibility of correct value judgments mysterious. In this book, Wheeler argues that given a Davidsonian understanding of truth, predication, and interpretation, and given a relativised version (...) of Aristotelian essentialism compatible with Davidson’s basic thinking, many metaphysical problems are not very deep. Likewise, many philosophers' claims that common sense needs to be modified are unfounded. He argues further that a proper consideration of questions of logical form clarifies and illuminates meta-ethical questions. Although the analyses and arguments he gives are often at odds with those at which Davidson arrived, they apply the central Davidsonian insights about semantics, understanding, and interpretation. We define self-control as an individual's efforts to bias the outcome of present or anticipated motivational conflicts in order to increase the likelihood that subsequent behavior serves perceived long-term interests. We suggest suppression and resolve are not “mechanisms” that underlie self-control, but rather are classes of strategies that influence motivations in order to increase the likelihood of successful self-control outcomes.

Previous scholarship on states’ autonomy from the interests of society has focused primarily on nondemocratic societies, raising the question of whether “state theory” is relevant to modern states. Public‐opinion research documenting the ignorance of mass polities suggests that modern states may be as autonomous as, or more autonomous than, premodern states. Premodern states’ autonomy was secured by their ability to suppress societal dissent by force of arms. Modern states may have less recourse to overt coercion because the very thing that (...) legitimates them in the eyes of society—democracy—virtually ensures that society will not control the state, since the putative agent of control, the electorate, cannot possibly be well informed about the multitudinous tasks undertaken by modern governments. Instead of focusing solely on armies, taxes, and bureaucracies, state theorists can now direct their attention to how the vagaries of public opinion and the legitimating effects of popular elections may fuel state autonomy. Matthew Leisinger (2020) argues that previous interpretations of John Locke’s account of akrasia (or weakness of will) are mistaken and offers a new interpretation in their place. In this essay, we aim to recapitulate part of this debate, defend a previously articulated interpretation by responding to Leisinger’s criticisms of it, and explain why Leisinger’s own interpretation faces textual and philosophical problems that are serious enough to disqualify it as an accurate reconstruction of Locke’s views. This paper explores the Australian community’s reaction to the deportation of unvaccinated tennis star, Novak Djokovic, in the lead up to the 2022 Australian Open. The analysis interprets the community’s hostile reaction to Djokovic by understanding community as both a structural and dynamic concept and, even more so, how fluid, evolving macro influences of community or group identification can intensify the demands of individuals to compromise for the common good based on ingrained expectations of the community. To do this, Norbert (...) Elias’ concepts of figurations and ‘we-they’ group identities are used to help highlight the link between structural and dynamic theories of community and identity. This study also outlines how ‘what is fair’ lies in pre-existing community rules and conventions being influenced by often momentary factors that impact and often change forms of group identity. These changes can be temporary or long-lasting and are driven by macro influences such as COVID-19 that can intensify existing community tensions. Throughout the analysis, it becomes clear that community’s response to Djokovic was not only fair, but a logical manifestation of community. (shrink)

In einer kritischen Würdigung zeitgenössischer kantianischer Positionen, der Tierrechtstheorie und dem Konzept der Tierwürde werden die Schwierigkeiten und Möglichkeiten einer Übertragung von Immanuel (...) Kants Verbot der vollständigen Instrumentalisierung auf die Mensch-Tier-Beziehung herausgearbeitet. Im Rahmen einer vergleichenden Analyse wird gezeigt, wie die Phänomene Instrumentalisierung, Verdinglichung und Ausbeutung von Tieren zueinanderstehen. This essay is an extended reflection on the relationship between death and love expressed in a fragment from Song of Songs 8:6: «Strong as death is love». The passage will be analyzed through a Jewish, Orthodox, and Catholic exegesis and literary reflection. In particular, the essay describes the role of a particular form of love (eros) within a particular form of education (education at the end of time). While eros has frequently been ignored or resigned to a purely sexualized role, (...) we will look closely at Augustine’s eulogy of his mother, Monica, in the Confessions, suggesting that perhaps the most visceral expression of eros is to be found in the phenomenology of death. We will also draw on the phenomenological manifestation of death by looking to the rich description of dying provided by Leo Tolstoy in his novella, The Death of Ivan Ilych. Together these investigations of eros and education yield a «curriculum of death», which draws on the re-conceptualist notion of curriculum. Our claim is that this curriculum of death offers a sense of urgency and seriousness found lacking in schools today, where death abounds, but is rarely if ever addressed in a humanistic way. This final methodological emphasis on the humanities elucidates more directly and critically the role of research for a curriculum of death within the dominance of social science in the field of education. According to Hendricks Impairment Argument (IA), abortion is immoral because it impairs the fetus. Here I argue it is not sufficient to show merely that abortion impairs, Hendricks must show that it harms the fetus. If the fetus is not numerically identical to the person it will become, then it isn’t harmed by an abortion. But if the fetus is numerically identical to the person it will become, it is harmed by the deprivation of a future of value. In the U.S.A., advocates of academic freedom—the ability to pursue research unencumbered by government controls—have long found sparring partners in government officials who regulate technology trade. From concern over classified research in the 1950s, to the expansion of export controls to cover trade in information in the 1970s, to current debates over emerging technologies and global innovation, the academic community and the government have each sought opportunities to demarcate the sphere of their respective authority and autonomy and assert themselves in (...) that sphere. In this paper, we explore these opportunities, showing how the Social Contract for Science set the terms for the debate, and how the controversy turned to the proper interpretation of this compact. In particular, we analyze how the 1985 presidential directive excluding fundamental research from export controls created a boundary object that successfully demarcated science and the state, but only for a Cold War world that would soon come to an end. Significant changes have occurred since then in the governance structures of science and in the technical and political environment within which both universities and the state sit. Even though there have been significant and persistent calls for reassessing the Cold War demarcation, a new institutionalization of how to balance the concerns of national security and academic freedom is still only in its nascent stages. We explore the value of moving from a boundary object to a boundary organization, as represented in a proposed new governance body, the Science and Security Commission. (shrink)

O’Donohue has identified 37 criticisms of the American Psychological Association’s Ethical Principles of Psychologists and Code of Conduct (Ethics Code), although many of his criticisms go far beyond what is found written in the APA Ethics Code, to include the process of adjudicating ethics complaints by the American Psychological Association Ethics Committee, and the process by which the Ethics Code was developed. The authors claim that a major shortcoming of O’Donohue’s article is that he adopted an unrealistically expansive role for (...) the Ethics Code that was not clearly linked to furthering the goals of the ethics code revision. This paper argues that the Theaetetus establishes conditions on objects of knowledge which entail that only of Forms can there be knowledge. Plato's arguments for this are valid. The principles needed to make Plato's premises true will turn out to have deep connection with important parts of Plato's over-all theory, and to have consequences which Plato, in the middle dialogues, seems to welcome on other grounds as well.

We analyze two problems in mathematics – the first (stated in our title) is extracted from Wittgenstein’s “Philosophy for Mathematicians”; the second (“What set of numbers is non-denumerable?”) is taken from Cantor. We then consider, by way of comparison, a problem in musical aesthetics concerning a Brahms variation on a theme by Haydn. Our aim is to bring out and elucidate the essentially riddle-like character of these problems.
