Firearm violence has soared in American cities, but most states statutorily preempt municipal firearm regulation. This article describes a unique collaboration in Philadelphia among elected officials, public health researchers, and attorneys that has led to litigation based on original quantitative analyses and grounded in innovative constitutional theories and statutory interpretation.

Pragmatist Metaphysics proposes a pragmatist re-articulation of the nature, aims and methods of metaphysics. Rather than regarding metaphysics as a ‘first philosophy’, an inquiry into the world independent of human perspectives, the pragmatist views metaphysics as an inquiry into categorizations of reality laden with human practices. Insofar as our categorizations of reality are practice-laden, they are also, inevitably, value-laden. Sami Pihlström argues that metaphysics does not, then, study the world’s ‘own’ categorial structure, but a structure we, through our conceptual (...) and practical activities, impose on the reality we experience and interact with. Engaging with the classical American pragmatists, in particular William James, and neopragmatists, including Hilary Putnam, the author seeks to correct long-held misconceptions regarding the nature of the relationship between metaphysics and pragmatism. He argues that a coherent metaphysical alternative to the currently fashionable realist metaphysics emerges from pragmatism and that pragmatism itself should be reinterpreted in a metaphysically serious manner. It is often assumed that adaptation — a temporary change in sensitivity to a perceptual dimension following exposure to that dimension — is a litmus test for what is and is not a “primary visual attribute”. Thus, papers purporting to find evidence of number adaptation motivate a claim of great philosophical significance: That number is something that can be seen in much the way that canonical visual features, like color, contrast, size, and speed, can. Fifteen years after its reported discovery, (...) number adaptation’s existence seems to be nearly undisputed, with dozens of papers documenting support for the phenomenon. The aim of this paper is to offer a counterweight — to critically assess the evidence for and against number adaptation. After surveying the many reasons for thinking that number adaptation exists, we introduce several lesser-known reasons to be skeptical. We then advance an alternative account — the old news hypothesis — which can accommodate previously published findings while explaining various (otherwise unexplained) anomalies in the existing literature. Next, we describe the results of eight pre-registered experiments which pit our novel old news hypothesis against the received number adaptation hypothesis. Collectively, the results of these experiments undermine the number adaptation hypothesis on several fronts, whilst consistently supporting the old news hypothesis. More broadly our work raises questions about the status of adaptation itself as a means of discerning what is and is not a visual attribute. (shrink)

This article argues that Georg Simmel's ideas on secrecy can shed new light on current debates around the relevance or otherwise of privacy as a protection against surveillance interventions. It suggests an interactional approach to privacy, and considers it as a dynamic process which redefines the boundary between what information should be disclosed and what information should be concealed in every social interaction. Simmel argues that this "natural" process relies on the identification of the interlocutor: her psychological/emotional involvement in the (...) relationship, her social position in society and the representation of her expectations. Recent empirical examples show that this interactional perspective may have the potential to reconcile differing privacy accounts, by linking theoretically different levels that are factually distinct: privacy as a collective fact, as a contextual integrity, and as an individual fact. The visual system adapts to a wide range of visual features, from lower-level features like color and motion to higher-level features like causality and, perhaps, number. According to some, adaptation is a strictly perceptual phenomenon, such that the presence of adaptation licenses the claim that a feature is truly perceptual in nature. Given the theoretical importance of claims about adaptation, then, it is important to understand exactly when the visual system does and does not exhibit adaptation. Here, we take as (...) a case study one specific kind of adaptation: visual adaptation to size. Supported by evidence from four experiments, we argue that, despite robust effects of size adaptation in the lab, (1) size adaptation effects are phenomenologically underwhelming (in some cases, hardly appreciable at all), (2) some effects of size adaptation appear contradictory, and difficult to explain given current theories of size adaptation, and (3) prior studies on size adaptation may have failed to isolate size as the adapted dimension. Ultimately, we argue that while there is evidence to license the claim that size adaptation is genuine, size adaptation is a puzzling and poorly understood phenomenon. (shrink)

The term ‘explicatures’ pertains to the inferential developments made of utterances with the objective of attaining a greater degree of clarity by the speaker (Sperber and Wilson 1986). It was first introduced by relevance theory to provide evidence that the explicit part of communication may contain a pragmatically inferred material, which facilitates communication and makes it more relevant (Carston. 2000. Explicature and semantics. UCL Working Papers in Linguistics 12. 44–89). Nevertheless, there are instances where explicatures are deliberately not fully articulated (...) in order to achieve certain social meanings as well as communicative goals. This research article examines the social functions, which are accomplished when communicators do not articulate pragmatically inferred material which is part of the explicit content of the utterance. Based on the analysis of genuine communications, obtained from real-life interactions from Jordanian Arabic, this article demonstrates that the act of not fully articulating explicatures serves certain social purposes, such as not inviting evil eye, not damaging the positive face of the addressee or the person under discussion, and avoiding the explicit mentioning of delicate matters like illnesses and social taboos; hence conforming to the established social conventions. Furthermore, the results referred to a remarkable association between particular areas of explicatures identification and certain social functions. (shrink)

Overlaps in form and meaning between morphologically related words have led to ambiguities in interpreting priming effects in studies of lexical organization. In Semitic languages like Arabic, however, linguistic analysis proposes that one of the three component morphemes of a surface word is the CV-Skeleton, an abstract prosodic unit coding the phonological shape of the surface word and its primary syntactic function, which has no surface phonetic content (McCarthy, J. J. (1981). A prosodic theory of non-concatenative morphology, Linguistic Inquiry, 12 (...) 373-418). The other two morphemes are proposed to be the vocalic melody, which conveys additional syntactic information, and the root, which defines meaning. In three experiments using masked, cross-modal, and auditory-auditory priming we examined the role of the vocalic melody and the CV-Skeleton as potential morphemic units in the processing and representation of Arabic words. Prime/target pairs sharing the vocalic melody but not the CV-Skeleton consistently failed to prime. In contrast, word pairs sharing only the CV-Skeleton primed reliably throughout, with the amount of priming being as large as that observed between word pattern pairs sharing both vocalic melody and CV-Skeleton. Priming between morphologically related words can be observed when there is no overlap either in meaning or in surface phonetic form. (shrink)

The present study aims at explaining how the Relevance Theory could be a viable approach to weigh up the main functions of some concessive Pragmatic Operators in Jordanian Arabic at the production and interpretation levels. A sample of twenty-two speeches delivered by members of the Jordanian Parliament the 16th was randomly selected for scrutiny. Three POs detected in their speeches were analyzed at the token level in light of three elementary RT assumptions about discourse connectives in general, namely connectivity, the (...) conceptual-procedural distinction, and monosemy. The major finding of this study was that concessive POs, as a subset of contrastives, are used to optimize relevance: highlight certain dimensions and/or suppress others of the scenario to the background. However, the point of departure from possibly all previous treatments is that the speakers, as politicians, still used them more strategically because total ambiguity resolution should not be a viable alternative in social settings laden with politics. Magna Carta is one of the most important illustrations of the exceptionalism of English common law. Within a completely feudal framework it gave the clearest possible articulation to the concept of the rule of law and at the same time it also showed that there were certain basic rights which every freeman enjoyed without any specific conferment by the king. From English perspective, continental European law after the process of the reception of Roman law was commonly regarded to be apart (...) and different from the English legal tradition, as well as being perceived to pose a continual threat. The English Parliament constantly turned down royal attempts to emulate the continental reception of Roman law by characterizing it as something entirely foreign to English law. Roman law was supposed to promote an authoritarian and absolutist vision of the relationship between rule and subjection and this was expressed in the famous phrases 'princeps legibus solutus' and 'quod principi placuit legis habet vigorem'. Roman law was also anti-feudal, because one of its main principles that all power originated from one central source was the antithesis of the distribution of power over multiple centers, which was a crucial element of the feudal society. Many English historians have held the view that the English law is democratic, whereas the continental tradition is undemocratic and authoritarian, and this is why the Roman law succeeded on the Continent and failed in England. In the Medieval period, Roman law and canon law formed ius commune or the common European law. The similarity between Roman and canon law was that they used the same methods and the difference was that they relied on different authoritative texts. In their works canonists and civilists combined the ancient Greek achievements in philosophy with the Roman achievements in the field of law. Canonists were the first who carried out research on the distinctions between various legal sources and systematized (...) them according to a hierarchical order. The Medieval civilists sought solutions in canon law for a large number of problems that Justinian’s Codification did not hinge on or did it only superficially. Solutions offered by canon law were accepted not only in the civil law of Continental Europe, but also in the English law. (shrink)

In this paper the authors present the psychological consequences of social isolation on domestic violence during the Covid-19 pandemic as well as the legal framework in the RNM on addressing the phenomenon of domestic violence. In this age of globalization and drive for material conformity, family life is quite difficult to cope with. This “war” for material comfort during the pandemic, has strained and stressed many families as a result of the created circumstances. Public safety measures, including physical distance and (...) social isolation, which have also been implemented in the RNM have contributed in making family problems even more pronounced. Social distance and staying at home are very effective in reducing the transmission of Covid-19 virus, but these safeguards disrupt the routines of spouses and families. Domestic violence affects a large number of families, and it is estimated that in times of social isolation, all forms of violence have been inflicted against family members regardless of their gender and age. The most common forms of domestic violence during Covid-19 pandemic in our country are psychological, physical and economic violence. Some countries affected by Covid-19 have seen increases in levels of domestic violence, including violence against children, violence against partners, and violence against the elderly. This paper presents the results of research conducted which highlight the fact that during the Covid-19 pandemic, there has been an increase in levels of domestic violence in the Republic of North Macedonia in the first six months of 2020. The authors give their recommendations on the need for action by state institutions during the Covid-19 pandemic in order to adapt methods and circumstances towards the protection of victims of domestic violence. This essay examines critically a number of characteristics of transcendental philosophy. The question, ?What, if anything, distinguishes transcendental philosophy and transcendental arguments from other types of philosophy and argument??, is given a negative answer: nothing, no essential thing, demarcates transcendental argumentation or philosophy from other kinds of philosophical reflection. In particular, argumentative structure alone is not a defining feature of transcendental philosophy. Illustrative examples of recent debates on the meaning and philosophical relevance of the ?transcendental? are discussed in the essay: (...) e.g., attempts to ?naturalize? the transcendental, Wittgensteinian reflections on the limits of meaningful language, and ?merely methodological? interpretations of Kantian transcendental idealism. Through these case studies, it is shown how transcendental inquiry can be rearticulated in a pragmatist context. (shrink)

Does the visual system adapt to number? For more than fifteen years, most have assumed that the answer is an unambiguous “yes”. Against this prevailing orthodoxy, we recently took a critical look at the phenomenon, questioning its existence on both empirical and theoretical grounds, and providing an alternative explanation for extant results (the old news hypothesis). We subsequently received two critical responses. Burr, Anobile, and Arrighi rejected our critiques wholesale, arguing that the evidence for number adaptation remains overwhelming. Durgin questioned (...) our old news hypothesis — preferring instead a theory about density adaptation he has championed for decades — but also highlighted several ways in which our arguments do pose serious challenges for proponents of number adaptation. Here, we reply to both. We first clarify our position regarding number adaptation. Then, we respond to our critics’ concerns, highlighting seven reasons why we remain skeptical about number adaptation. We conclude with some thoughts about where the debate may head from here. In this paper we maintain that abductive inferential processes should be embedded to a more general outlook on human cognition. Abduction has clear a.nities to the so-called interrogative model of inquiry in which inquiry and reasoning are conceptualized as a dialogue. We think, in addition, that dialogicality must be broadened to a “trialogical” framework which means a threefold relationship with mediating artefacts where the inquirer, other inquirers , and the object of knowledge are inextricably bound up with each other in (...) long term processes of inquiry. Seen from this perspective Peirce's semeiotic pragmatism has close connections to modern ideas about distributed cognition; also to Pera's dialectical model of science, and Davidson's theory of triangulation concerning human mind, cognition, and knowledge. Perspective taking is a critical yet tangled construct that is used to describe a range of psychological processes and that is applied interchangeably with related constructs. The resulting ambiguity is particularly vexing in science education, where although perspective taking is recognized as critical to informed citizens’ ability to negotiate scientifically related societal issues, or socioscientific issues via socioscientific reasoning, the precise nature of perspective taking remains elusive. To operationalize perspective taking, a theoretical conceptual analysis was employed and used to position (...) perspective taking within the context of SSR. The resulting, more precise construct identified as socioscientific perspective taking requires engagement with others or their circumstances, an etic/emic shift in one’s viewpoint, and a moral context guided by conscience. Amiri Baraka (formerly LeRoi Jones) views the social and political reality in its dynamism, and not in its immutability or stasis. Black art, within a repressive society, must be perceived as an arm, a weapon and not a means of banter or fun. Werner Sollors considers him as the engagé artist par excellence. The political art that Baraka espouses (...) is drastic and functional, an art that exposes common predicaments and plights. Entailed in Baraka’s dramatic art is the diatribe against art for art’s sake, thefusion of art and activism, and the finality of human action. Baraka considers theatrical playwriting as didactic, telic, and constructive. In this light, art, playwriting, and engagement constitute one monolithic unity that could stand in the face of liberal reactionary politics and arrangements. (shrink)

Transcendental Guilt challenges traditional ways of understanding moral philosophy by proposing, instead of mainstream ethical theorizing, a serious moral reflection on our ethical finitude, focusing on the concept of guilt. It argues that guilt plays a "transcendental" role in our ethical lives by being constitutive of the seriousness characteristic of the moral point of view.

This communique presents the Q-S synchronization of two nonidentical complex nonlinear hyperchaotic systems with unknown parameters. An adaptive controller based on adaptive integral sliding mode control and parameter update laws are designed to realize the synchronization and parameter identification to a given map vector. The aforementioned strategy’s employment demands the transformation of a system into a specific structure containing a nominal part and some unknown terms. An integral sliding mode controller is used to stabilize the error system by designing nominal (...) control accompanied by compensator control. For chattering suppression, a continuous compensator of smooth nature is used instead of conventional control. The stability of the proposed algorithm is established in an impressive way, using Lyapunov criteria. Determining optimal units of representing morphologically complex words in the mental lexicon is a central question in psycholinguistics. Here, we utilize advances in computational sciences to study human morphological processing using statistical models of morphology, particularly the unsupervised Morfessor model that works on the principle of optimization. The aim was to see what kind of model structure corresponds best to human word recognition costs for multimorphemic Finnish nouns: a model incorporating units resembling linguistically defined morphemes, a whole-word model, or a (...) model that seeks for an optimal balance between these two extremes. Our results showed that human word recognition was predicted best by a combination of two models: a model that decomposes words at some morpheme boundaries while keeping others unsegmented and a whole-word model. The results support dual-route models that assume that both decomposed and full-form representations are utilized to optimally process complex words within the mental lexicon. (shrink)

Ilkka Niiniluoto, a distinguished philosopher of science, has been a tirelesspokesman for scientific realism and reason more generally. Trained in the tradition of the Finnish school of inductive logic he has refined the notion of truthlikeness (verisimilitude) to make the realist idea scientific progress mathematically exact. Niiniluotos main technical works are included in his books Is Science Progressive? (1984) and Truthlikeness (1987), but his most recent general defense of scientific realism culminated in his Critical Scientific Realism (1999). Niiniluoto is, since (...) 1981, Professor of Theoretical Philosophy at the University of Helsinki, and since 2003 the Rector of the University. He has for a long time been one of the most prominent public intellectuals in Finland. This Festschrift brings about a selection of philosophical essays on Niiniluotos philosophy by prominent member of the international community. The contributions are grouped around three themes. The first ones deal with philosophy of logic, the philosophy of language, and the philosophy of mathematics, and the second group consists of papers on induction, truthlikeness, and scientific progress. The third part collects essays on the history of logical empiricism, the ontology of social groups, and the dispute between theism and atheism. It is thought that just as hunger itself, the expectancy to eat impacts attention and cognitive control toward food stimuli, but this theory has not been extensively explored at a behavioral level. In order to study the effect of expectancy to eat on attentional and cognitive control mechanisms, 63 healthy fasting participants were presented with an affective priming spatial compatibility Simon task that included both food and object distracters. The participants were randomly assigned to two groups: an “immediate expectancy” group (...) made up of participants who expected to eat immediately after the task and a “delayed expectancy” cohort made up of individuals who expected to eat a few hours later. Slower reaction times toward the food and non-food distracters and a more pronounced effect on the RTs in the incompatible condition [i.e., the Simon effect ] were noted in both groups. The effect of the food and non-food distracters on the RTs was more pronounced in the immediate with respect to the delayed expectancy group. The magnitude of the SE for the food and the non-food distracters was also greater in the immediate with respect to the delayed expectancy group. These results seem to indicate that when the expectancy to eat is short, the RTs are delayed, and the SE is more pronounced when food and non-food distracters are presented. Instead, when the expectancy to eat is more distant, the distracters have less of an effect on the RTs and the correspondence effect is smaller. Our results suggest that the expectancy to eat can modulate both attention orienting and cognitive control mechanisms in healthy fasting individuals when distracting details are competing with information processing during goal directed behavior. This essay contributes to the debate over whether there is, or can be, any place for metaphysics in pragmatism, in William James's pragmatism, in particular. The paper defends the possibility of pragmatist metaphysics, seeking to show how interesting forms of such metaphysics with a grounding in key Jamesian texts can, pragmatically, be put to work. This task is interesting from the perspective of both James scholarship and the ongoing re-evaluation and critical transformation of the pragmatist tradition. Furthermore, we need metaphilosophical (...) discussion of the possibility and prospects of metaphysics in a situation in which many philosophers believe metaphysics to be dead and buried, partly thanks to the classical pragmatists and their followers. Thus, the present paper examines critically the widespread idea that pragmatism is an inherently non- or even antimetaphysical philosophy (a view held not only by radical neopragmatists like Richard Rorty but also by scholars of classical pragmatism such as Charlene Haddock Seigfried). There are various ``classical'' arguments against abduction as a logic of discovery,especially that (1) abduction is too weak a mode of inference to be of any use, and (2) in basic formulation of abduction the hypothesisis already presupposed to be known, so it is not the way hypotheses are discovered in the first place. In this paper I argue, by bringing forth the idea of strategies,that these counter-arguments are weaker than may appear. The concept of strategies suggests, inter alia, that (...) many inferential moves are taken into account at the same time. This is especially important in abductive reasoning, which is basically a very weak mode of inference. The importance of strategic thinking can already be seen in Charles S.Peirce's early treatments of the topic, and N.R.Hanson's later writings on abduction although they did not use the concept of``strategies.'' On the whole, I am arguing that the focus should be more on methodological processes, and not only on validity considerations, which have dominated the discussion about abduction. (shrink)

This article considers a central ethically relevant interpersonal emotion, guilt. It is argued that guilt, as an irreducible moral category, has a constitutive role to play in our ways of conceptualizing our relations to other people. Without experiencing guilt, or being able to do so, we would not be capable of employing the moral concepts and judgments we do employ. Elaborating on this argument, the paper deals with what may be described as the "metaphysics of guilt." More generally, it is (...) suggested, through a case study on the concept of guilt, that a moral theory avoiding naïve emotivism yet emphasizing the role of emotions in morality can and should pay attention to the transcendental status of emotions such as guilt--emotions constitutive of our concept of moral seriousness. Instead of psychologizing moral emotions, the paper employs Raimond Gaita's Wittgenstein-inspired way of examining the place of the concepts of guilt and remorse in our ethical language-use. Finally, some methodological remarks on the possibility of transcendental reflection in moral philosophy are presented. While it is not necessary to commit oneself to any specific religious tradition in order to emphasize the constitutive role of guilt in the way suggested in the paper, it turns out that the moral depth of this concept requires that one is least open to religiously relevant ways of using moral language. In the fundamental metaphysical sense examined in the paper, guilt is a concept whose home language-game is religious rather than secular ethics. (shrink)

This paper accepts as given that business students want to get ahead. It criticizes business schools for their failure to reduce the incongruence between doing what is right and doing what it takes to get ahead. Because of this failure business school graduates carry negative ideas, attitudes and behaviors vis-à-vis social responsibility from business schools into the business world. Recommendations are made for increasing the social responsibility of business schools.

Classical Arabic poetry is replete with animal and fruit metaphors commonly used for endearment purposes. The comparative analysis of love metaphors in classical ghazal shows, however, a shift in the poetics of love from the use of animal metaphors in Badi poetry to the occurrence of fruit imagery in Bedouin ghazal. Based on a selection of classical Arabic love poetry, the paper traces the journey of love and sexuality to illustrate the conceptual change from the prevalence of the gazelle metaphor (...) in Bedouin ghazal of pre- and early Islam times to the emergence of fruit metaphors in Badi poetry of the Abbasid era. Evidenced in poetry, the metaphorical shit mirrors a change in the portrayal of women, who cease to be conceived as wild preys, fearing and fleeing male hunters to become exotic ripe fruits, waiting for the male to pick. Seemingly fortuitous, the shift in love imagery is reminiscent of sociocultural changes that help redefine the poetics of love in classical Arabic literature and inform gender dynamics in medieval Arabia.
