Many private business relationships are increasingly characterized by claims that certain actions should not be permitted since particular right claims are involved. Such claims should be taken seriously, but are they always ethically legitimate? This paper analyzes one context, the use of age as a rating variable in the pricing of automobile insurance, where such claims are made. By identifying, evaluating and assessing the relevant basis for the differentiation, actuarial equity, it is concluded that there is an ethical basis for (...) such a practice. Costa and Shrapnel have recently proposed an interventionist theory of quantum causation. The formalism generalizes the classical methods of Pearl and allows for the discovery of quantum causal structure via localized interventions. Classical causal structure is presented as a special case of this more general framework. I introduce the account and consider whether this formalism provides a causal explanation for the Bell correlations.

Megan1 is a young teenage patient who suffered a stillbirth at 28 weeks, leading to a year long police investigation dropped only after postmortem tests found that her pregnancy was lost due to natural causes. The stress of the investigation and her isolation from friends and support network following the seizure of her mobile and laptop compounded the trauma of the stillbirth, leaving her requiring emergency psychiatric care. Aisha1 is a vulnerable patient who suffered a premature delivery, having experienced similar (...) problems in earlier pregnancies. Things happened so quickly that Aisha delivered on her own at home, only then seeking medical care. She told hospital staff that earlier in her pregnancy she had considered an abortion. As a result, she found herself interviewed under police caution and was required to surrender her phone and tablet, limiting access to friend and family support just when most needed. Aisha was denied unsupervised access to her baby in the intensive care unit, needing to hand over expressed breast milk to a receptionist. These stories, which were reported in a recent meeting in Parliament,1 are sadly far from unusual. They reflect the collateral damage of a growing trend towards more enthusiastic enforcement of the archaic abortion laws of England and Wales.2–5 In such cases, women who present with miscarriage, stillbirth or a premature delivery have aroused the suspicion of health professionals, sometimes because—like Aisha—they speak honestly about having considered abortion earlier in their pregnancies. They then find themselves reported to the police, required to surrender electronic devices and sometimes advised by duty solicitors to speak to no one about events leading to their investigation, thus being denied emotional and full clinical support at a time of significant trauma. In the UK, female genital mutilation is unlawful, not only when performed on minors, but also when performed on adult women. The aim of our paper is to examine several arguments which have been advanced in support of this ban and to assess whether they are sufficient to justify banning female genital mutilation for competent, consenting women. We proceed by comparing female genital mutilation, which is banned, with cosmetic surgery, towards which the law has taken a very permissive stance. We (...) then examine the main arguments for the prohibition of the former, assessing in each case both (a) whether the argument succeeds in justifying the ban and, if so, (b) whether a parallel argument would not also support a ban on the latter. We focus on the following arguments. Female genital mutilation should be unlawful because: (1) no woman could validly consent to it; (2) it is an oppressive and sexist practice; (3) it involves the intentional infliction of injury; (4) it causes offence. Our view is that arguments (3) and (4) are unsound and that, although arguments (1) and (2) may be sound, they support not only a ban on female genital mutilation, but also one on (some types of) costmetic surgery. Hence, we conclude that the present legal situation in the UK is ethically unsustainable in one of the following ways. Either the ban on female genital mutilation is unjustified because arguments (1) and (2) are not in fact successful; or the law's permissive attitude towards cosmetic surgery is unjustified because arguments (1) and (2) are in fact successful and apply equally to female genital mutilation and (certain forms of) cosmetic surgery. The people of the countries where female genital mutilation is practised resent references to ‘barbaric practices imposed on women by male‐dominated primitive societies’, especially when they look at the Western world and see women undergoing their own feminization rites intended to increase sexual desirability: medically dangerous forms of cosmetic plastic surgery, for instance …. Realist interpretations of quantum mechanics presuppose the existence of elements of reality that are independent of the actions used to reveal them. Such a view is challenged by several no-go theorems that show quantum correlations cannot be explained by non-contextual ontological models, where physical properties are assumed to exist prior to and independently of the act of measurement. However, all such contextuality proofs assume a traditional notion of causal structure, where causal influence flows from past to future according to ordinary (...) dynamical laws. This leaves open the question of whether the apparent contextuality of quantum mechanics is simply the signature of some exotic causal structure, where the future might affect the past or distant systems might get correlated due to non-local constraints. Here we show that quantum predictions require a deeper form of contextuality: even allowing for arbitrary causal structure, no model can explain quantum correlations from non-contextual ontological properties of the world, be they initial states, dynamical laws, or global constraints. Despite the tremendous empirical success of quantum theory there is still widespread disagreement about what it can tell us about the nature of the world. A central question is whether the theory is about our knowledge of reality, or a direct statement about reality itself. Current interpretations of quantum theory, regardless of their stance on this question, regard the Born rule as fundamental and add an independent state update (or ‘collapse’) rule to describe how quantum states change upon measurement. In (...) this paper we present an alternative perspective and derive a unified probability rule that subsumes both the Born rule and the collapse rule. We show that this more fundamental probability rule can provide a rigorous foundation for informational, or ‘knowledge-based’, interpretations of quantum theory. Our result requires an assumption of instrument non- contextuality, a key notion that generalises previous approaches to non-contextuality. Therefore, the framework also permits one to consider non-contextuality in scenarios with arbitrary causal structure. (shrink)

It is widely held that it is difficult, if not impossible, to apply causal theory to the domain of quantum mechanics. However, there are several recent scientific explanations that appeal crucially to quantum processes, and which are most naturally construed as causal explanations. They come from two relatively new fields: quantum biology and quantum technology. We focus on two examples, the explanation for the optical interferometer LIGO and the explanation for the avian magneto-compass. We analyse the explanation for the avian (...) magneto-compass from the perspective of Woodward's interventionist theory and provide a causal model. Furthermore, we show how worries expressed by Woodward about quantum causation are circumvented in these cases, concluding that these kinds of explanations are most naturally construed as causal. COVID-19 is unique in that it is the first global pandemic occurring amidst a crowded information environment that has facilitated the proliferation of misinformation on social media. Dangerous misleading narratives have the potential to disrupt ‘official’ information sharing at major government announcements. Using an interrupted time-series design, we test the impact of the announcement of the first UK lockdown on short-term trends of misinformation on Twitter. We utilise a novel dataset of all COVID-19-related social media posts on Twitter from the (...) UK 48 hours before and 48 hours after the announcement. We find that while the number of tweets increased immediately post announcement, there was no evidence of an increase in misinformation-related tweets. We found an increase in COVID-19-related bot activity post-announcement. Topic modelling of misinformation tweets revealed four distinct clusters: ‘government and policy’, ‘symptoms’, ‘pushing back against misinformation’ and ‘cures and treatments’. (shrink)

Using relations of solidarity in global contexts, this article explores some of the debates about what constitutes solidarity. Three primary forms of solidarity are discussed, with particular attention to the different nature of the solidaristic relations and their moral obligations.

In this article, we wish to consider relationships internal and external to the farm household, and how these enable and/or mitigate the adoption of better farm practices. We find that internally, members of the farm household (successors or spouses ‘marrying in’), can influence the future direction of agricultural practice in a positive way, that is more profitable and sustainable. It is not a straightforward process though. Interpersonal household relations play a role; status and standing within the family can impact on (...) how decisions about change are made. This relates to both people marrying in and the position of the successor in an inter-generational household. We found that the power of the farming peer group to influence change is underestimated. Our data shows that farming is an occupation subject to strong cultural norms regarding acceptable farming practice. Sometimes farm family decisions to change agricultural practice falter under the weight of sanctions and derision encountered when trying to make adjustments. This paper draws from two data sets in Germany and England. We conclude that understanding internal farm household interactions, and their external relations with farming peer groups is critical to supporting the future of agriculture. (shrink)

A modest opposition to the brain disease concept of addiction has been mounting for at least the last decade. Despite the good intentions behind the brain disease rhetoric – to secure more biomedical funding for addiction, to combat “stigma,” and to soften criminal approaches – the very concept of addiction as a brain disease is deeply conceptually confused. We question whether Lewis goes far enough in his challenge, robust as it is, of the brain disease concept. For one thing, the (...) notion that addiction is a disease is challenging to refute or confirm because the disease concept itself is poorly defined in medical and psychological nosology. More important, quibbling over what kind of disease addiction is unlikely to be productive. The rational response to adjudicating whether addiction is a brain disease is not to engage in potentially fruitless debates over the question of disease classification but rather to view addiction as an enormously complex set of behaviors that operate on several dimensions, ranging from molecular function and structure and brain physiology to psychology, the psychosocial environment, and social and cultural relations. In her paper, 'The Open Universe: Totality, Self-reference and Time', Ismael argues that the agent experience of dynamic time, in which the world comes into being, is more than 'mere appearance'. The key to her argument is that the actual world includes agents (minds) and their corresponding agential (mental) activity, which Ismael describes as 'the crucial step down from 'mere appearance' to actuality'. We present here a model of an agent as a complex physical system with a view to providing (...) a tenable illustration of Ismael's schema for understanding the 'actuality' of time. The radical implication for physical time as a result is that there is, in Ismael's words, 'no pure... conception of the way [the] world is independently of ourselves and our representational activity', but rather only 'embodied and engaged' knowledge of the world. I argue that the right to solidarity may be understood as the negative right not to be hindered by social vulnerabilities in the exercise of citizen rights. I define social vulnerabilities as those vulnerabilities that result from structures of society. As a negative right, the right to solidarity shifts attention away from what is necessary for basic flourishing, and toward what is social structures that hinder full participation in other civic or political obligations and rights.

This article examines the particular moral obligations of solidarity focusing on the solidary commitment against injustice or oppression. I argue that political solidarity entails three relationships—to other participants in action, to a cause or goal, and to those outside the unity of political solidarity. These relationships inform certain obligations. Activism is one of those obligations and I argue that violent activism is incompatible with the other relations and duties of solidarity. Activists may find themselves confronted with a difficult choice between (...) respecting the relationships of political solidarity or employing physical violence in resistant self-defense against oppressive practices. -/- . We examined developmental changes in British children’s (8- to 10-year-olds) and adolescents’ (13- to 15-year-olds,N = 340; FemaleN = 171, 50.3%) indirect bystander reactions (i.e., judgments about whether to get help and from whom when witnessing social exclusion) and their social-moral reasoning regarding their reactions to social exclusion. We also explored, for the first time, how the group membership of the excluder and victim affect participants’ reactions. Participants read a hypothetical scenario in which they witnessed a peer being excluded from (...) a school club by another peer. We manipulated the group membership of the victim (either British or an immigrant) and the group membership of the excluder (either British or an immigrant). Participants’ likelihood of indirect bystander reactions decreased from childhood into adolescence. Children were more likely to get help from a teacher or an adult than getting help from a friend, whereas adolescents were more likely to get help from a friend than getting help from a teacher or an adult. For both indirect bystander reactions, children justified their likelihood of responding by referring to their trust in their teachers and friends. Adolescents were more likely to refer to group loyalty and dynamics, and psychological reasons. The findings support and extend the Social Reasoning Developmental (SRD) approach by showing the importance of group processes with age in shaping children’s judgments about how to respond indirectly by asking for help from others, when they are bystanders in a situation that involves exclusion. The findings have practical implications for combating social exclusion and promoting prosocial bystander behavior in schools. (shrink)

Bell’s theorem requires the assumption that hidden variables are independent of future measurement settings. This independence assumption rests on surprisingly shaky ground. In particular, it is puzzlingly time-asymmetric. The paper begins with a summary of the case for considering hidden variable models which, in abandoning this independence assumption, allow a degree of ‘backward causation’. The remainder of the paper clarifies the physical significance of such models, in relation to the issue as to whether quantum mechanics provides a complete description of (...) physical reality. In the Preface to the Phenomenology, Hegel indicates that the “philosophical” or “scientific” mode of cognition that emerges from the journey of consciousness contrasts with its “mathematical” counterpart which ignores time. The task of this paper is to draw clues from the Preface to the role Hegel assigns temporality in the Phenomenology. The thesis defended is that underlying the rigidity he discovers in mathematical cognition is what he takes to be a mistaken view of the origin of concepts, and an (...) insensitivity to their path. A feminist analysis of the Basque Mondragon system of industrial cooperatives suggests that women fare somewhat better in cooperatives than in private firms in employment, earnings, and job security. Market phenomena and the family as basic economic unit affect women workers negatively, as does increasing professionalism in the technical core of the system. Similarities in gender stratification and segregation in capitalist, socialist, and cooperative workplaces call into question the ability of all three to deal adequately with gender equality. Full workplace (...) democracy may depend on the distribution of goods and services based on need rather than work or the wage, socialization of homework and child care, degendering of technical and scientific knowledge, its dissemination as widely as possible throughout the workplace and the community, and the inclusion of all members of the community in major decisions. The article ends with modest suggestions for alleviating one pervasive problem in large industrial cooperatives—the concentration of technical and scientific skill among a few, primarily men. Transgenerational political solidarity disrupts the dominant framing that identifies conflict between generations-the “problem of generations”-as the driver of social change. Political solidarity across generations offers a way of thinking about social justice movements as contributing elements to global social justice efforts through their work in acknowledging the historical rootedness of structural injustice and their commitment to continually reimagine solidarities. Attending to features of transgenerational political solidarity is useful for theorists learning from engaged work on the ground. Transgenerational political solidarity - (...) collective movements for social change connected across past, present, and future - demonstrates the commitment to navigate through disagreement in a forward-looking manner, to find support in and echoes of the cause of past movements for social change, and to foreground the possibilities of future movements by situating collective action in relation to social justice understood in context. Learning about research ethics and research integrity is greatly facilitated by case studies, which illuminate, ground and personalise abstract questions. This paper argues that fiction can provide similar learning experiences, incarnating ethical dilemmas through a medium that is highly accessible yet sophisticated in its depictions of how researchers behave. Examples of fictional illustrations are given to illustrate various themes such as animal experimentation, exploitation of the vulnerable, researcher bias and research (...) fraud. (shrink)

A common reaction to Hegel’s suggestion that we collapse Kant’s distinction between form and content is that, since such a move would also deprive us of any way of distinguishing the merely logical from the real possibility of our concepts, it is incoherent and ought to be rejected. It is true that these two distinctions are intimately related in Kant, such that if one goes, the other does as well. But it is less obvious that giving them up as Kant (...) conceives them is as incoherent a proposal as many of Hegel’s critics think. It has been the point of a recent account of Hegel’s idealism to demonstrate that his critique of Kant’s dichotomy between form and content or concept and intuition does not commit him to the view that human cognition is materially creative of its content in the manner of a God-like or intuitive intellect—does not, in other words, signify a return to a pre-Critical metaphysics. This is the interpretative stance I adopt here as well, in hope of giving defenders of Kant reasons for taking Hegel more seriously. (shrink)

This article examines the relationship between trust and solidarity. Juxtaposing trust and solidarity reveals how they are different and how they recursively build on each other. By looking specifically at trust in political solidarity, I argue for an account of trust within solidarity movements for social change, one that suggests avenues for creating and building trust, rather than merely presuming it. Finally, reflecting on the interplay between trust and solidarity, I end with a nod to the transformative impact of solidarity (...) on communities. (shrink)

From the various discussions of Kant’s theoretical philosophy throughout Hegel’s works, it is not difficult to come away with the impression that Hegel thinks that the Kantian categories are derived from experience, and that the method of a “transcendental” investigation of the forms of subjectivity is nothing other than that of generalization upon observation. As early as the 1802-03 essay, Faith and Knowledge, for example, he characterizes the critical philosophy as the “completion and idealization” of Lockean “empirical psychology.” In § (...) 41 of the Encyclopedia he tells us that Kant’s systematization of the “special forms of the a priori element … of thought … is solely based upon psychological and historical grounds.” Moreover, in the Lectures on the History of Philosophy, he refers to Kant as going “psychologically,” i.e., “historically,” to work in his accounts of intuition, understanding, and reason in a manner that is “entirely empirical, and not developed out of the concept.”. This paper looks at some prominent discussions of rape in war as a violation of human rights within Radical Feminism. I begin with a brief overview of United Nations declarations and actions on the subject of rape in war. I then look at some radical feminist accounts of rape in war as a violation of human rights with particular emphasis on the discussions of Susan Brownmiller and Catharine MacKinnon. I conclude the paper with a critical analysis of these radical feminist (...) accounts and show how our human rights talk must distinguish between types of rape in war situations or risk silencing the individual victims. Nursing practice in correctional settings is ethically unique. Its premise is the contradiction between causing harm (the purpose of imprisonment) and acting for patients’ good (the purpose of health care). I describe three ethical regions in which correctional nurses can practise, based on different philosophies: punishment as retribution, as rationality, and as paradox. Retribution and rationality resolve the ethical contradiction by relegating offenders to intractable otherness. Restorative nursing based on paradox is an oppositional practice that preserves the contradiction, making engagement (...) possible between prisoner and nurse. Endorsement by nursing of one of the three philosophies of punishment could redefine care for the entire profession. (shrink)

This paper attends to the question of how to effectively teach ethics in universities. The author challenges the accepted skepticism amongst other disciplines that philosophers are no longer equipped to teach ethics courses to accommodate the moral demands of the contemporary world. Philosophers are believed to merely focus on abstract issues concerning moral attitudes and behavior. Currently, ethics courses in universities have replaced abstract moral issues of moral theory with concrete issues such as, homosexuality, the green house effect, pornography, and (...) gender and race issues. This paper seeks to offer an alternative way to think about the abstractness of moral theories that focus on moral attitudes, which will alleviate concerns about their validity and application to concrete ethical concerns.
