This paper proposes a formal top-level model of explaining the outputs of machine-learning-based decision-making applications and evaluates it experimentally with three data sets. The model draws on AI & law research on argumentation with cases, which models how lawyers draw analogies to past cases and discuss their relevant similarities and differences in terms of relevant factors and dimensions in the problem domain. A case-based approach is natural since the input data of machine-learning applications can be seen as cases. While the (...) approach is motivated by legal decision making, it also applies to other kinds of decision making, such as commercial decisions about loan applications or employee hiring, as long as the outcome is binary and the input conforms to this paper’s factor- or dimension format. The model is top-level in that it can be extended with more refined accounts of similarities and differences between cases. It is shown to overcome several limitations of similar argumentation-based explanation models, which only have binary features and do not represent the tendency of features towards particular outcomes. The results of the experimental evaluation studies indicate that the model may be feasible in practice, but that further development and experimentation is needed to confirm its usefulness as an explanation model. Main challenges here are selecting from a large number of possible explanations, reducing the number of features in the explanations and adding more meaningful information to them. It also remains to be investigated how suitable our approach is for explaining non-linear models. (shrink)

This paper advances the view that the history of philosophy is both a kind of history and a kind of philosophy. Through a discussion of some examples from epistemology, metaphysics, and the historiography of philosophy, it explores the benefit to philosophy of a deep and broad engagement with its history. It comes to the conclusion that doing history of philosophy is a way to think outside the box of the current philosophical orthodoxies. Somewhat paradoxically, far from imprisoning its students in (...) outdated and crystallized views, the history of philosophy trains the mind to think differently and alternatively about the fundamental problems of philosophy. It keeps us alert to the fact that latest is not always best, and that a genuinely new perspective often means embracing and developing an old insight. The upshot is that the study of the history of philosophy has an innovative and subversive potential, and that philosophy has a great deal to gain from a long, broad, and deep conversation with its history. Criticisms of the “container” model of pregnancy picturing female and embryo as separate entities multiply in various philosophical and scientific contexts during the last decades. In this paper, we examine how this model underlies received views of pregnancy in evolutionary biology, in the characterization of the transition from oviparity to viviparity in mammals and in the selectionist explanations of pregnancy as an evolutionary strategy. In contrast, recent evo-devo studies on eutherian reproduction, including the role of inflammation and new maternal cell (...) types, gather evidence in favor of considering pregnancy as an evolved relational novelty. Our thesis is that from this perspective we can identify the emergence of a newhistoricalindividual in evolution. In evo-devo, historical units are conceptualized as evolved entities which fulfill two main criteria, their continuous persistence and their non-exchangeability. As pregnancy can be individuated in this way, we contend that pregnant females are historical individuals. We argue that historical individuality differs from, and coexists with, other views of biological individuality as applied to pregnancy (the physiological, the evolutionary and the ecological one), but brings forward an important new insight which might help dissolve misguided conceptions. This paper aims to show that a proper understanding of what Leibniz meant by “hypercategorematic infinite” sheds light on some fundamental aspects of his conceptions of God and of the relationship between God and created simple substances or monads. After revisiting Leibniz’s distinction between (i) syncategorematic infinite, (ii) categorematic infinite, and (iii) actual infinite, I examine his claim that the hypercategorematic infinite is “God himself” in conjunction with other key statements about God. I then discuss the issue of whether the (...) hypercategorematic infinite is a “whole”, comparing the four kinds of infinite outlined by Leibniz in 1706 with the three degrees of infinity outlined in 1676. In the last section, I discuss the relationship between the hypercategorematic infinite and created simple substances. I conclude that, for Leibniz, only a being beyond all determinations but eminently embracing all determinations can enjoy the pure positivity of what is truly infinite while constituting the ontological grounding of all things. Background: Many studies have explored personal values in nursing, but none has assessed whether the predictions made by the theory of intergenerational value change are true for the different generations of nursing professionals and students. This theory predicts a shift in those personal values held by younger generations towards ones focussed on self-expression. Research question: The purpose of the study was to identify intergenerational differences in personal values among nursing professionals and nursing students and to determine whether generational value profiles (...) fit the predictions made by the theory. Research design: An exploratory comparative design with a cross-sectional survey method was used. Participants and research context: Participants were recruited from four public hospitals and 10 Primary Care Centres in medium-size cities in Spain. A sample of 589 nurses and 2295 nursing students participated in the study. An open survey method was used to collect data that were classified grouping reported values into categories following a method of value lexicon construction and analysed by contingency tables with Pearson’s χ2 and standardized residuals. Ethical considerations: Approval to conduct the study was obtained from the Deans of the nursing schools and the Directors of Nursing of the institutions. Anonymity was guaranteed, participation was voluntary and participants were informed of the purpose of the study. Findings: The results can be synthesized in two age-related trends in the reporting of values among three groups of participants. First, among younger nurses and students, some nursing core values (e.g. ethical and professional) decreased in importance, while other values centred on social relationships and personal well-being increased. Discussion and Conclusion: This study shows intergenerational change in personal values among both nursing students and young nursing professionals. Findings suggest the need to pay more attention to value training and professional socialization during the schooling period. (shrink)

En este artículo abordo la deriva más polémica del debate clásico en torno al realismo científico, a saber: la discusión sobre la naturaleza de los hechos de los que se ocupan las ciencias.

From its beginning, Critical Theory aimed to explore the laws governing social life as a formational totality and the forces shaping and driving its historical evolution. So the attempt to develop a comprehensive conception of ‘society’ encompassing both its structural as well as its cultural components can be considered one of the defining hallmarks of Critical Theory through all its theoretical and generational variations. But what, then, is Critical Theory’s conception of society? To answer this question, the authors make use (...) of a three-tiered heuristic model distinguishing synthesis (what is society?), dynamis (what are the driving forces of social change?) and praxis ((how) can social change be motivated or influenced by social actors?). In this way, they are able to reconstruct not only the divergences and controversies between the different versions and approaches in Critical Theory across the four generations of authors writing in this tradition, but also four core points of convergence which can serve to differentiate between Critical Theory in the Frankfurt School tradition and other critical theories. These four points, we suggest, should be seen to form the backbone of any valid conception of society in contemporary Critical Theory. (shrink)

Leibniz's metaphysics appears to go a long way towards monism: it supports a strong dependence of limited things on the absolute or God and understands this dependence not only as causal dependence but also as a pervasive ontological dependence which involves the communality of nature between absolute and limited. Yet, Leibniz stops short of affirming monism. Why? This paper takes a fresh look at Leibniz's reasons for opposing monism through the lens of a virtually unknown text of 1698 on the (...) metaphysical foundations of the infinite. Against the backdrop of the present-day monistic proposals of Jonathan Schaffer and Michael Della Rocca, the paper identifies and evaluates four different types of monism: 1. Whole-Part Monism; 2. World-Animal Monism; 3. God-Nature Monism and 4. Eleatic Monism. It argues that Leibniz's opposition to Whole-Part Monism, World-Animal Monism, and God-Nature Monism, is due to his conceptions of the infinite and of what it is to be “an absolutely absolute Being”. Furthermore, it argues that the only type of monism which could preserve Leibniz's demanding notions of real infinite and absolute is Eleatic Monism. The latter, however, is also rejected by Leibniz due to our first-hand experience of what it is to be a substance. (shrink)

This article examines the impact of ChatGPT on judicial reasoning, focusing on a recent Colombian case where the judge utilized ChatGPT in the decision-making process. The case, decided in January 2023, provides a unique “pilot case study” on the subject, as the judge, in the decision, openly referenced the questions he posed to ChatGPT and the responses of the system. The article explores the case’s implications, the initial reactions to it, and its meaning and implications within the evolving Colombian legal (...) landscape regarding the integration of technologies into judicial proceedings. In this paper I argue that, in Leibniz’s mature metaphysics, primary matter is not a positive constituent which must be added to the form in order to have a substance. Primary matter is merely a way to express the negation of some further perfection. It does not have a positive ontological status and merely indicates the limitation or imperfection of a substance. To be sure, Leibniz is less than explicit on this point, and in many texts he writes as if (...) primary matter were a positive constituent of a substance. It seems to me, however, that the view most in keeping with the thrust of his mature philosophical system is that captured by a striking remark of 1695: “Materia rerum est nihilum: id est limitatio [The matter of things is nothing: that is, limitation].” This becomes especially apparent in texts showing that Leibniz’s conception of primary matter corresponds to his conception of creaturely limitation. I start by discussing the notion of primary matter in the scholastic tradition. I then show that although Leibniz places the scholastic terminology of primary matter at a crucial juncture of his metaphysics, he thinks of primary matter in a way which significantly deviates from earlier scholastic views. I conclude that despite his adoption of distinctive terminology of Aristotelian scholasticism, instead of holding a broadly Aristotelian concept of primary matter as the ultimate subject of inherence, Leibniz thinks of primary matter according to a Neoplatonic blue-print in which matter is non-being, privation, mere absence of perfection. The purpose of the present paper is to reply to a misleading paper by M. Sachs entitled “Einstein's later view of the Twin Paradox” (TP) (Found. Phys. 15, 977 (1985)). There, by selecting some passages from Einstein's papers, he tried to convince the reader that Einstein changed his mind regarding the asymmetric aging of the twins on different motions. Also Sachs insinuates that he presented several years ago “convincing mathematical arguments” proving that the theory of relativity does not predict asymmetrical (...) aging in the TP. Here we give a definitive treatment to the clocks problem showing that Sachs' “convincing mathematical arguments” are non sequitur. Also, by properly quoting Einstein, we show that his later view of the TP coincides with the one derived from the rigorous theory of time developed in this paper. (shrink)

Art had always a prominent place in libertarian universe because the productions were advertising’s instruments that carried a marked ideological purpose. This article reconstructs the characteristics of anarchist art in Buenos Aires between 1900 and 1930. It studies the doctrinal texts of the main theorists and the way in which they influenced the local artists, as well as the articulation between local productions, newspaper articles and specialized art magazines, in order to address the aesthetic values that delineate these productions. It (...) concludes that, although anarchism preferred to exclude national realities due to its strong internationalism, argentine libertarian art had a strong local component that does not deny the libertarian anchorage of those artists and militants. In the age of neoliberalism, feminists strongly disagree on the ideal legal status of prostitution while the pro-prostitution lobby endeavours to keep their male-dominated business running smoothly. Feminist debates should be concerned with the sex buyers' belief system about women, which is likely to have practical consequences in the way they behave with women (prostituted and non-prostituted) in terms of sexuality and, therefore, for feminist purposes of equality, on a broader scale. A Critical Discourse Analysis of buyer-authored online reviews of (...) prostituted women provides the opportunity to verify whether the relationship they establish with them is based on democratic mutual equality or gendered power relations driven by domination and subordination.En la era del neoliberalismo, no hay consenso entre las feministas acerca del estatus legal que debería tener la prostitución; mientras, el lobby pro-prostitución intenta proteger tan lucrativo negocio. Los debates feministas deben abordar críticamente el sistema de creencias de los sujetos prostituyentes, en tanto que afecta a cómo actúan con las mujeres (prostituidas y no prostituidas) dentro del marco de la sexualidad y, por tanto, al potencial logro de la igualdad fáctica a nivel social. El análisis crítico del discurso online de los sujetos prostituyentes sobre las mujeres prostituidas permite comprobar si las relaciones que establecen con ellas están basadas en términos igualitarios o en la dicotomía dominación-subordinación característica de las relaciones de poder de género. A esta relación fundamental de dominio corresponde inseparablemente y en rigurosa correlación, de carácter ético y metafísico, el derecho fundamental de participar en el dominio de los bienes, con carácter personal y esto exige que estén al servicio de la dignidad y libertad. The moral virtues are the normative foundations of peace. Building on this, thepaper argued that peaceful co-existence among religions and identities is possibleeven in a highly pluralized society. The study employed the philosophical-criticalmethod where factual and philosophical data are extrapolated from relevant literatures and are used to advance the main thesis via a rigorous philosophical dialectic. The study found that the moral virtues are the primary principles of thenatural law, which are naturally and spontaneously known through the practicalreason/conscience. In as (...) much as religions presuppose the existence of God, themoral virtues constitute God’s primary will for all men to accomplish and arethe first and highest duties of religions. Although, most religions, if not all, teachthe importance of the moral virtues, they are not given the highest position.Conflicts arise when religious laws, customs and traditions, which sometimesare contrary to the moral virtues, are given the highest priority. Thus, the paperargued that the moral virtues should be considered as the primary and overridingprinciples by which religious observance is judged as faithful or not. The paperconcluded that peace can be achieved when leaders of different religions anchortheir religious teachings, religious life, and the notion of religious fidelity mainlyor primarily on the moral virtues, and above all, love. Connectedness is a significant element of sociality that occurs not only ideally and ‘leiblich’, but also consists of a material dimension. This is established through the materiality of the human body and points beyond it at the same time. The material aspect of connectedness is not simply social but has a social meaning nonetheless: Materiality has an impact on society and on the quality of human coexistence with the environment. To be able to describe this aspect, we use approaches of (...) feminist (neo-)materialisms. First, a neo-materialist perspective on subjectivity is developed, which, in addition to the immaterial aspects of the social, is also able to grasp the dependence of the development of human bodies on their environment. Connectedness as a material-discursive phenomenon adds a neo-materialist dimension to the established ‘phenomenological’ interpretation of the resonance concept that integrates interactions of repulsion or alienation by understanding feelings of alienation, rejection, or the silencing of the world-relationship as well as a resonant world-relationship always also as agentic cuts of the LeibKörper. This book considers the seminal debate in jurisprudence between Ronald Dworkin and Stanley Fish. It looks at the exchange between Dworkin and Fish, initiated in the 1980s, and analyses the role the exchange has played in the development of contemporary theories of interpretation, legal reasoning, and the nature of law. The book encompasses 4 key themes of the debate between these authors: legal theory and its critical role, interpretation and critical constraints, pragmatism and interpretive communities, and some general implications of (...) the debate for issues like the nature of legal theory and the possibility of objectivity. The collection brings together prominent legal theorists and one of the protagonists of the debate: Professor Stanley Fish, who concludes the collection with an interview in which he discusses the main topics discussed in the collection. Research in psychology clearly shows that implicit biases contribute significantly to our behaviour. What is less clear, however, is whether we are responsible for our implicit biases in the same way that we are responsible for our explicit beliefs. Neil Levy has argued recently that explicit beliefs are special with regard to the responsibility we have for them, because they unify the agent. In this paper we point out multiple ways in which implicit biases also unify the agent. We then (...) examine Levy’s claim that the assertibility of explicit beliefs means that they have a unique way of unifying the agent by being available for syntactical operations. We accept that syntactical operations are important, but worry that they are less straightforwardly connected to the unification of agents than Levy claims. (shrink)

This article presents research on the scale of the phenomenon of sexual violence against students at selected 33 universities across Poland, the mechanisms used to combat the problem and the awareness of students on the subject. The study focuses on the practical dimension of combating sexual violence against students in the Polish academic environment. It looks at the existence and functioning of both specialised bodies and the procedures used to help the victims and punish the perpetrators. Additionally, the paper describes (...) how the diversity of available legal measures to address the problem by both helping the victims and holding perpetrators accountable creates the issue of the coexistence of two systems—criminal and intra-university. Presenting preliminary results of gathered opinions of universities’ officials regarding functioning of the bodies specialised in combating sexual violence shows not only the most dominant observations and conclusions the professionals have regarding the functions they hold at their home universities, but also main challenges that have to be considered in both creating sufficient policies in order to deal with sexual violence and conducting comprehensive research on said phenomenon. In lieu of an abstract, here is a brief excerpt of the content:Why Iberia?María Rosa Menocal (bio)My first instinct was to correct the title and rename this essay “Why Medieval Spain?” rather than “Why Iberia?” After all, I never say I work on or teach about “Iberia.” And yet the editors have got it just right to signal—using the geographic Iberia instead of the national Spain—that the terrible difficulty of finding worthy names is at the heart of the matter (...) here, at the heart of why it is that the study of the cultures and peoples of the Iberian peninsula during the medieval period is as exacting, as stimulating, as important as it is. It is easy enough, and accurate enough too, to point out that the study of all premodern cultures brings with it comparable difficulties, that, for example, before there was a France or an Italy, it is also misleading to talk about what might have been French or Italian, and yet medievalists in those areas, as well as the man on the street, regularly do so. But in the case of the Iberian peninsula the misprisions reflected in the confusion of terms—when we call a Christian kingdom “Spanish” but an Islamic one “Moorish,” to take only one of dozens of egregious examples—are confusions both more severe and more meaningful. It is true that Dante is not an Italian, but rather a Florentine, and the distinction is far from trivial—indeed, for Dante, central. And yet the comparable distinctions in the Iberian peninsula are likely to be more searing, because they involve not just political but religious and ethnic distinctions. If we call Rodrigo Diaz, the Cid, a Spaniard, why not his contemporary Judah Halevi? And why do we so often—even among those of us who “know better”—persist in calling the Muslims of the Iberian peninsula “Moors” or even “Arabs”—thus grossly confusing religion and ethnicity and suggesting, every time we do, that to be a Muslim was always not to be a Spaniard, in the way that being a Christian was, or that confession is equivalent to ethnicity?Of course, at this late date we all know the largest answer to these and other comparable questions: Spain defined itself as a modern nation through the expulsion not only of its Jewish and Muslim citizens but especially through the expulsion of the memory that they had ever been a part of the real body politic of “Spain.” It is not merely that after 1492 and 1609 (and everything in between) to be a Spaniard was aggressively defined as those who were not (and, better still, had never been) Christian; it is that this early modern definition of the national identity was transferred to the medieval past, and the medieval past rewritten and reimagined accordingly, as if the twelfth century were already longing for the sixteenth. This obliteration of the historical memory of the cultural and religious complexities of the medieval Iberian universe has long meant that the parameters that define how we talk about its languages and cultures are profoundly misshaped, which I mean not as a moral but as a historical statement: Alfonso X would no doubt have been startled by the suggestion that Arabic was not a vital part of the Castilian cultural universe or that Jews were not Toledanos or Sevillanos, nor citizens of his “Spain.” [End Page 7]It is of course the singular fact in European history—and now the word is out, almost everyone knows it—that the three Abrahamic religions long coexisted, in highly complex and always-shifting ways, in the Iberian peninsula.
