O presente trabalho visa analisar a questão dos pronunciamentos judiciais ilegítimos, dada a compreensão e função da jurisdição constitucional, no bojo das formas de controle de constitucionalidade e da vinculação das decisões judiciais. Apresenta-se a tensão que isto pode trazer para a manutenção da Constituição, seus princípios e a segurança da ordem jurídica do Estado. A metodologia utilizada foi a teórica bibliográfica.

As corporate social responsibility (CSR) grows increasingly well known and accepted worldwide, organizations attempt to make sense of their social strategies bridge the gap between their current situation and what their stakeholders expect of them. If social strategies represent a potential stepping stone to more sophisticated forms of CSR, then research must investigate the strategies that organizations have adopted. After defining a framework for classifying and analyzing organizations' social strategies, this article considers empirical evidence from 10 case studies in Colombia (...) to reveal how organizations might build on their social involvement to engage in more sophisticated CSR practices. Situados en un progresivo traspaso de responsabilidades en la ejecución de los servicios sociales desde el Estado hacia actores no gubernamentales, aparece una demanda hacia el mismo Estado, el cual en lugar de simplemente declinar su labor, debiera de hecho expandir su regulación de modo de asegurar que la oferta social sea eficiente en satisfacer al ciudadano usuario en aquellos servicios prometidos por las políticas y programas sociales. Así mismo, la institucionalidad pública debiera reconocer las demandas del mundo privado para (...) actuar articuladamente hacia fines comunes, que finalmente conduzcan a un horizonte de desarrollo de una sociedad más igualitaria. Este estudio da cuenta de las tensiones, reveladas por autoridades de servicios públicos que atienden personas vulnerables, en su relación de colaboración con OSFL (Organizaciones Sin Fines de Lucro), para alcanzar tal horizonte. Cardiology is characterized by its state-of-the-art biomedical technology and the predominance of Evidence-Based Medicine. This predominance makes it difficult for healthcare professionals to deal with the ethical dilemmas that emerge in this subspecialty. This paper is a first endeavor to empirically investigate the axiological foundations of the healthcare professionals in a cardiology hospital. Our pilot study selected, as the target population, cardiology personnel not only because of their difficult ethical deliberations but also because of the stringent conditions in which they (...) have to make them. Therefore, there is an urgent need to reconsider clinical ethics and Value-Based Medicine. This study proposes a qualitative analysis of the values and the virtues of healthcare professionals in a cardiology hospital in order to establish how the former impact upon the medical and ethical decisions made by the latter. In a previous work, we have shown that the null result of the Michelson–Morley experiment in vacuum is deeply connected with the notion of time. The same is true for the postulate of constancy of the two-way speed of light in vacuum in all frames independently of the state of motion of the emitting body. The argumentation formerly given is very general and has to be true not only within Special Relativity and its “equivalence” of all inertial frames, but as (...) well as in Lorentz-Poincaré scenario of a preferred reference frame. This paper is the second of a trilogy intending to revisit the foundations of Special Relativity, and addresses the question of the constancy of the one-way speed of light and of the differences and similarities between both scenarios. Although they manifestly differ in philosophy, it is debated why and how the assumption of a “special system of reference experimentally inaccessible” is indeed compatible with Einstein’s Special Relativity, as beautifully outlined and discussed by Bell [Speakable and Unspeakable in Quantum Mechanics (Cambridge University Press, Cambridge, 1988)]. This rather trivial statement is still astonishing nowadays to a big majority of scientists. The purpose of this work is to bring such assertion into perspective, widening the somewhat narrow view of Special Relativity often presented in textbooks and scientific papers. (shrink)

The retina pigment epithelium (RPE) is a highly specialised epithelium that serves as a multifunctional and indispensable component of the vertebrate eye. Although a great deal of attention has been paid to its transdifferentiation capabilities and its ancillary functions in neural retina development, little is known about the molecular mechanisms that specify the RPE itself. Recent advances in our understanding of the genetic network that controls the progressive specification of the eye anlage in vertebrates have provided some of the initial (...) cues to the mechanisms responsible for RPE patterning. Here, we have outlined many recent findings that suggest that a limited number of transcription factors, including Otx2, Mitf and Pax6 and a few signalling cascades, are the elements required for the onset of RPE specification in vertebrates. Furthermore, using this information and the data available on the specification of the pigmented cells of primitive chordates, we have ventured some hypotheses on the origin of RPE cells during evolution. ABSTRACT The objective of this study was to determine the accuracy of a brief informed consent quiz to detect consent comprehension in individuals with cognitive impairment and to explore the degree to which cognitive domains and recent substance use, independently, predict comprehension. We performed a secondary analysis of two cross-sectional studies in individuals with substance use disorders. The ICQ total score was used as the index test and the Montreal Cognitive Assessment as reference standard in receiver operating characteristic curves. Two (...) independent multiple binary logistic regression models were performed using cognitive domains and days of recent substance use as predictors of ICQ outcome. We analyzed data from 215 and 251 participants, respectively. The ICQ showed moderate accuracy for major cognitive impairment and lower accuracy for mild impairment. Optimal cutoff score was set at 10 points or less for detecting comprehension difficulty. Lower scores in Short-Term Memory, Attention, Language, and Orientation increased the probability of failing the ICQ. A procedure including both the ICQ and cognitive screening measure could improve the accuracy of consent comprehension assessments. (shrink)

Tomando en cuenta las críticas más importantes a la teoría de los individuos transmundanos así como algunos argumentos en relación con el esencialismo de origen, este artículo trata con el problema de la identidad de aquellos individuos a través de mundos posibles. Proponemos la noción de mundo admisible como un tipo especial de modelo en Lógica Intensional, que, dentro de otro modelo, permite el mapeo de la historia e identidad de los individuos en diferentes mundos posibles. Esta propuesta sugiere una (...) solución plausible para determinar propiedades esenciales empíricamente relevantes ostentadas por los individuos transmundanos, un método eficaz para evaluar su identidad, y, finalmente, una nueva perspectiva desde la cual reexaminar el clásico debate entre realismo y anti realismo en la Filosofía del Lenguaje. Neste trabalho, pretendemos avaliar criticamente algumas das teses de John McDowellsobre a natureza da virtude, tal como expostas em seu artigo “Virtue and Reason” e, ao fazê-lo,expor algumas de suas limitações. Mais especificamente, tratarei o que vejo como problemas emsua apresentação da virtude como uma forma de conhecimento, e sua proposta – corporificada natese da unidade das virtudes – de que as virtudes comumente reconhecidas deveriam ser vistascomo manifestações parciais da virtude enquanto tal. Também enfocarei a assertiva de McDowellde que (...) o conhecimento que constitui a virtude não pode ser visto como tendo um conteúdoproposicional que se preste a uma codificação em princípios de conduta – a tese de nãocodificabilidade– e a relação da postura pessoal de McDowell com a empreitada mais ampla daética de virtudes. Em diversas ocasiões, Leibniz recorre à autoridade de Aristóteles a fim de roborar sua tese da verdade como inerência do predicado ao sujeito da proposição. Não é, contudo, evidente em que medida a filosofia aristotélica poderia oferecer amparo a essa reivindica- ção. Afinal, a Aristóteles tradicionalmente se atribui uma concepção de verdade diferente, consistente em uma relação de correspondência entre a proposição e a realidade que ela se destina a descrever. Sem discutir a conhecida tese da verdade como correspondência, este (...) trabalho é dedicado a investigar em que medida os escritos de Aristóteles permitem que Leibniz respalde neles as suas afirmações. Para tanto, a presente investigação estará focada nos Primeiros e os Segundos Analíticos, obras em que Aristóteles expõe sua teoria do racio- cínio e da demonstração. Visa-se averiguar se, e sob que condições, a noção de inerência ali mobilizada pode ser assimilada à noção leibniziana de inerência. (shrink)

For over a decade neuroscience has uncovered that appropriate decision-making in daily life decisions results from a strong interplay between cognition and covert biases produced by emotional processes. This interplay is particularly important in social contexts: lesions in the pathways supporting these processes provoke serious impairments on social behavior. One important mechanism in social contexts is empathy, fundamental for appropriate social behavior. This paper presents arguments supporting this connection between cognition and emotion, in individual as well as in social contexts. (...) The central claim of this paper is that biologically inspired cognitive architectures ought to include these mechanisms. A taxonomy of computational models addressing emotions is presented, together with a brief survey of the research published in this area. The Prisoner Dilemma game is used as a case study exposing the trade-off between individual rationality and cooperative behavior. Experiments using a simple implementation of empathy and emotion expression, employing an Iterated Prisoner Dilemma setup, illustrate the emergence of a cooperative behavior mutually beneficial for both players. El presente artículo busca enfocar la correlación entre el uso de la energía, el espacio, el territorio y el desarrollo local, teniendo en cuenta la utilización del gas natural en las cerámicas de Mato Grosso del Sur/Brasil. La importancia de los hechos geográficos es pautada por muchos parámetros, como el paso del tiempo, los nuevos descubrimientos tecnológicos, las necesidades de materias primas, los objetivos nacionales e internacionales y la ética de las relaciones internacionales. El gas natural no es utilizado aún (...) como fuente alternativa de energía en gran escala en el Estado. Puede ser considerado como uno de los resultados de la valorización de la política socio económica, de la cultura local y del medio ambiente preservado como parte de la identidad local del ser humano al mejorar su calidad de vida. This paper presents and discusses the most influential attempts to characterize physicalism without postulating relations of identity between the physical and the prima facie non-physical. The first section deals with a possible criticism that these attempts are misguided, since they contradict the physicalist slogan “everything there is physical.” In the second section, I elucidate the different formulations of the physicalist supervenience claim, and argue that none of them consists in an adequate characterization of physicalism. Three reasons are given in favor (...) of this conclusion: their compatibility with forms of dualism ; the fact that the supervenience relation is left unexplained; and Kim’s causal exclusion argument, which asserts that merely supervenient entities must be epiphenomenal. The third section presents the general features of another identity-independent attempt to characterize physicalism, namely realization physicalism. According to this view, tokens of prima facie non-physical types are realized by tokens of strictly physical types performing functional roles that specify the nature of the former. The third section also shows how realization physicalism deals with the objections that make physicalist supervenience claims inadequate for characterizing physicalism. Resumo O artigo apresenta e discute as tentativas mais influentes de caracterizar o fisicalismo sem postular relações de identidade entre o que é físico e o que é prima facie não físico. A primeira seção trata da possível crítica de que essas tentativas são equivocadas, porque contradizem o bordão fisicalista “tudo o que existe é físico”. Na segunda seção, elucido as diferentes formulações da tese fisicalista da superveniência, e argumento que nenhuma delas consiste em uma caracterização adequada do fisicalismo. Três razões são oferecidas em favor dessa conclusão: sua compatibilidade com formas de dualismo ; o fato de que a relação de superveniência é mantida sem explicação; e o argumento de Kim da exclusão causal, segundo o qual entidades meramente supervenientes devem ser epifenomenais. A terceira seção apresenta os aspectos gerais de outra tentativa de caracterizar o fisicalismo independente da identidade, a saber, o fisicalismo de realização. De acordo com essa posição, ocorrências de tipos prima facie não físicos são realizadas por ocorrências de tipos físicos quando estes executam os papéis funcionais que especificam a natureza dos primeiros. This article presents an interpretation of Cyrus’ psychology in Xenophon'sCyropaedia. Its point is that Cyrus’ psychological structure is composed by a set of three desires (philotimía, philanthrōpía, philomátheia) given by nature and a set of virtues (sōphrosúnēandenkráteia) acquired by education. The paper will argue that Cyrus, as an enkratic ruler, does not long for any kind of honours, but is guided by truephilotimía, that is, the desire for true honours—honours freely given by gratitude or admiration.philanthrōpíais the key to achieve these (...) honours, since it naturally prompts a benevolent and generous behaviour. At the same time,philomátheiaprovides the desire of knowledge necessary to acquire the techniques in order to accomplish ambitious and philanthropic deeds. Therefore, confronting those who have posed negative interpretations of Cyrus, the article will argue that the uncommon combination of these psychological predispositions makes Cyrus a virtuous and effective ruler. Abstract This paper reports the results obtained in an aid project designed to improve transport in the municipal area of Jocotán (Guatemala). The rural road network of an area occupied by indigenous people was analysed and a road chosen for repair using the labour-intensive method–something never done before in this area. The manpower required for the project was provided by the population that would benefit from the project; the involvement of outside contractors and businesses was avoided. All payment for labour (...) went into the pockets of the local people. The small earth movements made and the use of local materials guaranteed the project’s environmental sustainability, while the on-site training of the local community prepared its members for the continued maintenance of the road, thus investing the project with social sustainability. This paper begins the study of first-order functions, which are a generalization of truth-functions. The concepts of truth-table and systems of truth-functions, both introduced in propositional logic by Post, are also generalized and studied in the quantificational setting. The general facts about these concepts are given in the first five sections, and constitute a “general theory” of first-order functions. The central theme of this paper is the relation of definition among notions expressed by formulas of first-order logic. We emphasize that (...) logic is not concerned only with the consequence relation among notions expressed by formulas. It also attends to the relation of definition among notions, where a notion is defined from other notions. Sections 5 and 6 deal exclusively with the relation of definition among notions expressed by formulas of first-order logic. In these sections, we study the systems of first-order functions, which are the sets of first-order functions closed under definitions. Sections 7 and 8 are concerned with the relativization of first-order functions to a class of structures. The relativization to a class of structures is a fundamental operation which is used in order to relate the theory of first-order functions with set theory and first-order model theory, a subject which we have barely scratched the surface. The apparatus developed in this paper enables us to define what is a vehicle for the foundation of classical mathematics in set theory, and, in Sect. 8, we prove that first-order logic with one binary predicate variable is not a minimal vehicle for the foundation of classical mathematics in set theory. Sections 9 and 10 introduce further operations and ideals of first-order functions. Besides some results on the influence of the arguments of a first-order function, a result about definability is proved in Sect. 10.1. It is this theorem that provides necessary and sufficient conditions for a first-order function to be in a finitely generated ideal. In Sect. 11, this result is applied to the problem of predicate definability in classes of structures, the problem with which Beth’s theorem dealt in the case of elementary classes. (shrink)

Há sérios problemas, contudo, no que concerne à caracterizaçáo da noçáo de sentido fregeano. Por vezes, Frege sugere que o sentido de um nome próprio é dado por uma descriçáo definida associada, cujo conteúdo individua a referência do nome em questáo. Por sua vez, Bertrand Russell rejeita expressamente o sentido fregeano, e, ao mesmo tempo, afirma que nomes próprios comuns revelam-se, quando analisados, como descrições definidas disfarçadas. Essa posiçáo, hoje conhecida como descritivismo , foi atribuída, por Saul Kripke, entre outros, (...) a Frege e Russell, a despeito de suas posturas teóricas diversas. Infelizmente, os paradoxos da referência também sáo espinhosos para as teorias de referência direta. Neste artigo, fazemos um sumário das dificuldades para ambos os lados da disputa e apresentamos uma defesa da interpretaçáo náo-fregeana do sentido de Michael Devitt, a qual evita os problemas do descritivismo mas rejeita a referência direta. Faz-se um uso crucial da teoria histórico-causal, que náo temos razáo para abandonar. (shrink)

Los objetivos de este trabajo son dos: primero, integrar al debate de la racionalidad de las posiciones en desacuerdo la noción de paridad epistémica en términos de “horizonte de paridad”; segundo, argumentar que tanto el punto de vista firme como el conciliador o el escéptico son eficaces en el manejo de nuestrasatribuciones de conocimiento. La alternancia de estas posiciones es una actitud racional y estas dependen de si el desacuerdo es en primera, segunda o tercera persona. Se concluye que la (...) racionalidad de las elecciones acerca de las posiciones en desacuerdo descansa sobre la fuerza de nuestro carácter a la hora de emprender determinadas discusiones, ya sea con otros pares o con nosotros mismos. Honneth afirma que o léxico das palavras diagnóstico e patologia estão ligadas à medicina. Na área social, essas noções só podem ser interpretadas indiretamente, ou seja, através das narrativas literárias, do campo artístico e da cinematografia. O Observatório Global de Patologias Sociais propõe-se a superar esse déficit. Este artigo exibe não apenas a análise conceitual, mas também as percepções inovadoras oriundas de um questionário online. Foram três questões. Por um lado, trata-se de descrever uma conceptualização de patologia social. Por outro, (...) coletar sugestões para um instrumento empírico. Por fim, obter uma lista de patologias sociais. A análise demonstrou que há patologias restritas ao âmbito individual, enquanto outras são concernentes ao espaço coletivo. Nesse sentido, os efeitos e acometimentos também obedecem a categorias diferenciadas. Além do mais, aparecem percepções de patologias ligadas ao aspecto institucional, revelando uma preocupação com relação ao sistema social. Como conclusão, o texto sugere que a análise das patologias deve voltar-se à concretização social, institucional e histórica. Deste modo, os impulsos que, a princípio, eram tratados como subjetivos, individuais ou pessoais podem ser investigados como situações sociais coletivas e institucionais. (shrink)

In a recent paper in this journal, David Chalmers introduced the meta-problem of consciousness as “the problem of explaining why we think consciousness poses a hard problem” (Chalmers, 2018, p. 6). A solution to the meta-problem could shed light on the hard problem of consciousness. In particular, it would be relevant to elucidate whether people’s problem intuitions (i.e. intuitions holding that conscious experience cannot be reduced to physical processes) are driven by factors related to the nature of consciousness, or rather (...) by factors that are independent of consciousness. Whether people hold problem intuitions, and what factors drive those intuitions, are largely empirical questions. However, there is a lack of empirical research on these issues to date. The results of four studies will show that (1) problem intuitions are not widespread, and (2) when they arise, they do so because of factors that are unrelated to the nature of consciousness. This suggests that consciousness is, after all, not so problematic. (shrink)

Nele defendemos a tese de que não estamos diante de uma "crise financeira", mas de uma crise clássica de superprodução, determinada pelo caráter cada vez mais especulativo do capital e pela hipertrofia do capital financeiro diante do capital que produz diretamente a mais-valia. We argue here that this crisis is not a "financial" one, but a classical overproduction crisis, determined by the speculative character of capital and the hypertrophy of the financial capital in relation to the capital that produces directly plus-value. We discuss the structural dimensions of the crisis, the nature of financial capital and the structural determinations that produce the historical tendency to the fall of the profit tax. (shrink)

This paper elaborates on the link between different types and degrees of experience that can be gone through within a form of life or collectivity—the so-called levels of immersion—and the development of distinct types of tacit knowledge and expertise. The framework is then probed empirically and theoretically. In the first case, its ‘predictions’ are compared with the accounts of novices who have gone through different ‘learning opportunities’ during a pre-operational training programme for running a huge nickel industrial plant in Brazil. These are also analysed vis-à-vis the experience of an expert who has designed and experienced the outcomes of two pre-operational training sessions in the nickel industry before developing and managing the one discussed here. Theoretically, the framework is used to pinpoint exactly what interactional experts who have developed their expertise through linguistic socialisation alone are able to do as well as to analyse the case of technical connoisseurs. The results indicate that the proposed framework is useful. It supports the design and improvement of training programmes for the development of tacit knowledge while at the same time bringing about a refined analysis of claims concerning the abilities of types of experts and expertise. How can we identify and estimate workers’ tacit knowledge? How can we design a personnel mix aimed at improving and speeding up its transfer and development? How is it possible to implement tacit knowledge sustainable projects in remote areas? In order to answer these questions, it is necessary to distinguish between types of tacit knowledge, to establish what they allow for and to consider their sources. It is also essential to find a way of managing the tacit knowledge ‘stock’ and (...) distribution within the workforce. In short, a conceptual framework is needed to manage tacit knowledge. Based on previous works and 2 years of action research, this paper introduces such a framework and describes its partial application to support the pre-operational training and hiring in a large industrial plant in Brazil. Two contributions emerge from the research. First, the concept of ‘levels of similarity’ is introduced as a means to qualify the experience of workers and estimate the associated tacit knowledge. Second, the capability of carrying out three types of judgement properly and speedily is put forward as being a core ability of those who possess what has been called ‘collective tacit knowledge’ (Collins in Organ Stud 28(2):257–262, 2007). In practical terms, the results indicate the opportunity for companies to capitalize on the experience and tacit knowledge of their workers in a systematic way and with due recognition. Ultimately, positive impacts are expected in their absorptive capacity as well as in their management and human resources systems, accident prevention, productivity and the development of sustainable projects in remote areas. El presente artículo de revisión analiza las convergencias y diferencias entre el pensamiento complejo y laecología de saberes con el propósito de explorar posibilidades de complementación y sinergias en el marco de una epistemología crítica. Para tal efecto se ha realizado una revisión bibliográfica apoyada por los métodos deductivo y hermenéutico. Para la caracterización del pensamiento complejo se ha revisado la obra de Edgar Morin y otros autores como Boaventura de Sousa Santos. De la revisión se concluye que tanto el (...) pensamiento complejo como la ecología de saberes tienen similitudes pues comparten en mayor o menor medida los principios de sistemas organizados, dialogicidad, recursividad y retroactividad. Además, son explícitos en superar la distinción sujeto-objeto para pasar a una relación sujeto-sujeto. Ambas propuestas constituyen alternativas al pensamiento científico hegemónico y ponen el valor el pluralismo cognitivo y la justicia cognitiva. La principal diferencia es que la ecología de saberes tiene una apuesta más explícita por los conocimientos de los movimientos sociales en sus luchas de resistencia frente a las diversas formas del colonialismo vigente, que tienen correlato con un sistema económico que privilegia el mercado a la vida. En tal sentido es posible reconocer en la ecología de saberes un carácter más político. Ambas propuestas, aunque con diferencia de grados, se erigen como alternativas transformadoras de la realidad social. (shrink)

This article proposes an exposition and analysis of perceptions intrinsic to rituals carried out with the use of the jurema plant, especially when mixed with Syrian rue (juremahuasca) in contexts of contemporary esoteric re-actualizations in Brazil. These rituals are conducted by people who look at jurema as a spiritual path, once acquainted with its psychedelic properties. We highlight the mystical attributes and the cultural bricolage elaborated by these individuals, who conduct ceremonies in ritual spaces in which participants experience altered states (...) of perception and consciousness. Considered as an entheogen, jurema leads to states of mystical transformation in people. Such personal changes are often considered by users as the rhetoric of healing. Life stories and ethnographic contexts form the background of the article, which seeks to advance understandings about jurema based on speculations around the intertwining of the themes of consciousness, mysticism, and healing. In a seminal work, Tversky and Kahneman showed that in some contexts people tend to believe that a conjunction of events (e.g., Linda is a bank teller and is active in the feminist movement) is more likely to occur than one of the conjuncts (e.g., Linda is a bank teller). This belief violates the conjunction rule in probability theory. Tversky and Kahneman called this phenomenon the “conjunction fallacy”. Since the discovery of the phenomenon in 1983, researchers in psychology and philosophy (...) have engaged in important controversies around the conjunction fallacy. The goal of this paper is to explore the most important of these controversies, namely, the controversy about the nature of the conjunction fallacy. Is the conjunction fallacy mainly due to a misunderstanding of the problem by participants (misunderstanding hypothesis) or is it mainly due to a genuine reasoning bias (reasoning bias hypothesis)? A substantial portion of research on the topic has been directed to test the misunderstanding hypothesis. I review this literature and argue that a stronger case can be made against the misunderstanding hypothesis. Thus, I indirectly provide support for the reasoning bias hypothesis. (shrink)

The works of Vilém Flusser contain explicit as well as implicit traces of a philosophy of design, principally in the way of an investigation about the sign intentionality of the human as a symbolic animal. Retracing Flusser’s anthropological and philosophical ideas and hereby the cultural evolution from the formation of things to the information of non-things, the present essay points to the importance and responsibility of the designer in society today.

El presente trabajo estudia las diferentes figuras bajo las que aparece Dios en la Crítica de la razón pura de Kant. Estas figuras son: (1) el Dios de la metafísica, teóricamente cognoscible; (2) un Dios capaz de conocer las cosas en sí mismas; (3) Dios como una idea de la razón central para la actividad científica; y (4) un Dios asociado al ámbito práctico. Luego de presentar estas 4 figuras, se examinan sus relaciones, con el objetivo de mostrar que es (...) tan inexacto concebir la postura kantiana sobre el tema de Dios como atea, como pensar que, de manera incoherente y por mero conservadurismo, acaba dándole un lugar a Dios dentro de su sistema. Como conclusión, se examina de qué manera el tratamiento del tema de Dios ilustra la posición kantiana en relación a la metafísica. (shrink)
