Responsibility is often thought of as primarily a legal concept. Even when it is moral responsibility that is at issue, it is assumed that it is above all in moralities based on law-centered patterns and models that responsibility takes center stage, so that responsibility is a legal concept at its core, and is applicable to the realm of private morality only by extension and analogy.

Libertarianism needs a theory of class. This claim may meet with resistance among some libertarians. A few will say: “The analysis of society in terms of classes and class struggles is a specifically Marxist approach, resting on assumptions that libertarians reject. Why should we care about class?” A greater number will say: “We recognize that class theory is important, but libertarianism doesn't need such a theory, because it already has a perfectly good one.”.

J. S. Mill's distinction between higher and lower pleasures is often thought to conflict with his commitment to psychological and ethical hedonism: if the superiority of higher pleasures is quantitative, then the higher/lower distinction is superfluous and Mill contradicts himself; if the superiority of higher pleasures is not quantitative, then Mill's hedonism is compromised.

We began with three propositions: that people have a right not to be treated as mere means to the ends of others, that a woman who voluntarily becomes pregnant nevertheless has the right to an abortion, and that a woman who voluntarily gives birth does not have a right to abandon her child until she finds a substitute caretaker. These propositions initially seemed inconsistent, for the prohibition on treating others as mere means appeared to rule out the possibility of positive (...) rights, thus making it impossible to countenance the right to abort or the right not to be abandoned . But we have seen that the prohibition on treating people as mere means to the ends of others is best understood as ruling out basic positive rights while permitting derivative ones. Since a willing mother is responsible for bringing her child into the world in the first place, she cannot abandon it without violating its negative right not to be killed, and so such a child has a derivative positive right not to be abandoned. A pregnant woman, on the other hand, has a negative right not to have her body invaded, and from this negative right derives a positive right to abort her fetus, so long as doing so is not disproportionate to the seriousness of the threat . Therefore, far from being in conflict, propositions , , and have been shown to be in harmony with one another, the latter two being plausibly grounded in the first. Insofar as we have reason to accept , then, we have reason to accept and . Moreover, we have seen that a proper understanding of allows us to embed and in a larger moral perspective in which the limits of compulsory altruism are firmly drawn: enforceable rights to the use or assistance of others may be allowed into the moral domain only if they are “sponsored” by some negative right. A Lagrangian formulation is constructed for particle interpretations of quantum mechanics, a well-known example of such an interpretation being the Bohm model. The advantages of such a description are that the equations for particle motion, field evolution and conservation laws can all be deduced from a single Lagrangian density expression. The formalism presented is Lorentz invariant. This paper follows on from a previous one which was limited to the single-particle case. The present paper treats the more general case of many (...) particles in an entangled state. It is found that describing more than one particle while maintaining a relativistic description requires the specification of final boundary conditions as well as the usual initial ones, with the experimenter’s controllable choice of the final conditions thereby exerting a backwards-in-time influence. This retrocausality then allows an important theoretical step forward to be made, namely that it becomes possible to dispense with the usual, many-dimensional description in configuration space and instead revert to a description in space–time using separate, single-particle wavefunctions. Are federal prosecutions of non-federal officials for corruption likely to improve non-federal government? This essay suggests that such prosecutions can undermine the distinctive style of democracy at the state and local level, an effect that can be harmful to democracy in America overall. This conclusion rests on a larger argument about the different nature of federal and non-federal democracy in the United States. To insure that each official maintains impartial loyalty to values defined by a single, popularly accountable policymaker, the (...) federal system of bureaucratic populism strictly separates the officials’ public and private interests, through various devices such as civil service protection for executive officials, Article III life tenure, and fixed salary for federal judges, specialized training for federal officers, and conflict-of-interest rules that bar federal officers from acting when their judgment could be compromised by private interests. By contrast, participatory populism rejects this separation of the public and private spheres, instead mixing professional and lay decision-making by using thousands of part-time, under-paid executive and legislative officers who are expected to have substantial private interests in the communities that they represent. The essay argues that each style of democracy has mutually exclusive advantages and disadvantages. However, enforcement of federal anticorruption law against non-federal democracies can undermine their system of mingled private and public interests, reducing the degree to which such governments can provide laypersons with opportunities for political activity. As an illustration of the overextension of federal criminal law, I examine the First Circuit’s interpretation of 18 U.S.C. §§ 1341 and 1346, the federal mail fraud statute in United States v. Sawyer. Sawyer comes dangerously close to declaring that any undisclosed state or local officer’s conflict of interest constitutes a violation of § 1346 when it involves the U.S. mails. I argue that this view of § 1346 is an error. Participatory populism requires that private and public tasks be closely mingled in ways that bureaucratic populism forbids. Undoubtedly, this mixture of public and private creates a risk that public office will be used for private gain. However, it also avoids some of the bureaucratic sclerosis and lack of lay participation that can be endemic to the more centralized federal tradition. In conclusion, I suggest that federal prosecutors ought to content themselves with using § 1346 to enforce already-existing state criminal conflict-of-interest rules, for the sake of preserving a place in our federal regime for participatory populism. When a strange new test of perceptual style called the Rorschach reached the New World in the 1920s, it became almost immediately popular. Developed as a psychoana lytic "X ray" of the psyche, it succeeded because American psychologists wanted and needed it to do so, and to do so as that kind of test. Over a decade later, the MMPI was constructed as a more orthodox personality inventory geared to traditional psychiatric categories While this medical legacy was soon removed or (...) obscured, success was more gradual. After the war, clinical psychologists adopted a professional identity independent of psychiatry. Their personality assessment tools, and what counted as success, came to reflect a reclaimed disciplinary genealogy. Standardized mappings and rule-by-numbers tended to displace a trust in experience and expert Judgment. In this context, "proper" Rorschach use came to be seen as indulgent or sadly mistaken. Supporters of the MMPI were, in contrast, able to claim both science and efficiency on their side and colonized the field. The history of these tests clearly illustrates the process of co-production, of how the right tool can become very wrong as networks dissipate and professional time goes by. (shrink)

The author reviews Foundations of a Free Society: Reflections on Ayn Rand’s Political Philosophy, edited by Gregory Salmieri and Robert Mayhew, and finds it to be a rich and provocative anthology. However, the author is unpersuaded by the arguments, from a number of the contributors, for separating the prohibition on initiatory force as an ethical principle, from individual rights as a political principle—a separation that, on the ethical side, unduly discards the Aristotelean ethical approach with which Randian ethics claims affiliation, (...) and on the political side, is employed to ground an unconvincing case for the legitimacy of the state. James Stacey Taylor, in his book Markets With Limits, argues that Jason Brennan and Peter Jaworski, in their book Markets Without Limits, systematically mischaracterize the views of the anti-commodification theorists they are critiquing, attributing to them positions (e.g., semiotic essentialism and an asymmetry thesis) that they do not hold. Further, Taylor offers an anti-commodification hypothesis of his own to explain why talented academics like Brennan and Jaworski could fall into such systematic mistakes – namely, that the intrusion of market norms (...) into academia incentivizes scholars to prioritize original arguments in prominent venues over careful fact-checking. I argue that Taylor is correct in charging that Brennan and Jaworski have gotten their opponents’ views wrong; and I show how their subsequent replies to Taylor’s criticisms have been unconvincing. I also argue, however, that Taylor may be over-hasty in identifying the likely causes of their errors. (shrink)

A simple mathematical extension of quantum theory is presented. As well as opening the possibility of alternative methods of calculation, the additional formalism implies a new physical interpretation of the standard theory by providing a picture of an external reality. The new formalism, developed first for the single-particle case, has the advantage of generalizing immediately to quantum field theory and to the description of relativistic phenomena such as particle creation and annihilation.

The fact that the “probability density” expression provided by the Klein–Gordon equation can take on negative values is usually seen as an obstacle to formulating a particle interpretation of quantum mechanics. Nevertheless, reconciling this expression with a particle ontology is quite possible once a careful distinction is drawn between the outcomes of measurements and the positions of particles between measurements. Following this path, however, points to the involvement of retrocausality, as proposed by various authors in other contexts.

After the publication of my book and various articles about comparative religious ethics, obstacles in the field's further development seemed to mount as swiftly as practical issues seemed to trumpet the need for global ethics more loudly. Driven by impatience, I wondered if I were fiddling in unending discussion while the planet burned. As others persevered and evolved productively in addressing developmental issues in the field directly, I began to work through the lens of a less direct, but complementary, perspective: (...) ideologies and critical thought. The following essay seeks to connect my parallel approach to ongoing obstacles and solutions within the prolific development of comparative religious ethics, especially its urgent pursuit of common moral grounds sufficient to support peaceful coexistence and living. A Lagrangian description is presented which can be used in conjunction with particle interpretations of quantum mechanics. A special example of such an interpretation is the well-known Bohm model. The Lagrangian density introduced here also contains a potential for guiding the particle. The advantages of this description are that the field equations and the particle equations of motion can both be deduced from a single Lagrangian density expression and that conservation of energy and momentum are assured. After being developed in (...) a general form, this Lagrangian formulation is then applied to the special case of the Bohm model as an example. _A proactive, inclusive plan for the cross-disciplinary teaching of climate change from preschool to high school._ In _Teach for Climate Justice_, accomplished educator and social and emotional learning expert Tom Roderick proposes a visionary interdisciplinary and intersectional approach to PreK–12 climate education. He argues that meaningful instruction on this urgent issue of our time must focus on climate justice—the convergence of climate change and social justice—in a way that is emotionally safe, developmentally appropriate, and ultimately empowering. This paper is concerned with the causally symmetric version of the familiar de Broglie–Bohm interpretation, this version allowing the spacelike nonlocality and the configuration space ontology of the original model to be avoided via the addition of retrocausality. Two different features of this alternative formulation are considered here. With regard to probabilities, it is shown that the model provides a derivation of the Born rule identical to that in Bohm’s original formulation. This derivation holds just as well for a many-particle, (...) entangled state as for a single particle. With regard to “certainties”, the description of a particle’s spin is examined within the model and it is seen that a statistical description is no longer necessary once final boundary conditions are specified in addition to the usual initial state, with the particle then possessing a definite value for every spin component at intermediate times. These values are consistent with being the components of a single, underlying spin vector. The case of a two-particle entangled spin state is also examined and it is found that, due to the retrocausal aspect, each particle possesses its own definite spin during the entanglement, independent of the other particle. In formulating this picture, it is demonstrated how such a realistic model can preserve Lorentz invariance in the face of Bell’s theorem and avoid the need for a preferred reference frame. (shrink)

The meaning of its title, ‘Section with Verses’, may appear sufficient to explain why the Sagatha-vagga was identified as a discrete entity within the Samyuttanikaya. However, this article looks beyond that simple explanation, to discover whether some other rationale may underlie this grouping of samyuttas. It examines evidence that the compiling of the Sagatha-vagga was probably based on a familiar, although doctrinally marginal, piece of Buddhist teaching, namely the ‘eight Assemblies’.

It may be seen, then, that if one was prepared to accept the existence of insulating sheaths on the nerves, all the arguments raised against the proposed identification of the nervous and electrical fluids, except one, could be answered satisfactorily. The single exception involved the question of how an electrical disturbance in the brain could be confined to a single nerve, and, as was indicated earlier, it was scarcely fair to hold this sort of objection against the electrical theory alone. (...) In that case, there remained no convincing argument to show why one should not accept the identification of the two fluids. On the other hand, of course, it remained an open question as to whether there was any convincing argument to show why one should accept the identification either. It is generally assumed that every adjective ending in -ης is an s-stem like εủγενς -ος; cf. γνος gen. γνε-ος, Lat. genus gener-is, Skr. janas janas-as) or δνσμευς . Solmsen, for instance, does not hesitate to regard μ-ηγερς as evidence for the s-stem geres which he wishes to find in γοστóς σ-τóς), and Bechtel infers a stem παγεσ - from περπαγς. The result of this well-nigh universal belief has been that hardly anybody has thought it worth while to examine these (...) words carefully. (shrink)
