The return of genetic research results after death in the pediatric setting comes with unique complexities. Researchers must determine which results and through which processes results are returned. This paper discusses the experience over 15 years in pediatric cancer genetics research of returning research results after the death of a child and proposes a preventive ethics approach to protocol development in order to improve the quality of return of results in pediatric genomic settings.

Originally published in 1987 and re-issued in 2020 with a new Preface, this book presents and elaborates interrelated solutions to a number of problems in moral philosophy, from the location of intrinsic value and the nature of a worthwhile life, via the limits of obligation and the nature of justice, to the status of moral utterances. After developing a biocentric account of moral standing, the author locates worthwhile life in the development of the generic capacities of a creature, whether human (...) or nonhuman, and presents an account of relative intrinsic value which later generates a theory of interspecific justice. This value-theory also informs a consequentialist understanding of obligation, of moral rightness and of supererogation. The understanding thus supplied is shown to cope with the problems of integrity, of justice and of the 'Repugnant Conclusion' in population ethics. A cognitivist account of ethical conclusions such as those so far reached is then defended against non-cognitivist and relativist objections and a far-reaching naturalist theory is defended, integrating earlier conclusions with an account of the logic of the fundamental ethical concepts. This wide-ranging volume which maps the whole area of morality is thoroughly argued with reference both to contemporary philosophical developments and to classical theories. (shrink)

In 1928, Friedrich Solmsen argued that Aristotle'sPosterior Analyticswas largely composed before thePrior Analytics. Ross rejected Solmsen's position in 1939, and a rather lengthy series of rebuttals and counter-attacks between the two scholars followed. Quite recently, Jonathan Barnes has revived this issue with arguments in favour of something very close to Solmsen's thesis: that Aristotle first developed a theory of demonstration (‘apodeictic’) before he had worked out the syllogistic, and that thePosterior Analyticswas originally conceived against this background. Subsequently, when Aristotle formulated (...) a syllogistic, he is supposed by Barnes to have revised or added to the contents of thePosterior Analyticsso as to make syllogistic the logic of Aristotelian science. Thus, Barnes says: ‘the syllogism is in fact an incidental adjunct to the theory of demonstration: the theory can be formulated without reference, explicit or implicit, to Syllogistic, and itcould havebeen discovered by someone who knew nothing whatever about the Syllogism’ (pp. 33–4). It is often disillusioning to find that many great thinkers arenot nice people. Frequently, they are not even happy people.Schopenhauer was as miserable as they come, Heidegger was a memberof the Nazi Party, and Nietzsche went mad (though probably due to syphilis rather than philosophy). We expect philosophy to help us to live happily and wisely, yet many philosophers not only fail to do this, but are dull or unpleasant into the bargain.

When Thomas Hobbes published Leviathan in 1651, one of his main concerns was to attack the idea that subjects had rights over their sovereigns. This notion, he thought, would lead eventually to civil war of the kind he had just lived through. In his famously grim view of the State of Nature, everyone has the right to everything, and because this leads inevitably to competition, everyone is afraid of everyone else, a state he calls “diffidence”. This in turn leads to (...) a perpetual state of actual or potential war; the only alternative is for people to give up their “right of nature” to a common power, thus exchanging freedom for the security of civil society. It is widely held that moral obligations to non-human beings do not involve considerations of justice. For such a view, nonhuman interests are always prone to be trumped by human interests. Rawlsian contractarianism comprises an example of such a view. Through analysis of such theories, this essay highlights the problem of reconciling the claim that humans have obligations to non-humans with the claim that our treatment of the latter is not a matter of justice. We argue that if it is (...) granted that the basic interests of non-human beings sometimes count for more than the peripheral interests of humans, then our understandings of obligation and of justice must be aligned, so that what we say about obligation is not countered by assumptions about the invariable priority of humans in matters of justice. We further consider whether such a conclusion can be endorsed by those who adopt certain alternative theories to contractarianism. We conclude that adherents of a range of theories including sentientism and biocentrism must accept that human interests can sometimes be superseded by animal interests, and that this applies not least in matters of justice. In this paper, I explore the ways that phenomenological concepts like intercorporeality and mutual incorporation offer new tools in trying to make sense of human experiences via mediating systems. In particular, I think about how the COVID-19 pandemic hastened a large population into mediated interactions, and what is lost, perhaps contingently or perhaps intrinsically, when human experiences are mediated in this way. I look to research in presence, skillful interaction, and enactive social cognition to argue that there remains something ineffable (...) or at least extremely hard to pin down about intercorporeality, and embodied togetherness has not yet been replicated in the mediating systems we currently embrace. Many state governments in the United States promote locally-produced farm products. This paper discusses issues related to the ethics and equity of such promotional programs. The paper argues that generic promotion is generally easier to justify in terms of ethics and equity than brand promotion. It also argues that informative and factual brand promotions are easier to justify than deceptive and persuasive brand promotions. Additional equity issues arising when taxpayers finance state-promotional programs are also discussed.

When schools react to contemporary events and focus on complex moral problems they commonly fail to make basic distinctions between the morally serious and trivial, the moral and the non-moral, and problems and dilemmas. We need to teach the distinction between moral and other values, and between what is intrinsically good, what is right in practice and what is justifiable. Moral theory seeks to delineate an ideal situation. Different circumstances give rise to different particular practices; but the principles of freedom, (...) fairness, respect for persons, truth and felicity constitute a widely recognized view of the essence of morality. These principles, and the nature of education itself, are often ignored in programs of moral education, which should proceed by providing an understanding of the nature and limits of the moral sphere. Nietzsche is usually presumed to be an atheist because of his proclaimation that God is dead. This dissertation argues, however, that the death of God is not atheistic but theistic, for Nietzsche's concept of Dionysus, Will to Power itself, entails an implicit commitment to theism. ;Chapter One indicates the enigmatic and nuanced quality of Nietzsche's style. Nietzsche wears masks. In order to decipher these masks with respect to the problem of God, six criteria of the traditional theistic understanding of God (...) are established. These six criteria are: Dionysus is eternal. He is the creative source of the world and man. The world and man exemplify the presence of Dionysus and yet they are not exhaustive of Him. Therefore Dionysus, as more than the world, can be spoken of as "other" than man and the world. This "otherness" entails a relationship between Dionysus and man/world. This relationship is not determinative of Dionysus. Man and world are an experiment on Dionysus' behalf; one that may "terminate," although Dionysus himself will not. ;Chapter Two sets out to formulate and expound upon the first four criteria of theism. This sets down the basic ontology. ;Chapter Three sets forth the problem of nihilism. Nihilism is the result of the death of God. ;Chapter Four discusses the relation of nihilism to morality. For Nietzsche, the moralization of life, and in particular the moralization of God, has led to God's death. Thus this chapter indicates the fifth criterion of theism, i.e., man's relation to God. ;Chapter Five sets out to decode hermeneutically the various masks that Nietzsche wears in reference to the problem of atheism. This chapter demonstrates how Nietzsche's own overt atheistic statements are proclaimations of iconotrophy, not godlessness. ;Chapter Six explicates Nietzsche's positive philosophy of God. This philosophy of God is formulated in terms of The Text of the Divine, God as Non-evaluatable, God and Eschatology, God and the Problem of Causality. It is widely known that Kasimir Twardowski was a student of Franz Brentano. In view of the fact that Brentano generally had great impact through his lectures, especially during his Vienna period (1874-1895), and consequently became one of the towering figures of Austrian philosophy, it is a matter of no small interest to determine how he influenced Twardowski. I’ll first consider presentations as they are described in Brentano’s psychology and then proceed to discuss Brentano’s account of the latter in his (...) logic. (shrink)

Fatalism is a doctrine about which philosophers have by and large been in complete agreement. Even the arguments they have used to dispose of it have been remarkably constant. Yet some of these arguments are surprisingly inadequate. The purpose of this discussion is to point out a set of fallacies which are especially common in recent discussions of fatalism. Their common feature is an emphasis on the relation between fatalism and deliberation. The claim they make is that if fatalism is (...) true, any deliberation over one's future actions is pointless. If this is not quite a refutation of fatalism by itself, it is at least a strong objection, especially when advanced ad hominem. Yet I think that it is wholly false. In the following discussion I will show how every argument intended to establish this incompatibility between fatalism and deliberation involves some fallacy. (shrink)

Argues that Plato's views as expounded in the "Republic" indicate that he was a utilitarian. This book also argues that utilitarianism is the only acceptable ethical theory, and that these conclusions have significant repercussions for education.

This paper focuses on independent training providers (ITPs) – in other words, private companies – as suppliers of vocational education and training in post-war England. Whilst acknowledging the central role of further education (FE) colleges in delivering vocational learning, it draws attention to a large, diverse sector of ITPs operating alongside FE colleges, particularly during the 1960s and 1970s. Data suggest that around 15–20% of vocational learners were enrolled as fee-paying customers with private providers at that time – a figure (...) broadly similar to today. There are, it is argued, three related reasons for this. First, the post-war policy environment, and the varied and uneven nature of colleges at that time, allowed significant room for ITPs to operate as alternative providers of vocational education. Second, the far-reaching ‘efficiency’ gains required since FE colleges left local authority control have largely attenuated the space in which ITPs previously operated. Third, neoliberal assumptions about the superiority of private enterprise mean that ITPs now receive significant funding from the state, largely to deliver Apprenticeships and other programmes of work-related learning – which has, somewhat perversely, reduced the incentive for them to act as bone fide commercial providers of a broader range of vocational learning. This edited volume considers the ways in which multiple stages, phases, or periods in an artistic or design process have served to arrive at the final artefact, with a focus on the meaning and use of the iteration, over the end result. In examining iteration, this collection of essays seeks to explore ways of theorising ideas surrounding series of objects, whether the original, the unfinished, the interim object, or the copy, vis-à-vis antecedents and successive exemplars. It asks how a closer (...) look at iterations of a single object-type - whether art, architecture, or design - might reveal new insight into the production of other objects and the production of thought alike. Written by an international team of contributors, offering a range of perspectives, it will look broadly at meaning and insight offered by the iteration, the multiple, and the design process, for historical research and its methods.
