Simplicius reports that Xenocrates and Andronicus reproached Aristotle for positing an excessive number of categories, which can conveniently be reduced to two: τὰ καθ᾽αὑτά and τὰ πρός τι. Simplicius, followed by several modern commentators, interprets this move as being equivalent to a division into substance and accidents. I aim to show that, as far as Xenocrates is concerned, this interpretation is untenable and that the substance-accidents contrast cannot be equivalent to Xenocrates’ per se-relative one. Studying Giles of Rome’s De ecclesiastica potestate, scholars usually focus their attention on the first part, where the Augustinian master argues in favor of his extreme theory of papal power. The present paper deals with the second part of the treatise, devoted to the relationship between the Church and temporal possessions. The main issues discussed in this part are therefore not political and ecclesiastical power, but ownership and poverty. The paper underlines in the first place the connection existing between Giles (...) of Rome’s treatment of these problems and the controversy between Secular and Mendicant clergy. Although originally a mendicant friar himself, Giles tries to avoid any interpretation of mendicant proverty that could undermine the right of the Church to exercise lordship over temporal goods. In the second place, the paper shoes how Giles’ account of the origin of private poverty is functional to his claim that the Church possesses all rights on temporal goods at the highest level. In this way, the Church is the sole authority that can grant a right of property, so that every human being depends on the Church also for his legitimate possession of temporal goods. (shrink)

The article shows a comparison between two ideas or ‘models' of community, Tönnies Gemeinschaft, reworked by Schmitt, and the Latin American indigenous peoples' Comunidad. A comparison that starts from the respective origin myths and arrives at the reflections on the subject of rights and freedoms that these narratives still produce today, in contemporary intercultural societies. The study focuses in particular on how the element of identity and belonging to a community can be used to motivate policies and laws oriented to (...) the exclusion or inclusion, to discrimination or emancipation. This book by Roberto Esposito - a leading Italian political philosopher - is a highly original exploration of the relationship between human bodies and societies. The original function of law, even before it was codified, was to preserve peaceful cohabitation between people who were exposed to the risk of destructive conflict. Just as the human body's immune system protects the organism from deadly incursions by viruses and other threats, law also ensures the survival of the community in a life-threatening (...) situation. It protects and prolongs life. But the function of law as a form of immunization points to a more disturbing consideration. Like the individual body, the collective body can be immunized from the perceived danger only by allowing a little of what threatens it to enter its protective boundaries. This means that in order to escape the clutches of death, life is forced to incorporate within itself the lethal principle. Starting from this reflection on the nature of immunization, Esposito offers a wide-ranging analysis of contemporary biopolitics. Never more than at present has the demand for immunization come to characterize all aspects of our existence. The more we feel at risk of being infiltrated and infected by foreign elements, the more the life of the individual and society closes off within its protective boundaries, forcing us to choose between a self-destructive outcome and a more radical alternative based on a new conception of community. Some algebraic structures of the set of all effects are investigated and summarized in the notion of a(weak) orthoalgebra. It is shown that these structures can be embedded in a natural way in lattices, via the so-calledMacNeille completion. These structures serve as a model ofparaconsistent quantum logic, orthologic, andorthomodular quantum logic.

We investigate certain Brouwer-Zadeh lattices that serve as abstract counterparts of lattices of effects in Hilbert spaces under the spectral ordering. These algebras, called PBZ*-lattices, can also be seen as generalisations of orthomodular lattices and are remarkable for the collapse of three notions of “sharpness” that are distinct in general Brouwer-Zadeh lattices. We investigate the structure theory of PBZ*-lattices and their reducts; in particular, we prove some embedding results for PBZ*-lattices and provide an initial description of the lattice of PBZ*-varieties.

This paper essentially originates from the notion of a block in an orthomodular lattice. What happens to orthomodularity when orthocomplementation is weakened? We will show that, under definitely smooth conditions, a great deal of the theory of orthomodular lattices carries over naturally.

In four studies, we investigated the role of remembering, reflecting on, and mutating personal past moral transgressions to learn from those moral mistakes and to form intentions for moral improvement. Participants reported having ruminated on their past wrongdoings, particularly their more severe transgressions, and they reported having frequently thought about morally better ways in which they could have acted instead (i.e., morally upward counterfactuals; Studies 1–3). The more that participants reported having mentally simulated morally better ways in which they could (...) have acted, the stronger their intentions were to improve in the future (Studies 2 and 3). Implementing an experimental manipulation, we then found that making accessible a morally upward counterfactual after committing a moral transgression strengthened reported intentions for moral improvement—relative to resimulating the remembered event and considering morally worse ways in which they could have acted instead (Study 4). We discuss the implications of these results for competing theoretical views on the relationship between memory and morality and for functional theories of counterfactual thinking. (shrink)

The problem of universals is one of the main philosophical issues. In this book the author reconstructs the history of the problem from Boethius to John of Salisbury, considering a selection of medieval representative texts.

This book presents the theory of anticipation, and establishes anticipation of the future as a legitimate topic of research. It examines anticipatory behavior, id est a behavior that 'uses' the future in its actual decisional process. The book shows that anticipation violates neither the ontological order of time nor causation. It explores the question of how different kinds of systems anticipate, and examines the risks and uses of such anticipatory practices. The book first summarizes the research on anticipation conducted within (...) a range of different disciplines, and describes the connection between the anticipatory point of view and futures studies. Following that, its chapters on Wholes, Time and Emergence, make explicit the ontological framework within which anticipation finds its place. It then goes on to discuss Systems, Complexity, and the Modeling Relation, and provides the scientific background supporting anticipation. It restricts formal technicalities to one chapter, and presents those technicalities twice, in formal and plain words to advance understanding. The final chapter shows that all the threads presented in the previous chapters naturally converge toward what has come to be called "Discipline of Anticipation". (shrink)

In this paper, I present a new interpretation of Kant’s notion of consciousness of oneself as a Subject on behalf of a polemic with a recent reading suggested by Longuenesse. My central aim is to provide a systematic interpretation of Kant’s metaphysics of consciousness in general. I present and defend new interpretations for four capital Kant’s notions. First, I present a reading of Kant’s sensible intuition as a de re form of mental representation without conceptual content and any structure. It (...) makes the subject aware only in the limited sense of demonstratively representing what appears to him. In the sequence, I present a reading of empirical consciousness as the result of a first-order representation. The important introduction of §16 of the first Critique is construed here as expressing what is known today as the access consciousness. Lastly, I propose a new reading for the transcendental Apperception as an intransitive form of consciousness. (shrink)

A recepção de Hannah Arendt ocorre principalmente no domínio da filosofia política, de modo a interpretá-la como uma teórica das crises do século XX. Contudo, essa perspectiva perde de vista os pressupostos e compromissos teóricos que a obra arendtiana assume com a tradição filosófica alemã, os quais permitem identificar problemas ainda não tratados em sua recepção. Assim, por meio de uma revisão bibliográfica, aliada à análise de ensaios teóricos da autora, esse artigo objetiva apontar uma lacuna na literatura arendtiana ao (...) verificar, de um lado, a presença de uma estrutura fenomenológica nos textos de Hannah Arendt e, por outro, conexões entre os seus temas e métodos e o problema da crise de identidade da filosofia. Dessa forma, ao evidenciar o tratamento deste problema na obra de Hannah Arendt, amplia-se sua recepção além do domínio da filosofia política. (shrink)

Neste estudo, busca-se uma exposição e uma análise da teoria tomasiana da “restituição” (restitutio). Isso implica apresentar a restitutio como parte da teoria da justiça comutativa e expor os vários aspectos de consideração que servem como pressupostos e condições para a sua realização virtuosa. Em particular, procura-se analisar a confluência de motivos normativos e penitenciais que a abordagem de Tomás de Aquino contém e que, ao final, é decisiva para a devida compreensão da dimensão de obrigação que a restituição importa.

Aliás, das inúmeras qualidades do trabalho, talvez possa destacar a abordagem inovadora e corajosa como a que mais me chamou a atenção. Há algum tempo venho me manifestando no sentido da necessidade de uma maior integração entre o processo civil e as outras ciências que tangenciam o Direito. É certo que já houve grande evolução em nossa disciplina, desde a concretização dos Movimentos de Acesso à Justiça e da aceitação uniforme dos conceitos de Processo Justo, Garantias Fundamentais e, sobretudo, de (...) um Processo Civil Constitucionalizado. Ocorre que os problemas da atualidade vêm demonstrando ser necessário um nível ainda maior de interdisciplinaridade, extrapolando os limites do Direito e ingressando em ciências conexas como a filosofia, a sociologia, a psicanálise e a ciência política. (...) Nessa linha de raciocínio, trabalhos como este, de autoria do Roberto Darós, trazem uma inestimável contribuição a essa nada fácil tarefa. Dialogar com a filosofia, a partir dos conceitos mais relevantes cunhados por dois dos maiores filósofos do mundo moderno - Habermas e Dworkin - já seria um trabalho árduo. Identificar os pontos de interseção entre o direito processual civil e a filosofia, a partir das obras desses Mestres, e trazer conclusões concretas para as questões do Estado Democrático de Direito, é realmente algo corajoso. A partir desses conceitos e de muitos outros, Roberto estrutura seu texto convidando o leitor a mergulhar nas teorias filosóficas com o objetivo de chegar ao entendimento da verdadeira função social do processo enquanto instrumento pacificador da comunidade, concluindo pela necessidade de busca de um novo modelo de celeridade processual. RESUMO A recente publicação de Faria tem como objetivo demonstrar que, “se o anti-individualismo estiver correto, então a obscuridade da validade é mais ampla do que necessitamos presumir para os objetivos atuais.” Através da rejeição de “uma variedade de movimentos exculpatórios, projetados para blindar a racionalidade de um pensador possivelmente azarado,” Faria sugere que o externalismo de conteúdo pode afetar drasticamente nossa autocompreensão como seres racionais. Temo que tenha que discordar. Faria superintelectualiza o pensamento, sempre performado da perspectiva de primeira (...) pessoa e é sujeito ao controle reflexivo pelo pensador. Para ter certeza, o externalismo de conteúdo mostra que um pensamento saudável é contingente no amplo ambiente e, assim, não depende exclusivamente das habilidades lógicas do ser vivo, mas é uma questão de sorte lógica. Apesar disso, o externalismo de conteúdo não é ameaça à racionalidade. Meu diagnóstico: através da adoção da estratégia de Wittgenstein de “trazer as palavras de volta pra casa”, Faria negligencia as conquistas da ciência cognitiva: na sua forma mais simples, a “inferência transitiva,” a racionalidade pervade o reino animal. Content nonconceptualism and State conceptualism are motivated by constraints of content-attribution that pull in opposite directions, namely, the so-called cognitive significance requirement and what I would like to call here the same representing constraint. The solution to this apparent contradiction is the rejection of the real content view and the adherence to what I call here Content-pragmatism. In CPR, “proposition” is not as real as a mental state, but rather is a term of art that semanticists use, as a matter (...) of theoretical convenience, to classify mental states. What follows from CPR is Content-pluralism : there is no such a thing as the content of experience. Because both criticisms and the defense of SNC overlook CPR and CP, they are ineffective. In this paper, I will argue that the opposition between SNC and CNC is a real one, but only a relative one, that is, relative to the opposite constraints to be met, namely CSR and SRR. If we want to meet CSR, the best we can do is to let the content of experience be modeled as neo-Fregean content, namely a compound of non-conceptual modes of presentation of objects and properties. In this case, CNC prevails. In contrast, if we want to meet SRR, the best we can do is let the content of experience be modeled either as a Russellian compound of objects and properties or as a function from possible worlds to truth-values. Nesse trabalho, pretendo poder mostrar que é um grave equívoco interpretarmos o papel das representações sensíveis na obra teórica de Kant como conteúdos não-conceituais (na acepção contemporânea técnica do termo “conteúdo” que, tais como dêiticos mentais, representariam o que aparece no espaço e no tempo de forma de re. A interpretação alternativa que me parece adequada é a seguinte: sem possuírem um conteúdo representacional próprio, a representação sensível deve ser entendida fundamentalmente como uma relação cognitiva entre o sujeito e as (...) entidades objetivas no espaço e no tempo com as quais ele está contato epistêmico. Nos termos dessa relação, a referência imediata da intuição sensível ao seu respectivo objeto é entendida como uma forma de conhecimento por contato com tais entidades. This volume offers a significant overview of authors, works and characteristics of philosophy in Latin America in the 16th - 18th centuries, i.e. essentially "colonial scholasticism": this is actually a remarkable chapter in the history of Baroque or Modern scholasticism. This volume is a collection of studies on Latin American scholasticism originally presented at the Fourth International Conference of Medieval Philosophy at the Pontifícia Universidade Católica do Rio Grande do Sul (PUCRS), Porto Alegre, Brazil, November 12-14, 2012. These essays provide (...) a significant overview of authors, works and areas of interest associated to scholastic thought in the 16th-18th centuries, focusing particularly on Latin American or European-born authors whose philosophical and theological careers were significantly set in Latin American soil and, due to their education, reveal a profound acquaintance with European philosophical theories and problems. The reception and development of Medieval thought in Baroque scholasticism, the connections between European philosophy, mainly Iberian scholasticism, and philosophical-theological debates in the New World, and the revisiting by Latin American scholars of Medieval schools of thought and theoretical patterns taught in Europe, prompted by the encounter with several peoples living in the new continent and the search and justification for models of colonization, are some of the relevant issues discussed in here. It is an established Hellenistic topos that philosophy is the ‘medicine’ of the soul, in charge of ‘healing’ the soul in the same way as medicine is in charge of healing the body. The ‘diseases’ of the soul deemed to be in need of healing are its passions, that is, its fears and desires, and the moral ‘health’ that philosophers pledge to grant their followers is freedom from passions and hence peace of mind.

After discussion of the mainstream definition of ontology, and a short analysis of the Aristotelian's principles, the paper addresses the problem of the categorial nature of the future by distinguishing (a) possibility from potentiality and (b) forward from upward emergence.
