Cuidados paliativos: solución ética acorde con la dignidad humana al final de la vida Cuidados paliativos: solução ética de acordo com a dignidade humana no final da vida It is said that passing laws to legalize euthanasia is absolutely necessary but, in my opinion, it is more pressing to enact a law for the patient to access a universal palliative care service at the end of their life than a law on euthanasia. This article discusses the difference between euthanasia and (...) palliative care. It is affirmed that being in favor of the latter does not mean wanting the patient to be in pain and to suffer, nor extending their life unreasonably. However, opting for palliative care is, on the one hand, what the physician can ethically do as a health worker and, on the other, the only morally acceptable alternative to the natural end of human beings that is appropriate to their dignity. Therefore, palliative care immerses us in an anthropological reflection about our own limitation and fragility, since respect for human life and palliative care dignify the process of dying. En este artículo se exponen las objeciones éticas y jurídicas a la maternidad subrogada. Algunos opinan que ésta es una cuestión de solidaridad con las parejas infértiles, por lo que es una práctica reproductiva, que nace de la autonomía de la mujer gestante y del derecho que a todo ser humano le asiste de ser padres. Otros opinan que los defensores de la maternidad subrogada en cualquiera de sus dos modalidades: comercial y altruista, olvidan a los dos sujetos más importantes (...) implicados en la misma: la mujer gestante y su bebé. Consideran que la maternidad subrogada discrimina y cosifica al bebé y a la mujer gestante mercantilizando e instrumentalizando su cuerpo. Utiliza a la gestante y al niño, como medios al servicio del cumplimiento de los deseos de otros. Luego parece que con la admisión de la maternidad subrogada resulta evidente que la dignidad de la mujer y la maternidad no se contemplan como algo indisponible y digno de protección. También el bebé no tiene valor en sí mismo, sino que lo tiene únicamente si es querido, recibido, deseado. En definitiva, no se puede admitir una práctica reproductiva que, en mi opinión, tiene como objetivo ser padre o madre a cualquier «precio». (shrink)

El tema del aborto siempre está en debate. Más todavía, cuando en España, desde finales del 2013, se estaba discutiendo el Ante- proyecto de Ley Orgánica sobre el aborto. El núcleo central del debate radica, como presupuesto del bioderecho, en dos cuestiones. La primera, si esa realidad que está en el vientre materno se puede considerar desde la concepción un ser humano o, por el contrario, no puede considerarse como tal desde el comienzo, esto es, si desde la concepción podemos (...) hablar de identidad humana. El segundo, es la cuestión de si el ser humano no nacido queda protegido jurídicamente en la Constitución española, es decir, el tema del derecho a la vida. Afirmo que, según los datos de las ciencias empíricas, por un lado, el no nacido es un ser humano. Por otro, que el no nacido no solo es un bien jurídico constitucionalmente protegido, como dice la Sentencia del Tribunal Constitucional español, sino que también es un sujeto de derecho a la vida. Para ello, es necesario un cambio en la Constitución española para defender la vida, la salud y la dignidad del embrión y del feto humano desde su concepción. (shrink)

These ethical limits enable any debate and investigation, in particular, with human beings. Therefore, any investigation would be unfeasi- ble without those limits. We talk about ethical limits, not in the sense of impediment but in the sense of possibility for action; you can only speak of ethical limits if you af rm a truth that is valid for everyone and for all (...) times, regardless of oneself. We are witnessing a true progress as long as a research is carried out for the bene t of human beings. That’s right; you can only speak of progress if it is understood in a growth in humanity. El siguiente documento es el resultado de un seminario de investigación sobre novela policíaca latinoamericana reciente, desarrollado en el curso de Novela Latinoamericana, de la Facultad de Filosofía y Letras en la Universidad de La Salle. La fundamentación teórica del seminario tuvo como marco general la Estética de la Recepción fundada en la Escuela de Constanza, Alemania, por Hans Robert Jauss y Wolfgang Iser. Para el caso concreto de la teoría literaria sobre novela policíaca vista en perspectiva sociológica, preferimos apelar (...) a las reflexiones fundacionales de Roger Caillios (1942), las que tiene un sugestivo subtítulo, a saber, La novela policíaca. –De cómo la inteligencia se retira del mundo para consagrarse a sus juegos y de cómo la sociedad introduce sus problemas en éstos. Por otra parte, elegimos la novela corta de Roberto Bolaño, La pista de hielo; y sobre esta elaboramos distintas hipótesis de trabajo, hasta lograr, al juicio de nuestros lectores, una propuesta de teoría literaria, que dé cuenta de la nueva narrativa policíaca. Amid a devastating economic crisis, two tragic events coming from the outside – the wave of immigration and Islamic terrorism – have radically changed the profile and significance of the space we call Europe. Given a paradigm leap of this sort, philosophical reflection is in a position to exert its creative power more than other types of knowledge. But this can only happen if it is able to go beyond its own lexical boundaries, by turning its gaze outside itself. Here (...) the leading Italian philosopher Roberto Esposito looks at how various strands of German, French, and Italian thought have achieved this outward turn and successfully captured international attention by breaking with the language of early nineteenth-century crisis philosophies. When analyzed from this novel perspective, the great texts of Adorno, Derrida, Foucault, and Deleuze, as well as works by the latest Italian thinkers, are cast in a new light. This paper deals with the intellectual relationship between Walter Benjamin and Carl Schmitt. It takes as starting point Benjamin’s famous letter to Schmitt on The Origin of German Tragic Drama as well as Benjamin`s mentions of Schmitt’s Political Theology in his work on the Baroque. Nevertheless, I prove the importance of Schmitt’s book on Dictatorship for Benjamin’s portrayal of sovereignty during the Baroque period and therefore its character of hidden reference for the Jewish thinker. The last section is devoted to (...) Schmitt`s public and private reading of The Origin of German Tragic Drama and to his critique of Benjamin’s Habilitationsschrift, namely his incapacity of understanding the difference between Shakespeare’s Hamlet and Hobbes’s Leviathan. This work offers a critical approach to Franz Rosenzweig’s conception of community in The Star of Redemption based on Helmuth Plessner’s political anthropology. First, it presents Plessner’s critique of social radicalism and of the apoliticism of the German spirit, and its parallelism with the Jewish spirit. Second, it delves into the passage from Hegel und der Staat to The Star in a communitarian key. Third, it dwells on the difference between community of blood and community of faith in Rosenzweig, together (...) with his theological-political translation into the distinction between the eternal people and the peoples of the world. Last, as a conclusion, it makes manifest the apoliticism of the Rosenzweigian proposal, and therefore, its incapacity to give an answer to the political problem in Weimar, of which its catastrophic consequences Rosenzweig did not know. In the beginning of the 20 th century, the discussion of the anthropological theme across the field of French philosophical debate. It also implies a redefinition of philosophy and politics at different levels. This is about the second episode of great anthropological questioning that took place in the 20th century, since the first had to do with the great German philosophical works which draws on the writings of Max Scheler, Martin Heidegger, Helmuth Plessner, Arnold Gehlen, and Ernst Cassirer, among others. (...) In the early 1960, the issues of the debate are of a different order. What is at the heart of this reflection is both a radical discussion issue of anthropology as an attempt to define the role and status of criticism in contemporary thought. Foucault makes the anthropological critique the point of departure, at the same time, in his review of the role and function of the Humanities on the device knowledge-power of modern and contemporary societies and the whole philosophical trajectory in which he will involve his searches during the duration of his life. He tries to understand what the meaning of the field of empirical knowledge that comes to emerge at this time with the claim to be a science, anthropology. Anthropology ends up wanting to resume human experience and philosophy in a move where the man gives his truth as the soul of truth. It is at this movement that Nietzsche put an end, when he showed that the death of God accompanies the death of man; that death of God is the end of metaphysics, and the place left free isn't absolutely the man who takes. The critique of the anthropological question is the starting point of an analysis with larger theme the problem of subject’s deconstruction and reconstruction, namely, the deconstruction of the subject as a cause and reconstruction of subjectivity as effect.Au début des années 1960 la mise en discussion du thème anthropologique traverse le champ du débat philosophique français. Elle implique aussi une redéfinition de la philosophie et du politique à différents niveaux. Il s’agit du deuxième épisode du grand questionnement anthropologique qui a eu lieu dans la philosophie du 20 e siècle ; le premier ayant affaire à la grande entreprise philosophique allemande qui se dessine dans les œuvres de Max Scheler, Martin Heidegger, Helmuth Plessner, Arnold Gehlen, et Ernst Cassirer, entre autres. Au début des années 1960 les enjeux du débat sont d’une autre nature. É a este movimento que Nietzsche colocou um fim, quando mostrou que a morte de Deus se acompanha da morte do homem; que a morte de Deus é o fim da metafísica, e o lugar deixado livre não é absolutamente o homem que o toma. Although Volk may be considered as a central concept in the work of Carl Schmitt, and one to which the German jurist dedicated a sizable amount of writing, a remarkably limited number of publications have so far provided an analytical study of how Schmitt conceptualised Volk, particularly in English-language secondary literature. This article intends to address this gap by systematically reviewing how the concept of Volk appears in the Schmitt’s theoretical effort, with a particular focus on his publications from the (...) late 1920s to 1945, and how it relates to his main legal-theoretical and political claims, both in his constitutional doctrine (Staatsrechtslehre) as well as in international law. It sketches some interpretive pathways to locate Volk in a broader historical and theoretical context, and it offers a conceptualisation of the relation between Schmitt and existentialist nationalism. This paper aims to investigate the transformations undergone by Dewey’s philosophy in the period from 1916 to 1921. By analyzing three different problematic situations with which Dewey found himself confronted (German militarism; the effects of propaganda on American society; the experience of a two-year stay in China), the paper seeks to show the various lines of development at work in his thought. The thesis of the paper is that in the war and immediately post-war years Dewey was concerned with outlining (...) a new account of the nature of theory which was preliminary to the formulation of his social philosophy. The paper presents Dewey’s main philosophical achievements, with the aim of providing some background knowledge that could be useful to understanding that place and significance of the Lectures in China in the overall context of his thought. Nicolai Hartmann was one of the most prolific and original, yet sober, clear and rigorous, 20th century German philosophers. Hartmann was brought up as a Neo-Kantian, but soon turned his back on Kantianism to become one of the most important proponents of ontological realism. He developed what he calls the “new ontology”, on which relies a systematic opus dealing with all the main areas of philosophy. His work had major influences both in philosophy and in various scientific disciplines. Resumo:A reflexão de Nietzsche acerca do conhecimento é inseparável do contexto positivista das universidades alemães na segunda metade do século XIX. Deste modo, Nietzsche assimila uma forte tendência naturalista, que lhe fornece argumentos contra a interpretação metafísico-racionalista do conhecimento. O presente artigo visa a analisar aspectos do desdobramento desses pressupostos no que diz respeito à consideração do conhecimento efetuada por ele, que o afastam tanto do idealismo como do reducionismo naturalista.:Nietzsche's reflection about knowledge is inseparable from the positivist context of (...) German universities in the second half of the nineteenth century. Nietzsche assimilates from it a strong naturalistic tendency, which gives him arguments against the metaphysical-rationalist interpretation of knowledge. This article aims to analyze aspects of these assumptions with regard to his consideration of knowledge, that keeps him away from idealism to the naturalist reductionism. (shrink)

Psychological failure to legislate norms from a state of normative nil is the core sceptical case that German philosophy had left unsolved, and that after Kant was handed over to each new generation of philosophers, until it exploded with great force in debates that spanned the 1910s. This article seeks to provide a context for Carl Schmitt's statement that `nobody could ever describe a single person's intentions as a norm', and to link this kind of normative scepticism with Schmitt's later (...) notion of `exception'. In the face of several attempts to dismiss Schmitt's theory in light of his personal and professional allegiance to the Nazis, this article appeals to the possibility of consilium pravorum, the idea that one can learn from someone whose ideas or actions are despicable. Schmitt distinguishes himself (especially in his early works before 1922) for both his normative scepticism and his willingness to interrogate premises that contemporary political philosophy seems to have left unexamined. This intervention concerns the different statute of abstraction in Marx's work. By means of a critical confrontation with Chris Arthur's work, Finelli presents his thesis of the presence of a double theory and fuction of abstraction in Marx's work. In the early Marx, until the German Ideology, abstraction is, in accordance with the traditional meaning of this term, a product of the mind, an unreal spectre. More exactly, it consists in negating the common essence belonging to labouring humanity and projecting (...) it, as alienated universal, into the idea of philosophy, into the state of politics and into the money of the market. In the later Marx, the nature of abstraction is, rather than mental, practical. It is directly related to the quantity without quality of capitalist labour, and it is the product of the systemic connection of machines to labour-power. In contrast to Arthur, Finelli maintains that practical abstraction in the Marx of Capital is not located in the zone of exchange and the market, where there is the mediation of money. On the contrary, it is located in the zone of production, which, for Marx, is a social ensemble not mediated by money but by relations of technological domination. (shrink)

Scholars from all the continents have written articles to celebrate the seventieth birthday of Jan Srzednicki, a thinker still at the height of his powers. Born in Warsaw on 24 April 1993, Jan Srzednicki divided his energies between his philosophical studies at the University of Warsaw and his service in the underground army. In 1944 he was caught up in the dramatic attempt to liberate Warsaw from the Nazis. Srzednicki's scientific work alternates between problems of Austrian and German philosophy and (...) questions of political philosophy. The papers published in this volume discuss topics of general philosophy, in the clear and deep style both of Srzednicki's own philosophical work and of the Authors investigated in his writings. The imposing scope and penetrating insights of German philosopher Nicolai Hartmann’s work have received renewed interest in recent years. The Neo-Kantian turned ontological realist established a philosophical approach unique among his peers, and it provides a wealth of resources for considering contemporary philosophical problems. The chapters included in this volume examine his ethics, ontology, aesthetics, philosophy of mind, and philosophy of nature. They explore his ontology of values, autonomy and human enhancement, and law; his theory of levels of reality, space-time (...) and geometry, the categories of temporality, causality, and “life,” the question of realism, and social ontology. Others take inspiration from his aesthetic theory, ideas about education,and his embrace of the Socratic pathos of wonder. They bring his philosophy into conversation with that of his contemporaries, including Roman Ingarden and Konrad Lorenz’s appropriation of Hartmann, as well as with the history of philosophy, including Plato’s theory of recollection, pre-Socratic philosophy, and that of his Russian teacher Nikolai Lossky. Those familiar with Hartmann’s wide-ranging systematic philosophy will benefit from these new engagements with his work, and those new to it will find them relevant to a number of current philosophical debates. This book is the first complete study of the translations of Machiavelli's Prince made in Europe and the Mediterranean countries during the period from the sixteenth to the first half of the nineteenth century: the first, unpublished French translation by Jacques de Vintimille (1546), the first Latin translation by Silvestro Tegli (1560), as well as the first translations in Dutch (1615), German (1692), Swedish (1757) and Arabic (1824). The first translation produced in Spain - dated somewhere between the end of (...) the sixteenth and the early seventeenth century - remained in manuscript form, while there was a second vernacular Spanish version around 1680. The situation in Great Britain was different from the rest of Europe, as it could boast four manuscript translations by the end of the sixteenth century. (shrink)

In order to memorize sentences we use both processes of language comprehension during encoding and processes of language production during maintenance. While the former processes are easily testable via controlled presentation of the input, the latter are more difficult to assess directly as language production is typically initiated and controlled internally. In the present event-related potential (ERP) study we track subvocal rehearsal of sentences, with the goal of studying the concomitant planning processes with the help of a silent cued-production task. (...) Native German participants read different types of sentences word-by-word, then were prompted by a visual cue to silently repeat each individual word, in a rehearsal phase. In order to assess both local and global effects of sentence planning, we presented correct sentences, syntactically or semantically violated sentences, or random word order sequences. Semantic violations during reading elicited an N400 effect at the noun violating the selectional restrictions of the preceding verb. Syntactic violations, induced by a gender incongruency between determiner and noun, led to a P600 effect at the same position. Different ERP patterns occurred during the silent production phase. Here, semantically violated sentences elicited an early fronto-central negativity at the verb, while syntactically violated sentences elicited a late right-frontal positivity at the determiner. Random word order was accompanied by long-lasting slow waves during the production phase. The findings are consistent with models of hierarchical sentence planning and further indicate that the ongoing working memory processes are qualitatively distinct from comprehension mechanisms and neurophysiologically specific for syntactic and lexical-semantic level planning. In conclusion, active working memory maintenance of sentences is likely to comprise specific stages of sentence production that are indicated by ERP correlates of syntactic and semantic planning at the phrasal and clausal level respectively. Octavio Paz: Ontology and Surrealism discusses poet Octavio Paz (1914-1998), one of Mexico's most controversial intellectuals. Over several decades, Paz has been celebrated for his impact on literature and culture as a poet as well as an essayist, and he is recognized as a great thinker and as a student of German ontology and phenomenology. Roberto Sanchez Benitez analyzes in detail Paz's training within the European philosophical thinking of the twentieth century, as well as in the artistic avant-garde, to (...) illustrate the way in which philosophical, anthropological, linguistic, sociological, literary, and artistic proposals enriched his work and Mexican culture during the post-revolutionary period. Sanchez Benitez posits that Paz moved from a phenomenological ontology to a historicism of the human condition, wherein morality, politics, and the arts all reside in an ideological context where dogmatisms where impose in the face of a lack of internal criticism. This book explores the themes of the poetic act that Paz associated with his ontological and surrealist readings, leading up to when they were transformed by his experience in India and the assimilation of Eastern philosophies, along with going through a set of Western proposals relating to love, eroticism, and art. The article endeavours to compare the reflections on the Shoah of two of the most celebrated intellectuals of Jewish origin of the 20th century, namely the German philosopher Hans Jonas and the Soviet writer Vasily Grossman. Both Jonas’ essay on The Concept of God after Auschwitz and Grossman’s novels and reports, such as The Hell of Treblinka, Life and Fate, and The Sistine Madonna, are characterised by a thorough enquiry into the ambivalence of the human condition, that tries to shed (...) some light on the disturbing abyss of Auschwitz and the Shoah. Although neither Jonas nor Grossman considered themselves as religious believers, thanks to the Shoah they recollected their Jewish roots and developed peculiar and innovative thoughts on the meaning and vulnerability of life, human freedom, immortality, and God. This article comes from reading a text by Theodor Kisiel on Heidegger's conceptual debt to Lask. From then on, in an attempt to explain this debt, we realized that it also extends to Ernst Cassirer. In this sense, we intend to highlight the interplay of rupture and continuity between these three authors. In doing so, we believe there is a proximity between Heidegger and Cassirer based on this common debt. We therefore argue that Lask's aggregating cut of judgment, Heidegger's problem (...) of being and Cassirer's philosophy of symbolic forms establish a relationship of “kinship”, but also of difference. This is my humble contribution to the study of German philosophy in Brazil. (shrink)

With the outbreak of severe acute respiratory syndrome coronavirus 2 (SARS-CoV-2), global researchers were confronted with major challenges. The German National Pandemic Cohort Network (NAPKON) was launched in fall 2020 to effectively leverage resources and bundle research activities in the fight against the coronavirus disease 2019 (COVID-19) pandemic. We analyzed the setup phase of NAPKON as an example for multicenter studies in Germany, highlighting challenges and optimization potential in connecting 59 university and nonuniversity study sites. We examined the ethics application (...) process of 121 ethics submissions considering durations, annotations, and outcomes. Study site activation and recruitment processes were investigated and related to the incidence of SARS-CoV-2 infections. For all initial ethics applications, the median time to a positive ethics vote was less than two weeks and 30 of these study sites (65%) joined NAPKON within less than three weeks each. Electronic instead of postal ethics submission (9.5 days (Q1: 5.75, Q3: 17) vs. 14 days (Q1: 11, Q3: 26), p value = 0.01) and adoption of the primary ethics vote significantly accelerated the ethics application process. Each study center enrolled a median of 37 patients during the 14-month observation period, with large differences depending on the health sector. We found a positive correlation between recruitment performance and COVID-19 incidence as well as hospitalization incidence. Our analysis highlighted the challenges and opportunities of the federated system in Germany. Digital ethics application tools, adoption of a primary ethics vote and standardized formal requirements lead to harmonized and thus faster study initiation processes during a pandemic. (shrink)

This theoretical essay gathers reflections from three publications by Jürgen Habermas from the 1960s that can contribute to the study of the public communication of science. We use these ideas to create a graphical representation that summarizes a desirable dynamic for practice while considering information flows that pass through politicized universities, the social life-world and the context of political decisions. This essay considers the inclusion of the public in the scientific agenda and in policy decisions related to that agenda. A (...) concept of public communication of dialogical science—now widely advocated but still difficult to operationalize—is present in the German philosopher’s thinking in books published more than 50 years ago. This paper argues that some of the misunderstandings surrounding the meaning and function of the concept of human dignity in bioethics arise from a lack of distinction between two different roles that this notion plays: one as an overarching policy principle, and the other as a moral standard of patient care. While the former is a very general concept which fulfils a foundational and a guiding role of the normative framework governing biomedical issues, the latter reflects a much more concrete (...) and context-specific understanding of the patient as a “person”. The importance of dignity as a policy principle will be described by appealing to the distinction between principles and rules as developed by some legal philosophers. The value of dignity as a standard of patient care will be illustrated with the help of concrete examples and by drawing on the taxonomies of dignity proposed by Jonathan Mann and other scholars. The overall scope of the article is to highlight this double and complementary role of human dignity in bioethics. (shrink)

We propose the mereological theory of odors, according to which odors are proper parts of concrete objects. We distinguish between object solid core and gaseous periphery; the odor is the periphery and plays a role in olfactory perception similar to the role played by surfaces in visual and tactile perception. Some epistemological and metaphysical consequences of the theory are explored, in particular the fact that objects are larger than they visually appear, and that smell turns out to be more accurate (...) than both vision and touch. In the context of dealing with infectious diseases transmitted by airborne particles, a reconceptualization of odors could be leveraged for inducing better mental representations and protective measures. SPANISH: En el presente trabajo nos hemos propuesto la factura de una interpretación en torno a la idea de la filosofía, entendida como liberación del pensamiento, a partir justamente de la obra de José Gaos. Consideramos que esta posibilidad es viable en virtud de que en la obra de nuestro autor pueden localizarse por lo menos dos alusiones a este sentido de emancipación de la misma filosofía. La primera de éstas tiene que ver con el derrumbe del espíritu de sistema (...) como la forma y camino exclusivo del pensamiento filosófico. Asimismo, la segunda alusión de esta emancipación se ve satisfecha cuando mediante la hipostación de la conciencia histórica, el autor dibuja el horizonte para la liberación de la existencia individual y el pensamiento, so pretexto de una filosofía inmanentista. ENGLISH: The purpose of this paper is drawing an interpretation around the idea of philosophy understood as thought’s liberation, just based on the work of José Gaos. We think that this is possible because in our author’s work at least two mentions to this sense of emancipation of the philosophy can be found. The first one has to do with the collapse of the spirit of system as the only form and unique way of philosophical thinking. Likewise, the second mention to this emancipation is fulfilled when, through hypostatization of historical consciousness, the author sketches the horizon for the liberation of the individual existence and thinking, under the pretext of an immanentist philosophy.
