In 1972 a public choice model predicted that the incipient environmental movement in the United States would grow but encounter overwhelming industrial opposition. Twenty years later we find the model overstated this opposition. Environmental pressure groups were able to pass substantial legislation, resist counter forces, and reduce most targeted pollutants. A revised public choice model predicts that the success of the present global environmental movement depends on (1) information flows between scientists and the public on the potential costs of deterioration, (...) and (2) means for reducing the costs of regulation such as relying more on market incentives. This chapter presents the text of a lecture on the Industrial Revolution in Great Britain given at the British Academy's 2009 Keynes Lecture in Economics. This text suggests that the Industrial Revolution was Britain's response to the global economy that emerged after 1500 and that Britain's success in world trade resulted in one of the most urbanised economies in Europe with unusually high wages and cheap energy prices. This paper defends the commonsense conception of linguistic competence according to which linguistic competence involves propositional knowledge of language. More specifically, the paper defends three propositions challenged by Devitt in his Ignorance af Language. First, Chomskian linguists were right to embrace this commonsense conception of linguistic cornpetence. Second, the grammars that these linguists propose make a substantive claim about the computational processes that are presumed to constitute a speaker’s linguistic competence. My aim is to propose affectivity as a criterion for personal identity. My proposal is to be taken in its weak version: affectivity as _only one_ of the criteria for personal identity. I start by arguing for affectivity being a better candidate as a criterion for personal identity than thinking. Next, I focus on synchronic vs. diachronic and on ontic vs. epistemic distinctions (my proposal will concern diachronic ontic personal identity) and consider the realm of affectivity in its temporal dimension. (...) In my argument, I rely on the genuineness of affectivity and I exploit chiefly long- or everlasting feelings (or emotions) and those which involve the feeling subject more rather than less. Medical ethics changed dramatically in the past 30 years because physicians and humanists actively engaged each other in discussions that sometimes led to confrontation and controversy, but usually have improved the quality of medical decision-making. Before then medical ethics had been isolated for almost two centuries from the larger philosophical, social, and religious controversies of the time. There was, however, an earlier period where leaders in medicine and in the humanities worked closely together and both fields were richer for it. (...) This volume begins with the 18th century Scottish Enlightenment when professors of medicine such as John Gregory, Edward Percival, and the American, Benjamin Rush, were close friends of philosophers like David Hume, Adam Smith, and Thomas Reid. They continually exchanged views on matters of ethics with each other in print, at meetings of elite intellectual groups, and at the dinner table. Then something happened, physicians and humanists quit talking with each other. In searching for the causes of the collapse, this book identifies shifts in the social class of physicians, developments in medical science, and changes in the patterns of medical education. Only in the past three decades has the dialogue resumed as physicians turned to humanists for help just when humanists wanted their work to be relevant to real-life social problems. Again, the book asks why, finding answers in the shift from acute to chronic disease as the dominant pattern of illness, the social rights revolution of the 1960's, and the increasing dissonance between physician ethics and ethics outside medicine. The book tells the critical story of how the breakdown in communication between physicians and humanists occurred and how it was repaired when new developments in medicine together with a social revolution forced the leaders of these two fields to resume their dialogue. Andrews, Robert M A way of dealing with historical episodes, the consequences of which continue to challenge us, is to ask a counterfactual-a 'what if?' question. Martin Luther's life, his critique of the Catholic Church, his challenge to the social and political hegemony of European Catholicism, the resultant splintering of an ecclesial unity assumed by the medieval mind to be practically impenetrable, is one such historical episode. My counterfactual is as follows: What would have been the consequences to European (...) Catholicism had Luther not rebelled against the church? As this article will later discuss, Luther famously spent many hours in the confessional during his time as an Augustinian friar. Luther's superior, spiritual guide, and confessor, Johann von Staupitz -whose motto was 'I am yours, save me'-often assured Luther that his sins were forgiven, that Christ's work had been done, and that he consequently had no need to despair of the mercy of God. It was advice that Luther ultimately found unsatisfactory. 'I did not love, no, rather I hated the just God who punishes sinners', Luther famously said in 1545, reflecting on his time as a monk, articulating a conscience that found solace only outside of Roman communion. In this article, I take up two arguments in favor of the discursive model of legal argumentation: the claim to correctness argument and the dual nature thesis. The argument of correctness implies the dual nature thesis, and the dual nature thesis implies a nonpositivistic concept of law. The nonpositivistic concept of law comprises five ideas. One of them is the special case thesis. The special case thesis says that positivistic elements, that is, statutes, precedents, and prevailing doctrines, are necessary for (...) law in order to achieve legal certainty. Without this, law would not be as perfect as it could possibly be. But it says, at the same time, that this alone would not be enough to fulfill the claim to correctness. The claim to correctness refers not only to the real dimension of law, defined by statutes, precedents, and prevailing doctrines, but also to its ideal dimension, defined, first and foremost, by justice. The special case thesis is my oldest thesis. It has remained an essential element of my system over the years. Its connection with four other theses—the Radbruch formula, the human rights thesis, the idea of deliberative democracy, and principles theory—does not change this at all. On the contrary, this connection has lent greater strength to the special case thesis. (shrink)

The Chain of Change is the first full-scale philosophical commentary devoted to Aristotle's Physics VII, in which Aristotle argues for the existence of a first, unmoved cosmic mover. This study systematically considers the major issues of the book, and argues for the fundamental importance of Physics VII in our understanding of Aristotelian cosmology and natural science. Physics VII is extant in two versions, and therefore poses special editorial problems. For this reason one of the features of Dr. Wardy's study is (...) the provision of an improved text and translation in both versions. The author's comprehensive comparison of their merits, philosophical and philological, has a significant bearing on our understanding of the nature and evolution of the Aristotelian corpus. The second part of the book is devoted to critical examination of the argument, including one of the most elaborate and challenging in the entire Aristotelian corpus. Throughout, the author concentrates on those points where Aristotle diverges most sharply and provocatively from contemporary presumptions in philosophy and natural science. (shrink)

These lead to the suggestion that jurisprudence should be defined as a general juristic theory of law and legal science. In the second part, the character and elements of this definition are explained systematically. Robert Brain traces the origins of artistic modernism to specific technologies of perception developed in late-nineteenth-century laboratories. Brain argues that the thriving fin-de-siècle field of “physiological aesthetics,” which sought physiological explanations for the capacity to appreciate beauty and art, changed the way poets, artists, and musicians worked and brought a dramatic transformation to the idea of art itself.

This book argues that the primary function of human thinking in language is to make judgments, which are logical-normative connections of concepts. Robert Abele points out that this presupposes cognitive conditions that cannot be accounted for by empirical-linguistic analyses of language content or social conditions alone. Judgments rather assume both reason and a unified subject, and this requires recognition of a Kantian-type of transcendental dimension to them. Judgments are related to perception in that both are syntheses, defined as the (...) unity of representations according to a rule/form. Perceptual syntheses are simultaneously pre-linguistic and proto-rational, and the understanding makes these syntheses conceptually and thus self-consciously explicit. Abele concludes with a transcendental critique of postmodernism and what its deflationary view of ontological categories—such as the unified and reasoning subject—has done to political thinking. He presents an alternative that calls for a return to normativity and a recognition of reason, objectivity, and the universality of principles. (shrink)

The aim of this paper is twofold: The first part, drawing on Spinoza and Deleuze’s reading of Spinoza, develops a broad outline of what might be called a metaphysics of immanence. In the second part, I will propose to understand phenomenology in the context of this metaphysics of immanence and I will point to some methodological and ontological shifts in phenomenological research this metaphysical interpretation might entail.
