Bringing Ritual to Mind explores the cognitive and psychological foundations of religious ritual systems. Participants must recall their rituals well enough to ensure a sense of continuity across performances, and those rituals must motivate them to transmit and re-perform them. Most religious rituals the world over exploit either high performance frequency or extraordinary emotional stimulation to enhance their recollection. But why do some rituals exploit the first of these variables while others exploit the second? McCauley and Lawson advance the ritual (...) form hypothesis, arguing that participants' cognitive representations of ritual form explain why. Reviewing evidence from cognitive, developmental and social psychology and from cultural anthropology and the history of religions, they utilize dynamical systems tools to explain the recurrent evolutionary trajectories religions exhibit. Aristotle's observation that all human beings by nature desire to know aptly captures the spirit of "intellectualist" research in psychology and anthropology. Intellectualists in these fields agree that humans' have fundamental explanatory interests (which reflect their rationality) and that the idioms in which their explanations are couched can differ considerably across places and times (both historical and developmental). Intellectualists in developmental psychology (e.g., Gopnik and Meltzoff, 1997) maintain that young children's conceptual structures, like those of scientists, are theories and that (...) their conceptual development--like the development of science--is a process of theory formation and change. They speculate that our explanatory preoccupations result, at least in part, from a natural drive to develop theories. Intellectualists in the anthropology of religion (e.g., Horton, 1970 and 1993) hold that, although it may do many other things as well, religion is primarily concerned with providing explanatory theories. They maintain that religion and science have the same explanatory goals; only the idioms of their explanations differ. The connections between the concern for explanation, the pursuit of science, the persistence of religion, and the cognitive processes underlying each clearly merit further examination. By considering both their cultural manifestations and their cognitive foundations, I hope to clarify not only how science and religion are related but some of the ways their explanatory projects differ. I shall argue that, despite their centuries' old antagonisms, no development in science will ever seriously threaten the persistence of religion or the forms of explanation religion employs or the emergence of new religions. (I strongly suspect that science will never seriously threaten the persistence of particular religions either, but I only aim to defend the weaker, collective claim here.) In this paper's fourth section I shall show that religion and its characteristic forms of explanation 1 are a natural outgrowth of the character and content of human association and cognition.. This article offers a critique of research practices typical of experimental philosophy. To that end, it presents a review of methodological issues that have proved crucial to the quality of research in the biobehavioral sciences. It discusses various shortcomings in the experimental philosophy literature related to (1) the credibility of self-report questionnaires, (2) the validity and reliability of measurement, (3) the adherence to appropriate procedures for sampling, random assignment, and handling of participants, and (4) the meticulousness of study reporting. Is faith that p compatible with disbelief that p? I argue that it is. After surveying some recent literature on the compatibility of propositional and non-propositional forms of faith with the lack of belief, I take the next step and offer several arguments for the thesis that both these forms of faith are also compatible, in certain cases, with outright disbelief. This is contrary to the views of some significant recent commentators on propositional faith, including Robert Audi and Daniel (...) Howard-Snyder. The primary argument revolves around the possibility of maintaining a single faith through drastic changes in cognitive attitude. I argue that once we allow that propositional faith is compatible with weaker cognitive attitudes than belief, such as acceptance or assent, there is prima facie reason to consider propositional faith as sometimes compatible with disbelief. I then consider objections and offer some final reflections on the significance of the thesis. (shrink)

In this paper, we present an informal introduction to Logical English and illustrate its use to standardise the legal wording of the Automatic Early Termination clauses of International Swaps and Derivatives Association Agreements. LE can be viewed both as an alternative to conventional legal English for expressing legal documents, and as an alternative to conventional computer languages for automating legal documents. LE is a controlled natural language, which is designed both to be computer-executable and to be readable by English speakers (...) without special training. The basic form of LE is syntactic sugar for logic programs, in which all sentences have the same standard form, either as rules of the form conclusion if conditions or as unconditional sentences of the form conclusion. However, LE extends normal logic programming by introducing features that are present in other computer languages and other logics. These features include typed variables signalled by common nouns, and existentially quantified variables in the conclusions of sentences signalled by indefinite articles. Although LE translates naturally into a logic programming language such as Prolog or ASP, it can also serve as a neutral standard, which can be compiled into other lower-level computer languages. How can we experience real emotions when viewing a movie or reading a novel or watching a play when we know the characters whose actions have this effect on us do not exist? This is a conundrum that has puzzled philosophers for a long time, and in this book Robert Yanal both canvasses previously proposed solutions to it and offers one of his own. First formulated by Samuel Johnson, the paradox received its most famous answer from Samuel Taylor Coleridge, (...) who advised his readers to engage in a "willing suspension of disbelief." More recently, philosophers have argued that we are irrational in emoting toward fiction, or that we do not emote toward fiction but rather toward factual counterparts, or that we do not have real but only quasi-emotion toward fiction, generated by our playing games of make-believe. All of these proposed solutions are critically reviewed. Finding these answers unsatisfactory, Yanal offers an alternative, providing a new version of what has been dubbed "thought theory." On this theory, mere thoughts not believed true are seen as the functional equivalent of belief at least insofar as stimulating emotion is concerned. The emoter's disbelief in the actuality of components of the thoughts must be rendered relatively inactive. Such emotion is real and typically has the character of being richly generated yet unconsummated. The book extends this theory also to resolving other paradoxes arising from emotional response to fiction: how we feel suspense over what comes next in a story even when we are re-reading it for a second or third time; and how we take pleasure in narratives, such as tragedy, that excite unpleasant emotions such as fear, pity, or horror. The personalistic theory of probability prescribes that a person should use personal probability assessments in decision-making and that these assessments should correspond with his judgments. Since the judgments exist solely in the assessor's mind, there is no way to prove whether or not this requirement is satisfied. De Finetti has proposed the development of methods which should oblige the assessor to make his assessments correspond with his judgments. An ideal Assessor is hypothesized and his behavior is investigated under a number (...) of such methods. The implications of these methods for the theory of personal probability are discussed. Finally, although the present interest is primarily normative, the practicability of the methods is also discussed. (shrink)

The United Nations Special Representative on Transnational Corporations and Human Rights, John Ruggie, has adopted a new framework for considering this issue within the international legal system. This article examines this framework in terms of its coherence, its consistency with international human rights law and how it can be 'operationalized' (which is required by the United Nations). In regard to the states legal obligation to protect human rights, it is considered whether this obligation is broader and deeper than is envisaged (...) in the framework, especially if it can include the extra-territorial activities of corporations. The corporate responsibility to respect human rights is examined in terms of its conceptual and definitional problems, and the article also questions whether there will be sufficient legal remedies available to victims under the framework. Can it be rational to be religious? Robert Audi gives a persuasive positive answer through an account of rationality and a rich, nuanced understanding of what religious commitment means. It is not just a matter of belief, but of emotions and attitudes such as faith and hope, of one's outlook on the world, and of commitment to live in certain ways.

We recommend the attitude of optimistic agnosticism toward animal mindreading: suspending acceptance until tests succeed in overcoming Povinelli's problem, and being optimistic about the feasibility of such tests. Fletcher and Carruthers argue for sufficient reasons to accept animal mindreading; we find their arguments unconvincing. Points they raise against the behavior-reading theory apply equally to mindreading theory, and their claims of greater parsimony are unfounded. Premature acceptance of mindreading could inhibit the search for innovative ways to overcome longstanding methodological problems. Optimistic (...) agnosticism, in contrast, encourages the pursuit of approaches that can lead to important insights about animal social cognition. (shrink)

In this paper we explore the thesis that the role of argumentation in practical reasoning in general and legal reasoning in particular is to justify the use of defeasible rules to derive a conclusion in preference to the use of other defeasible rules to derive a conflicting conclusion. The defeasibility of rules is expressed by means of non-provability claims as additional conditions of the rules.We outline an abstract approach to defeasible reasoning and argumentation which includes many existing formalisms, including default (...) logic, extended logic programming, non-monotonic modal logic and auto-epistemic logic, as special cases. We show, in particular, that the admissibility semantics for all these formalisms has a natural argumentation-theoretic interpretation and proof procedure, which seem to correspond well with informal argumentation. Are guest-worker programs exploitative? Egalitarian and neoclassical theories of exploitation agree that they always are. But these judgments are too indiscriminate. Privileged guests are the exception, and the exception points toward a more sensitive standard for identifying exploitation. This more sensitive standard, the sufficiency theory of exploitation, is used to analyze several guest-worker programs. Even when guest-worker programs are exploitative, it is argued that the unfairness should be tolerated if the exploitation is modest, not severe, and if the most likely (...) nonexploitative alternative worsens the plight of the disadvantaged. In this essay I describe two of the accounts that Peirce provides of personhood: the semiotic account, on which a person is a sequence of thought-signs, and the naturalistic account, on which a person is an animal. I then argue that these disparate accounts can be reconciled into a plausible view on which persons are numerically distinct entities that are nevertheless continuous with each other in an important way. This view would be agreeable to Peirce in some respects, as it (...) is modeled on his theory of perception, incorporates his categories of Firstness, Secondness and Thirdness, and is in harmony with his objective idealism. But it diverges from Peirce in one important respect, viz. its rejection of the idea that some groups of human beings count as persons. (shrink)

Many methodologists are firmly convinced that Popper's arguments concerning the status of the rationality principle (RP) are incoherent or incompatible with the essentials of falsificationism. The present essay first shows that the accusation of incompatibility of situational logic with falsificationism does not hold up to scrutiny but then shows that Popper's arguments are nonetheless flimsy if not indefensible. For it seems that one can distinguish between two different versions of the RP in Popper's writings. If the first version is plainly (...) "objectivist" and can be characterized with Popper as empirically false, the second one is rather "subjectivist" and is not falsifiable as such. The essay shows that this second reading of the RP is the one that Popper finally adopts but that, unfortunately enough, this formulation of the RP looks more like a metaphysical statement than like an empirical law. It could then be held to be a priori valid as such, by analogy with Popper's line of argument concerning the principle of causality. If this is correct, then Popper's thesis on the empirical status of the RP is confuted. (shrink)

The author outlines his thesis that legal discourse is a special case of general practical discourse (Sonderfallthese) and develops it as an attempt to cover both the authoritative, institutional, or real and free, discursive, or ideal dimension of legal reasoning. On this basis, he examines the objections raised by Habermas (1996) to the special case thesis. First, he discusses the reduction of general practical discourse to moral discourses (genus proximum problem) holding that the former is a combination of moral, ethical, (...) and pragmatic arguments within the priority of just; second, he examines the objection that general practical arguments change their character or nature when employed in legal contexts (subset and specification problem) and the related problems concerning legal validity and unjust law. Growing concern about economic inequality has generated a polarized narrative regarding the causes and consequences of extreme wealth. We contend that divided ideological positions obscure a more mundane reality about the typical wealthiest 1% households. Using data from the triennial survey of consumer finance, we demonstrate that there is substantial heterogeneity within the 1%. Contrary to public discourse, the typical 1% household does not have wealth reflective of popular rich lists, but derives a significant share of its wealth from ownership (...) and active management of small- to medium-sized private enterprise. We use these findings to shed new insights on business families’ relationship to economic inequality and open promising new areas of inquiry regarding the role of the family business in society.
