Can the characters in Black Mirror survive the loss of their bodies? This chapter considers what happens to characters like Greta in White Christmas, Clayton in Black Museum, and Yorkie in San Junipero when artificial models are made of their minds. One possibility is that the original characters persist in cookie form, without their bodies, but retaining the essence of who they originally were. Another possibility is that cookies cannot replicate a person's essence: instead, each time a cookie is created, (...) a new, entirely distinct person comes into being. Institutional review boards are almost universally considered to be overworked and understaffed. They also require substantial commitments of time and resources from their members. Although some surveys report average IRB memberships of 15 people or more, federal regulations require only five. We present data on IRB meetings at eight of the top 25 academic medical centers in the United States funded by the National Institutes of Health. These data indicate substantial contributions from primary reviewers and chairs during protocol discussions but (...) little from other members, which implies that it may be possible for smaller IRBs to accomplish the same tasks with no reduction in the quality of review. Pancreatitis is a complex, progressively destructive inflammatory disorder. Alcohol was long thought to be the primary causative agent, but genetic contributions have been of interest since the discovery that rare PRSS1, CFTR and SPINK1 variants were associated with pancreatitis risk. We now report two associations at genome-wide significance identified and replicated at PRSS1-PRSS2 and X-linked CLDN2 through a two-stage genome-wide study. The PRSS1 variant likely affects disease susceptibility by altering expression of the primary trypsinogen gene. The CLDN2 risk allele is (...) associated with atypical localization of claudin-2 in pancreatic acinar cells. The homozygous CLDN2 genotype confers the greatest risk, and its alleles interact with alcohol consumption to amplify risk. Marshalling a mind-numbing array of data, Harvard political scientist Robert D. Putnam, in his book Bowling Alone, shows that on virtually every conceivable measure, civic participation, or what he refers to as “social capital,” is plummeting to levels not seen for almost 100 years. And we should care, Putnam argues, because connectivity is directly related to both individual and social wellbeing on a wide variety of measures. On the other hand, social capital of the “bonding kind” brings with it (...) the ugly side effect of animosity toward outsiders. Given the increasing heterogeneity of our world, the goal therefore must be to enhance connectivity of the “bridging sort,” i.e., connecting across differences. This, in turn, requires that we first clarify what bridging communicative styles looks like. Examining communication as it might transpire in Kant’s kingdom of ends, through the perspective of Habermas’ “communicative action,” and within the scientific community, offers a compelling suggestion that there is a way of communicating such that, if adopted, one would come to view others as if they were persons, i.e., that a bridging communicative style facilitates a kind of bonding that sees through differences toward the commonality of personhood. Profiles of art education in nineteen countries around the world by citizens or longtime residents of those countries comprise the core of this book. Guidelines for the cross-cultural study of art education are presented by the editors in a general introduction and three part introductions, and also by contributing specialists. This paper considers the prospects for the current revival of interest in Hegel, and the direction it might take. Looking back to Richard J. Bernstein's paper from 1977, on ‘Why Hegel Now?’, it contrasts his optimistic assessment of a rapprochement between Hegel and analytic philosophy with Sebastian Gardner's more pessimistic view, where Gardner argues that Hegel's idealist account of value makes any such rapprochement impossible. The paper explores Hegel's account of value further, arguing for a middle way between (...) these extremes of optimism and pessimism, proposing an Aristotelian reading which is more metaphysical than Bernstein recognizes, but not as at odds with thinking in current analytic philosophy as Gardner suggests, as it finds a counterpart in the work of Philippa Foot, Michael Thompson, Rosalind Hursthouse and others. The thesis that law necessarily claims authority is popular amongst legal philosophers. Some distinguished legal philosophers, including the late John Gardner, Joseph Raz and Scott Shapiro, have suggested that support for this thesis is found in legal officials’ use of deontic language. This article begins by considering the merits of this suggestion. I discuss two unpromising arguments for the claim thesis based on the use of deontic language in law. I then suggest that a more plausible basis for the (...) claim thesis lies in the felicity conditions of the speech acts that legal officials perform. In the absence of an explicit claim to authority, legal officials make a presupposition to authority over their subjects. The presupposition arises from interaction between the felicity conditions of legal speech acts and basic norms of cooperative communication. I consider some implications of this conclusion for our understanding of legal authority. (shrink)

This paper argues that Philosophical Intelligence is an important form of human intelligence best developed in children through philosophical dialogue. Howard Gardner’s theory of Multiple Intelligences (MI) is critically reviewed. MI theory, it is argued, requires clearer definition and a theory of pedagogy to make it practical and applicable in school settings. This paper focuses on redefining the concept of existential intelligence and on identifying a workable pedagogy through which it can be developed. Gardner’s ‘existential intelligence’ is redefined (...) in terms of Philosophical Intelligence and linked to the historical tradition of philosophical enquiry. The community of enquiry provides a pedagogical basis for developing Philosophical Intelligence. Ways that Philosophical Intelligence can be developed through communities of enquiry are illustrated with recent research using ‘Stories for Thinking’ and other forms of stimulus. (shrink)

Professor Robert Alexy wrote a book whose avowed purpose is to refute the basic tenets of a type of legal theory which 'has long since been obsolete in legal science and practice'. The quotation is from the German Federal Constitutional Court in 1968. The fact that Prof Alexy himself mentions no writings in the legal positivist tradition [in English] later than Hart's The Concept of Law (1961) may suggest that he shares the court's view. The book itself may be (...) evidence to the contrary. After all why flog a dead horse? Why write a book to refute a totally discredited theory? Perhaps Alexy was simply unlucky. The burst of reflective, suggestive and interesting writings in the legal positivist tradition reached serious dimensions only in the years after the original publication of his book, when Waldron, Marmor, Gardner, Leiter, Shapiro, Murphy, Himma, Kramer, Endicott, Lamont, Dickson, Bix and others joined those who had made important contributions to legal theory in the positivistic tradition in the years preceding the original publication of Alexy's book: Lyons, Coleman, Campbell, Harris, Green, Waluchow and others, who are still among the main contributors to legal theory in the positivist tradition. It is a great shame that nothing in these writings influenced the arguments of the book. Perhaps this regret is misplaced. After all ‘positivism' in legal theory means, and always did mean, different things to different people. What Radbruch, one of Alexy's heroes, meant when he first saw himself as a legal positivist and then recanted was not the same as what 'legal positivism' means in Britain (and nowadays in the United States as well) among those who engage in philosophical reflection about the nature of law. Perhaps Alexy is simply addressing himself to a German audience, and refuting, or attempting to refute, legal theories of a kind identified in Germany as 'legal positivism'. Perhaps, though his references to Hart show that he does not intend it that way. My aims in this chapter are, however, reasonably clear. My main purpose is to explore whether any of Alexy's arguments challenge any of the views which I have advocated. Subsidiary aims are, first, to clarify why what Alexy says is legal positivism is not what is understood as such in the English speaking world, so that some of Alexy's sound points find no target; secondly, to try and clarify some of his arguments which I found, at least initially, rather obscure. Given the prominence of Alexy's book I will refer only to it, and will not consider his other publications. (shrink)

The author offers a fresh solution to the problem of rendering two key Aristotelian uses of the articular infinitive τὸ εἶναι with an embedded modifier, the one τί ἦν, and the other the dative noun and/or adjective, two usages which are clearly meant to be parallel.

In order to solve problems, humans are able to synthesize apparently unrelated concepts, take advantage of serendipitous opportunities, hypothesize, invent, and engage in other similarly abstract and creative activities, primarily through the use of their visual systems. In _Scenario Visualization_, Robert Arp offers an evolutionary account of the unique human ability to solve nonroutine vision-related problems. He argues that by the close of the Pleistocene epoch, humans evolved a conscious creative problem-solving capacity, which he terms scenario visualization, that enabled (...) them to outlive other hominid species and populate the planet. Arp shows that the evidence for scenario visualization -- by which images are selected, integrated, and then transformed and projected into visual scenarios -- can be found in the kinds of complex tools our hominid ancestors invented in order to survive in the ever-changing environments of the Pleistocene world. Arp also argues that this conscious capacity shares an analogous affinity with neurobiological processes of selectivity and integration in the visual system, and that similar processes can be found in the activities of organisms in general. The evolution of these processes, he writes, helps account for the modern-day conscious ability of humans to use visual information to solve nonroutine problems creatively in their environments. Arp's account of scenario visualization and its emergence in evolutionary history suggests an answer to two basic questions asked by philosophers and biologists concerning human nature: why we are unique; and how we got that way. The relation (...) between words and the Word has always been of in· terest in Christian theology. Earlier in this century a school of writers approached " the Bible as literature " with a view to bringing Scripture into a more persuasive relation with literature at large, but their insistence on the rigorous exclusion of dogmatic elements from literary scrutiny impoverished their work. A later set of procedures and perspectives on rhetoric and language in their relation to reality was bet· ter able to allow the utterances of a text's speakers their own integrity, whether sacred or secular. In any case, a thematic interpretation of the founding texts of Christianity, influenced by Aristotle's Rhetoricwhere form is a means for persuasively communicating an idea-content -had long predominated in ecclesial usage, germane as it was to the didactic concerns of the Church. An alternative tradition, more indebted to Aristotle's Poetics, where form, content, and functions are treated as factors making for the indissoluble whole which is the literary work, has been less conspicuous-though its offer of initiation into the " world " of the sacred writers gives it great exegetical potential. The text's "word " should be encountered at the level of its own patterned imagery and wrought design. In the appreciation of the Gospels this has become in recent decades a commonplace. However, as the T. S. Eliot scholar Helen Gardner warned, one should not so react against the older approach as to treat the biblical text as the product of a disembodied imagination, rather than a human being writing a work that might make his readers "wise unto salvation." David S. Cunningham's Faithful Persuasion extends this discussion of the propriety or impropriety of a rhetorical approach to Scripture to the discourse of Christian theology as a whole. The intent is a laudable one but its execution vitiated, to my mind, by the excessive concessions to scepticism from which the author sets out. Because his theological epistemology, aware of the limitations of the propositions in which we assert the truths of faith, will grant those assertions no more than a 354 BOOK REVIEWS (continuously) revisable character, he falls back on an account of theology as rhetoric so as to make the best of a bad job. For persuasion is what we use when we know demonstration is hopeless. As a result, Professor Cunningham's study, which could most usefully have "placed" a variety of theologies of past, present, and, prospectively, future on the spectrum of (onto-) logic, poetic, and rhetoric, concludes instead that theology must regard itself as rhetorical or perish! This inevitably narrows the several services theologies of different kinds can perform for the Church. Imagine how biblical studies would be reduced were the exegete only to treat his text as paraenesis, and never as history or as a symbolic world. ABSTRACTAnalytic philosophy is often associated with a physicalistic naturalism that privileges natural-scientific modes of explanation. Nevertheless there has since the 1980s been a heterodox, somewhat subterranean trend within analytic philosophy that seeks to articulate a more expansive, ‘non-reductive‘ conception of nature. This trend can be traced back to P.F. Strawson’s 1985 book Skepticism and Naturalism: Some Varieties. However, Strawson has long been ignored in the literature around ‘soft naturalism’ – especially in comparison to John McDowell. One of the reasons for (...) this is that Strawson’s account of soft naturalism is not often viewed as particularly plausible – it has come in for heavy criticism from the likes of Sebastian Gardner and Robert Stern. In this paper, I argue that Strawson’s soft naturalism ought to be re-assessed: that his critics can be refuted, and that his naturalism remains a compelling alternative to the likes of McDowell’s. I attempt this through a ‘radicalisation’ of the modest Strawson’s position, demonstrating that his naturalism has implicit in it something like Marx’s conception of human ‘species-being’. (shrink)

In this paper we explore the thesis that the role of argumentation in practical reasoning in general and legal reasoning in particular is to justify the use of defeasible rules to derive a conclusion in preference to the use of other defeasible rules to derive a conflicting conclusion. The defeasibility of rules is expressed by means of non-provability claims as additional conditions of the rules.We outline an abstract approach to defeasible reasoning and argumentation which includes many existing formalisms, including default (...) logic, extended logic programming, non-monotonic modal logic and auto-epistemic logic, as special cases. We show, in particular, that the admissibility semantics for all these formalisms has a natural argumentation-theoretic interpretation and proof procedure, which seem to correspond well with informal argumentation.
