Is it true that the suffering associated with chronic illness can be controlled in all but a few intractable cases? The bio-ethical literature gives the impression that suffering is primarily pain and that a competent physician should be able to control suffering. This perception jibes neither with my forty years of clinical experience nor with suffering as depicted in novels. Using Kenaz' novel,The Way to the Cats as a starting point, I argue that, with regard to suffering and illness, fiction (...) is closer to reality than professional literature, and suffering is far more than pain. I content that the control of suffering is a modern myth. This argument applies equally well to the control of non-insulin dependent diabetes. Patient selection, duration of follow-up, remembering what we want to remember, bias, self-fulfilled prophecy, and asking the wrong questions are offered as partial explanation for the gap between perception and reality. The complexity of suffering and the elusiveness of its control should be honestly recognized. (shrink)

This is a wide-ranging 2004 book about arguments for and against beliefs in God. The arguments for the belief are analysed in the first six chapters and include ontological arguments from Anselm to Gödel, the cosmological arguments of Aquinas and Leibniz, and arguments from evidence for design and miracles. The next two chapters consider arguments against belief. The last chapter examines Pascalian arguments for and against belief in God. There are discussions of Cantorian problems for omniscience, of challenges to divine (...) omnipotence, and of the compatibility of everlasting complete knowledge of the world with free-will. There are appendices that present formal proofs in a system for quantified modal logic, a theory of possible worlds, notes on Cantorian set theory, and remarks concerning non-standard hyperreal numbers. The authors argue against direction of fit accounts of the distinction between belief and desire.

Scepticism has been the driving force in the development of Greco-Roman culture in the past, and the impetus for far-reaching scientific achievements and philosophical investigation. Early Jewish culture, in contrast, avoided creating consistent representations of its philosophical doctrines. Sceptical notions can nevertheless be found in some early Jewish literature such as the Book of Ecclesiastes. One encounters there expressions of doubt with respect to Divine justice or even Divine involvement in earthly affairs. During the first centuries of the common era, (...) however, Jewish thought, as reflected in rabbinic works, was engaged in persistent intellectual activity devoted to the laws, norms, regulations, exegesis and other traditional areas of Jewish religious knowledge. An effort to detect sceptical ideas in ancient Judaism, therefore, requires a closer analysis of this literary heritage and its cultural context. This volume of collected essays seeks to tackle the question of scepticism in an Early Jewish context, including Ecclesiastes and other Jewish Second Temple works, rabbinic midrashic and talmudic literature, and reflections of Jewish thought in early Christian and patristic writings. David Sobel defends subjectivism about well-being and reasons for action: the idea that normativity flows from what an agent cares about, that something is valuable because it is valued. In these essays Sobel explores the tensions between subjective views of reasons and morality, and concludes that they do not undermine subjectivism.

Reuven Leigh provides the first in-depth introduction to the pioneering philosophy of Rabbi Shalom Schneersohn. Bringing him into dialogue with key continental philosophers Emmanuel Levinas, Jacques Derrida and Julia Kristeva, this book reveals how Schneersohn's views anticipated many prominent themes in 20th-century thought. Shalom Schneersohn (1860-1920) was the fifth Rebbe of the Habad-Lubavitch dynasty. He was a traditional, kabbalistic thinker and yet, beyond mysticism, he wrote extensively on speech, gender and the body. So why is he not better known? (...) Leigh begins by uncovering and contesting numerous scholarly assumptions that have operated to exclude traditional rabbinic thinkers from contemporary philosophical debates. Seeking to correct this, this book offers a close reading of Schneersohn's 1898 discourses. With the disruption of traditional binary structures being the dominant theme pervading Schneersohn's work, Leigh challenges Levinas' controversial ideas on the feminine. Examining Schneersohn on language, too, he highlights how Derridean deconstruction involves a more positive approach to presence that was already anticipated in the writings of Schneersohn. And from the disruption of the hierarchy of signification to the semiotic aspect of language and the maternal body, this book demonstrates how Schneersohn foreshadows a number of Kristeva's central philosophical concerns. A wide-ranging and inclusive volume, The Philosophy of Rabbi Shalom Schneersohn demonstrates not only how forward-thinking Schneersohn's ideas were a century ago, but how relevant they still are today. J. Howard Sobel has long been recognized as an important figure in philosophical discussions of rational decision. He has done much to help formulate the concept of causal decision theory. In this volume of essays Sobel explores the Bayesian idea that rational actions maximize expected values, where an action's expected value is a weighted average of its agent's values for its possible total outcomes. Newcomb's Problem and The Prisoner's Dilemma are discussed, and Allais-type puzzles are viewed from the (...) perspective of causal world Bayesianism. The author establishes principles for distinguishing options in decision problems, and studies ways in which perfectly rational causal maximizers can be capable of resolute choices. Sobel also views critically Gauthier's revisionist ideas about maximizing rationality. This collection will be a desideratum for anyone working in the field of rational choice theory, whether in philosophy, economics, political science, psychology or statistics. Howard Sobel's work in decision theory is certainly among the most important, interesting and challenging that is being done by philosophers. (shrink)

In this article I examine a recent approach to regulating assisted reproduction, whereby use of some kind of medical intervention ‘triggers’ laws governing legal parenthood that are more favourable to intending parents and sperm providers. I argue that although perhaps an improvement on the previous legal framework, these laws are problematic for three important reasons. First, they are prone to violating parental rights and unjustly imposing substantial burdens on individuals. Second, they are discriminatory. Third, even if we take a pragmatic (...) approach to the question of parenthood in these cases, these laws fail to properly consider the welfare interests of children. Finally, I conclude by showing that my argument does not entail adopting a laissez-fair attitude to conception using third-party sperm. (shrink)

Chow's defense of NHSTP ignores the fact that in psychology it is used to test substantive hypotheses in theory-corroborating research. In this role, NHSTP is not only inadequate, but damaging to the progress of psychology as a science. NHSTP does not fulfill the Popperian requirement that theories be tested severely. It also encourages nonspecific predictions and feeble theoretical formulations.

It also tests the outer limits of the ethical deployment of power. I. Types of Wars The Jewish ethics of war focuses on two issues: its legitimation and its conduct. The Talmud classifies wars according to their source oflegitimation. Biblically mandated wars (...) are termed mandatory (milhemet mitzvah or milhemet hovah). Wars undertaken at the discretion of the Sanhédrin are termed discretionary (milhemet reshut). There are three types of mandatory wars: Joshua's war of conquest againstthe seven Canaanite nations, the war againstAmaleq, anddefensive wars against an already launched attack. Discretionary wars are usually expansionary efforts undertaken to enhance the political prestige of the government or to secure economic gain. The first type of mandatory war is only of historical interest as the Canaanite nations lost their national identity already in ancient times. This ruling, which appears repeatedly in rabbinic literature, is part ofa tendency to blunt the impact of the seven-nations policy. The Bible points out that these policies were not implemented even during the zenith of ancient Israel's power (Kings 9:20; 2 Chr 8:7-9; see also Judges 1:21-33, Ps 106:34). Indeed, an ancient Midrash explicitly excludes the possibility of transferring the seven-nations ruling to other non-Jewish residents of the Land ofIsrael. Maimonides is just as explicit in emphasizing that all trace 44Reuven Kimmelman of them has vanished. By limiting the jurisdiction of the seven-nations ruling to the conditions ofancient Canaan it was effectively removed from the postbiblical ethical agendaand vitiated as aprecedent forcontemporary practice. The second category ofmandatory war, against Amaleq, has also been rendered operationally defunct by comparing them with the Canaanites, or by postponing the battle to the immediate premessianic struggle, or by viewing them as a metaphor for genocidal evil. The two remaining categories, reactive defensive wars (which are classified as mandatory) and expansionary wars (which are classified as discretionary) remain intact. So, for example, King David's response to the Philistine attackaredesignated mandatory, whereashis wars "to expandthe border of Israel" are designated discretionary. Intermediate wars such as preventive, anticipatory, or preemptive defy so neat a classification. Not only are the classifications debated in the Talmud, but commentators disagree on the categorization of the differing positions in the Talmud. The major clash occurs between the eleventh century Franco-German scholar Rashi and the thirteenth century Franco-Provencal scholar Meiri. According to Rashi, the majority position considers preemptive action to be discretionary whereas the minority position expounded by Rabbi Judah considers it to be mandatory. According to Meiri, a preemptive strike, against an enemy who it is feared might attack or who is already known to be preparing for war is deemed mandatory by the majority ofthe rabbis, but discretionaryby Rabbi Judah. Accordingly, Rabbi Judah defines a counterattack as mandatory only in response to an already launched attack. A similar reading of Maimonides also limits the mandatory classification to a defensive war launched in response to an attack. With these distinctions between mandatory and discretionary wars in mind, we should be able to investigate the Jewish concerns with the problematics ofwarby focusing on preemptive strikes, declarations ofwar, ethics of warfare, and draftability. II. Preemptive Strikes as Self-Defense Not only Machiavellians view the security and survival ofthe state as nonnegotiable. National self-defense is as much amoral right as is personal self-preservation. Whereas it is clear that offensive war cannot be subsumed under the inalienable right of self-defense, the moral status of pre-emptive attacks is not as clear. Is the moral category of self-defense Working Warfare and Its Restrictions in the Jewish Tradition 45 limited to an already launched attack? The majority talmudic position, according to Rashi, and that of Rabbi Judah, according to Meiri, would answer in the affirmative. Their position is seconded by Article 51 of the United Nations Charter, which states: "Nothing in the present Charter shall impair the inherentright ofindividual ofcollective self-defense ifan armed attack occurs against a member." Previous research suggests that children can infer causal relations from patterns of events. However, what appear to be cases of causal inference may simply reduce to children recognizing relevant associations among events, and responding based on those associations. To examine this claim, in Experiments 1 and 2, children were introduced to a “blicket detector,” a machine that lit up and played music when certain objects were placed upon it. Children observed patterns of contingency between objects and the machine's activation that (...) required them to use indirect evidence to make causal inferences. Critically, associative models either made no predictions, or made incorrect predictions about these inferences. In general, children were able to make these inferences, but some developmental differences between 3- and 4-year-olds were found. We suggest that children's causal inferences are not based on recognizing associations, but rather that children develop a mechanism for Bayesian structure learning. Experiment 3 explicitly tests a prediction of this account. Children were asked to make an inference about ambiguous data based on the base rate of certain events occurring. Four-year-olds, but not 3-year-olds were able to make this inference. (shrink)

Sophisticated arguments advanced by Harry Silverstein, David Boonin, and Jeff McMahan attempt to show that being responsible for an individual's existence need not result in an obligation to ensure that the needs of that individual are satisfied. While these arguments take place within the abortion debate, by extension they threaten causal accounts of procreative responsibility more generally. In this article, I defend causal accounts of procreative responsibility by showing that these arguments do not succeed, but without thereby undermining the permissibility (...) of abortion. Further, while being causally involved in the existence of a person is not sufficient for acquiring procreative responsibilities, I argue that there is an especially strong case for ascribing such responsibilities to gamete donors. Libertarian self-ownership views have traditionally maintained that we enjoy very powerful deontological protections against any infringement upon our property. This stringency yields very counter-intuitive results when we consider trivial infringements such as very mildly toxic pollution or trivial risks such having planes fly overhead. Maintaining that other people's rights against all infringements are very powerful threatens to undermine our liberty, as Nozick saw. In this paper I consider the most sophisticated attempts to rectify this problem within a libertarian self-ownership framework. (...) I argue that all of these responses are significantly flawed. Born in a small town in Lithuania, Rabbi Reuven Agushewitz emigrated to the United States in 1929. A Talmudic genius and an autodidact in philosophy, Rabbi Agushewitz published three philosophical works in Yiddish. Ancient Greek Philosophy, the first published but the last to be translated into English, offers a unique blend of clear philosophical principles and a flavorful Yiddish style, which Mark Steiner's translation preserves. Rabbi Agushewitz not only explains what the early Greek philosophers said, he also amplifies their (...) arguments with creative proofs that the ancients themselves did not offer. His attempts to correlate ancient philosophical statements with monotheism will resonate with the modern religious reader. In addition to the present volume, R. Agushewitz's philosophical books are Faith and Heresy and Principles of Philosophy, both published in translation under the auspices of the Michael Scharf Publication Trust of Yeshiva University Press. His volume of Talmudic novellae on Bava Kamma, "Bi'ur Reuven," was published with approbation from both Rabbi Aharon Kotler and Rabbi Joseph B. Soloveitchik. These Talmudic giants differed sharply on their attitude toward the study of philosophy, but they concurred wholeheartedly on the scholarship of R. Agushewitz. (shrink)

Reuven Brandt on anonymity and mitochondrial donation.

“Israel is to blame, and not Oslo,” writes Reuven Kaminer, a longtime member of the Israeli left. The almost instinctual tendency to delegitimize the Palestinian right to determine their future on an equal basis is the source of the current tension, he explains, arguing that the conflict continues today because Israel, backed by the United States - which has repeatedly proven not to be an “honest broker” - refuses to recognize the just national rights of the Palestinian people.

I have based my psychological hypotheses on studies in perception and in personality. Research in these two areas began independently, but by the late forties the supposedly unconnected processes came to be seen as different aspects of one process. For instance, a low tolerance for perceptual ambiguity and cognitive dissonance was found to be significantly correlated with lack of emotional responsiveness, dogmatism, and authoritarianism; conversely, a high tolerance for perceptual ambiguity and cognitive dissonance was found to be significantly correlated with (...) tolerance of emotional ambivalence, openness to new experience, and a liberal world view.1 Later studies, primarily those conducted in the sixties, then established strong correlations between these findings and information-processing styles. Information processing involves three stages: first, stimuli are selected from the environment ; these stimuli are then arranged into "dimensions"; finally, if two or more dimensions result, they are compared and/or combined according to certain rules. H. M. Schroder and his colleagues have established correlations between personality styles and styles of information processing.2 For example, an intolerant personality—that is, one with a low integration index—"identifies and organizes stimuli in a fixed way, and the rules derived from existing schemata are explicit in defining this one way" . What psychologists call an "abstract personality" and identify in terms of "flexibility" or "tolerance of ambiguity"—what in literary studies is most conveniently called "negative capability"—is not necessarily characterized as lacking rules but rather as possessing a greater number of conflicting rules on a lower level which may be accommodated by rules on a higher level. · 1. Rational actions reflect beliefs and preferences in certain orderly ways. The problem of theory is to explain which beliefs and preferences are relevant to the rationality of particular actions, and exactly how they are relevant. One distinction of interest here is between an agent's beliefs and preferences just before an action's time, and his beliefs and preferences at its time. Theorists do not agree about the times of beliefs and desires that are relevant to the rationality of action. Another distinction (...) is between actions that would, in one sense or another, maximize expected utilities given relevant beliefs and desires, and actions, decisions for which would, in one sense or another, be stable. There is disagreement about the relevance of these things to the rationality of actions. Here, in the first part below, several possible positions on these issues are explained and compared. In the second part, I contrast perspectives on these issues, and comment on arguments that might be brought against the position I favor. In the third part, I restate and elaborate on this position. There is much dispute about what we owe the children we are responsible for creating. Some argue that so long as we provide offspring with lives worth living we do no wrong. Others argue that our procreative obligations are weightier and oblige us to provide (or attempt to provide) our offspring with a reasonable opportunity to thrive, or meet some other standard beyond merely providing a life worth living. Our practices and intuitions on this matter are inconsistent. For example, gamete (...) donors who intentionally participate in the project of creating a child are thought to have few obligations to their offspring, but those who create a child accidentally are thought to have weighty obligations. Furthermore, a justification for why we are obliged to provide offspring with more than a life worth living has been elusive. To resolve this puzzle I argue that an under-theorized element of morality, the directed duty of care, explains why we owe our offspring more than a life worth living. (shrink)

In this article I reject the claim that the responsibilities acquired by gamete providers can be transferred to their biological children's intending parents. I defend this position by first showing that arguments in defence of the transferability of responsibilities in gamete provision cases fail to distinguish between the transfer and delegation of responsibility. I then provide an argument against the transferability of responsibilities in gamete provision cases that differs from the ones offered by James Lindemann Nelson and Rivka Weinberg. Though (...) I conclude that gamete providers have inalienable responsibilities towards their biological offspring, I note that the precise ethical and policy implications this has for gamete provision remain somewhat unclear. Dov Fox’s Birth Rights and Wrongs offers a largely compelling argument for expanding the scope of legal actions and remedies available to those whose reproductive choices are wrongfully frustrated by the actions of others. The dominant focus of the book is individuals who, due to the negligence and/or malice of medical professionals, suffer harms arising from reproduction imposed, denied, or confounded. A serious examination of these kinds of injuries is certainly appropriate given that medical professionals are increasingly involved in individuals’ (...) reproductive plans and that serious harms may arise when desired medical interventions are improperly implemented. I will not take issue with the general framework developed by Fox for addressing these kinds of harms. My focus here will be to show that Fox’s arguments have consequences for two kinds of cases that lie beyond the scope of those he explicitly acknowledges. The first is instances of reproductive wrongs that occur outside the confines of the patient/medical practitioner relationship. The second is claims made by children for harms suffered in virtue of being denied contact with their biological parents and/or access to identifying information about their biological parents. This is a theoretical and methodological statement of what isn’t and what is Cognitive poetics. It is focused on Peter Stockwell’s discussion of deixis; but, I claim, much of what I have to say on Stockwell’s work would apply to some degree to the work of many other critics. I argue that Stockwell translates traditional critical terms into a “cognitive” language, but does not rely on cognitive processes to account for issues related to the texts discussed; and that he uses (...) these terms to label or classify poetic expressions rather than point out their interaction in generating poetic effects. The present paper does not presume to tell what is the “correct” way to handle those terms, but attempts to give examples of how the same terms could be used with reference to cognitive processes, so as to account for poetic effects. This book studies how poetic structure transforms verbal imitations of religious experience into concepts. The book investigates how such a conceptual language can convey such non-conceptual experiences as meditation, ecstasy or mystic insights. Briefly, it explores how the poet, by using words, can express the ‘ineffable’. It submits to close reading English, French, German, Spanish, Italian, Armenian and Hebrew texts, from the Bible, through medieval, renaissance, metaphysical, and baroque poetry, to romantic and symbolistic poetry.

One of the central assumptions of the present study is that mystic or religious poetry not just formulates mystic or religious ideas: it somehow converts theological ideas into religious experience, by verbal means. It somehow seems to reach the less rational layers of the mind by some drastic interference with the smooth functioning of the cognitive system, or by a quite smooth regression from ‘ordinary consciousness’ to some ‘altered state of consciousness’. In this way, the experience is affected not only (...) by its contents, but also by the perceived quality of the structure of the underlying mental process. This brings us to recognize that mystic or religious poetry is sometimes of vastly different styles. In my book I distinguish between two prototypes of such styles, those that are based on drastic and on smooth interference, respectively. The present article will examine poems based on a very special kind of drastic disruption, of which George Herbert was the grand master. This prototype uses typographic schemes for disruptions in orientation, activating mechanisms of prelinguistic babbling, delaying connection of signifiers with the signified, and transcending distinctions to go to unity. Also looked at will be psychological and social defenses against these disruptions as well as ways to overcome those defenses. In this article I will consider the relationship between mystic poetry and what Willie van Peer calls ‘typographic foregrounding’. In this relationship, I will suggest, both mystic and aesthetic principles are involved. (shrink)

This review-article of Martha Roth's Law Collections focuses on selected sections in the Laws of Ur-Namma, Eshnunna, Hammurabi, Lipit-Ishtar, and the Neo-Babylonian Laws. It discusses potentially misleading divisions of sections and problems of rendering the term awīlum (lú). It also asserts that students of law will benefit from Roth's translations for generations.

In his Truth and Probability (1926), Frank Ramsey provides foundations for measures of degrees of belief in propositions and preferences for worlds. Nonquantitative conditions on preferences for worlds, and gambles for worlds and certain near-worlds, are formulated which he says insure that a subject's preferences for worlds are represented by numbers, world values. Numbers, for his degrees of belief in propositions, probabilities, are then defined in terms of his world values. Ramsey does not also propose definitions of desirabilities for propositions, (...) though he is in a position to do this. Given his measures for probabilities of propositions and values of worlds, he can frame natural definitions for both evidential and causal desirabilities that would measure respectively the welcomeness of propositions as items of news, and as facts. His theory is neutral with respect to the evidential/causal division. In the present paper, as Ramsey's foundations are explained, several problems and limitations are noted. Their distinctive virtue – their evidential/causal neutrality – is demonstrated. Comparisons are made with other foundational schemes, and a perspective is recommended from which nonquantitative foundations are not the be all for quantitative theories of ideal preferences and credences. The Institute of Medicine has recently endorsed arguments put forward by John Appleby calling for mandatory sex selection against female offspring in the initial trials of mitochondrial replacement techniques. In this paper I argue that, despite this endorsement, the reasons offered by Appleby for mandatory sex selection are inadequate. I further argue that plausible revisions to Appleby's arguments still fail to convincingly defend such an intrusive policy. While I remain neutral about whether intending parents making use of mitochondrial replacement techniques (...) ought to have access to sex selection, I conclude that to date the case for mandatory sex selection has not been satisfactorily made. Consequentialism, many philosophers have claimed, asks too much of us to be a plausible ethical theory. Indeed, the theory's severe demandingness is often claimed to be its chief flaw. My thesis is that as we come to better understand this objection, we see that, even if it signals or tracks the existence of a real problem for Consequentialism, it cannot itself be a fundamental problem with the view. The objection cannot itself provide good reason to break with Consequentialism, because it (...) must presuppose prior and independent breaks with the view. The way the objection measures the demandingness of an ethical theory reflects rather than justifies being in the grip of key anti-Consequentialist conclusions. We should reject Consequentialism independently of the Objection or not at all. Thus, we can reduce by one the list of worrisome fundamental complaints against Consequentialism. (shrink)

According to a familiar argument, iterated prisoner's dilemmas of known finite lengths resolve for ideally rational and well-informed players: They would defect in the last round, anticipate this in the next to last round and so defect in it, and so on. But would they anticipate defections even if they had been cooperating? Not necessarily, say recent critics. These critics "lose" the backward-induction paradox by imposing indicative interpretations on rationality and information conditions. To regain it I propose subjunctive interpretations.
