To mark the 70th anniversary of the adoption of the Universal Declaration of Human Rights, the author embarked on an attempt to analyze the theoretical and historical framework that contributed to the adoption of the document. The first part of the article discusses the development of the philosophy of personalism from Mounier to Maritain and analyzes Maritain’s views on human rights. In the second part of the article, the author shows the decisive influence of the personalists Charles Malik and Rene (...) Cassin on the adoption of the document, which clearly bears the mark of the Christian personalistic discourse and notions. (shrink)

This paper presents a dynamic perspective in which the psychological contract is treated as a structured set of beliefs that are held by individual employees about the mutual obligations of the organization as employer and themselves as employees. This set of beliefs is assumed to produce a state of commitment to the organization in which the employee is willing to accept work roles and tasks offered by the organization, and to carry them out in accordance with certain standards. The dynamic (...) model that is presented can help to explain why the commitment of employees remains relatively stable over time, and why it may suddenly decrease or increase under circumstances that are perceived as critical by the employee. The model assumes that the employee's evaluation of the organization's behavior changes over time, but that the structure of the psychological contract and the associated commitment change only when certain limits are overstepped. This perspective on changes in the psychological contract transforms the concept into a powerful construct that may lead to fruitful research on the dynamics of organization-employee relationships. Representationalists hold that the phenomenal character of a perceptual experience is identical with, or supervenes on, an aspect of its representational content. As such, representationalism could be disproved by a counter-example consisting of two experiences that have the same representational content but differ in phenomenal character. In this paper, I discuss two recently proposed counter-examples to representationalism that involve ambiguous or reversible figures. I pursue two goals. My first, and most important, goal is to show that the representationalist can offer (...) plausible responses to both counter-examples. My second goal is to show the implications of these responses for the nature of the spatial representational contents of perceptual experiences. (shrink)

Perceptual experiences inform us about objective properties of things in our environment. But they also have perspectival character in the sense that they differ phenomenally when objects are viewed from different points of view. Contemporary representationalists hold, at a minimum, that phenomenal character supervenes on representational content. Thus, in order to account for perspectival character, they need to indentify a type of representational content that changes in appropriate ways with the perceiver’s point of view. Many representationlists, including Shoemaker and Lycan, (...) argue that such contents are best construed in terms of mind-dependent properties. Other representationalists, including Tye and Dretske, hold that these contents involve only mind-independent properties. Susanna Schellenberg has recently developed an account of perceptual experience that would serve these latter representationalists extremely well. She suggests that we can do justice to the perspectival character of perceptual experience by appeal to representations of a certain type of relational properties, so-called ‘situation-dependent properties.’ In this paper, I critically engage with Schellenberg’s proposal in order to show how mind-independent representationalists can explain perspectival character. I argue that appeal to situation-dependent properties is problematic. I then show that mind-independent representationalists can account for perspectical character by means of scenario contents in Christopher Peacocke’s sense. (shrink)

Which properties can we visually experience? Some authors hold that we can experience only low-level properties such as color, illumination, shape, spatial location, and motion. Others believe that we can also experience high-level properties, such as being a dog or being a pine tree. On the basis of her method of phenomenal contrast, Susanna Siegel has recently defended the latter view. One of her central claims is that we can best account for certain phenomenal contrasts if we assume that we (...) can visually experience natural kind properties. In this paper, I argue that certain kinds of low-level properties, namely shape-gestalt properties, can explain these phenomenal contrasts just as well as high-level properties. If successful, this is a modest, but nevertheless significant result. Even though it does not prove the falsity of Siegel’s proposal, it nevertheless secures the existence of a plausible alternative. In this highly original book, René Brouwer shows how jurists transformed the study of law into a science with the help of philosophical methods and concepts, such as division, rules and persons, and also how philosophers came to share the (...) jurists' preoccupations with cases and private property. The relevance of this cross-fertilization for present-day law and philosophy cannot be overestimated: in law, its legacy includes the academic study of law and the Western models of dispute resolution, while in philosophy, the method of casuistry and the concept of just property. Degree-sentences, i.e. sentences that seem to refer to things that allow of degrees, are widely used both inside and outside of philosophy, even though the metaphysics of degrees is much of an untrodden field. This paper aims to fill this lacuna by addressing the following four questions: [A] Is there some one thing, such that it is degree sensitive? [B] Are there things x, y, and z that stand in a certain relation to each other, viz. the relation that x (...) has more y than z? [C] In those cases in which degree sentences do not refer to phenomena that are degree sensitive, what is responsible for their prima facie seeming to do so? [D] If there are degree sensitive things, to which ontological categories do they belong? We answer each of these questions by arguing that there are, metaphysically speaking, different phenomena that degree sentences refer to: some refer to determinates that emanate from a certain determinable, others to tokens that are instantiations of a certain type, and yet others to what we call ‘complex, resultant properties that are constituted by stereotypical properties’. Finally, we show the relevance of our answers by applying them to the notions of freedom and belief. (shrink)

Ce traite, qui s'appuie sur un resume de la biologie cartesienne, s'oriente vers une medecine concrete des affections psycho-physiologiques et s'epanouit en une apologie de la generosite. Aux observations scientifiques, Descartes ne dedaigne pas d'adjoindre des notations psychologiques dont la finesse evoque parfois ces maximes qui fleurissaient dans les salons au XVIIe siecle. Ainsi l'ampleur des conclusions scientifiques, morales et metaphysiques, sources (...) d'etudes toujours renaissantes pour les specialistes, se colore par surcroit d'une richesse vecue qui fait de ce Traite, ecrit pour une princesse et offert a une reine, le modele des ouvrages accessibles au plus grand public. We give a procedure for counting the number of different proofs of a formula in various sorts of propositional logic. This number is either an integer (that may be 0 if the formula is not provable) or infinite.

Many viewers presented with a round plate tilted to their line of sight will report that they see a round plate that looks elliptical from their perspective. Alva Noë thinks that we should take reports of this kind as adequate descriptions of the phenomenology of spatial experiences. He argues that his so‐called enactive or sensorimotor account of spatial perceptual content explains why both the plate's circularity and its elliptical appearance are phenomenal aspects of experience. In this paper, I critique the (...) phenomenal adequacy of Noë's sensorimotor account of spatial perceptual content. I begin by showing that some of its central claims are in conflict with the phenomenology of perceptual experience. I then argue that shape appearances have no phenomenal reality, thus undermining this central motivation for his account. (shrink)

The identification of plausible epistemic approaches in science as well as the social problem definitions with which scientists implicitly work is essential for the quality of a deliberative public policy. While responding to the Nanofutures project, I will reflect on the essential elements of such a policy.

La nature du projet de Danielle Lories est exposée clairement dans les premières pages de l’ouvrage. L’auteure situe les origines de son entreprise dans la volonté d’affronter la difficulté que présente la notion de «sens commun», aux paragraphes 18, 22 et 40 de la Critique de la faculté de juger de Kant, mais aussi le propos de Hannah Arendt tiré de «La crise de la culture» qu’elle cite en page 2, sur la jonction des sens communs kantien et aristotélicien. Ce (...) qui préoccupe essentiellement l’auteure, dans la pers-pective d’une pensée de la «spécificité du jugement praxique», est ici la façon dont s’articulent le sens commun en tant qu’unification de l’expérience sensorielle par-delà la diversité des cinq sens, et le sens communautaire en vertu duquel nous communions dans une même appréhension du réel, la constitution d’un rapport au réel étant d’abord affaire de sens: «Chez Arendt, tout se passe comme si le partage des choses perçues avec autrui et donc leur réalité “objective” était le prolongement naturel du partage d’une même chose perçue par nos divers sens». En arrière-plan de l’entreprise figure un intérêt pour les rapports entre jugements pratique et esthétique. L’auteure se trouve amenée à traiter d’Aristote, et entend montrer que si chez lui le sens commun du De anima et des Parva naturalia est bien un sens global du réel, il n’a guère encore cette dimension communautaire que présente en revanche la φρόνησισ, «excellence du jugement pratique et excellence politique», laquelle φρόνησισ se trouve en continuité avec la discrimination perceptive unitaire, dans la mesure où pour l’une comme pour l’autre, l’objet est le particulier du monde réel perçu. Danielle Lories est également conduite à examiner si, entre le livre VI de l’Éthique à Nicomaque, d’une part, et la Critique de la faculté de juger d’autre part, il n’y a «rien qui vaille mention». Ayant travaillé sur Shaftesbury, un des pères britanniques de la philosophie du sens commun, sous l’espèce notamment du sens moral, par ailleurs précurseur du désintéressement esthétique kantien, et enfin lecteur d’Épictète, l’auteure se trouve orientée dans la direction de sa source stoïcienne. De là cette fois, malgré l’obstacle apparent que constitue le fait pour le stoïcisme de s’apparenter davantage au platonisme qu’à l’aristotélisme en concevant la φρόνησισ comme une science et en l’identifiant à la σοφία, tout en faisant en outre à peu près silence sur l’αἴσθησισ κοινή, l’idée d’«étudier l’éventuel apport du stoïcisme — ancien — à l’analyse du jugement pratique — celui du phronimos au sens où l’entendait Aristote», la thèse étant que la marque du stoïcisme dans l’histoire de la pensée occidentale du jugement pratique «consiste à faire converger dans ce jugement plusieurs formes de “sens commun” dont certaines sont dérivées de l’aisthèsis koinè ou encore de la phronèsis aristotéliciennes». Le discours éthique est à la mode, nourri de craintes et de plaintes, de précautions vertueuses, de pétitions de principes. Dans le champ médical, il apparaît comme réservé aux questions touchant à la maîtrise de la vie, aux cas difficiles excédant les régulations coutumières, aux soignants spécialistes de soins particuliers (procréation, greffes... ). Peut-on parler d'une éthique de la pratique quotidienne d'un soin à donner, d'un geste à faire, d'un mot à dire, au chevet d'un malade, dans une consultation pour (...) un trouble banal, un acte de soin infirmier habituel, un exercice rééducatif ordinaire, d'une éthique de la clinique partageable par tous les soignants? Dans le champ clinique, le discours psychologique est proposé pour comprendre ce qui advient, venu de l'autre ou de soi, dans la relation singulière initiée par une souffrance et une demande de soin. Est-il un appui suffisant? L'auteur ne prétend donner ni réponse, ni modèle. A partir de l'analyse des cadres convenus, thérapeutique, déontologique, juridique, éthique, il invite au questionnement des discours, des théories et des pratiques, à une réflexion sur le " bon pour la vie " et le " bien pour l'homme ". Il appelle les intervenants dans le champ du soin, soignants, mais aussi gestionnaires, législateurs, juristes, à penser ensemble une visée éthique du soin de l'humain, à l'intégrer dans un " vivre ensemble " fondé sur la possibilité d'une conscience interrogative, réflexive et critique.
