Although the principle of fair subject selection is a widely recognized requirement of ethical clinical research, it often yields conflicting imperatives, thus raising major ethical dilemmas regarding participant selection. In this paper, we diagnose the source of this problem, arguing that the principle of fair subject selection is best understood as a bundle of four distinct sub-principles, each with normative force and each yielding distinct imperatives: (1) fair inclusion; (2) fair burden sharing; (3) fair opportunity; and (4) fair distribution of (...) third-party risks. We first map out these distinct sub-principles, and then identify the ways in which they yield conflicting imperatives for the design of inclusion and exclusion criteria, and the recruitment of participants. We then offer guidance for how decision makers should navigate these conflicting imperatives to ensure that participants are selected fairly. (shrink)

This book defends the fundamental place of the marital family in modern liberal societies. While applauding modern sexual freedoms, John Witte, Jr also defends the traditional Western teaching that the marital family is an essential cradle of conscience, chrysalis of care, and cornerstone of ordered liberty. He thus urges churches, states, and other social institutions to protect and promote the marital family. He encourages reticent churches to embrace the rights of women and children, as Christians have long taught, and (...) encourages modern states to promote responsible sexual freedom and family relations, as liberals have long said. He counsels modern churches and states to share in family law governance, and to resist recent efforts to privatize, abolish, or radically expand the marital family sphere. In their article on the limited duty to reinterpret genetic variants, Watts and Newson argue that clinical labs are not morally obligated to conduct routine reinterpretation despite its potential clinical and personal value.1 We endorse the authors’ argument for a circumscribed duty to reclassify genomic variants in certain cases, including to promote diagnostic equity for racial and ethnic minority populations that have been historically excluded from and exploited by genomic research and medicine. However, given the history and resilience of scientific (...) racism, the use of socially constructed racial and ethnic categories to enhance diagnostic equity raises several ethical and practical challenges. In the short term, using socially constructed racial and ethnic categories to identify patients for variant reclassification is a practical approach for addressing concerns of diagnostic equity. In contrast, diagnostic accuracy depends on patients’ genetic similarity to reference genomes, rather than their socially determined race or ethnicity.2 Thus, in the long term, securing both diagnostic equity and diagnostic accuracy through targeted variant reclassification will require a shift away from relying on race and ethnicity and towards assessing genetic similarity. Heute dominieren vereinseitigende Selbstbeschreibungen des Menschen, die ihn gentechnologisch, radikalkonstruktivistisch oder hirnphysiologisch auf sein biologisches Substrat reduzieren. Die Polyphonie, die man noch um 1800 in der Beschreibung des Menschen als das Zugleich von Körper und Geist hören konnte, weicht einer Einstimmig- und Einsinnigkeit kraft einer nur noch naturwissenschaftlichen Selbstthematisierung. Hieran ist zu erinnern, wenn man für die Zeit um 1800 festhält, dass sich die Denker zwar um solch disziplinäre Grenzen zwischen Naturgeschichte, Philosophie und Literatur nicht kümmerten, aber gerade dadurch der (...) Vielstimmigkeit einen Raum eröffneten. Die Verwendung des „Bildungstriebes“ in unterschiedlichen Zusammenhängen ist hierfür ein beredtes Zeugnis. Die vorliegende Arbeit zum „Bildungstrieb“ will und kann bisherige Rekonstruktionen des Bildungsbegriffs keineswegs ersetzen, sondern bestenfalls ergänzen. Damit aber werden im „Bildungstrieb“ Wurzeln des Bildungsbegriffs wieder in Erinnerung gerufen, die jenseits einer rein kognitiven, mentalen, subjektivistischen Zurichtung von „Bildung“ liegen. ***** Today, the dominant feature of the self-description of humans is one that confines them to their biological substrate. Genetic engineering, radical constructivism or brain physiology are among those disciplines which advocate such a perspective. The polyphonic descriptions of human beings around 1800, pointing out the simultaneity of body and mind, fall silent in favour of a one-sided and limited purely scientific self-thematization. Around 1800, due to their non-compliance regarding disciplinary boundaries between natural history, philosophy and literature, thinkers opened up a space for polyphony. The use of the “Bildungstrieb” (nisus formativus) in various contexts is eloquent evidence for this. The present volume on the “Bildungstrieb” does not and cannot replace previous reconstructions of the concept of “Bildung”, but at best complements them by drawing the reader’s attention once again to the roots of the concept of “Bildung” in the “Bildungstrieb” that lie beyond a purely cognitive, mental, subjectivist understanding of “Bildung”. When young children first come to school they bring with them a depth of being; the authors suggest that the educational community should respond to children with a pedagogy that is capable of nurturing this depth. The authors of this paper are teachers of many years’ experience. Their own work in classrooms has shown them that, paradoxically, depth in pedagogy is most surely to be found when teachers follow the light in the eyes of children. The authors draw upon a (...) selection of vignettes and narratives taken from classroom experiences to describe how this is done. They also show how children and teachers can approach the complex learning that requires transcendence of the known. Notions of relational consciousness (), as well as ethical and spiritual sensibility () are developed through reference to a range of educators including Bronson Alcott, Ralph Waldo Emerson, John Dewey, Stanley Cavell, Maxine Greene, Nell Noddings, Vivan Paley and Arthur Vogel. The broader educational community is reminded that school experiences should balance the measurable and the immeasurable. The authors question some aspects of the, sharing their concern that it may focus teachers’ attention too tightly on ‘that which is formed from without’. The authors suggest that the weight of this legislation may result in the neglect of some very important aspects of learning. The broader educational community is invited to consider the implications of a pedagogy of depth, to become more aware of the skill of transcending known limitations through coming to shared understanding, and to find ways to reconcile the potential violence of legislated structures with the being‐in‐the‐world of children in schools. In this note, we review paradoxes like Russell’s, the Liar, and Curry’s in the context of intuitionistic logic. One may observe that one cannot blame the underlying logic for the paradoxes, but has to take into account the particular concept formations. For proof-theoretic semantics, however, this comes with the challenge to block some forms of direct axiomatizations of the Liar. A proper answer to this challenge might be given by Schroeder-Heister’s definitional freedom.

Was die Frage nach der Funktion der Sprache im Erkenntnisprozeß betrifft, haben wir zuerst die verschiedenen Theorien dargestellt. Nach einer Reihe alleinstehender Personen wie Derbolav, Bühler, Jost, Glinz behandeln wir die Strömungen der symbolischen Logik und der linguistic analysis. Die symbolische Logik will das Denken in einer logischen Modellsprache analysieren. Die linguistic Analysis betrachtet die gewöhnliche Umgangssprache als Trägerin des Denkens und will, daß alle Philosophen und Wissenschaftler sich in dieser gewöhnlichen Umgangssprache ausdrücken, die bei guter Analyse für jeden intelligenten (...) Menschen verständlich ist. Die Strömungen der Phänomenologie und des Existentialismus äußern die Erfahrung, daß der Mensch seine Existenz ganz in einer sprechenden Welt erfährt und daß sich seine Existenz in der Sprache vollzieht : die Sprache ist das Haus seines Daseins. Keine Sache kann in unserem Bewußtsein zur Existenz gelangen, wenn wir sie nicht zu Wort bringen können. Die Ethnolinguisten und Psycholinguisten sind zu dem Ergebnis gekommen, daß die Formen, in denen ein Mensch jeweils denkt, von den unerbittlichen und unentrinnbaren Strukturen der Wörter mit ihren Bedeutungen und den Strukturen der Wortkombinationen kontrolliert werden. Diese Strukturen sind die Strukturen der jeweiligen Muttersprache. Das Denken eines Menschen vollzieht sich in seiner Sprache. Die Strukturen der Sprache liefern die Modelle für das Denken, für die Analyse der Eindrücke. Unser ganzes Denken bewegt sich in einer denkerisch-sprachigen Welt. Jedes Denken muß sich in Sprachstrukturen kanalisieren lassen. Die Sprache ist das formgebende Organ des Denkens. Die Denkanalyse vollzieht sich in Sprache. In einem bestimmten Augenblick der Entwicklung des Kindes begegnen sich Sprache und Denken ; dann wird das Denken „sprachig” und das Sprechen „denkerisch”. Von nun an werden die meisten Reize der physischen Welt durch ein sprachiges zweites Reizsystem gefiltert ; die Reize werden „in Sprache übersetzt”. Dieser Sprachfilter ist auch in der Analyse nach der dynamischen Erfassung der Reize vorhanden. Diese Daten aus den Theorien der Linguistic Analysis, der Phänomenologie, des Existentialismus, der Ethnolinguistik und Psycholinguistik kann man in direkte Verbindung bringen mit der neoklassischien Theorie, die über ein Erfassen von Erkenntnis-Daten in einer Intuition spricht, die implizit die Möglichkeit zu einem Explizitieren und Analysieren enthält. Somit kommen wir zu folgendem Schema : Reize, sprachiger Empfangsapparat ↓ Erfassung der Reize, Konzeption, Sicht ↓ Denk-Sprachanalyse ↓ Die phonische Äußerung der Denk-Sprachanalyse. While the Historische Kulturwissenschaft is introduced as a new way of writing history the question has to be answered what Kultur means or how it should be interpreted. The paper deals primarily with the special German notion of ‘Kultur’. The distinction between ‘intension’ and ‘extension’ is made and contrasted with both the narrow and the wide concept of ‘Kultur’. Writing history as new cultural history is shaped at least by five aspects: space, perspective, language, acting and time which are discussed (...) in this thesis. The intension of ‘Kultur’ in Historische Kulturwissenschaft leads to popularisation. The sense of the popular approach to history emphasizes modality in the conception and writing of history. In his introductory paper to first-order logic, Jon Barwise writes in the Handbook of Mathematical Logic :[T]he informal notion of provable used in mathematics is made precise by the formal notion provable in first-order logic. Following a sug[g]estion of Martin Davis, we refer to this view as Hilbert’s Thesis.This paper reviews the discussion of Hilbert’s Thesis in the literature. In addition to the question whether it is justifiable to use Hilbert’s name here, the arguments for this thesis are compared with (...) those for Church’s Thesis concerning computability. In his Complaint of Peace, the great sixteenth-century humanist Erasmus allows "Peace" to talk. Peace speaks as a plaintiff, protesting her shabby treatment at the hands of humankind and our ever-ready inclination to launch wars. Against this lure of warfare, Erasmus pits the higher task of peace-building, which can only succeed through the cultivation of justice and respect for all human life. First articulated in 1517, the complaint of peace has echoed through subsequent centuries and down to our age--an age (...) convulsed by world wars, holocausts, and ethnic cleansings. Distinguished political scientist Fred Dallmayr traces this complaint from the writings of Erasmus through the evolution of the "law of nations" to recent and contemporary co-plaintiffs in the West. He also highlights the role of non-Western thinkers and teachings in giving voice to "Peace." In addition to Erasmus, Dallmayr engages major thinkers such as Francisco de Vitoria, Hugo Grotius, Immanuel Kant, Hannah Arendt, Martin Heidegger, Mahatma Ghandi, the Dalai Lama, John Rawls, and Martha Nussbaum. This book is a protest against some geopolitical agendas that are pushing the world toward a major global war and possibly toward a nuclear apocalypse. As an antidote, Fred Dallmayr issues a call to people everywhere to oppose this rush to destruction and to restore the "wholeness of humanity" through the quest for just peace.

There is a gap between two different modes of computation: the symbolic mode and the subsymbolic (neuron-like) mode. The aim of this paper is to overcome this gap by viewing symbolism as a high-level description of the properties of (a class of) neural networks. Combining methods of algebraic semantics and non-monotonic logic, the possibility of integrating both modes of viewing cognition is demonstrated. The main results are (a) that certain activities of connectionist networks can be interpreted as non-monotonic inferences, and (...) (b) that there is a strict correspondence between the coding of knowledge in Hopfield networks and the knowledge representation in weight-annotated Poole systems. These results show the usefulness of non-monotonic logic as a descriptive and analytic tool for analyzing emerging properties of connectionist networks. Assuming an exponential development of the weight function, the present account relates to optimality theory – a general framework that aims to integrate insights from symbolism and connectionism. There is a continuing irresolution on the levels, both of theory and political praxis, vis-à-vis a coming to terms with the problem of 'historical greatness'. This results from the pre-history of a concept which is, when seen in the context of a systematic theory of science, in two respects methodologically unsatisfactory. 1. The pre-idealist understanding of "greatness", in the sense of canonical exemplariness, is based on a timeless concept of morality, itself determined through a heteronomous concept of norm-giving transcendence and/or (...) nature. 2. The philosophy of history ignores the Kantian reference to the autonomy of the genesis of human orientation; instead it sees this genesis not as the expression of a potentially autonomous normativity but as a source of normative existential orientation. In this orientation the goal and the steps towards the goal are pre-reflexively implied. In the philosophy of history the 'historically great' function as genial mediators between telos and epoché. Their actions are not explicable by the categories of normal rationality. The lack of a sufficient methodology of socially practicable communication continues to lessen the chances of overcoming the practical and theoretical dependency on the idea of the mediating genius. Yet the shift to a critical social hermeneutic remains impossible as long as hermeneutic theory is willing to deny itself in the face of a purely scientistic analytic philosophy. (shrink)

Man rekonstruierte das Werk detailliert in seinen Brüchen und Kontinuitäten und ordnete es in den historischen Kontext der Zeit ein. Schmitt wurde als Akteur entdeckt. Der vorliegende kooperative Kommentar will zur theoretischen Auseinandersetzung zurückführen, indem er dessen Schlüsselschrift "Der Begriff des Politischen" in ihrer internen Kohärenz und Systematik prüft und ihre Reichweite auslotet.
