The Nursing and Midwifery Council, the United Kingdom regulator of nursing and midwifery has recently revised its professional code of practice. This article begins by arguing that a professional code must be capable of sustaining close reading and of action guidance. Using four exemplar clauses, it is argued that the new revised code does not meet this purpose. First, I show that in setting out requirements for consent and documentation, the meaning of the relevant clause has changed significantly during the (...) editing process so that a literal reading of the final document bears little relation to established professional practice. Second, I argue that the clause concerning the nature of professional relationships has also been altered during the editing process so that it is inconsistent with other professional groups and established accounts of the professional nurse–patient relationship. Third, I argue that the clause concerning disclosure of confidential information, which survived revision and editing with its meaning intact, is nevertheless factually incorrect and inconsistent with UK law and authoritative guidance. Finally, fourth, I argue that use of the word ‘inappropriate’ is inappropriate as it amounts to meaningless circularity, discussed in relation to a clause on expressing personal beliefs. Taken together, these examples demonstrate that the Code is seriously flawed and does not fulfil its purpose. One way that simple prescriptive clauses in the Code can be usefully understood is through the provision of detailed guidance. I argue that the Nursing and Midwifery Council has changed its position on its view of the value of guidance and has significantly reduced the amount of written guidance and advice it provides. The article concludes by arguing that in order to meet its action directing function, further clarifying revision and the provision of detailed guidance is required. (shrink)

Despite the end of the Cold War and the ascendancy of liberal democracy celebrated by Francis Fukuyama as “the end of history”, a growing number of scholars and political activists point to its inherent shortcomings. However, they have tended to dismiss it on the basis of one or two of its salient weaknesses. While this is a justifiable way to proceed, it denies the searching reader an opportunity to see the broad basis for the growing rejection of liberal democracy among (...) African political theorists. Consequently, in this article, I argue that from an African perspective, the almost hegemonic status of liberal democracy can be challenged on at least five grounds, namely, logical inconsistency, impracticability due to the largely communalistic outlook of many africans, inconsistency between affirmation and action, violation of the right to ethnic identity, and the moral imperative to assert the right to cultural emancipation. -/- I conclude by calling upon African and Africanist political theorists to utilise indigenous African political thought, coupled with emancipatory aspects of political thought from other parts of the world, to design practicable models of democracy for contemporary African states. I further conclude that in order to promote genuine inter-cultural dialogue on democratisation, people from Western cultures ought to acknowledge the equality of all cultures, and to recognise that systems of governance are part and parcel of those cultures. This article criticizes Mathias Risse and Richard Zeckhauser's recent utilitarian defense of racial profiling. I use a novel thought-experiment to argue that even if a negative phenomenon could be reduced by profiling members of certain groups who happen to be disproportionately associated with it, the practice can be implausible. Specifically, I explore the possibility that in a given society, platinum blondes have a higher per capita incidence of a serious sexually transmitted disease, D. And I argue that doctors and health (...) officials in the society would not be justified in profiling such blondes, given that there is nothing about being a platinum blonde that causes one to have D. This essay develops a Rahnerian view of kairos and proposes its contemporary utility in addressing the multiple prophetic calls to action in our media-saturated environment. In Rahner’s theology, kairos is the time of grace and opportunity, inaugurated by the event of Jesus Christ, in which each human person must accept or reject God’s loving self-communication. Because the chronos of daily life takes place within the kairos of Jesus Christ, there is kairos in every moment of chronos. Thus, the typical depiction (...) of chronos and kairos is inverted. Instead of occasional moments of kairos interrupting the ongoing stream of chronos, Rahner portrays chronos as set within the larger reality of kairos. Our chronos takes place within the kairos of Jesus Christ. Such a view does not mitigate or prioritize the many prophetic calls contemporary Christians receive. It can, however, place them in appropriate theological context of the history of God that succeeds. Kairos is a reality created by God’s salvific activity and an opportunity to participate in the salvific love of God. (shrink)

Using tombstoning (jumping from a height into water) as an example, this article claims that public health policies and health promotion tend to assess the moral status of activities following a version of health maximizing rule utilitarianism, but this does not represent common moral experience, not least because it fails to take into account the enjoyment that various health effecting habits brings and the contribution that this makes to a good life, variously defined. It is proposed that the moral status (...) of health threatening activities should instead be defined by a version of act utilitarianism where both maximizing value and method of calculation are decided by individuals. In this account personal responsibility for health is reduced to the obligation to undertake calculations effectively, comprising of two duties; epistemic and reflective. If there is an individual epistemic duty, it is plausible to suggest that health promotion should present information in a way which facilitates it, but despite the prevalent language of autonomous choice, discussion of health promotion messages, for example, related to drinking and smoking demonstrates that this currently does not happen. Health promotion strategies should seek to encourage reflection about the harm our health effecting behaviour causes others. (shrink)

The human face conveys a myriad of social meanings within an overlapping array of features. Herein, we examine such features within the context of gender-emotion stereotypes. First we detail the pervasive set of gender-emotion expectations known to exist. We then review new research revealing that gender cues and emotion expression often share physical properties that represent a confound of overlapping features characteristic of low versus high facial maturity/dominance. As such, gender-related facial appearance and facial expression of emotions often share social (...) meaning and physical resemblance. Thus, stereotypic and phenotypic information conveyed by the face are intertwined—sometimes confounded, sometimes clashing. We discuss implications of this work for gender-emotion stereotypes, as well as for emotion and face processing more generally. (shrink)

The classical literature on Confucianism exhorted leaders to practice five core virtues as the basis for becoming a noble person and for sustaining harmonious communities built on trust and good example. We present a theory about how the senior management in modern corporations, by enacting the five Junzi virtues through virtuous environmental, social, and governance policies and practices, might inspire virtue-based relationships between superiors and subordinates and between employees. We argue that if middle managers and employees observe and experience that (...) their firm’s ESG policies and practices are virtuous, they would feel encouraged to practice those virtues in their own behavior, and thus embody and promote interpersonal harmony. We provide three types of illustration for our theory. First, we map the five Junzi virtues to the content of a specimen ESG report. Second, we map seven subtypes of servant leadership behavior of middle managers to the five Junzi virtues. Third, we map seven types of employee organizational citizenship behavior to the five Junzi virtues. (shrink)

For decades the study of social perception was largely compartmentalized by type of social cue: race, gender, emotion, eye gaze, body language, facial expression etc. This was partly due to good scientific practice, and partly due to assumptions that each type of social cue was functionally distinct from others. Herein, we present a functional forecast approach to understanding compound social cue processing that emphasizes the importance of shared social affordances across various cues. We review the traditional theories of emotion and (...) face processing that argued for dissociable and noninteracting pathways, as well as more recent evidence for combinatorial processing of social cues. We argue here that early, and presumably reflexive, visual integration of such cues is necessary for adaptive behavioral responding to others. In support of this claim, we review contemporary work that reveals a flexible visual system, one that readily incorporates meaningful contextual influences in even nonsocial visual processing, thereby establishing the functional and neuroanatomical bases necessary for compound social cue integration. Finally, we explicate three likely mechanisms driving such integration. Together, this work implicates a role for cognitive penetrability in visual perceptual abilities that have often been ascribed to direct encapsulated perceptual processes. (shrink)

When a Jehovah’s Witness patient is traumatically injured, the lack of uniform professional consensus guidelines and the cultural knowledge deficit of many clinicians adds an additional layer of legal and ethical complexity to the inherent difficulty of managing a critically ill patient. We present here the case of an incapacitated Jehovah's Witness patient with severe traumatic hemorrhagic shock. We go on to discuss the historical and contemporary case law on proxy refusal of blood transfusion for the incapacitated adult, as well (...) as the ethics of self-determination and the application of the principle of proportionate reason in the management of the critically injured Jehovah's Witness patient. This essay explores elements of the relationship between feminist activism and feminist theory focused on language. I examine the autobiographies of two seventeenth century Quaker women who were activists, and then use the writings of Luce Irigaray to interpret their work. For both the Quaker autobiographers and the French feminist philosopher, the concrete oppression of women is connected to the primacy of the word in western culture. Drawing on these sources, I argue that given the masculine economy of language, resisting (...) the dominance of men can be profoundly related to resisting the unrivalled primacy of the written word. The discursive disruption called for by feminist theory can be perhaps most profoundly accomplished with embodied action, while the activist concerns of feminism achieve greater potency when social action is also used to subvert discourse. Responding to Richard Lennan’s paper, this short essay highlights three elements of Rahner’s work on ecclesiology: sacramentality, heresy, and mission. In Lennan’s account, the first two of these call for self-reflection and self-criticism. Viewing church as sacramental, rather than as a continuation of the incarnation, is important for Rahner because it makes room for ongoing self-criticism. Rahner even turns the category of heresy into an opportunity for self-reflection rather than the condemnation of others, asking how the church offers a compelling (...) “yes” as well as a guiding “no.” The third element of Rahner’s ecclesiology that Lennan engages is mission. Rahner’s work does not fit neatly into traditional notions of evangelism or contemporary typologies of mission. In Lennan’s rendering, however, Rahner’s ecclesiology provides a powerful view of mission as persistent, embodied hope. This view of mission—appropriate to a self-critical and self-reflective church—might be precisely what is needed today. (shrink)

Learning outcomes currently play an increasingly important role in higher education. This paper identifies a number of key issues that need to be taken into account in identifying and making use of them. It includes a review of the background from which learning outcomes have emerged. It also highlights the behaviourist approach underlying their use in teaching and assessment and identifies key issues that need to be taken into account in adopting such an approach.

Employees with self-perceived misattributed culpability or incompetence are on the receiving end of complaints, reprimands, or accusations which, from their perspective, incorrectly assume that that they have fallen short of required standards or outcomes. We analyzed an archive of 23 personal stories featuring SMCI, which had been provided by 16 Hong Kong Chinese employees. The stories indicated that the most severe impacts on employee morale had arisen from punitive and targeted feedback based on misrepresentations by superiors, who had engaged in (...) blame deflection, politicking and manipulation, conflict and retaliation, and/or prejudice and stereotyping. We also identified organizational processes, such as soliciting and accepting voice and engaging in problem solving discussions that could attenuate any adverse emotional impact. (shrink)

This article challenges an important argument in the abortion debate, according to which at least early abortions are acceptable because they do not terminate the actual existence of something of moral significance (i.e., a ‘person’), but rather prevent a potentially significant entity from becoming actual, which happens whenever one uses contraceptives.This article argues that insofar as we see something as morally significant or valuable, we tend to think it wrong to deliberately terminate its actual existence and to deliberately prevent a (...) corresponding potential entity from becoming actual, a principle I call the ‘Inverse Proportional Value Principle’. After defending this principle and showing it to oppose the idea that abortion is acceptable since it simply prevents the existence of something of moral worth or value, I show this principle to sanction some abortions, given that the entity which stands to result from a pregnancy is sufficiently lacking in value. The World Health Organisation encourages that blood donation becomes voluntary and unremunerated, a system already operated in the UK. Drawing on public documents and videos, this paper argues that blood donation is regarded and presented as altruistic and supererogatory. In advertisements, donation is presented as something undertaken for the benefit of others, a matter attracting considerable gratitude from recipients and the collecting organisation. It is argued that regarding blood donation as an act of supererogation is wrongheaded, and an alternative account (...) of blood donation as moral obligation is presented. Two arguments are offered in support of this position. First, the principle of beneficence, understood in a broad consequentialist framework obliges donation where the benefit to the recipient is large and the cost to the donor relatively small. This argument can be applied, with differing levels of normativity, to various acts of donation. Second, the wrongness of free riding requires individuals to contribute to collective systems from which they benefit. Alone and in combination these arguments present moral reasons for donation, recognised in communication strategies elsewhere. Research is required to evaluate the potential effects on donation of a campaign which presents blood donation as moral obligation, but of wider importance is the recognition that other-regarding considerations in relation to our own as well as others’ health result in a range not only of choices but also of obligations. Nursing codes of ethics and conduct are features of professional practice across the world, and in the UK, the regulator has recently consulted on and published a new code. Initially part of a professionalising agenda, nursing codes have recently come to represent a managerialist and disciplinary agenda and nursing can no longer be regarded as a self‐regulating profession. This paper argues that codes of ethics and codes of conduct are significantly different in form and function similar to the difference between (...) ethics and law in everyday life. Some codes successfully integrate these two functions within the same document, while others, principally the UK Code, conflate them resulting in an ambiguous document unable to fulfil its functions effectively. The paper analyses the differences between ethical‐codes and conduct‐codes by discussing titles, authorship, level, scope for disagreement, consequences of transgression, language and finally and possibly most importantly agent‐centeredness. It is argued that conduct‐codes cannot require nurses to be compassionate because compassion involves an emotional response. The concept of kindness provides a plausible alternative for conduct‐codes as it is possible to understand it solely in terms of acts. But if kindness is required in conduct‐codes, investigation and possible censure follows from its absence. Using examples it is argued that there are at last five possible accounts of the absence of kindness. As well as being potentially problematic for disciplinary panels, difficulty in understanding the features of blameworthy absence of kindness may challenge UK nurses who, following a recently introduced revalidation procedure, are required to reflect on their practice in relation to The Code. It is concluded that closer attention to metaethical concerns by code writers will better support the functions of their issuing organisations. (shrink)

In Latin America Cardenal is generally regarded as an enduring poet. He brought a recognizably Latin American material into his poetry, and he introduced to Spanish-language poetry in general such poetic techniques as textual collage, free verse lines shaped in Poundian fashion, and, especially, a diction that is concrete and detailed, textured with proper names and the names of things in preference to the accepted poetic language, which was more abstract, general, and vaguely symbolic. But what is notable in Spanish-language (...) poetry is not only Cardenal’s “craft,” in the sense given this word by Seamus Heaney to mean manipulation of poetic resources; there is also this poet’s “technique,” which in Heaney’s sense means a “definition of his stance toward life.”2 Cardenal’s characteristic poetic stance has been admired because he addresses the political and social pressures that shape—and often distort, damage, or destroy—life and feeling. This is apparent even in the earliest poems Cardenal has chosen to preserve. “Raleigh,” for example, is a dramatic meditation from 19493 in which the treasure-hunting explorer marvels at the expanse and wealth of the American continents and out of sheer pleasure recounts some of the triumphs and hardships of his travels. Although his alertness and wonder make him sympathetic, this Raleigh’s vision of the New World as a limitless source of wealth is forerunner to the economic exploitation of the land and people.One might ask, What are the political and social circumstances which, rather than distorting and damaging life and feeling, nurture and preserve them? Perhaps one might answer that, paradoxically, destructive conditions of life have many times proven insufficiently powerful to prevent the creation of poetry. And some poetry has even arisen in reaction to the destructive: such conditions produce resistance, which, if it cannot heal the spirit, can lend it strength. One might answer further that it is not Cardenal’s or any artist’s responsibility to establish what circumstance will form a fruitful matrix for art, but only to work as honestly and as hard as political, social, and artistic circumstances will permit. 2.
