Austin addresses the objection that his description of these conditions is due to a misunderstanding about the use of ‘fact’, arguing, against Strawson, that facts are not pseudo-entities and that the notion of ‘fitting the facts’ is not (...) a useless notion. Justice and Power in the Sociolegal Studies asks what interdisciplinary work in the law and society tradition tells us about the relationship of law and justice, as well as the way power operates in and through law. The fundamental concepts of justice and power provide points of departure for leading scholars to explore the various domains of socio-legal research. Self-narration, many philosophers assume, makes important contributions to our mental lives. Two views on self-narration can be distinguished. On the internalistic view, self-narration unfolds in the secluded mind and does not require overt communication. On the situated view, self-narration often depends on the conversational interaction with an interlocutor. The situated view has many advantages over its internalistic rival, including theoretical consistency and empirical plausibility. Yet, research on situated conversational self-narration has been shaped by a harmony bias, which consists in the (...) tacit assumption that interlocutors contribute to self-narration in ways that are beneficial and supportive, rather than malicious and harmful. This paper seeks to mitigate the harmony bias by considering the phenomenon of gaslighting, which is characterized by an interlocutor’s erosion of someone’s sense of epistemic and moral competence. In cases of narrative gaslighting, this erosion proceeds by maliciously interfering with the self-narrator’s mnemonic, interpretational, and conceptual abilities. Bringing together research on situated self-narration and gaslighting for the first time, it will be argued that the emerging account of narrative gaslighting has important implications for both. Powers are properties defined by what they do. The focus of the large majority of the powers literature has been mainly put on explicating the (multifaceted) results of the production of a power in certain (multifaceted) initial conditions: but all this causal complexity is bound to be—and, in fact, it has proved to be—quite difficult to handle. In this paper we take a different approach by focusing on the very activity of producing those multifaceted manifestations themselves. In this paper, we (...) propose an original account of what the essence of a power consists in which stems from a radical reconceptualisation of power-causation according to which counterfactuals are to be explained away by powers, and not vice-versa. We call this approach the dynamical operator account of powers. According to this account, the causal role of powers consists in their ensuring that the ontological transition from a stimulus S to a manifestation M happens. Powers thus have a dynamical essence which consists in the fundamental activity of generating the counterfactuals typically associated with them. We show that if one conceptualises this functional activity as the metaphysical fulcrum around which counterfactual-based causation revolves, one is granted not only an improved methodology to individuate powers but also a better understanding of their knowability, modality and directedness. In this article I discuss various humility theses about individuals and intrinsic properties as discussed by authors such as David Lewis. I argue that we should accept a similar humility thesis about the world’s space-time structure regardless of which metaphysics of space-time we accept. I argue this undercuts some important motivations opting in for an ontic structural realist metaphysic.

The Hybrid Model for Concept Development was used to develop a conceptual structure of dignified death in PICUs in an attempt to define the concept. The fieldwork study was carried out by means of in-depth interviews with nine nurses and seven physicians working in PICUs. Not unexpectedly, the concept of dignified death was found to be a complex (...) phenomenon involving aspects related to decisions made by the multidisciplinary team as well as those related to care of the child and the family. Knowledge of the concept’s dimensions can promote reflection on the part of healthcare professionals regarding the values and beliefs underlying their conduct in end-of-life situations. Addresses Bedford’s attack on appeals to introspection in the identification of emotions, which lead him to raise the question of how to draw the line between genuine and pretended anger. Austin demonstrates, through a close examination of the speech acts of ‘pretending’ and ‘really being’, that none of the supposed conditional relations between these two notions actually holds. É reconhecida, contemporaneamente, a capacidade da literatura na formação de sujeitos críticos e participantes socialmente. Sendo assim, tão logo a escola passou a ser popularizada, a literatura teve, também, ampla divulgação nesse espaço. No entanto, apesar dessa relação ter sido iniciada por volta de cinquenta anos, cada vez mais, constata-se a dificuldade da escola na formação de leitores literários. Em vista disso , é objetivo deste artigo problematizar questões pertinentes ao trabalho com a literatura em dois espaços fundamentais para melhorar (...) a qualidade da educação básica no Brasil : a sala de aula e a biblioteca. Esta pesquisa tem como tema a prática da análise de necessidades de formação de professores, e como principal objetivo compreender as condições que favorecem essa prática a se tornar um referencial de saberes para a legitimação das práticas de formação continuada para professores. Para alcançar esse objetivo, serão utilizadas as ferramentas teórico-metodológicas foucaultianas próprias da genealogia e arqueologia na análise de documentos pertencentes ao âmbito da atual política educacional brasileira e de trabalhos científicos sobre a análise de necessidades de professores. In this paper, I explore the intersection of climate justice and international cooperation, focussing on the compulsory licensing of climate-related technologies. I aim to contribute to a critical analysis of the role of intellectual property rights (IPRs) and global development in the twenty-first century, particularly within the context of a climate crisis, by: (i) explaining the evolution of the principle of Common but Differentiated Responsibilities and Respective Capabilities (CBDR&RC) in the international governance on climate change, and (ii) analysing discussions around (...) compulsory licensing of climate-related technologies within the international system of IPRs’ protection. For this, I use qualitative research methods, including critical discourse analysis and a preliminary literature review, to understand the interactions between delegations and the narratives constructed for international cooperation to address climate change. I then argue that a ‘climate justice’ framework would improve discussions of the development and transfer of climate-related technologies and bring transformative possibilities for the understanding of global development. Picks up on a previous discussion of responsibility, freedom, and excuses, in which Austin argues that, in order to discover whether someone acted freely, we must discover whether certain excuses relevant to the situation at hand are acceptable. The notion of freedom, according to this view, is intractably linked to the notion of responsibility. Chapter 12 refines the previous discussion, by illuminating the differences between the notions of purpose, intention, and deliberation in a variety of speech acts.

This study addresses the current lack of empirical data on the experiences and attitudes of clinical research professionals towards AI-powered clinical trial management tools. Clinical research professionals affiliated with various Swiss and international clinical research networks were invited to participate in an online survey. The survey focused on nine use cases of AI-powered clinical trial management tools. Participants were asked to share their ethical considerations, and their experiences were assessed at both the individual and institutional levels. Answers from 110 participants, (...) primarily from Swiss academic institutions, were included in the data analysis. While participants generally held positive attitudes, mixed views were also common. Governmental attitudes were widely perceived as unclear or cautious, with the associated regulatory opacity possibly contributing to the limited adoption of AI in trial management observed in this study. In addition to a clear AI governance, ethical compliance and training emerged as crucial aspects. There was also broad consensus on the necessity of informing patients about tools’ uses and of ensuring an independent certification of the respective tools. The widespread adoption of AI-powered clinical trial management tools remains distant, entangled in a net of complexities that require further empirical investigation. Ethical concerns appear to play a crucial role, driven by distrust and the absence of a clear regulatory framework. Urgent actions are needed at both institutional and governmental levels, including the establishment of a governance framework and training provision. (shrink)

Neste texto refletiremos sobre a importância da imagem como possibilidade de construção mental e social. Investigaremos o discurso laico em representações imagéticas dos monarcas franceses Francisco I e Henrique II. Nesse período, a sociedade passava por mudanças sociais entre o Medievo e a Modernidade, implicando a construção da ideia de Estado, como organizador social. Entendemos que as imagens além de revelar as relações sociais, eram também, um veículo formador. Acreditamos, assim, na relevância da realização de pesquisas na História, na Educação (...) e na Arte, nos oportunizando a compreensão da formação do sujeito social. (shrink)

ZusammenfassungIm Gesetzentwurf des Bundesrates zur Änderung des Betreuungsrechts ist eine regelhafte Stellvertretung durch Angehörige für zur Entscheidung unfähige Patienten vorgesehen. Mithilfe eines strukturierten Fragebogens wurden die Einstellungen von Tumorpatienten, gesunden Kontrollpersonen, Pflegenden und Ärzten zur Präferenz der zu bevollmächtigenden Personen ermittelt. Nur 10–20% der Befragten haben eine Patientenverfügung verfasst. Als Entscheidungbefugte im Falle akuter Erkrankung werden Angehörige und Ärzte gemeinsam genannt. Als Gesundheitsbevollmächtigte werden Ehepartner/lebenspartner bevorzugt und nichtangehörige Personen nur von einer Minderheit genannt. Die grundsätzliche Bereitschaft, als Gesundheitsbevollmächtigte Verantwortung zu (...) übernehmen, ist hoch, erstreckt sich jedoch überwiegend auf Angehörige. Nur Ärzte sind in bis zu 50% auch für nichtangehörige Personen bereit, als Bevollmächtigte zu entscheiden. Die regelhafte Stellvertretung in Gesundheitsfragen durch Angehörige entspricht den Wünschen der Mehrheit von Tumorpatienten, gesunden Vergleichspersonen und medizinischem Personal. (shrink)

Slips of the tongue, unwitting favoritism and stereotyped assumptions are just some examples of microaggression. Nearly all of us commit microaggressions at some point, even if we don’t intend to. Yet over time a pattern of microaggression can cause considerable harm by reminding members of marginalized groups of their precarious position.
