An initial study of Robin George Collingwood's The Principles of Art and Benedetto Croce's Aesthetic: A Science ofExpression and General Linguistic gives an immediate impression that Collingwood appropriated and incorporated many elements in Croce's work to his own position. This is probably the main reason why Collingwood, in his correspondence with Croce, sincerely expressed his gratitude to the Italian Philosopher for laying the foundation of his art-theory. Collingwood's acknowledgement of Croce's influence and the apparentsimilarity in their theories on art disposes (...) us to wonder if Collingwood mayhave only extended, hence, reiterated the principles of Croce's position. Given this impression, the present article hopes to provide a study between Collingwood's and Croce's theories of art in the hope that we can tease out a crucial difference between their standpoints. If we can demonstrate a significant difference, then we may have provided ourselves with the cudgels to assert that Collingwood's theory of art is also unique. (shrink)

The principle of overlap of classes holds that when two entities interface, the effect is a blurring of boundaries between conceptual territories. In this paper, this question is in order: Is Folk Catholicism an instance of overlap of classes? If Folk Catholicism is not construed as such, these fallacies – using Robin George Collingwood’s perspective in his An Essay on Philosophical Method, may unfold: the fallacy of precarious margins, the fallacy of identified coincidents, and the fallacy of false disjunction. The (...) first fallacy holds that the ‘Folk’ in Folk Catholicism has no contribution to how ‘Catholicism’ unfolds. The second fallacy maintains that the extensions of both ‘Folk’ and ‘Catholicism’ are clearly delineated. The third fallacy underscores that Folk and Catholicism are mutually exclusive terms. When such fallacies are accepted, this paper holds that Folk Catholicism as a construct may be a contradiction of terms on what it means to be Folk and Catholic. This is the illogical consequence given that the truth of what it means to be folk necessitates the falsity of what it means to be Catholic and vice-versa. However, when recognized from the lens of the overlap, Folk Catholicism is construed as a term that evolves and is historically conditioned. (shrink)

This striking Lacanian contribution to discourse analysis is also a critique of contemporary psychological abstraction, as well as a reassessment of the radical opposition between psychology and psychoanalysis. This original introduction to Lacan's work bridges the gap between discourseanalytical debates in social psychology and the social-theoretical extensions of discourse theory. David Pavón Cuéllar provides a precise definition and a detailed explanation of key Lacanian concepts, and illustrates how they may be put to work on a concrete discourse, in this case (...) a fragment of an interview obtained by the author from the Mexican underground Popular Revolutionary Forces (EPR). Throughout the book, Lacanian concepts are compared to their counterparts in psychology. Such a comparison reveals insuperable incompatibilities between the two series of concepts. The author shows that Lacan's psychoanalytical terminology can neither be translated nor assimilated to the terms of current psychology. Among the notions in actual or potential competition with Lacanian concepts, the book deals with those proposed by semiology, Marxism, phenomenology, constructionism, deconstruction, and hermeneutics. Taking a stand on those theoretical positions, each chapter includes detailed discussion of the contribution of classical approaches to language; including Barthes, Bakhtin, Althusser, Politzer, Wittgenstein, Berger and Luckmann, Derrida, and Ricoeur. There is sustained reference in the body of the text to the arguments of Lacan and Lacanians, of Miller, Milner, Soler, and Zizek. At the same time, in the extensive notes accompanying the text, there is a systematic reappraisal and reinterpretation of debates and pieces of research work in social psychology, especially in a discursive and critical domain that has incorporated elements of psychoanalytic theory. This paper explores two persistent questions in the literature on presumptions: the place and the nature of presumptions in law and legal argumentation. These questions were originally raised by James Bradley Thayer, one of the masters of the Law of Evidence and the author of the classic chapter devoted this subject in A preliminary treatise on Evidence. Like Thayer, I believe that these questions deserve attention. First the paper shows that the connection between presumptions and argumentation is a constant feature (...) in the literature on presumptions, since its foundation in the Middle Ages to modern times. James Bradley Thayer was probably the last jurist who clearly saw that presumptions belong to argumentation. Second, the paper examines two sources of controversy in the language of presumptions. First, “presumption” is an ambiguous word in the legal discourse. As a result, it is almost impossible to provide a clear and succinct answer to the question “What is a presumption?”. Second, there are at least four reconstructions of the concept of presumption whose merits and shortcomings are relevant to explore. The analysis presented here may be of interest for legal and non-legal scholars and, hopefully, it may help to shed light on the possibilities and limits of an interdisciplinary dialogue about presumptions. Le sujet de cet article est le rapport entre le processus actuel de mondialisation et la démocratie. Le plan de travail démarre par le concept de démocratie, ses différents niveaux et significations, ses pièges et ses paradoxes, ses effets et ses conséquences, ses avantages et ses inconvénients dans l’horizon de la vie contemporaine. Après l’introduction, l’article trace un aperçu historico- philosophique de l’évolution de la mondialisation des temps anciens jusqu’au monde contemporain. Le point de vue philosophique central est celui d’Immanuel (...) Kant et de Georg Wilhelm Friedrich Hegel – deux autorités et deux approches du processus de développement d’une « société mondiale » opposées. Kant a expliqué les moyens du statut de « citoyenneté mondiale » comme une « finalité naturelle ». Hegel a exposé la nécessité de l’évolution de l’histoire mondiale jusqu’à l’état d’une liberté globale. La question de savoir si le processus de création d’une société mondiale met en danger la démocratie dans le monde contemporain est aujourd’hui une question clé. Tout le monde s’accorde pour dire que le processus de mondialisation affaiblit le champ de l’action politique authentique. La démocratie tire son origine de « polis », la petite Cité-Etat, et symbolise la gouvernance dans une petite communauté politique. Le pas entre la démocratie du polis vers la démocratie de l’Etat nation a été le résultat de la mutation de la démocratie directe vers la démocratie représentative. Le passage d’une politique nationale à une politique supranationale et mondiale nécessite une nouvelle transformation importante de la nature de la démocratie. (shrink)

The paper outlines the historical development of question about ambiguous and mysterious human nature, in particular considering the reasons and conditions for the founding of modern philosophical anthropology. Subsequently, it brings an overview of the conceptual beginnings and directions of anthropological research in Croatia. The focus is on the following questions: When did the investigations begin in the field of philosophical anthropology, in what kind of thinking environments were they shaped and what scientific achievements were reached? The presentation brings to (...) light the cognition that philosophical anthropology in Croatia got its first contours and valuable contributions to the very beginning of the contemporary renewal of this discipline, shortly after its phenomenological and scientific revivals in the ventures of Scheler and Plessner. The development of this research branch is, according to Hans Lankʼs model, divided into four main conceptual orientations. The anthropology from above shows the creative contributions of Stjepan Zimmermann, Vilim Keilbach, Rajmund Kupareo, Miljenko Belić, Ante Kusić, Josip Ćurić, Hrvoje Lasić and Ivan Koprek. The anthropology from below is illustrated by the reference to the research by Vera Ehrlich-Stein, Rudi Supek, the Institute of Anthropology, Pavao Rudan and Darko Polšek. For the anthropology from culture, the philosophical achievements of Pavao Vuk-Pavlović, Vladimir Filipović, Vjekoslav Mikecin, Esad Ćimić, Nikola Skledar, Branka Brujić, Milan Galović and Mihaela Girardi-Karšulin were delineated. Under the anthropology from history, the works of Predrag Vranicki, Milan Kangrga, Vanja Sutlić, Gaja Petrović, Hotimir Burger, Mislava Kukoč and Raul Raunić are outlined. The conclusion summarises four insights. 1. Philosophical anthropology is an under-researched and not enough appreciated field, which represents one of the most fertile currents of thought in the 20th century. 2. Creative contributions are presented in all four major orientations. 3. In the context of anthropological research, lively dialogue and a fruitful meeting of different worldviews were realised. 4. The beginnings of the development of the discipline should be moved earlier in history than previously considered, from the 1950s and 1960s to the early 1930s. The last insight points to the need for further exploration of the perceived, and so far largely neglected, continuity of anthropological themes and related ideas in the history of recent philosophy in Croatia. Slijedeći Fichteovu misao da »svatko izabire onakvu filozofiju kakav je tko čovjek«, u članku se ocrtavaju misaoni sklopovi stvaralačkoga opusa Ante Pažanina, u nastojanju da se na taj način osvijetle stožerne sastavnice njegove životne filozofije. Pažaninova istraživanja o filozofiji kao strogoj znanosti, fenomenologiji, praktičnoj filozofiji, etici i politici imaju znatan odjek i utjecaj ne samo u Hrvatskoj nego su zapažena i u svijetu. Na međunarodnoj pozornici privukla je zanimanje njegova osebujna koncepcija normativne političke filozofije u kojoj kritički rasvjetljuje i ukazuje (...) na posljetke suvremene znanstveno-tehničke civilizacije. Nasuprot novovjekovnom odvajanju etike od prava i politike, Pažanin se oslonio na aristotelovsku tradiciju praktične filozofije koja polazi od jedinstva etike i politike. Praktičnu filozofiju promatra kao samostalno i neovisno područje o poietičnoj techne i teoretskoj episteme. Takav pristup praktičnoj filozofiji nadilazi poteškoće aprirornoga univerzalizma teoretskoga utemeljenja etičkih normi te bolje odgovara suvremenoj raznovrsnosti svijeta života i njegovoj složenosti. Pažaninovu životnu filozofsku misiju može se prispodobiti Gadamerovu opisu »nasljedovanja« Aristotela u nastojanju filozofa da se pomoću filozofske teorije stavi u službu ljudske prakse. Njegova je praktična životna filozofija svojevrsno misaono nastojanje oko razumijevanja i posuvremenjenja odnosa između refleksivnih oblika teorije i praktične umnosti povijesnoga svijeta života. Filozofska refleksija za njega ima zadaću ne samo primjereno razumjeti praktični svijet nego ga time i odgovorno mijenjati u nastojanju za ozbiljenjem najvišega ljudskog dobra kao bitne svrhe čovjekova življenja. Este artículo es una breve exposición de la formación discursiva de la biopolítica propuesta por Michel Foucault en la década de los setenta. El propósito es presentar el estatuto teórico original del mencionado concepto como una tecnología de doble faz, establecida en los siglos XVII, XVIII y XIX que interviene y establece controles reguladores sobre la vida biológica en dos formas que no son antitéticas. La primera, se centra en el cuerpo como máquina: anatomopolítica del cuerpo humano. La segunda, se (...) enfoca en el cuerpo-especie: es la biopolítica de la población. La metodología utilizada es un análisis de tipo documental que agrupó los cursos: Defender la sociedad; Seguridad, territorio y población y Nacimiento de la biopolítica, así como el libro Historia de la sexualidad 1, para conocer de manera sintética y reflexionar la idea y el sentido original del término como una tecnología de conducción de conductas individuales y colectivas. Dans l’article, il est question du modèle et des traits essentiels de l’éducation démocratique dans l’oeuvre de Dewey. La question suivante sert de point de départ : que signifient les concepts d’éducation et d’enseignement de Dewey pour la démocratie délibérative contemporaine ? Son idéal éthique de l’humanité peut-il fonder philosophiquement la valorisation et la justification de la pratique démocratique ? Dewey a-t-il sapé les fondements du libéralisme, comme l’affirmait Richard Rorty ? Ou son renouveau de la philosophie fait-elle revenir en (...) réalité le libéralisme à la vie et n’ouvre-t-elle pas de nouvelles voies pour la démocratie ? La dernière vague de la réception de la philosophie de Dewey montre certainement de plus en plus profondément que l’héritage de sa pensée, grâce aux confrontations fructueuses avec des idées et tendances contemporaines, fait ressortir quelque chose qui dépasse le cadre de la contemporanéité et qui implique l’avenir. Dans l’actuelle renaissance du pragmatisme, il est intéressant de noter que la critique profondément subtile que Dewey fait de l’ « individualisme » moderne, ainsi que sa défense du renforcement des liens moraux et démocratiques participatifs dans les communautés locales, trouve l’écho dans les arguments communautaristes. Pour conclure, en soulignant le rapport substantiel entre la communication , la communauté et le commun , Dewey ne mine pas les fondements du libéralisme et de la démocratie, mais au contraire les enrichit, les renforce et les élève à un niveau supérieur. The topic of this article is the relation between the modern process of globalization and democracy. The agenda starts with the concept of globalization, its different meanings and various layers, traps and paradoxes, consequences and effects, advantages and disadvantages in the horizon of contemporary life. Following a brief introduction into the theme, the article outlines a short historic philosophical review into the development of globalization from theancient times to the contemporary world. The focus of the philosophical view is that of (...) two significant authorities and opposite approaches in the process of developing ‘World Society’ – Immanuel Kant and Georg Wilhelm Friedrich Hegel. Kant explained the means to the status of ‘World Civility’ as a ‘Natural Purpose’. Hegel exposed the necessity of the development of world history to the state of global freedom. The question: Does the process of making global society threaten democracy in the modern world - is the key issue nowadays. All agree that the globalization process diminishes the area of the authentic political acting. Democracy originates from the ‘polis’ or small town republic and is a symbol of the government in the small political community. The step from the polis democracy to the national state democracy was the result of change from the direct to the representative democracy. The transition from the national to the supranational and global politics requires new essential transformation of the being of democracy. (shrink)

Within the framework of the contemporary discussions of the presuppositions of democracy, the author of this paper poses the question whether discussing justice primarily from the social rather than the personal aspect and level is, perhaps, more appropriate. This ties in with the question of the primary object of justice – is justice the trait of social institutions or individuals? Thus the question of what kind of justice matches democracy. The author explicates this network of questions through three underlying models (...) of the theory of justice – Plato, Aristotle and Rawls’s model. Plato’s model is about the realisation of a good life in a political community in view of the idea of justice that one should do that which is proper to one. Aristotle’s understanding of justice sets forth from a systematic analysis of the concepts that differentiate between the levels of general and particular justice. Rawls’s model of distributive justice rests on the mechanism of the forces of the institutional functional frameworks in well-organised societies. The author’s conclusion is that both forms of justice correspond well to the realisation of democracy. It is best when one’s personal disposition to justice provides strength and support to the social institutions of democracy. Without an adequate institutional framework there is, most certainly, no democracy. Without the personal support of citizens, which issues from fundamental consent, democracy can neither be sustained nor developed. In a democratic system, the private sphere of citizens cannot be fully separated from their public actions. Democracy always and necessarily contains in itself some of the political ideals, which citizens cannot, in their worldviews, relate to neutrally. The questions of the institutional and political shaping of relations, and the questions of the good and just life should be in the interest of the citizens. If they do not accomplish their democratic ideals through their own belief and virtue, then there is no substance that would shape identity for a just system of social institutions. If they do not relate to it as to their own common sense and good to be preserved, democracy has no prospects. (shrink)

Este trabalho analisa a influência tributária na definição do modelo constitucional de atribuição dos resultados econômicos da exploração do petróleo offshore, no Brasil. Além da abordagem constitucional do tema, destaca-se a participação dos entes federativos estaduais nas rendas da produção de petróleo, sua federalização e, em decorrência, a redução das rendas dos entes federativos subnacionais, implicando num movimento compensatório pela via da utilização de elementos de natureza tributária, tais como o extinto Imposto Único sobre Minerais e o regime constitucional especial (...) de cobrança na origem do ICMS devido nas operações de combustíveis e derivados de petróleo. This thesis analyzes from a philosophical perspective different models for nonmonotonic inference, belief revision and the handling of inconsistencies. ;The first chapter serves as an introduction to the subject, giving examples and analyzing the main concepts. As a result of these discussions, this thesis tries to: produce a refined map of the main notions related to this subject, maintain that there can be a fault tolerant logic that stands in support of fault tolerant reasoning, and defend the use of deductive (...) databases as models for changes of belief. ;The second chapter explores monotonic proposals to deal with uncertain reasoning. These include logics based on a classical notion of consequence, interpretations of defeasible reasoning as containing implicit premises, and systems in which temporal change is an integral part of the representation of states of affairs, via temporal indices or more elaborate devices. ;The third chapter explores quantitative approaches to nonmonotonic reasoning like dispositional logic, and theories of probabilistic reasoning including Bayesian, certainty factors, and Dempster-Shafer. ;The fourth chapter explores qualitative approaches. Here we mention conditional, default, and nonmonotonic logics, and the circumscription and autoepistemic formalisms. ;The fifth chapter studies different proposals to deal with contradictions. It starts with a review of the types of belief inconsistencies, and then it presents mechanisms to prevent, control or correct them. I explore paraconsistent logics, specially relevance logics, to "bracket" the area of conflict and allow inferences about non-related topics to continue unaffected. Then I examine different methods to get rid of the inconsistencies, including the use of dependency-directed backtracking and of relevance logic. ;Finally, I present my conclusions, and mention some of the open problems. When is a proposition true? It is common to expert an answer of the form “at instant x”. In section I) I present an example of the consequences that such instantaneous semantics in tense logic can have, and review some of the problems that have led to the proposal of using intervals, rather than instants, as the indices at which to evaluate propositions. In the section II) I present some of the problems with the intervals themselves, and in section III) (...) I consider the possibilities of having he best of both worlds. Due to the still tentative character of interval semantics, I focus on the consideration of metatheoretical issues rather than on the technical points of the particular systems of interval semantics so far proposed. The notion of rationality is crucial to Computer Science and Artificial Intelligence, Economics, Law, Philosophy, Psychology, Anthropology, etc. Most if not all of these disciplines presuppose the agent's capacity to infer in a logical manner. Theories about rationality tend toward two extremes: either they presuppose an unattainable logical capacity, or they tend to minimize the role of logic, in light of vast data on fallacious inferential performance. We analyze some presuppositions in the classical view of logic, and suggest empirical and (...) theoretical evidence for the place of inferential heuristics in a theory of rationality. We propose (1) to outline a new theory of rationality that includes the key notion of logical capacity as a necessary but realistic factor, (2) to expand the notion of inference to include non-deductive inference, specifically non-monotonic, and (3) to emphasize the logical role of inferential heuristics and constraints such as cognitive economy. Objective: To evaluate moral development as an indicator of the capacity to consent among two groups of patients from the Hospital de Clínicas in Porto Alegre, RS, Brazil.Method: Fifty-nine adolescents and 60 patients over 60 years of age participated in a cross-sectional study to assess moral development using Loevinger’s model of ego stages.Results: Age and moral development showed no association, with most participants in the two groups being in the conscientious phase.Conclusions: Age is probably not an adequate variable to measure (...) decision-making capacity, because questions of medical consent relate to participants’ own personal health. Decision-making capacity should be viewed as a continuous function. While the age of the person whose consent is needed should be considered, age alone, from a moral perspective, is not the main determinant of this capacity. (shrink)
