Feenberg’s new book,Technosystem: the social life of reason, makes an important intervention in the study of technological systems by showing that instrumental reason requires value judgement at the moment of its realization in this world. It fosters hope that technological development can be redirected towards the fulfilment of human needs through public interventions of nonexperts. However, Feenberg does not sufficiently engage with the political dilemmas that inevitably accompany these interventions as a result of the formal capitalist bias of the technosystem. (...) The importance of teleology in the 18 th century has mainly been studied from the point of view of a few specific authors. Leibniz is one of the most convinced advocates of the use of final causes in both physics and metaphysics. Despite its significance for the history of teleology, very few studies were in fact devoted to the influence of the Leibnizian doctrine during the 18 th century. However, Leibniz’s reception allows us not only to understand his own views (...) on teleology in comparison with those that 18 th century thinkers attributed to him, but also to feed the conceptual debate on the legitimate articulation of finality and efficiency in natural philosophy in that period. Consequently, studies on 18 th century physico-theology may help us to clarify the following questions: what is the difference between explanations concerning organic functions and in the architectonic use of the principle of optimum in physics? And how exactly do “the details of physics” illustrate the general harmony of the world? In order to clarify these kinds of questions, the present issue explores how Leibniz’s 18 th century readers integrated in their own philosophical doctrines multiple interpretative possibilities opened up by Leibniz’s texts. Advances in molecular biological research in the latter half of the twentieth century have made the story of the gene vastly complicated: the more we learn about genes, the less sure we are of what a gene really is. Knowledge about the structure and functioning of genes abounds, but the gene has also become curiously intangible. This collection of essays renews the question: what are genes? Philosophers, historians and working scientists re-evaluate the question in this volume, treating the gene as (...) a focal point of interdisciplinary and international research. En dépit de toutes les proclamations sur la " mort de la métaphysique ", la philosophie ne peut aujourd'hui, pas plus qu'hier, se passer de l'interrogation métaphysique. Si elle décidait d'abandonner l'enquête sur les questions au-delà de l'expérience, elle laisserait le champ libre à toutes les spéculations irrationnelles, aux charlatanismes de la quête spirituelle, aux marchands d'illusion illuminée. La question " Pourquoi y a-t-il quelque chose plutôt que rien? " semble réunir à elle seule quelques vertus et tous les péchés (...) que l'on prête à la métaphysique. Certainement insoluble, elle en montre bien le caractère ridicule, dépassé, voire inepte. Evidemment radicale, elle indique ce que la métaphysique a d'inévitable, de nécessaire, voire d'ultime. In this paper I aim to answer two questions: Can spin be treated as a determinable? Can a treatment of spin as a determinable be used to understand quantum indeterminacy? In response to the first question I show that the relations among spin number, spin components and spin values cannot be captured by a single determination relation; instead we need to look at spin number and spin value separately. In response to the second question I discuss three ways in which (...) the determinables model might be modified to account for indeterminacy, and argue that none of them is fully successful in helping us to understand quantum indeterminacy. In Chapter 6, Johanna E. Wolff uses models of measurements as a case for exploring two forms of scientific realism that are meant to address the problem of plurality of models in science: structural realism and perspectival realism. She distinguishes their motivations in the following way: structural realists address the plurality of models by looking for similarities, namely structural commonalities, between the models, whereas perspectival realists emphasize how differences among a plurality of models can be complementary. In comparing these (...) realist alternatives, Wolff chooses to focus on measurement theory. Wolff urges the idea that perspectival realism and structural realism are not competing realist accounts but complementary ones. (shrink)

Commentary on Adina Preda & Kristin Voigt, The Social Determinants of Health: Why Should We Care?

Résumé Le but de cet article est de mettre en dialogue Ricœur avec la théorie sociale d’Anthony Giddens, plus spécifiquement l’herméneutique de l’homme capable avec la théorie de la structuration. Nous commencerons par explorer quelques termes clefs permettant de comparer les deux auteurs au sujet du rapport entre acteurs et systèmes. Chez Ricœur, nous commenterons les notions d’institution et de pratique; chez Giddens, des notions importantes pour présenter la “dualité de structure.” Au cours de cette exploration, quatre tâches seront identifiées (...) en vue de préciser la “théorie sociale” de Soi-même comme un autre : dépasser le schéma foncièrement téléologique de l’action; explorer la stabilisation de l’action malgré l’incertitude inscrite dans le schéma téléologique; réinvestir la notion de contrainte; et clarifier l’ambiguïté de la notion d’institution. En conclusion, nous montrerons quels apports la mise en dialogue de Ricœur avec Giddens pourrait offrir pour accomplir ces quatre tâches. Mots-clés : Homme capable, sructuration, acteur, dualité de structure, institution, contrainte.The aim of this article is to reconstruct a dialogue between Ricœur and Anthony Giddens, in particular between the hermeneutics of the capable human and the theory of structuration. The article starts with an exploration of key concepts on the basis of which to compare the two authors on the relation between actors and systems. On Ricœur’s side the concepts of institution and practice will be commented on; on Giddens’ side notions selected to present the “duality of structure” will be considered. In the course of this exploration, four tasks will be identified by which to refine the “social theory” of Oneself as Another : surpass its ultimately teleological schema of action; explore the stabilisation of action despite the uncertainty attributed to the teleological schema; reinvest the notion of constraint; and clarify the ambiguity in the notion of institution. In conclusion the contribution of a Ricœur-Giddens dialogue to the accomplishment of these four tasks will be demonstrated. This is an extensive critical review of Euthanasia in International and Comparative Perspective. My Review is divided into five parts. First, I outline the book's strengths. I proceed by speaking of the need for clear and cohesive terminology. I then discuss end-of-life decision-making in some of the countries: Belgium, The Netherlands, and the State of Oregon in the United States, all allow PAS. Belgium and The Netherlands also allow euthanasia. I also discuss Israel's Dying Patient Law,13 enacted by the Knesset (...) on December 5, 2005. Finally, I make some suggestions for improvement, including a detailed proposal for PAS which I conceive to be the best policy when balancing one against the other the autonomy of the patient, on the one hand, and the safeguards against abuse when life might be considered too lightly, on the other. Indeed, the main difference between euthanasia and PAS is that in euthanasia, it is the physician who makes the final act of taking patient's life, whereas in PAS it is the patient who takes his or her life. In euthanasia, the physician has control over the process. In PAS, the physician controls the procedure up until the last act. The patient has control over the very act of suicide. (shrink)

Ann Arbor: University of Michigan Press, 1994. Pp. xiii 1 164.Over the last fifteen years research in Greek law has expanded rapidly, especially in Anglo-American countries. In consequence, significant differences of approach to this material have become apparent. The older, juristic approach is largely continental, where the living tradition of Roman law as the basis (...) for current legal codes has meant that most Greek legal historians first studied Roman law, were trained as lawyers, and now teach in law schools. By contrast, most Anglo-Americans now working in this field were trained as ancient historians or philologists. They know little of Roman or modern law and mostly care less about it, arguing that most Greek legislation was unsystematic, arising piecemeal in response to interpersonal or community problems. For these scholars, a juristic approach to Greek law is sometimes even misleading: sociology and anthropology offer more appropriate methodologies. Sealey places his new book squarely in the continental tradition. He expressly rejects sociology (22), and modestly announces his intention to publicize the work of Wolff, Ruschenbusch, and Thür (ix–x). However, S. also was trained as a historian and philologist. How far does his book add to the juristic tradition of Greek legal scholarship? And how far does it make its own, historical contribution? [End Page 130]“This book is an inquiry into the rule of law,” its first sentence declares. It is not always that, but rather, a wide-ranging exposition of various questions about Greek law, which ruled and in some areas (S. indicates) failed to rule. S.’s book offers a number of lucid, courteous discussions, presented sometimes in a paratactic way, but conveying overall a sense of chronological development. Its general intention is “to discover the historical contribution of Greek thought to the field of law, justice, and right... [and] to discover principles, concepts, and aims that underlay the development of law in Greek cities” (133). With a scope so large, the book is often too brief. With rapid strokes S. adopts positions typically without evaluating much of the scholarship regarding them. Some arguments S. has made before. He repeats them despite previous criticisms. S. includes several lengthy discussions of Roman and Near Eastern law, typically to illustrate differences with Greece. This may contrast with legal anthropologists, who illuminate Greek practices through comparative materials. Although S. adopts various hypotheses of his continental colleagues, it is not his purpose to add much to their arguments. More significantly, despite S.’s intention to find “the historical contribution of Greek thought to the field of law, justice, and right,” it remains unclear that the Greeks made such a contribution. As S. himself says, the Greeks “did not recognize an underlying body of thought expressed” in particular laws (59). By contrast, in smaller instances and in his general conclusions regarding the “principles, concepts, and aims” underlying Greek law, the positive results of S.’s work are historical, and even sociological.Chapter 1, “Scope of the Inquiry,” is perhaps most problematic. S. begins with the role of law in society, the meaning of the term “law,” and philosophical discussions of the nature of law especially in Savigny (7–9). Having set out objections to Savigny’s thesis that every nation’s civil law springs from, and remains true to, its distinctive character or historical circumstances (9–12), S. concludes, somewhat abruptly, that Savigny’s great merit was his recognition that “law can develop without statutory enactment and that the development stays within limits or follows lines that can be discerned” (12). It is so far unclear how Savigny’s thesis pertains to ancient Greece. It remains so during S.’s three illustrations of the development of Greek law beyond statutory enactment, in atimia, testimentary practice, and the marriage of heiresses (12–19). Indeed, it turns out, S. largely rejects Savigny’s primary insight (21–22). For S., laws are shaped not by national character but by “an underlying body of thought” characteristic of the society. This contribution examines the role of diagrams in early modern pedagogy. It begins with an analysis of images from the 1632 Dialogo and 1638 Discorsi. I claim that Galileo often employed images in a pedagogical context, illustrating to readers through his dialogue how he may have used images in his own teaching. Building on the work of previous historians, I argue that a classification of Galileo’s images should include not only heuristic images and images used for virtual witnessing, but also (...) pedagogical images designed to illustrate to the reader (or student) how to reach conclusions about a given question. I then turn to the way Galileo’s readers at the University of Pisa employed Galileo’s images in their own teaching. I argue that Galileo’s readers employed his images in their own works in ways which reflected their training and the genre in which they wrote and taught. (shrink)

Over 60 years ago, the influential language philosopher L. Wittgenstein suggested that there is no need to use "understanding" and "meaning" to understand how language works and, in fact, that the two theoretical terms are part of a primitive idea. Today, both remain two of the most frequently used terms in education. The purpose of this paper is to stimulate a discussion about abandoning these terms from the theoretical discourse of education in the way these are commonly used. Case materials (...) from the research literature chosen from a large database on knowing and learning in science are used to exemplify the approach that does not require either concept.
