In the second section of Chapter V of The concept of law, Hart lays down the concept of legal obligation throughout a critique of the concept of obligation in John Austin’s predictive theory. The critique aims at the core domain of this theory, which occupies the major part of the section, and shows how wrong it is to describe the legal obligation in terms of commands and habits of obedience. At the end of this section, Hart introduces the concepts of (...) internal and external point of view, in order to criticize the methodological model used by the predictive theory – the great responsible for the mistakes of Austin’s account. The following paper makes a review of the “debate” between both theories and, at the end, it tries to demonstrate how the introduction of Hart’s new conceptions (internal and external points of view) is done to avoid the mistakes occurred in Austin’s predictive theory. RESUMONeste ensaio defende-se o argumento de que a configuração cronotópica potencializa a obra literária como forma metafórica para experimentar a vida cotidiana. Esse argumento apoia-se nas declarações em que Bakhtin destacou que a organização de processos psicológicos de personagens no enredo está relacionada com a experiência da unidade tempo-espaço, conceitualmente denominada de cronotopo. Para exemplificar essas questões desenvolveu-se aqui uma análise da configuração cronotópica do autor-personagem no Livro do desassossego de Fernando Pessoa. A dificuldade do autor-personagem para negociar as posições (...) de figura e fundo no seu pensamento refletiu uma experiência de fronteira específica, revelada na frequente associação de termos antagônicos e uso frequente de neologismos. Percebendo o funcionamento cronotópico da narrativa, discute-se o potencial da literatura na provisão de metáforas para vida real. Nessas considerações chamou-se a atenção para a participação do leitor na constituição do cronotopo e da obra.ABSTRACTIn this essay we defend the argument that chronotopic configuration enhances literary works providing metaphors for everyday life. This argument is embedded in statements in which Bakhtin emphasized that the organization of the characters' psychological processes in plots is related to the experience of temporal-spatial unity, conceptually called the chronotope. In order to address these issues, we developed an analysis of chronotopic configuration of author-character, in "The Book of Disquiet" by Fernando Pessoa. The difficulty met by the author-character in negotiating positions of figure and background in plots reflects a specific border experience, revealed in the common association of antagonistic terms and frequent use of neologisms. Considering properties of narrativity in the chronotopic analysis we can discuss the potential literature has of providing real life metaphors. Moreover, through these remarks, greater emphasis has been placed on the reader's participation in the constitution of the chronotope and on literary work. (shrink)

What we envisaged as a dossier to explore the connection between style and philosophy in this unique transitional period of Presocratic philosophy has turned out to be a volume that breaks with several conventional views of the Presocratics and has the potential to take the interpretation of style and Presocratic philosophy in a whole new and more fruitful direction.

Morality has traditionally been described in terms of an impartial and objective “moral law”, and moral psychological research has largely followed in this vein, focusing on abstract moral judgments. But might our moral judgments be shaped not just by what the action is, but who is doing it? We looked at ratings of moral wrongness, manipulating whether the person doing the action was a friend, a refugee, or a stranger. We looked at these ratings across various moral foundations, and conducted (...) the study in Brazil, US, and UK samples. Our most robust and consistent findings are that purity violations were judged more harshly when committed by ingroup members and less harshly when committed by the refugees in comparison to the unspecified agents, the difference between refugee and unspecified agents decays from liberals to conservatives, i.e., conservatives judge them more harshly than liberals do, and Brazilians participants are harsher than the US and UK participants. Our results suggest that purity violations are judged differently according to who committed them and according to the political ideology of the judges. We discuss the findings in light of various theories of groups dynamics, such as moral hypocrisy, moral disengagement, and the black sheep effect. (shrink)

I develop an interpretation of Maurice Merleau-Ponty's concept of motor intentionality, one that emerges out of a reading of his presentation of a now classic case study in neuropathology—patient Johann Schneider—in Phenomenology of Perception. I begin with Merleau-Ponty's prescriptions for how we should use the pathological as a guide to the normal, a method I call triangulation. I then turn to his presentation of Schneider's unusual case. I argue that we should treat all of Schneider's behaviors as pathological, not only (...) his abstract movements, as is commonly acknowledged in the secondary literature, but also crucially his concrete movements. Using these facts of Schneider's illness, I reconstruct a ‘fundamental function’ of consciousness, as Merleau-Ponty called it, in which there are two kinds of bodily agency: the power of the body to be solicited by a situation and the power of the body to project a situation. I propose that these powers became dissociated in Schneider's case, as evidenced by his abstract and concrete movements, while in the normal case, these powers comprise a dynamic unity, enacted as motor intentionality. I also discuss how my interpretation complements Merleau-Ponty's assertion that motor intentions exist between mind and matter. (shrink)

While ethical and empirical interest in so-called secondary variants and incidental findings in clinical genetics contexts is growing, critical reflection on the ethical foundations of the various recommendations proposed is thus far largely lacking. We examine and critique the ethical justifications of the three most prominent disclosure positions: briefly, the clinical geneticist decides, a joint decision, and the patient decides. Subsequently, instead of immediately developing a new disclosure option, we explore relevant foundational ethical values and norms, drawing on the normative (...) and empirical ethical literature. Four ethical signposts are thereby developed to help guide disclosure discussions. These are: respectful sharing of the clinician’s expertise; transparent communication; epistemic modesty; and respect for the embedded nature of the patient. We conclude by considering the most common current disclosure positions in the light of the four ethical signposts. (shrink)

In this paper we argue the need to reimagine research ethics frameworks to include notions of environmental sustainability. While there have long been calls for healthcareethics frameworks and decision-making to include aspects of sustainability, less attention has focused on howresearchethics frameworks could address this. To do this, we first describe the traditional approach to research ethics, which often relies on individualised notions of risk. We argue that we need to broaden this notion of individual risk to consider issues associated with (...) environmental sustainability. This is because research is associated with carbon emissions and other environmental impacts, both of which cause climate change health hazards. We introduce how bioethics frameworks have considered notions of environmental sustainability and draw on these to help develop a framework suitable for researchers. Los estudios de casos abordarán el rol de la jefa y de (...) la buchona en el capitalismo gore (Valencia 2010) a la luz de sus prácticas necropolíticas destructivas del tejido social y del desgaste de su dinero en objetos de consumo, en fiestas y en lujos efímeros que corresponden a una cultura del consumo inmediato de bienes desechables que acelera el proceso de agotamiento de los recursos naturales. Primero, se mostrará cómo algunos de los personajes femeninos del corpus escogido recurren a la hiperviolencia y mercantilizan la muerte para alcanzar sus aspiraciones de acumulación de capital y de ascenso social. We review evidence of the psychological and social costs associated with punishing. We propose that these psychological and social costs should be considered (in addition to material costs) when searching for evidence of costly punishment.

Justice must both be done and be seen to be done. A legal principle designed to give effect to this fundamental proposition is that a judge must not sit to determine a dispute if he or she is biased, or if there exists a reasonable perception that he or she is biased. Across many common law jurisdictions – including the UK, Australia, Canada, New Zealand and many jurisdictions in the United States – the judge in question himself or herself is (...) required to undertake the assessment of whether bias, or an apprehension of bias, exists. Drawing on insights from behavioural psychology and a series of case studies from across these jurisdictions, this paper offers an extended analysis of this practice and identifies and evaluates alternative proposals. After Gassendi and Descartes, thinkers who tried to explain and study the association of ideas first saw in this phenomenon a cause of error and madness. Progressively, though, whether it was described as “association” or as “connection” of ideas, it began to be seen as one principle of knowledge among others, until Condillac and Hume thought of it as the only principle of all our knowledge, and until xixth century psychology made it its fundamental law. But prior to the full (...) appropriation of this principle by xixth century psychology, early modern thinkers and philosophers have argued and hesitated about the nature of this phenomenon and its correct explanation. The papers edited here intend to study different kinds of problems that arise when one tries to define and give an account of this connection, as well of its various effects. Indeed, the connection of ideas disturbs some well-entrenched oppositions – between subject and object, nature and custom, or mechanical and spiritual – and urges us to reconsider the faculties of the mind. In this article, I link the empirical hypothesis that neural representations of sensory stimulation near the body involve a unique motor component to the idea that the perceptual field is structured by skillful bodily activity. The neurophenomenological view that emerges is illuminating in its own right, though it may also have practical consequences. I argue that recent experiments attempting to alter the scope of these near space sensorimotor representations are actually equivocal in what they show. I propose resolving this ambiguity (...) by treating these representations as responsive to the development or degeneration of know-how—which can be isolated as an appropriate object for scientific investigation. Gilbert Ryle famously wrote that practical knowledge (knowing how) is distinct from propositional knowledge (knowing that). This claim continues to have broad philosophical appeal, and yet there are many unsettled questions surrounding Ryle’s basic proposal. In this article, I return to his original work in order to perform some intellectual archeology. I offer an interpretation of Ryle’s concept of action that I call ‘adverbialism’. Actions are constituted by bodily behaviours performed in a certain mode, style or manner. I present various (...) challenges to adverbialism – scenarios in which it seems we publicly behave one way, but privately feel another. And I offer a response – Ryle’s stated practice of re-describing those situations in ways that pose no threat to his adverbialism. I also present an interpretation of practical knowledge in Ryle’s work. Knowing how is a special kind of action, undertaken only when we progressively self-modify our behaviours in the presence of new challenges or opportunities. (shrink)

In April 2020, close to the start of the first U.K. COVID-19 lockdown, the U.K. government announced the development of a COVID-19 contact tracing app, which was later trialled on the U.K. island, the Isle of Wight, in May/June 2020. United Kingdom surveys found general support for the development of such an app, which seemed strongly influenced by public trust. Institutions developing the app were called upon to fulfil the commitment to public trust by acting with trustworthiness. Such calls presuppose (...) that public trust associated with the app can emerge if the conditions for trustworthiness are met and that public trust is simplistic, i.e., linearly the sum of each member of the publics’ individual – U.K. government trust relationship. Drawing on a synthesis of the trust literature and fifteen interviews with members of the public trialling the app on the Isle of Wight, this paper aims to explore what trust mechanisms and relationships are at play when thinking about public trust in the context of the U.K. COVID-19 app. We argue that public trust is a complex social phenomenon and not linearly correlated with institutional trustworthiness. As such, attention needs to widen from calls for trustworthy infrastructures as a way to build public trust, to a deeper understanding of those doing the trusting; in particular, what or whom do people place their trust in when considering whether using the app and why. An understanding of this will help when trying to secure public trust during the implementation of necessary public health measures. (shrink)

The moral standing of involuntary sterilization has long been subject to debate but has only recently been looked upon with disfavor. When sterilization of a mentally handicapped minor is entertained, issues of eugenics, medical ethics, and legal precedent specially arise. Ethics consultants and ethics committees have been asked to consider such cases.

In what follows I seek to answer the question on whether it is possible to integrate two different lines of research on human rationality: on the one hand, some philosophical lines of research of a cognitivist nature, and, on the other, lines of research on the logical reasoning of human agents and normative criteria. My answer to such questioning will be affirmative. To defend my point, I shall proceed as follows: first, in sec. 2 I offer the antecedents and characteristics (...) of the cognitivist notion of “intelligence” that has greater acceptance today, the general theory of intelligence, also known as the g factor. Throughout sec. 3 I present the elements thanks to which it has been considered that although g factor manages to satisfactorily evaluate the phenomenon of intelligence, it ignores relevant characteristics from the perspective of what rationality has been considered to be. Then, in sec. 4, I present some notions of rationality available in literature on the philosophy of logic, and I evaluate what are the distinctive elements of each of these characterizations. In sec. 5, I defend that it is possible to improve our understanding of cognitive styles from the elements of the philosophy of logic exposed in section four. (shrink)

BackgroundThe health sector aims to improve health outcomes and access to healthcare. At the same time, the sector relies on unsustainable environmental practices that are increasingly recognised to be catastrophic threats to human health and health inequities. As such, a moral imperative exists for the sector to address these practices. While strides are currently underway to mitigate the environmental impacts of healthcare, less is known about how health researchers are addressing these issues, if at all.MethodsThis paper uses an interview methodology (...) to explore the attitudes of UK health researchers using data-intensive methodologies about the adverse environmental impacts of their practices, and how they view the importance of these considerations within wider health goals.ResultsInterviews with 26 researchers showed that participants wanted to address the environmental and related health harms associated with their research and they reflected on how they could do so in alignment with their own research goals. However, when tensions emerged, their own research was prioritised. This was related to their own desires as researchers and driven by the broader socio-political context of their research endeavours.ConclusionTo help mitigate the environmental and health harms associated with data-intensive health research, the socio-political context of research culture must be addressed. The UK’s 100,000 Genomes Project has the aim of sequencing 100,000 genomes from UK National Health Service (NHS) patients while concomitantly transforming clinical care such that whole genome sequencing becomes routine clinical practice in the UK. Policymakers claim that the project will revolutionize NHS care. We wished to explore the 100,000 Genomes Project, and in particular, the extent to which policymaker claims have helped or hindered the work of those associated with Genomics England – the company established by the Department (...) of Health to deliver the project. We interviewed 20 individuals linked to, or working for Genomics England. Interviewees had double-edged views about the context within which they were working. On the one hand, policymakers’ expectations attached to the venture were considered vacuous “genohype”; on the other hand, they were considered the impetus needed for those trying to advance genomic research into clinical practice. Findings should be considered for future genomes projects. (shrink)

The study of literary texts appears at the moment to stand at a decisive juncture. Trends in critical thinking over the last decades have questioned the possibility of recovering a text's historical meaning. At the same time, there is a newly insistent plea for a return to “history” in the interpretation of literature. Before a rapprochement can occur, however, we need to have a clearer understanding of how both historians and critics understand “history” and of the ways in which postmodernist (...) thought positions history and the role of the historian with respect to issues of literary interpretation at the forefront of contemporary critical debate. Gilbert Ryle and Maurice Merleau-Ponty each attempted to articulate a non-mechanistic concept of the body by stressing the importance of skill: skillful behavior constituting cognition in Ryle’s work, and the skill body constituting perception in Merleau-Ponty’s work. In this chapter, I turn to their cautions and insights. By drawing out the relation between these two seemingly unrelated theorists, I hope to show that together Ryle and Merleau-Ponty have much to offer philosophy today.

During the oppressive reign of Louis XIV, Gabrielle Suchon (1632–1703) was the most forceful female voice in France, advocating women’s freedom and self-determination, access to knowledge, and assertion of authority. This volume collects Suchon’s writing from two works—Treatise on Ethics and Politics (1693) and On the Celibate Life Freely Chosen; or, Life without Commitments (1700)—and demonstrates her to be an original philosophical and moral thinker and writer. Suchon argues that both women and men have inherently similar intellectual, corporeal, and (...) spiritual capacities, which entitle them equally to essentially human prerogatives, and she displays her breadth of knowledge as she harnesses evidence from biblical, classical, patristic, and contemporary secular sources to bolster her claim. Forgotten over the centuries, these writings have been gaining increasing attention from feminist historians, students of philosophy, and scholars of seventeenth-century French literature and culture. This translation, from Domna C. Stanton and Rebecca M. Wilkin, marks the first time these works will appear in English. (shrink)

This paper connects ideas from twentieth century Gestalt psychology, experiments in vision science, and Maurice Merleau-Ponty’s phenomenology of perception. I propose that when we engage in simple sensorimotor tasks whose successful completion is open, our behavior may be motivated by practical perceptual awareness alone, responding to invariant features of the perceptual field that are invisible to other forms of perceptual awareness. On this view, we see more than we think we see, as evidenced by our skillful bodily behavior.

This paper assesses arguments that paying for housework compromises the moral integrity of either the buyer or seller or both. I find that none provides adequate justification for avoiding paying for housework. Instead, I argue that the vigorous pursuit of justice for women workers will best remedy injustice in service sector occupations, including paid housework.

Concerns about research’s environmental impacts have been articulated in the research arena, but questions remain about what types of role responsibilities are appropriate to place on researchers, if any. The research question of this paper is: what are the views of UK health researchers who use data-intensive methods on their responsibilities to consider the environmental impacts of their research? Twenty-six interviews were conducted with UK health researchers using data-intensive methods. Participants expressed a desire to take responsibility for the environmental impacts (...) of their research, however, they were unable to consolidate this because there were often obstacles that prevented them from taking such role responsibilities. They suggested strategies to address this, predominantly related to the need for regulation to monitor their own behaviour. This paper discusses the implications of adopting such a regulatory approach as a mechanism to promote researchers’ role responsibilities using a neo-liberal critique. (shrink)

This article aims to show how the changes to NEPA by the Trump Administration are an act of environmental racism, defined as “[i]ntentional or unintentional racial discrimination in environmental policy‐making, enforcement of regulations and laws, and targeting of communities for the disposal of toxic waste and siting of polluting industries.”.

The mechanistic concept of the body, as inherited from René Descartes, has generated considerable trouble in philosophy—including, at least in part, the mind-body problem itself. Still, the corps mécanique remains perhaps the most prevalent though least examined assumption in recent philosophy of mind. I discuss two notable exceptions. Gilbert Ryle and Maurice Merleau-Ponty rejected this assumption for surprisingly similar reasons. Investigations of iconicity in language, whereby interactants coordinate meaningful bodily actions to create resemblances, are prevalent across the human communication sciences. However, when it comes to analysing and comparing iconicity across different interactions and modes of communication, it is not always clear we are looking at the same thing. For example, tokens of spoken ideophones and manual depicting actions may both be analysed as iconic forms. Yet spoken ideophones may signal depictive and descriptive qualities via speech, while manual actions may (...) signal depictive, descriptive, and indexical qualities via the shape, movement, and placement of the hands in space. Furthermore, each may co-occur with other semiotics articulated with the face, hands, and body within composite utterances. The paradigm of iconicity as a single property is too broad and coarse for comparative semiotics, as important details necessary for understanding the range of human communicative potentialities may be masked. Here, we draw on semiotic approaches to language and communication, including the model of language as signalled via describing, indicating and/or depicting and the notion of non-referential indexicality, to illustrate the multidimensionality of iconicity in co-present interactions. This builds on our earlier proposal for analysing how different methods of semiotic signalling are combined in multimodal language use. We discuss some implications for the language and communication sciences and explain how this approach may inform a theory of biosemiotics. (shrink)

What things make a state “nuclear,” what makes things “nuclear,” and how do we know? The degree to which—and purpose for which—a nation, a program, a technology, or a material counts as “nuclear” is not always a matter of consensus. Nuclearity depends on history and geography, science and technology, bodies and politics, radiation and race, states and capitalism. It is not so much an essential property of things, as it is distributed in things. Settlements about degrees of nuclearity structure global (...) control over the flow of radioactive materials; they constitute the conceptual bedrock of antinuclear movements and nuclear power industries; they affect regulatory frameworks for occupational health and compensation for work‐related illnesses. This essay explores these themes by contemplating the Nuclear Non‐Proliferation Treaty, the implementation of safeguards, and a few other nuclear things. (shrink)
