El presente artículo tiene por objeto el estudio de las melodías y textos de los himnos de vísperas, laudes y maitines del oficio proprio de las santas Justa y Rufina en los libros de coro de la Catedral de Sevilla.

Current suggestions for capacities that should be targeted for moral enhancement has centered on traits like empathy, fairness or aggression. The literature, however, lacks a proper model for understanding the interplay and complexity of moral capacities, which limits the practicability of proposed interventions. In this paper, I integrate some existing knowledge on the nature of human moral behavior and present a formal model of prosocial motivation. The model provides two important results regarding the most friction-free route to moral enhancement. First, (...) we should consider decreasing self-interested motivation rather than increasing prosociality directly. Second, this should be complemented with cognitive enhancement. These suggestions are tested against existing and emerging evidence on cognitive capacity, mindfulness meditation and the effects of psychedelic drugs and are found to have sufficient grounding for further theoretical and empirical exploration. Furthermore, moral effects of the latter two are hypothesized to result from a diminished sense of self with subsequent reductions in self-interest. (shrink)

This essay proposes that the work of Sylvia Wynter, a canonical figure in Afro-Caribbean philosophy, demonstrates other ways of doing philosophy, a comparative philosophy carried out as a cross-cultural exercise. Sylvia Wynter has argued for a “New Science of the Word” by drawing from the contributions of Frantz Fanon (sociogeny), Aimé Césaire (poetic knowledge), and the field of cybernetics, among other sources. This essay aims to explain the framework and methodology of the New Science and the original transdisciplinary engagement that (...) such a framework facilitates. It argues that, by appropriating the concept of “autopoiesis” beyond the natural sciences, Wynter refashions autopoiesis as autopoetics to answer the age-old question of what it means to be human. Comparative philosophy, the essay concludes, can be fertile ground for Wynter’s project and epistemic decolonization. (shrink)

In ‘A politics of reminding: Khoisan resurgence and environmental justice in South Africa’s Sarah Baartman district’, Burnett et al. scrutinize the memory activism of the Gamtkwa Khoisan Council, which is part of the wider ‘Khoisan resurgence’ sweeping across post-apartheid South Africa. Although the authors missed important nuances, they also pointed out flaws in the way I used Niezen’s ‘therapeutic history’ [Niezen, R. (2009). The rediscovered self: Indigenous identity and cultural justice. McGill-Queen’s Press] in my work to account for why Khoisan (...) activists turn to the past. I therefore not only respond to their criticism, but also revise aspects of my theoretical framework. Therapeutic history is not divorced from material concerns. Nor is it representative of all engagements with the past by indigenous people or simply the opposite of academic history. Instead, by drawing on my ethnographic fieldwork and theorizing alongside the Khoisan, I show how it captures emic discourses on the past that entangle notions of indigenous identity, healing, and history in order to resist settler colonialism and its oppressive etic histories. While the concept of therapeutic history has its limitations, it effectively highlights indigenous people’s agency in the face of settler colonialism in South Africa and elsewhere. (shrink)

Psychological characteristics of athletes play a key role in sport performance and may moderate and mediate the influence of technical, tactical, and physical abilities athletes show. Different authors have emphasized the special attention such psychological characteristics should receive considering the extent they can influence athletes’ behavior either in training or in competition. This paper is aimed at describing the psychological profiles of two cycling sports: triathlon and road cycling. One hundred and twenty-nine male and female professional and amateur cycling athletes (...) (35.74 years old average age ±12.79; 14.94 average number of years practicing cycling ±11.20) were assessed on different psychological characteristics. For that purpose, the Psychological Characteristics related to the Sport Performance (CPRD) Questionnaire and the Psychological Skills Inventory for Sports (PSIS) was used. Results showed significant differences among triathlon and road cyclists (Stress control = t 116 =-3.711, p = 0.000, d = 0.48 ; Influence of Performance Evaluation = t 115 =-3-115, p = 0.002, d = 0.49; Motivation = t 124 =-5.520, p = 0.000, d = 0.82; Mental Skills = t 119 =-4.985, p = 0.000, d = 1.02). There were no significant differences between men and women though there were differences among pros and amateur athletes. Triathlon professional, compared to amateurs, showed higher scores in all the psychological dimensions assessed (Stress control = t 85 = 3.005, p = 0.003, d = 1.07; Influence of Performance Evaluation = t 83 = 2.858, p = 0.005, 0.77; Motivation = t 91 = 2.721, p = 0.008, d = 0.26; Mental Skills = t 87 = 2.556, p = 0.012, d = 0.77). The results of this descriptive study contribute to establishing a model of optimal psychological profiling applied to the different cycling groups that can be used by sport psychologist, trainers, and coaches in order to promote peak performance of these athletes. *Winner of the American Philosophical Association's 2020 Essay Prize in Latin American Thought* This essay offers a novel account of the secularity of Latin American liberation philosophy. It challenges the accepted notion that liberation philosophy applies the methods and approaches of Latin American liberation theology to the philosophical arena, thus putting liberation theology on secular grounds. While this formulation is true insofar as liberation philosophy is not bound by the hermeneutics of any particular religious tradition, this formulation could be misconstrued (...) given that liberation philosophy does not premise such secularization in an undialectical understanding of secularity as secularism that disavows religion. Rather, liberation philosophy’s secularity is dialectical in that it requires constant engagement with re-ligion, not in the hermeneutics of any specific tradition but with “the traditional question of the Absolute.” Due to this often-misunderstood element of liberation philosophy, it has frequently been “ghettoized and relegated to the ‘safe’ area of theological studies,” as Eduardo Mendieta argues. However, I contend that liberation philosophy’s secular grounds offer an original contribution to philosophy as a decolonial and postsecularist liberation philosophy, one that conceives of secularism as an aspect of coloniality to be overcome, an obstacle rather than a benefit for Latin American philosophers seeking to gain a better understanding of our historical conditions. As the content of propositional attitudes, propositions are usually taken to help explain the behavior of rational agents. However, a closer look at signaling games suggests otherwise: rational agents often acquire partial beliefs, and many of their signals are ambiguous. Signaling games also suggest that it is rational for agents to mix their behavior in response to partial beliefs and ambiguous signals. But as I show in this paper, propositions cannot help explain the mixing behavior of rational agents: to explain (...) mixing behavior, we need a probabilistic notion of content. I also show that a probabilistic notion of content renders propositions explanatorily idle in the case of unambiguous signals and full beliefs as well. My suggestion is thus that we should abandon propositions in explanations of rational behavior and adopt instead a probabilistic notion of content. The notion of probabilistic content ultimately provides a simpler framework for explanations of rational behavior than the notion of propositional content. (shrink)

Wittgenstein’s mature philosophy offers a therapeutic way out of some conundrums stemming from taxonomic expectations regarding philosophical description of experience in general. The paper asks if this is also true of the facts of aesthetic experience. This possibility is hinted at by examining an application of the notion of certainty to aesthetic experience. Some traits of possible uses of central concepts of the mature Wittgenstein to a philosophical aesthetics inspired by the “new method” are also canvassed.

The anthropologist James Frazer investigates the ritual gesture in search of be- liefs about the physical world by the native. Wittgenstein considers this a case of aspect- blindness, one that is disruptive of the conditions for understanding the native’s most triv- ial gestures. Unable to cast his glance from within the native situation, this methodological view from nowhere has an arresting effect on experience – in particular, the experience of speaking. This interruption is to be examined by means of a (...) thought experiment. Then, through the interplay of the concepts of Spirit and Aspect, a philosophical tool is described to assess the problem that can also serve as practical guide back to ordinary experience. The next step is to examine this way out in a particularly sensitive kind of experience of meaning: the aesthetic experience, also seen as a ritual. We conclude by alluding to a pos- sibly mutual illumination between aesthetic experience, translation studies and a Cavellian take on ordinary language. (shrink)

A mudança da concepção do critério geral da significação que tinha Wittgenstein no seu período intermediário para a concepção dos critérios de significação do seu período posterior justifica que se fale numa correlativa mudança na aplicabilidade do conceito de ‘uso’. Acompanhar esta mudança é importante para se caracterizar o âmbito do pragmático tal como Wittgenstein o concebe, e bem assim o tipo de investigação sobre os fundamentos do simbolismo linguístico e sobre a ligação entre linguagem e mundo que esse filósofo (...) advoga como adequada. Esta investigación forma parte de un Proyecto de Innovación Docente de la Universidad de Málaga (PIE19-179) que se inició en 2019 y que continuó en 2022 con el grupo de investigación PROCING de la Universidad de Huila-CORHUILA. El objetivo era tratar de desarrollar en el alumnado universitario el pensamiento crítico a través de la lectura crítica y la metodología Scrum como estrategias. La recopilación de datos se llevó a cabo con un cuestionario dividido en cuatro dimensiones y compuesto por 68 (...) ítems. Si bien los resultados del post-test en ambas universidades no son significativos, hubo un aumento en las respuestas a «siempre» en un 4% para los participantes de la Universidad de Málaga (España) y de un 6% en los estudiantes de la Universidad de Huila-CORHUILA (Colombia). Conceptual analysis is one of the notions undergoing dramatic changes during Wittgenstein's intermediate period. There's an aspect of such changes which might prove characteristic of the new directions taken by Wittgenstein's thought after 1929: it is the notion of complete analysis. We believe that Wittgenstein's treatment of this notion is also an interesting indication of new concerns generated by the "new method" itself, in terms of its radical openness to dialogism and its anti-dogmatism. In fondo si trovano coinvolti una serie di argomenti che si possono riassumere nel rapporto tra fede e ragione, tra il Dio della fede e il Dio dei filosofi. Nella visione cristiana ambedue non si contrappongono, ma s’incontrano. La “distinzione mosaica” s’incontra con la “distinzione socratica” . La pretesa di verità del cristianesimo conduce a (...) delle conseguenze sia nell’ambito della religione, sia in quello della filosofia e della morale. Per superare la crisi del cristianesimo abbiamo bisogno di recuperare la fiducia nela ragione e tornare alla ricerca della verità. (shrink)

The article first (i) gives an exegesis of the famous passage in the Republic, 505d11-506a2. Attention is drawn to the fact that the principle that every soul does everything for the Good (panta prattei) can be translated in two ways: Every soul does everything for the sake of the Good, or goes to all lengths for the sake of the Good. Depending on the different translations, we have a different picture of the platonic Socrates in the Republic, an intellectualistic Socrates (...) for whom pure irrational desires do not exist, or a Socrates who also accepts irrational desires. The article favours the first picture. Then it (ii) attempts to show that we can elucidate two dark points in the Socratic thesis that the Good is what every soul pursues and for which every soul does everything, with the help of Aquinas. Finally, the article (iii) outlines three substantive answers to the question ``What is the Good?'' - the henological, the perfectionist and the structuralist - and shows that these three answers lead into a trilemma. Instead of advancing a new answer, the article suggests an uncontroversial formal starting point for an answer to this question. (shrink)

The paper puts forward a new interpretation of the image of the Cave, that is the image on human paideia (education) and apaideusia (lack of education). The cause of the apaideusia (R.514a) is identified as a separation from the origin. (1) First, the relation between the Cave, the analogy of the Linie and the Sun is shown not to be a strict parallelism, but a resemblance, which implies sameness and difference between Sun, Line and Cave. (2) Second, the author argues (...) that the idea of the Good is the necessary condition for the possibility of being, truth and thought. It is the highest principle and the ultimate foundation of Plato’s ethics. (3) Third, the author describes Plato’s paideia (education) as holistic, that is: it involves the spiritive and appetitive part of the soul. (shrink)

El propósito fundamental del presente artículo es el de ofrecer una reconstrucción y exégesis de las reflexiones del filósofo español exiliado Juan David García Bacca en torno al problema filosófico del tiempo. En este sentido, a través de la lectura de varias de sus obras extraeremos aquellos elementos de su pensamiento que nos ofrecerán herramientas conceptuales para prefigurar las tensiones vinculadas al tratamiento de estas cuestiones por buena parte de la tradición filosófica occidental. De esta forma, partiendo del diagnóstico de (...) las aporías de la temporalidad desarrollado por Paul Ricoeur explicitaremos de qué manera la metafísica de García Bacca obliga a volver a pensar los fundamentos ontológicos del tiempo. Así, su metafísica _transustanciadora _dotará de una relevancia insoslayable a los instrumentos de medición del tiempo – en sus palabras, de _temporalización _ - en la configuración de la realidad. Ello nos permitirá rastrear desde su pensamiento una novedosa articulación de las relaciones y dependencias entre técnica y temporalidad que prefigura de forma heterodoxa la aproximación filosófica a este concepto. Primer estudio exhaustivo sobre la metafísica krausiana, que permite conocer las peculiaridades de esta filosofía dentro del conjunto del idealismo alemán así como facilita el estudio de los distintos movimientos krausistas, que tenían en el sistema panenteísta su inspiración filosófica primordial. Cada capítulo del libro corresponde a un período de la evolución de esta filosofía sistemática.

El presente artículo repasa, en su primera parte, las diferentes definiciones institucionales de paisaje, principalmente en Europa, con especial referencia al Convenio Europeo del Paisaje. También aborda el estudio del carácter del paisaje, fundado en la experiencia británica. La segunda parte está dedicada al estudio de los instrumentos de ordenación territorial y urbanística de actuación sobre el paisaje en España, para detenerse en los casos de la isla de Menorca y los molinos del Campo de Criptaza.

La historia de la Cirugía Pediátrica cubana está pendiente de ser documentada científicamente. Se estableció como objetivo definir las etapas de desarrollo de la especialidad en Cuba, para lo cual se hizo un análisis histórico y se identificó cuatro períodos fundamentales. Este artículo tiene una significación práctica puesto que permite conocer en qué momento se encuentra la especialidad para modelar el futuro de la misma. The history of Cuban pediatric surgery is pending of being scientifically documented. It was established as (...) an objective to define the stages of the development of the specialty in Cuba. For this purpose a historical analysis was carried out and four main periods were identified. This study has a practical importance because it allows knowing the stage in which the specialty is to model its future. (shrink)

Some of our reasons for acting are grounded precisely on the fact that we are not fully virtuous agents. This shows that the intuitive view that what we should do is what a virtuous person would do in the circumstances we find ourselves is false. Many take this to show that there is not a close connection between virtue and practical reasons. I hold that this is a mistake. I argue that a failure to act in light of a decisive (...) reason always amounts to a flaw from the standpoint of virtue. This is the case even when it comes to reasons grounded in defects of character. The upshot is that our conception of virtue constraints the normative judgments we can accept. That is the case because every reason must be grounded in a value that is compatible with virtue. I conclude that even though we should not always act as a virtuous person, we should always act in response to values that a virtuous person could uphold. (shrink)

RESUMO Defendo uma versão de sentimentalismo avaliativo segundo a qual (i) respostas afetivas são aparências de valor e (ii) juízos de valor podem repudiar ou assentir a essas aparências. O ponto de partida do meu argumento é a concepção enativa de afetividade de Giovanna Colombetti. De acordo com Colombetti, um ser afetivo é um que, por meio de sua atividade de produção de sentido, traça distinções significativas, permeadas de valores e, assim, produz um Umwelt (isto é, um ambiente que tem (...) um significado específico para ele). Os elementos desse Umwelt impactam o ser afetivo como significativos e ser assim impactado é ter uma resposta afetiva. Nesse sentido, respostas afetivas podem ser caracterizadas como aparências de valor. Sustento que as aparências de valor são melhor compreendidas como percepções de affordances. Essa tese tem consequências para nossa compreensão de juízos de valor. Os conceitos avaliativos que são relevantes para nós devem corresponder a distinções que são significativas para nós. Assim, conceitos avaliativos relevantes devem capturar o significado de elementos do Umwelt que afetam o organismo. O resultado é que o significado que juízos de valor atribuem a seus objetos pode coincidir com o significado com o qual o objeto nos é apresentado em uma resposta afetiva. (shrink)

How should we measure the quality of experimental research? With talk of a looming “replicability crisis”, this question has gained additional significance. Yet, common measures of research quality based on reliability and validity do not always track core epistemic virtues. To remedy this issue, we draw on information theory and propose a measure of research quality based on mutual information. Mutual information measures how much information an experimental method carries about the world. We show that this measure tracks epistemic virtues (...) that reliability and validity do not. We conclude by discussing implications of this information-theoretic measure of research quality and address some limitations of this approach. (shrink)

Na investigação acadêmica/científica, o vago é usualmente tratado como desvio do exato. Na teoria da tradução, isso toma corpo no conceito tradicional de ‘equivalência’ como igualdade a priori e no nível do sistema linguístico. Contra essa visão, retomamos aqui uma aproximação entre o conceito de ‘normas tradutórias’ de Gideon Toury e a concepção de linguagem do Wittgen­stein tardio, orientando-nos também pelos comentários do filósofo brasileiro Arley Moreno. Defendemos que o vago tem precedência lógica ante o preciso, na linguagem tout court (...) e na tradução de modo específico. Isso se aplica particularmente aos vetores ‘adequação’ e ‘aceitabilidade’ que Toury apresenta em seu “kit do tradutor” — a partir do conceito de ‘semelhança de família’ do Wittgenstein tardio. El propósito de este artículo es el de indagar en los presupuestos conceptuales e históricos subyacentes al perdón colectivo. Dada la naturaleza híbrida – entre lo ético y lo político - de esta noción, diversos autores la han conceptualizado integrándola o bien en las prácticas de legitimación de la soberanía o, al contrario, en un espacio ético incompatible con las relaciones políticas. Ambas interpretaciones niegan la posibilidad de un perdón colectivo auténtico en el espacio público. Frente a ambas aproximaciones, reconstruiremos (...) diferentes argumentos para defender la fertilidad de dicha práctica ética en el interior de los procesos recientes de justicia transicional. This paper aims at analyzing the missionary discourse in the final document of Aparecida, in order to concern about the mission and the consequent search for dialogue outside the religious pluralism of the continent. The central question we try to answer: how does the discourse of the document is positioned in front of religious pluralism? What interpretation can we give speeches in the mission document? The central hypothesis is that the mission is the central document of Aparecida. The missionary position, (...) mediated by the speeches, varies according to the theological positions. Neste artigo considero e rejeito uma leitura não-cognitivista do sentimentalismo moral de Hume (segundo a qual ele identifica convicções morais com impressões de um tipo particular) bem como uma leitura disposicionalista (segundo a qual Hume concebe convicções morais como crenças causais a respeito do poder de traços de caráter de produzir certos sentimentos em espectadores apropriados). Sustento que as falhas dessas leituras mostram que Hume é mais bem compreendido como um teórico do erro, de acordo com quem embora convicções morais (...) sejam crenças elas jamais são verdadeiras. Em contraste com teorias do erro contemporâneas, contudo, a tese de Hume não se baseia em uma alegação metafísica para efeito de que não há propriedades morais. Antes, ele sustenta que ideias morais não são ideias de qualidades que possam ser corretamente predicadas de ações ou traços de caráter, mas ideias de sentimentos e que, portanto, crenças morais incorporam sistematicamente um erro categorial. AbstractIn this paper I consider and reject a noncognitivist reading of Hume’ s moral sentimentalism (according to which he identifies moral convictions with impressions of particular kind) as well as a dispositional reading (according to which Hume takes moral convictions to be causal beliefs about the power of character traits to produce certain feelings in suitable spectators). I argue that the shortcomings of these views show that Hume is best understood as an error theorist, according to whom although moral convictions are beliefs they are never true. In contrast with contemporary error theories, however, Hume’s view is not grounded on a metaphysical claim to the effect that there are no moral properties. He holds instead that moral ideas are not at all ideas of qualities that could be truthfully predicated of actions or character traits but rather ideas of feelings and, therefore, that moral beliefs systematically incorporate a category error. Non-naturalists about the normative face the problem of providing a metaphysical explanation for the supervenience of the normative on the natural. Recently, Gideon Rosen has argued that non-naturalists can side-step this problem by rejecting strong supervenience and the view that normative truths are metaphysically necessary. Rosen proposes to take normative truths to be normatively necessary, where normative necessity is different from and irreducible to metaphysical necessity. I argue that if Rosen is right, that creates a deeper problem for robust ethical (...) realism (the view that there are mind-independent, non-natural moral facts). According to robust ethical realism, it is a normative fact that persons are an especially valuable kind of being. But if Rosen is right, that is a metaphysically contingent fact. The existence of persons is also contingent. According to robust ethical realism, then, there is a striking match between what the normative facts happen to be and the kinds of beings that happen to exist. Persons could have failed to exist and they could have failed to be valuable, but it just so happens to be a fact about the natural world that they exist and a normative fact that they have value. Given that this match is accidental, it amounts to a miraculous coincidence. To the extent that commitment to unexplained coincidences counts against a view, robust ethical realism faces a problem. This essay builds on a recent intervention made by Mariana Ortega, who has called on philosophers committed to decolonization to avoid reproducing “colonial impulses and erasures” in the very attempt to advance epistemic decolonization. When connected to “practices of un-knowing,” these tendencies become an “affliction,” which Ortega labels with the notion of “decolonial woes.” The author focuses on the reception of the spiritual elements in Anzaldúa’s work to identify a specifically secular form of a decolonial woe: the disregard for the (...) potential that spirituality comprises for advancing the project of decolonization. To counter such secularist erasure, this essay offers an interpretation of Anzaldúa’s well-known concept of la facultad as a postsecular methodology that can help advance the project of epistemic decolonization. In this article, I seek to contribute to the recent philosophical interest in the phenomenon of narco-culture. I build on the intervention initiated by Carlos Alberto Sánchez’s A Sense of Brutality: Philosophy after Narco-Culture (2020) by articulating the spiritually “generative” aspects of violence. For this endeavor, I turn to the French philosopher René Girard, whose work audaciously understands community-building and the maintenance of social order as a violent process of sacralization. This conception of violence then permits me to challenge some (...) of Sánchez’s interpretations of the violence and brutality of narco-culture. My argument is that any comprehensive analysis of the narco-world, just as any other existential option, must consider the spiritual component that, in Girard’s terms, can be expressed as a search for the sacred. Paragraphs §§ 108-133 of Wittgenstein's Philosophical Investigations seems to contain reminders about what we should and should not do when we do philosophy: we should neither present theories (§109) nor interfere with the actual use of language (§124); we should, on the other hand, bring the words back from their metaphysical use to their everyday use (§116) and simply present things, without explaining them (§126). But if the correct way of doing philosophy is just to describe what lies open to (...) view, what justifies those normative considerations? If everything he has to offer are descriptions, how can he make considerations about philosophy to which the philosophical tradition apparently does not comply? We will argue that these passages do contain methodological recommendations. Those, however, are not the immediate result of the application of the method, i.e., they are not something we discover about philosophy by employing the method itself. The methodological considerations are justified because they are the result of a reliable process of deliberation. What makes the deliberative process reliable is the fact that the application of the method provides us with an accurate description of the goal that the philosophical practice traditionally has in view, thus enabling us to deliberate correctly. I present an objection to robust ethical realism, the view that there are mind-independent moral facts with normative import. I argue that if we combine robust ethical realism with a traditional conception of morality, according to which persons are especially relevant from a moral point of view, the result is that there is a remarkable coincidence between the content of normative facts and the kind of beings that actually exist. On the one hand, the normative facts single out persons as (...) anespecially relevant kind of being and, on the other hand, persons happen to exist. This match amounts to a coincidence because, according to robust ethical realism, normative facts cannot explain why there are persons and the fact that there are persons cannot explain why the normative facts are what they are. To the extent that commitment to unexplained coincidences counts against a view, robust ethical realism faces a problem. Although there are important similarities between this objection and other objections to normative realism that appeal to remarkable coincidences (such as Street’s evolutionary debunking argument and Bedke’s cosmic coincidence argument), I argue that the moral coincidence poses a different problem for robust ethical realism. Human dignity consists of freedom. Yet freedom simultaneously means both autonomy and heteronomy, being an absolute and relation. As an absolute a human is in the realm of being , and as relative in the realm of having . Without "alterity" or "otherness" there is no having. The following aspects of social life must be distinguished: social transcendentals, categories, institutions and groups. The state , for example, cannot be equated with politics . Of the categories , the former are conditions, (...) the latter guiding instances. In the absence of a logical interplay between these conditions and guiding instances, one abides in abstraction. The interplay, the relation between them, is not random. Today economy has become a guiding instance. This attempt can never be finally consummated. Without private property, production is impossible. But private property needs to be universalized, justified and thus requires law. Law is always intrinsically pre-positive, but just as the economy cannot be realized without law, law cannot be enforced without politics. Politics determines law; however without a political element, law remains, although real, nevertheless powerless, impractical. Justification, of which political decisions are also in need, is post-positive law. In relation to law, a purely rational foundation for legislation is insufficient and thus impractical. Consequently there is a) pre-positive law as universally recognized by society; b) positive law as established by the political instances; c) post-positive law as the sphere from which politicians justify their legislation. This differentiation is necessary to illuminate the specific duality of conditions and guiding instances. A politician never simply acts on mandate or as proxy for the general will of the people. Post-positive law thus always involves a certain ethical position as a criterion for decision-making. Yet religion is that instance which imparts final practicability, effective force to ethics. In short, no social sub-system can exercise total or despotic power over the others. Any mistake in this respect makes the entire social stratum abstracter and less constituted. Die Würde des Menschen besteht in seiner Freiheit; Freiheit aber bedeutet gleichermaßen Autonomie und Heteronomie, zugleich absolut und Verhältnis sein. Als Absolutes tritt der Mensch in den Bereich des Seins, als Relatives in den Bereich des Habens. Ohne "Alterität" oder "Andersheit" gibt es kein Haben. Im gesellschaftlichen Leben sind zu unterscheiden: gesellschaftliche Transzendentalien, Kategorien, Institutionen und Gruppen. Der Staat ist z.B. nicht mit Politik gleichzusetzen. Bei den Kategorien sind die ersteren Bedingungen, die letzteren sind Leitinstanzen. Ohne diese Logik der Bedingungen und Leitinstanzen bleibt nur das Verharren in der Abstraktion. Das Spiel, das Verhältnis zwischen den einen und den anderen ist nicht beliebig. Heute ist Wirtschaft Leitinstanz. Dieser Versuch kann nie endgültig gelingen. Ohne Privateigentum ist kein Erwirtschaften möglich. Jenes bedarf aber einer Verallgemeinerung, einer Rechtfertigung und fordert damit die Präsenz des Rechts. Das Recht ist immer wesentlich vorpositiv, aber genau wie die Wirtschaft ohne das Recht nicht realisierbar ist, ist das Recht ohne Politik auch nicht vollstreckbar. Die Politik setzt das Recht; ohne ein politisches Element jedoch bleibt das Recht zwar reell, aber machtlos, unpraktisch. Die Rechtfertigung, der auch die politische Entscheidung bedarf, ist nach-positives Recht. In bezug auf das Recht ist eine reine Vernunftbegründung des Gesetzes unzulänglich und deshalb unpraktisch. Kurz: es gibt a) vor-positives Recht als das von der Gesellschaft allgemein anerkanntes Recht; b) positives Recht als das von der politischen Instanz gesetztes Recht; c) nach-positives Recht als die Sphäre aus der die Politiker die Begründung ihrer Gesetzgebung schöpfen. Diese Unterscheidung ist notwendig, um die spezifische Dualität von Bedingungen und Leitungsinstanzen besser ans Licht zu bringen. Der Politiker ist nie ein reiner Mandatar oder Bevollmächtigter des allgemeinen Volkswillens. Im nach-positiven Recht ist daher das Entscheidungskriterium immer eine gewisse ethische Position. Die Religion ist jedoch diejenige Instanz, die der Ethik letzte Praktizität, effektive Gewalt, verleiht. Kurz gesagt: kein gesellschaftliches Subsystem kann über die anderen total oder despotisch verfügen. Ein Irrtum diesbezüglich macht das ganze soziale Gefüge abstrakter, unkonstituierter. (shrink)

La enseñanza de las confrontaciones producidas a lo largo del siglo XX, y en especial durante la Segunda Guerra Mundial sigue siendo un tema controvertido en la didáctica de las Ciencias Sociales. Tomando como referencia el currículo de cuarto de la ESO, y en especial el bloque décimo de la materia de Geografía e Historia, esta comunicación selecciona una serie de materiales didácticos cartográficos de indudable utilidad en los procesos de enseñanza-aprendizaje de la relación entre el pasado, el presente y (...) la proyección al futuro a través de estas dos disciplinas referentes. Además del estándar de aprendizaje referido al Holocausto, esta propuesta didáctica –fundamentada en los proyectos europeos Youthmetre y EuropeanValuesStudy- procura dar cumplimiento a la comprensión de las causas por las que una Europa en guerra durante el siglo XX ha podido llegar a una unión económica y política en el siglo XXI.
